अध्याय-I प्रारम्भिक

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।— (i) यह नियमावली 'बिहार निबंधन पुराभिलेखपाल संवर्ग (भर्ती एवं सेवार्शों) नियमावली, 2009' कही जा सकेगी ।

(ii) इसका विस्तार संपूर्ण बिहार राज्य में होगा । (iii) यह तुरन्त प्रवृत होगी।

2. परिभाषा। - इस नियमावली में, जब तक कोई बात विषय या संदर्भ के विरूद्ध न हो— (i) ''संवर्ग'' से अभिप्रेत है निबंधन विभाग के नियंत्रण में पृथक इकाई के रूप में कार्यरत बिहार निबंधन पुराभिलेखपाल संवर्ग;

(ii) ''राज्य सरकार'' से अभिप्रेत है बिहार सरकार; (iii) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (iv) ''राज्यपाल'' से अभिप्रेत है बिहार के राज्यपाल; (v) ''निबंधन पुराभिलेखपाल'' से अभिप्रेत है बिहार निबंधन पुराभिलेखपाल संवर्ग में नियुक्त व्यक्ति; (vi) ''अनुसूची'' से अभिप्रेत है इस नियमावली से संलग्न अनुसूची; (vii) ''वर्ष से'' अभिप्रेत है विाीय वर्ष अर्थात्‌ 1 अप्रैल से प्रारम्भ होकर अगले वर्ष 31 मार्च को समाप्त होने वाला वर्ष; तथा2 (cid:18)बहार गजट (असाधारण)] 9 जून 2009 (viii) ''वर्ष के अन्दर रिक्ति'' से अभिप्रेत है एक वर्ष में निबंधन पुराभिलेखपाल के नए पदों के सृजन या किसी सदस्य की सेवानिवृति या मृत्यु अथवा संवर्ग से हटाये जाने अथवा पदच्युत किये जाने अथवा त्यागपत्र दिये जाने के फलस्वरूप उपलब्ध रिक्ति अथवा पूर्व वर्षाें की ऐसी रिक्तियाँ जो भरी नहीं जा सकी हो ।

3. संवर्ग की संरचना । - यह संवर्ग निबंधन, उत्पाद एवं मद्य निषेध विभाग (निबंधन) के प्रशासी नियंत्रण के अधीन होगा जिसके विभागाध्यक्ष निबंधन महानिरीक्षक होंगे और राज्य सरकार, समय-समय पर, संवर्ग का प्राधिकृत बल विनिश्चित कर सकेगी तथा इस नियमावली की अनुसूची में उल्लिखित पूर्व से स्वीकृत पदों के अतिरिक्त इस संवर्ग के स्थायी/अस्थायी पदों के सृजन की स्वीकृति दे सकेगी।

4. पद स्थिति। - बिहार निबन्धन पुराभिलेखपाल संवर्ग के पुराभिलेखपाल राज्य सरकार के समूह-'ग' के अराजपत्रित श्रेणी के होंगे।

अध्याय - II

भर्त्ती

5. भर्त्ती का स्रोत। - इस संवर्ग में र्भाी सिर्फ सीधी र्भाी के द्वारा होगी। 6. आरक्षण। - राज्य सरकार द्वारा समय-समय पर विहित नियम एवं प्रक्रिया के अनुसार सीधी र्भाी के आधार पर र्भाी हेतु निर्धारित आरक्षण/ रोस्टर का अनुपालन आवश्यक होगा।

7. रिक्तियों का निर्धारण एवं आयोग को संसूचन। - राज्य सरकार प्रत्येक वर्ष की पहली अप्रैल को भरी जाने वाली रिक्तियों की संख्या निर्धारित करेगी तथा इस प्रकार निर्धारित रिक्तियों की सूचना प्रत्येक वर्ष 30 अप्रैल तक आयोग को देगी।

8. आयोग द्वारा भर्त्ती। - विभाग से कोटिवार रिक्तियों की संख्या प्राप्त होने पर आयोग निबंधन पुराभिलेखपाल के पद हेतु योग्य अभ्यर्थियों से आवेदन प्राप्त करेगा।

