सं0 एल0जी0-1-06/2009/लेज-64—बिहार विधान मंडल द्वारा यथा पारित निम्नलिखित अधिनियम, जिसपर राज्यपाल दिनांक 29 अगस्त, 2009 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है—

बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम 11, 2007) का संशोधन करने के लिए अधिनियम। भारत गणराज्य के साठवें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो- 1. संक्षिप्त नाम, विस्तार और प्रारम्भः- (1) यह अधिनियम बिहार नगरपालिका (संशोधन) अधिनियम, 2009 कहा जा सकेगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरत प्रवृत्त होगा।

2. बिहार अधिनियम 11, 2007 की धारा-12 का संशोधन—

(i) उक्त अधिनियम की धारा-12(2) की कंडिका (क) के द्वितीय कण्डिका में शब्द ''विहित रीति से'' के पश्चात्‌ शब्द ''दो क्रमिक आम निर्वाचन के पश्चात्‌'' अन्तःस्थापित किये जायेंगे। (ii) उक्त अधिनियम की धारा-12(2)(क) की तृतीय कंडिका के दूसरे वाक्य में शब्द ''उत्तरवर्त्ती चुनावों में'' के पश्चात्‌ शब्द ''दो क्रमिक आम निर्वाचन के पश्चात्‌'' अन्तःस्थापित किये जायेंगे।

(iii) उक्त अधिनियम की धारा-12(2)(घ) में शब्द ''यथाविहित रीति से'' के पश्चात्‌ शब्द ''दो क्रमिक आम निर्वाचन के पश्चात्‌'' अन्तःस्थापित किये जायेंगे।

(iv) उक्त अधिनियम की धारा-12(2)(घ) के पश्चात्‌ उल्लेखित स्पष्टीकरण ''शंकाओं के निवारण हेतु एतद्‌ द्वारा घोषणा की जाती है कि इस उप-धारा के अधीन अनुसूचित जाति एवं अनुसूचित जन-जाति के पदों के आरक्षण के प्रयोजनार्थ चक्रानुक्रम सिद्धान्त बिहार नगरपालिका (संशोधन) अधिनियम, 1995, पटना नगर निगम (संशोधन) अधिनियम, 1995 के प्रारंभ होने के पश्चात्‌ हुए प्रथम निर्वाचन से प्रारंभ होगा।'' निम्नलिखित द्वारा प्रतिस्थापित की जायगी, यथा-

''शंकाओं के निवारण हेतु एतद्‌ द्वारा घोषणा की जाती है कि इस उप-धारा के अधीन अनुसूचित जाति, अनुसूचित जनजाति, पिछड़ा वर्ग, पिछड़े वर्गों की महिलाओं तथा अनारक्षित श्रेणी की महिलाओं के पदों के आरक्षण के प्रयोजनार्थ चक्रानुक्रम सिद्धान्त बिहार नगरपालिका अधिनियम, 2007 के प्रारंभ होने के पश्चात्‌ हुए प्रथम निर्वाचन से प्रारंभ होगा।''

3. बिहार अधिनियम 11, 2007 की धारा-29 का संशोधन—

(i) उक्त अधिनियम की धारा-29(1)(क) की द्वितीय कंडिका में शब्द ''विहित रीति से'' के पश्चात्‌ शब्द ''दो क्रमिक आम निर्वाचन के पश्चात्‌'' अन्तःस्थापित किये जायेंगे। ़़़

(ii) उक्त अधिनियम की धारा-29(1)(क) की तृतीय कंडिका के दूसरे वाक्य में शब्द ''उत्तरवर्त्ती निर्वाचनों में'' के पश्चात्‌ शब्द ''दो क्रमिक आम निर्वाचन के पश्चात्‌'' अन्तःस्थापित किये जायेंगे।

(iii) उक्त अधिनियम की धारा-29(1)(घ) में शब्द ''विहित रीति से'' के पश्चात्‌ शब्द ''दो क्रमिक आम निर्वाचन के पश्चात्‌'' अन्तःस्थापित किये जायेंगे।

(iv) उक्त अधिनियम की धारा-29(1)(घ) के पश्चात्‌ उल्लेखित स्पष्टीकरण ''शंकाओं के निवारण हेतु एतद्‌ द्वारा घोषणा की जाती है कि इस उप-धारा के अधीन अनुसूचित जाति एवं अनुसूचित जनजाति के पदाें के आरक्षण के प्रयोजनार्थ चक्रानुक्रम सिद्धान्त बिहार नगरपालिका (संशोधन) अधिनियम, 1995 एवं पटना नगर निगम (संशोधन) अधिनियम, 1995 के प्रारंभ होने के पश्चात्‌ हुए प्रथम निर्वाचन से प्रारंभ होगा।'' निम्नलिखित द्वारा प्रतिस्थापित की जायगी, यथा-3 (cid:18)बहार गजट (असाधारण), 3 िसत,बर 2009 ''शंकाओं के निवारण हेतु एतद्‌ द्वारा घोषणा की जाती है कि इस उप-धारा के अधीन अनुसूचित जाति, अनुसूचित जनजाति, पिछड़ा वर्ग, पिछड़े वर्गाें की महिलाओं तथा अनारक्षित श्रेणी की महिलाओं के पदों के आरक्षण के प्रयोजनार्थ चक्रानुक्रम सिद्धान्त बिहार नगरपालिका अधिनियम, 2007 के प्रारंभ होने के पश्चात्‌ हुए प्रथम निर्वाचन से प्रारंभ होगा।''

