सं0 3/4/आई.डी/2009/एस.डी.आर(परिशद्)—यतः निर्वाचन आयोग, वर्श 2000 से लोक सभा और विधान सभाओं के निर्वाचनों में विषिश्ट दस्तावेजों के माध्यम से निर्वाचकों के लिए अनिवार्य पहचान की नीति अपनाता रहा है, ताकि निर्वाचनों में प्रतिरूपण रोका जा सके, जिससे लोक प्रतिनिधित्व अािध्नियम, 1951 की धारा-62 के अधीन असली निर्वाचक के अधिकार को अधिक प्रभावी बनाया जा सके; और
2. यतः, निर्वाचकों का संचालन नियम, 1961 के नियम 35(3) और 37(2) (ख) के उपबन्धों को ध्यान में रखते हुए, आयोग निदेष जारी करता रहा है कि लोक सभा और विधान सभाओं के निर्वाचनों में निर्वाचकों को मतदान केन्द्र पर निर्वाचक पहचान-पत्र या अन्य विषिश्ट दस्तावेज प्रस्तुत करने होगें और निर्वाचक पचान-पत्र प्रस्तुत करने में असफल रहने या उनके द्वारा मना करने की स्थिति में उन्हें मतपत्र प्रदान करने या मतदान करने की अनुमति देने से रोका जा सकता है; और
3. यतः, निर्वाचकों की पहचान तथा प्रतिरूपण के विरुद्ध सुरक्षा उपायों के सम्बन्ध में उक्त उपबन्ध स्थानीय प्राधिकार निर्वाचन-क्षेत्रों के निर्वाचनों पर भी समान रूप से लागू होगा और क्योंकि इन निर्वाचन क्षेत्रों के निर्वाचक विधान-सभा निर्वाचन क्षेत्रों के निर्वाचक भी होते हैं, उन्हें उनकी विधान सभा निर्वाचन क्षेत्रों के निर्वाचक के रूप में निर्वाचक पहचान-पत्र दिए जा सकते है;
4. अतः अब, सभी प्रासांगिक तथ्यों तथा विधि तथा तथ्यात्मक स्थिति को ध्यान में रखने के बाद, निर्वाचन आयोग एतद्द्वारा निदेष देता है कि बिहार राज्य राज्य में पटना, नालन्दा, गया-सह-जहानाबाद-सह-अरवल, औरंगाबाद, नवादा, भोजपुर-सह-बक्सर, रोहतास-सह-कैमूर, सारण, सिवान, गोपालगंज, पिष्चम चम्पारण, पूर्वी चम्पारण, मुजफ्फरपुर, वैषाली, सीतामढ़ी-सह-षिवहर, दरभंगा, समस्तीपुर, मुगेंर-सह-जमुई-सह-लखिसराय-सह-षेखपुरा, बेगूसराय-सह-खगड़िया, सहरसा-सह-मधेपुरा-सह-सुपौल, भागलपुर-सह-बॉका, मुधबनी, पूर्णियॉ-सह-अररिया-सह-किषनगंज एवं कटिहार स्थानीय प्राधिकारी निर्वाचन क्षेत्रों के द्विवार्शिक निर्वाचनों में सभी निर्वाचकों को, जिन्हें निर्वाचक फोटो परिचय-पत्र जारी किए गए हैं, अपने मताधिकार का प्रयोग करते समय इन पहचान-पत्रों को प्रस्तुत करना होगा जब वे बिहार राज्य में दिनांक 19 जून 2009 को अधिसूचित विधान परिशद के उक्त निर्वाचन-क्षेत्रों के द्विवार्शिक निर्वाचन के लिए, मत डालने मतदान केन्द्रों पर आएं। तथापि, उन निर्वाचकों को जो अपने निर्वाचक फोटो पहचान पत्र प्रस्तुत नहीं कर पाते हैं उन्हें इन द्विवर्शिक निर्वाचनों में मत डालने की अनुमति होगी बषर्ते कि निम्नलिखित वैकल्पिक दस्तावेजों में से कोई एक प्रस्तुत करने पर भी उनकी पहचान स्थापित हो :-
1. संबंधित स्थानीय निकाय के निर्वाची पदाधिकारी के हस्ताक्षर एवं मुहर से निर्गत निर्वाचन प्रमाण-पत्र। 2. यदि निर्वाचन प्रमाण-पत्र उपलब्ध नहीं हो तो संबंधित स्थानीय निकाय के मुख्य कार्यपालक पदाधिकारी (पदनाम जो लागू हो) द्वारा फोटो सहित निर्गत प्रमाण-पत्र जिसमें सदस्यता दर्षाई गयी हो।
3. संसद/विधान मंडल के सदस्य को निर्गत परिचय-पत्र 4. पासपोर्ट 5. वाहन-चालक (ड्राइविंग) लाइसेंस 6. आयकर पहचान पत्र (पैन कार्ड) 7. संबंधित जिला पदाधिकारी/संबंधित अनुमण्डल पदाधिकारी द्वारा निर्वाचक के फोटो सहित निर्गत प्रमाण-पत्र जिसमें उसकी निर्वाचक संख्या का उल्लेख हो।
5. पहचान के लिए उपर्युक्त वैकल्पिक दस्तावेज ऐसे छूटे हुए निर्वाचकों के संबंध में भी लागू होगें, जिन्हें निर्वाचक पहचान पत्र दिए तो गए हैं, लेकिन वे किन्हीं ऐसे कारणो से जो उनके नियन्त्रण से बाहर हैं, उन्हें प्रस्तुत नहीं कर सकते ।