9. अर्हताएँ। - (1) शैक्षणिक योग्यताएँ- (क) किसी मान्यता प्राप्त विश्वविद्यालय से इतिहास में कम से कम द्वितीय श्रेणी में (आधुनिक भारतीय इतिहास विशेष पत्र के साथ) स्नातकोार उपाधि। (ख) आधुनिक भारतीय इतिहास में दो वर्षों के शोध कार्य का अनुभव/किसी मान्यता प्राप्त शिक्षण संस्थान में आधुनिक भारतीय इतिहास में शिक्षण का दो वर्षों का अनुभव/पुराभिलेखीय अध्ययन में एक वर्षीय डिप्लोमा के साथ किसी पुराभिलेख कार्यालय में दो वर्षों का कार्यानुभव अथवा आधुनिक भारतीय इतिहास में तीन वर्षों का शोध कार्य का अनुभव/अभिलेखीय अध्ययन में एक वर्षीय डिप्लोमा के साथ भारतीय इतिहास में शोध कार्य का 2 वर्ष का अनुभव/किसी मान्यता प्राप्त शिक्षण संस्थान में आधुनिक भारतीय इतिहास में 2 वर्ष का अध्यापन कार्य का अनुभव/पुराभिलेखीय कार्यालय में कार्य का 2 वर्ष का अनुभव।

अथवा

पुराभिलेखीय विज्ञान के ज्ञान के साथ 3 वर्षों का आधुनिक भारतीय इतिहास में शोध कार्य का अनुभव। (ग) स्नातक स्तर पर वैकल्पिक भाषा के रूप में अंग्रेजी का अध्ययन किया हो। (घ) किसी मान्यता प्राप्त संस्थान से प्रिजर्वेशन ऑफ रेकर्ड्‌स में सर्टिफिकेट कोर्स उाीर्ण हो।

(2) वांछनीय योग्यता। - हिन्दी एवं अँग्रेजी के साथ किसी अन्य भाषा का ज्ञान। सीधी र्भाी हेतु अभ्यर्थी की न्यूनतम आयु सीमा 27 वर्ष तथा अधिकतम आयु सीमा वही होगी जो राज्य सरकार (कार्मिक एवं प्रशासनिक सुधार विभाग) द्वारा समय-समय पर निर्धारित की जाय।

10. मौखिक परीक्षा। - कोई लिखित परीक्षा नहीं होगी। नियम-9 में विहित अर्हताओं के आधार पर चयनित अभ्यार्थियों को आयोग द्वारा गठित बोर्ड के समक्ष मौखिक परीक्षा के लिए उपस्थित होना होगा। मौखिक परीक्षा एक सौ (100) अंकों का होगा। मौखिक परीक्षा हेतु न्यूनतम अर्हतांक चालीस (40) होगा।

11. आयोग द्वारा अभ्यर्थियों की अनुशंसा। - शैक्षणिक योग्यताओं एवं मौखिक परीक्षा के आधार पर आयोग मेधा सूची तैयार कर अभ्यर्थियों की उतनी संख्या की अनुशंसा राज्य सरकार को करेगा जितनी संख्या में रिक्तियाँ प्रतिवेदित की गई हों। पैनल की वैधता एक वर्ष तक ही रहेगी। किसी अभ्यर्थी के योगदान न करने अथवा अपेक्षित अभ्यर्थियों का चयन न होने पर अवशिष्ट रिक्तियाँ अगले वर्ष के लिए अग्रणीत कर दी जायेगी। 12. चिकित्सा परीक्षा। -नियुक्ति के लिए चुने गये प्रत्येक अभ्यर्थी को राज्य सरकार द्वारा गठित चिकित्सा बोर्ड के समक्ष चिकित्सा परीक्षा के लिए उपस्थित होना पड़ेगा। पदीय कर्तव्यों को दक्षतापूर्वक निष्पादित करने की दृष्टि से जो अभ्यर्थी अपनी अपेक्षित शारीरिक योग्यता के संबंध में चिकित्सा बोर्ड को संतुष्ट करने में सफल होगा उसी अभ्यर्थी को नियुक्त करने पर विचार किया जा सकेगा ।

