सं0 100/बि.-वि.प./1/2009 (1) :- यत्‌ः बिहार राज्य की विधान सभा के सदस्यों द्वारा विधान परिशद्‌ के लिए निर्वाचित श्री राम बदन राय का स्थान, जिनकी पदावधि 21 जुलाई, 2010 को सम्मिलित करते हुए उस तारीख तक थी, के समाप्त होने से पूर्व ही उनके त्यागपत्र देने के कारण दिनांक 17 मार्च, 2009 से रिक्त हो गया है ; और

यतः, इस प्रकार हुई रिक्ति को भरने केे प्रयोजन से उप-निर्वाचन कराना है ; अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-151, धारा 39 की उपधारा (1) और धारा 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्‌द्वारा :- (अ) बिहार राज्य की विधान सभा के सदस्यों से यह अपेक्षा करता हैं कि वे 14 अगस्त, 2009 (षुक्रवार) से पूर्व तथा उक्त अधिनियम और तद्‌धीन बनाए गए नियमों और किए गए आदेषों के उपबन्धों के अनुसार राज्य की विधान परिशद्‌ में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दें ; (आ) उक्त निर्वाचन के संबंध में :-

1 अगस्त, 2009 (षनिवार) 3 अगस्त, 2009 (सोमवार) 5 अगस्त, 2009 (बुधवार)

(क) नाम निर्देषन करने की अन्तिम तारीख (ख) नाम निर्देषन की संवीक्षा की तारीख (ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख (घ) वह तारीख, जिसको यदि आवष्यक हुआ तो मतदान होगा 12 अगस्त, 2009 (बुधवार) और (ड़) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा 14 अगस्त, 2009 (षुक्रवार)

नियत करता है ; और (इ) 9.00 बजे पूर्वाहन्‌ से 4.00 बजे अपराह्‌न तक का समय, ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवष्यक हुआ है तो, निर्वाचन के लिए उपर्युक्त विनिर्दिश्ट तारीख को, मतदान होगा ।

No.100/BR-LC/1/2009 (1) :- Whereas, the seat of Shri Ram Badan Rai, in the Legislative Council of the State of Bihar, elected by the members of the Legislative Assembly of the State, has become vacant on 17th March, 2009 by the reason of his resignation, before the expiration of his term of office which was upto and including the 21st July, 2010; and

WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;

NOW, THEREFORE, in pursuance of section 151, sub-section (1) of section 39 and section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby- (A) calls upon the members of the Legislative Assembly of the State of Bihar to elect, before 14th August, 2009 (Friday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Legislative Council of the State; (B) appoints with respect to said election,-

(a) the 1st August, 2009 (Saturday), as the last date for making nominations; (b) the 3rd August, 2009 (Monday), as the date for the scrutiny of nominations; (c) the 5th August, 2009 (Wednesday), as the last date for the withdrawal of candidatures;

(C) fixes the hours from 9.00 A.M to 4.00 P.M, as the hours during which the poll shall, if necessary, be taken on the date specified above, for the election.

सं0 100/बि.-वि.प./1/2009 (4) :- लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 21 के अनुसरण में और धारा 22 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग, बिहार राज्य सरकार के परामर्ष से तारीख 25 जुलाई, 2009 को राज्य के शासकीय राजपत्र में प्रकाषित आयोग की अधिसूचनाओं सं. 100/बि.-वि.प./1/2009 (1), 100/बि.-वि.प./1/2009 (2) और 100/बि.-वि.प./1/2009 (3) के अनुसरण में इस राज्य की विधान सभा के सदस्यों द्वारा बिहार राज्य की विधान परिशद के लिए होने वाले उप निर्वाचनों के संबंध में, एतद्‌द्वारा :-

(I) नीचे की सारणी के स्तम्भ (1) में विनिर्दिश्ट अधिकारी को रिटर्निग आफिसर के रूप में पदाभिहित करता है ; और (II) उक्त सारण्ाीं के स्तम्भ (2) में विनिर्दिश्ट अधिकारी को, रिटर्निंग आफिसर की उसके क्‌त्यांें के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।
