संख्या 576/3/ई0वी0एम0/2009/एस0डी0आर0(वि0स0) - यतः, लोक प्रतिनिधित्व अधिनियम 1951 की धारा 61 क में यह उपबंधित है कि मतदान मषीनों द्वारा मत ऐसी रीति से डाले और रिकार्ड किए जाएंगें जैसा कि निर्वाचन आयोग ऐसे निर्वाचन क्षेत्रों के लिए प्रत्येक मामले की विषिश्ट परिस्थितियों को ध्यान में रखते हुए निर्दिश्ट करे; तथा

2. यतः आयोग ने उत्तराखण्ड विधान सभा निर्वाचन क्षेत्र में 42-कापकोट, बिहार विधान सभा निर्वाचन क्षेत्र में 186-फतुहा(अ0जा0), पंजाब विधान सभा निर्वाचन क्षेत्र में 36-नूर महल तथा त्रिपुरा विधान सभा निर्वाचन क्षेत्र में 8-टाउन बार्डोवाली क्षेत्रों की परिस्थितियों पर विचार किया है और वह संतुश्ट है कि उपर्युक्त विधान सभा निर्वाचन क्षेत्रों में मतदान के लिए पर्याप्त संख्या में इलैक्ट्रानिक वोटिंग मषीनें उपलब्ध है, तथा मतदान कर्मचारी इलैक्ट्रानिक वोटिंग मषीनों के दक्षतापूर्वक संचालन करने के लिए प्रषिक्षित हैं तथा निर्वाचक भी इलैक्ट्रानिक वोटिंग मषीनों की कार्यप्रणाली से पूर्णतया परिचित हैं ;

3. अतः, अब, भारत निर्वाचन आयोग एतद्‌द्वारा उत्तराखण्ड विधान सभा निर्वाचन क्षेत्र में 42-कापकोट, बिहार विधान सभा निर्वाचन क्षेत्र में 186-फतुहा(अ0जा0), पंजाब विधान सभा निर्वाचन क्षेत्र में 36-नूर महल तथा त्रिपुरा विधान सभा निर्वाचन क्षेत्र में 8-टाउन बार्डोवाली क्षेत्रों को ऐसे निार्वचन क्षेत्रों के रूप में विनिर्दिश्ट करता है जिसमें 4 मई, 2009 को अधिसूचित उक्त राज्यों की विधान सभाओं के लिए चालू उप निर्वाचन में, निर्वाचनों का संचालन नियम, 1961 के अधीन निर्धारित रीति से इलैक्ट्रानिक मतदान मषीनों के माध्यम से मत डाले और रिकार्ड किए जाएंगे जैसा कि इस विशय पर आयोग द्वारा समय समय पर अनुपूरक अनुदेष जारी किए जाते है।

ELECTION COMMISSION OF INDIA ——— DIRECTION Nirvachan Sadan, Ashoka Road, New Delhi-110 001/ Dated : 19th May, 2009 No. 576/3/EVM/2009/SDR(LA):– WHEREAS, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituencies as the Election Commission of India may, having regard to the circumstances of each case specify; and

2. WHEREAS, the Commission has considered the circumstances in 42-Kapkot Assembly Constituency in Uttarakhand, 186-Fatuha (SC) Assembly Constituency in Bihar, 36-Nur Mahal Assembly Constituency in Punjab, 8-Town Barowali Assembly Constituency in Tripura, and is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the abovementioned Assembly Constituencies, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;

3. NOW, THEREFORE, the Election Commission of India hereby specifies 42-Kapkot Assembly Constituency in Uttarakhand, 186-Fatuha (SC) Assembly Constituency in Bihar, 36-Nur Mahal Assembly Constituency in Punjab, 8-Town Barowali Assembly Constituency in Tripura, as the constituencies in which the votes at the current bye-elections to the Legislative Assemblies of the said States notified on 4th May, 2009, shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.