अध्याय- III

13. परिवीक्षा अवधि। -किसी मौलिक रिक्ति के विरूद्ध नियुक्त प्रत्येक पदाधिकारी को पदग्रहण की तिथि से दो वर्षाें की अवधि तक परिवीक्षा पर रखा जायेगा। परिवीक्षा अवधि में सेवा संतोषप्रद नहीं रहने पर परिवीक्षा अवधि एक वर्ष के लिए बढ़ायी जा सकेगी। वर्द्धित अवधि मंें भी सेवा संतोषप्रद नहीं रहने पर सेवामुक्त किया जा सकेगा।3 (cid:18)बहार गजट (असाधारण)] 9 जून 2009 14. सम्पुष्टि। -निबंधन पुराभिलेखपाल के पद पर नियुक्त व्यक्ति दो वर्षाें की परिवीक्षा अवधि पूरी करने के बाद सम्पुष्ट किया जा सकेगा, यदि वह विभागीय परीक्षा में विहित स्तर से उाीर्ण हो गया हो तथा राज्य सरकार उसे सम्पुष्टि हेतु उपयुक्त समझती हो।

15. वेतन वृद्धि। - वार्षिक वेतन वृद्धि सरकार द्वारा यथा विहित परीक्षा में उत्तीर्ण होने के बाद देय होगी। परन्तु यह कि प्रथम वेतनवृद्धि के बाद अगली वेतनवृद्धि विभागीय परीक्षा उाीर्र्ण होने पर ही अनुमान्य होगी।

विविध

16. इस संवर्ग के लिए अन्य सेवा शर्तें यथा- अनुशासनिक कार्रवाई, छुट्टी, देय सेवानिवृति लाभ इत्यादि जो इस नियमावली से आच्छादित नहीं हैं या जो इस संवर्ग के लिए पृथक रूप से अधिसूचित नहीं है; बिहार सेवा संहिता, बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के सुसंगत प्रावधानों द्वारा अथवा राज्य सरकार द्वारा, समय-समय पर, निर्गत अन्य सुसंगत नियमावलियों, आदेशों तथा परिपत्रों द्वारा नियंत्रित होंगी। 17. राज्य सरकार को यह अधिकार होगा कि वह इस नियमावली में विहित प्रावधानों को यथा आवश्यक संशोधित करें । प्रशासी विभाग इस नियमावली के प्रावधानों को कार्यरूप देने के लिए नियमावली के प्रावधान के अनुरूप प्रक्रिया निर्धारित करने हेतु विनियमावली बना सकेगी।

18. इन नियमों के कार्यान्वयन में भविष्य में हो सकने वाली किसी कठिनाई को दूर करने के लिए संगत निदेश निर्गत करने की शक्ति निबंधन, उत्पाद एवं मद्य निषेध विभाग को होगी।

19. निरसन। - इस नियमावली के लागू होने के पूर्व इस संवर्ग के संबंध में निर्गत संकल्प अनुदेश आदि निरसित समझे जायेंगे।

अनुसूची-I

संवर्गीय पदों की संरचना, वेतनमान, पद बल एवं कार्यक्षेत्र

राज्य सरकार पदों की संख्या में आवश्यकतानुसार भविष्य में वृद्धि अथवा कमी कर सकेगी ।

------- 8 जून 2009 सं0 II/एम¹-1040/2008-1344-पटना, दिनांक 8 जून 2009 द्वारा प्रकाशित 'बिहार निबंधन पुराभिलेखपाल संवर्ग (भर्ती एवं सेवार्शों) नियमावली, 2009' का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-384 के खंड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

Preiliminaries

1. Short Title, Extent & Commencement.— (i) These rules may be called the 'Bihar Registration Archivists Cadre (Recruitment & Service Conditions) Rules 2009'.

(ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force at once.

2. Definitions.—In these rules, unless there is anything repugnant in the subject or context,

(i) '' Cadre'' means the cadre of Bihar Registration Archivist working under the control of Registration Department approved as a separate unit;

(ii) '' The State Government'' means the Government of Bihar; (iii) ''Commission'' means Bihar Staff Selection Commission; (iv) ''Governor'' means the Governor of Bihar; (v) "Registration Archivist" means a person, working in Bihar Registration Archivist Cadre;

(vi) ''Schedule'' means Schedule appended to these rules; (vii) "Year" means financial year, i.e., year commencing from 1st April and ending on 31st March of succeeding year;

(viii) ''Vacancy during a year'' means the available vacancies during a year due to creation of new posts in cadre or due to retirement or death or removal or dismissal from or due to resignation or such vacancies of previous year which could not have been filled up.

