अधिसूचना 20 मई 2009 सं॰ 237 (नियम) —भारतीय संविधान के अनुच्छेद 229 के खण्ड (2) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए माननीय मुख्य न्यायाधीष, उच्च न्यायालय, पटना ''पटना उच्च न्यायालय पदाधिकारी एवं कर्मचारी (सेवा शर्त्त एवं आचरण) नियमावली, 1997'' में निम्नलिखित संषोधन करते हैंः-
1. यह नियम 'पटना उच्च न्यायालय पदाधिकारी एवं कर्मचारी (सेवा शर्त्त एवं आचरण) नियमावली, 1997, नवम् संषोधन नियमावली, 2009 कहलायेंगें।
2. यह संषोधन तत्काल प्रभाव से प्रवृत होगा। 3. भाग - VII में नियम 9 एवं 10 में संषोधन :-
(क) वर्त्तमान नियम 9 के प्रथम कंडिका को निम्नलिखित प्रकार से प्रतिस्थापित किया जायः- ''9, अनुसूचित जाति इत्यादि के लिए आरक्षण - अनुसूचित जाति, अनुसूचित जनजाति एवं अन्य पिछड़ा वर्ग के उम्मीदवारों एवं विकलांगों के पक्ष में 'स्थापना' में विभिन्न कोटि के पदों पर सीधी नियुक्ति हेतु आरक्षण माननीय मुख्य न्यायाधीष द्वारा, समय-समय पर, विधायी अधिनियमिति का समुचित सम्मान करते हुए, निर्गत आदेष तथा बिहार राज्य के महामहिम राज्यपाल द्वारा, इस विशय पर समय-समय पर, निर्गत आदेष के अनुसार होगा।'' 2 (cid:18)बहार गजट, (असाधारण)] 26 मई 2009 The 20th May 2009 No. 237 (Rules) —In exercise of the powers conferred by Clause (2) of Article 229 of the Constitution of India, the Hon'ble the Chief Justice of the High Court of Judicature at Patna makes the following amendments in 'The Patha High Court Officers and Staff (Condition of Service and Conduct) Rules, 1997:-
1. These Rules shall be called 'The Patna High Court Officers and Staff (Condition of Service and Conduct) Rules, 1997, 9th Amendment Rules, 2009. 2. The amendment shall come into force with immediate effect. 3. Amendment in Rules 9 and 10 in Part – VII :-
(a) Substitute the existing 1st Para of Rule 9 with the following:-
"9. Reservation for Scheduled Castes etc. – Reservation for direct recruitment to the various categories of posts in the 'Establishment' in favour of the scheduled castes, scheduled tribes and O.B.C. candidates and handicapped shall be in accordance with the orders issued by the Chief Justice from time to time having due regard to the legislative enactment and orders issued by the Governor of Bihar from time to time on the subject."
(b) Substitute the existing Rule 10 with the following:-
"10. Substitute the words 'Suitable weightage may be given in all Class III posts
in the establishment of the Court' for the words 'one per cent of vacancies in
all Class III posts in the establishment of the Court shall be reserved' before
the words 'at the stage of direct recruitment * * *'