No. 3/4/ID/2009/SDR (Council)—WHEREAS, the Election Commission has been following the policy of compulsory identification of electors by means of specified identification documents at elections to the House of the People and Legislative Assemblies from the year 2000 onwards, so as to prevent impersonation at elections thereby making the right of genuine electors to vote under section 62 of the Representation of the People Act, 1951 more effective; and
2. WHEREAS, keeping in view the provisions of Rules 35(3) and 37(2)(b) of the Conduct of Election Rules, 1961, the Commission has been issuing directions that the3 (cid:18)बहार गजट (असाधारण)] 16 जुलाई 2009 electors at election to House of the People and Legislative Assemblies shall produce their Electoral Identity Cards or other specified documents at the polling station and failure or refusal on their part to produce those Electoral Identity Cards or documents may result in the denial of supply of a ballot paper to them and permission to vote; and
3. WHEREAS, the said provisions regarding identification of electors and safeguards against personation are equally applicable at elections from Local Authorities Constituencies, and as the electors in these constituencies are also electors in assembly constituencies, they may have been supplied with Electoral Identity Cards as electors in their respective Assembly Constituencies;
4. NOW, THEREFORE, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that all electors at the biennial elections in Patna, Nalanda, Caya-cum-Jahanabad-cum-Arwal-Aurangabad, Nawada, Bhojpur-cum-Buxar, Rohtas -cum- Kaimur, Saran, Siwan, Gopalganj, West Champaran, East Champaran, Muzaffarpur, Vaishali, Sitamarchi-cum-Sheohar, Darbhanga, Samastipur, Munger-cum-Jamui-cum-Lakhisarai-cum-Sheikhpura, Begusarai-cum-Khagaria, Saharsa-cum-Madhepura-cum-Supaul, Bhagalpur-cum-Banka, Madhubani, Purnea-cum-Araria-cum-Kishanganj & Katihar Local Authorities Constituencies in the State of Bihar, who have been issued with their EPICs, shall have to produce these cards to exercise their franchise, when they come to the polling stations for voting at the Biennial Elections to the Bihar Legislative Council from the said Constituencies, notified on 19.6.2009. However, for those electors who are not able to produce the EPIC, they will be permitted to vote at the Biennial Elections, provided their identity is otherwise established by producing any of the following alternative documents:–
(i) Certificate of election (Nirvachan Praman-Patra) issued under his seal by the respective Returning Officer of the Local Authority.
(ii) If (1) is not available, a certificate with photograph indicating membership in the local authority issued by the Chief Executive Officer (or by whatever name he is known as) of the Local Authority. (iii) Identity card issued to the members of State Legislative/Parliament (as they are ex-officio members of some of Local Authorities). (iv) Passports (v) Driving Licences (vi) Income Tax Identity (PAN) Card (vii) Photo certificate issued by the DM/SDO which also includes the electors number.
5. The above alternative documents for identification will also apply in respect of such of the odd electors, who have been supplied with Electoral Identity Cards, but are not able to produce them for reasons beyond their control.