3. Structure of Cadre.—This cadre shall be under the administrative control of Registration, Excise and Prohibition Department (Registration), of which the Head of the Department shall be the Inspector General of Registration and the State Government may from time to time decide the authorised cadre strength and may sanction the creation of permanent/temporary posts in this cadre in addition to already sanctioned posts mentioned in Schedule of these rules. 4. Status of Post.—The Archivists of Bihar Registration Archivist Cadre shall be of Group 'C' in the Non-gazetted category of the State Government.

CHAPTER - II.

Recruitment

5. Source of recruitment.—The recruitment in this cadre shall be made only by direct recruitment. 6. Reservations.—It shall be essential to follow the reservation/roster in recruitment in accordance with rules and procedure prescribed by the State Government from time to time for direct recruitment. 7. Determination of vacancies and communication to Commission.—On the first April of each year, the State Government shall determine the vacancies to be filled up and shall communicate the category wise vacancies so determined to the Commission by 30th April of each year. 8. Recruitment through Commission.—The Commission, after receiving the vacancy category-wise from the department, shall receive applications from eligible candidates for recruitment to the post of Registration Archivist. 9. Eligibility.— (i) Educational Qualifications- (a) A Second class Post Graduate Degree in History (With Modern Indian History as special paper) from a recognized University. (b) Experience of two years research work in Modern Indian History/two years teaching experience in Modern Indian History in a recognized educational institution/two years experience of work in an Archival Office with one year diploma in Archival study or three years experience of research work in Indian History/two years5 (cid:18)बहार गजट (असाधारण)] 9 जून 2009 teaching experience in modern Indian History from recognized educational institution./two years research experience in Indian History with one year diploma in Archival study/two year experience of work in an archival office. Or Three years experience of research work in Modern Indian History with the knowledge of Archeology. (c) Must have studied English as an optional subject at degree level. (d) Must have passed certificate course in preservation of records from a recognized institution. (ii) Desirable Qualification- Knowledge of any other language with the knowledge of Hindi and English.

The minimum age limit of the candidate for direct recruitment shall be 27 years and the maximum age limit shall be as the state government (Personnel & Administrative Reforms Department) decides from time to time. 10. Viva Voce Test.—There will be no written test. The candidates selected on the basis of eligibility criteria prescribed in Rule 9 above shall have to appear before the board constituted by the Commission for Viva Voce test. The Viva Voce Test shall be of hundred (100) marks. The minimum qualifying marks for Viva Voce Test shall be forty (40). 11. Recommendation of Candidates by the Commission.—The commission shall, after preparing a merit list on the basis of educational qualifications and viva voce test, recommend the number of candidates according to the vacancy reported to it. The panel shall remain valid only for a year. The remaining vacancies due to non-joining of any candidate or non selection of requisite candidates shall be carried forward for the next year. 12. Medical Examination.—Every candidate selected for appointment shall have to appear for medical examination before the Medical Board constituted by the State Government. The candidates, who shall be able to satisfy the Medical Board regarding their medical fitness with a view to efficient execution of the liability of the official duty, may only be considered for appointment.

CHAPTER - III. 13. Probation Period .—Every officer appointed against a substantive vacancy shall be on probation for two years from the date he joins his post. In case the service during the probation period is not satisfactory, the probation period may be extended for one year. Even during the extended period if the service is not satisfactory, he may be removed from service. 14. Confirmation.—A person appointed on the post of Registration Archivist may be confirmed after the completion of probation period of two years, if he has passed the departmental examination as per prescribed standard and the State Government considers him to be fit for confirmation. 15. Increment.—Annual increment of pay shall be admissible after passing the examination as prescribed by the State Government, provided that the next increment shall be admissible only after passing the departmental examination.

Miscellaneous 16. The other service conditions for this cadre, such as, disciplinary action, leave, admissible retirement benefits, which are not covered by these rules or which are not separately notified for this cadre shall be controlled by the relevant provisions of Bihar Service code, Bihar Civil Services (Classification, Control & Appeal) Rules, 2005 and by other relevant Rules, orders and circulars issued from time to time by the State Government.

17. The State Government shall have the right to amend the provisions of these rules as required. The administrative department may make regulations in order to prescribe the procedure in accordance with the provisions of these rules for implementing these rules. 18. The Registration, Excise & Prohibition Department shall have the power to issue relevant instructions to remove any difficulty which may arise in implementation of these rules in future. 19. Repeal.—The resolutions, instructions etc. issued prior to the coming into force of these rules shall be deemed to be repealed.