4. बिहार अधिनियम 11, 2007 की धारा-75 का संशोधन।-बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम 11, 2007) की धारा-75 के परन्तुक के पश्चात्‌ निम्नांकित एक और परन्तुक जोड़ा जायेगाः- ''परन्तु यह और भी कि विभाग उपर्युक्त व्यय सीमा में समय-समय पर अधिसूचना द्वारा परिवर्त्तन कर सकेगा।''

5. बिहार अधिनियम 11, 2007 की धारा-79 का संशोधन ।-बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम 11, 2007) की धारा-79(2) के पश्चात्‌ निम्नांकित एक परन्तुुक जोड़ा जायेगाः- ''परन्तु यह कि राज्य सरकार नगर निकायों को उनके क्षेत्र के संपूर्ण विकास के लिए उनके क्षेत्र के अन्तर्गत किसी कार्यक्रम या परियोजना या किसी अन्य कार्य को करने हेतु, जो भारतीय संविधान की बारहवीं अनुसूची में है, जिसमें किसी एजेंसी को चिन्हित करने का कार्य भी सम्मलित है, के संबंध में उचित निदेश देने के लिए सक्षम होगी, चाहे उसके लिए निधि का स्रोत कोई भी हो।

धारा-79 की उप-धारा-(2) का परन्तुक बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम, 11, 2007) के लागू होने की तिथि से प्रवृत्त माना जायेगा तथा इसके अन्तर्गत राज्य सरकार द्वारा की गई कार्रवाई उक्त परन्तुक के द्वारा प्रदत्त शक्ति के अन्तर्गत की गई कार्रवाई मानी जायेगी''।

सं0 एल0जी0-1-06/2009/लेज-65—बिहार विधान मंडल द्वारा यथापारित और राज्यपाल द्वारा दिनांक 29 अगस्त 2009 को अनुमत बिहार नगरपालिका (संशोधन) अधिनियम, 2009 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा—

(Bihar Act 8, 2009) THE BIHAR MUNICIPAL (AMENDMENT) ACT, 2009 AN ACT TO AMEND THE BIHAR MUNICIPAL ACT, 2007 (BIHAR ACT 11, 2007) BE, it enacted by the Legislature of the State of Bihar in the sixtieth year of the Republic of India as follows:-

1. Short title, extent and commencement:-(1) This Act may be called the Bihar Municipal (Amendment) Act, 2009.

(2) It shall extend to the whole of the state of Bihar. (3) It shall come into force at once.

2. Amendment of Section 12 of the Bihar Act 11, 2007—

(i) In the second paragraph of section 12 (2) (a) of the said Act, the words ''after two consecutives general elections" shall be inserted after "in the prescribed manner."

(ii) In second sentence of third paragraph of section 12(2)(a) of the Act, the words "after two consecutive general elections "shall be inserted after the words" during subsequent elections."

(iii) In section 12(2)(d) of the Act, the words "after two consecutive general election."Shall be inserted after the words" in such manner as may be prescribed by it."

(iv) The explanation mentioned after section 12(2)(d) of the Act "For the removal of doubts it is herby, declared that the principle of rotation for the purpose of reservation of officers for the scheduled cast and scheduled Tribes under this sub-section shall commence from the first election held after the commencement of the Bihar Municipal(Amendment) Act, 1995 and Patna Municipal Corporation(Amendment) Act, 1995 shall be substituted as under— "For the removal of doubts it is, hereby, declared that the principle of rotation for the purpose of reservation of offices for the Scheduled Caste, Scheduled Tribes, Backward classes, Women of Backward classes and Women of unreserved category under this sub- section shall commence from the first election held after the commencement of the Bihar Municipal Act, 2007."

3. Amendment of Section 29 of the Bihar Act 11, 2007—

(i) In the second paragraph of section 29(1)(a) of the Act, the words ''after two consecutives general elections" shall be inserted after the words "in the prescribed manner."

(ii) In second sentence of third paragraph of section 29(1)(a) of the Act, the words "after two consecutive general elections" shall be inserted after the words "during subsequent elections."

(iii) In section 29(1)(d) of the Act, the words "after two consecutive general election." shall be inserted after the words "in such manner as may be prescribed."

(iv) The explanation mentioned after section 29(1)(d) of the Act "For the removal of doubts it is herby, declared that the principle of rotation for the purpose of reservation of officers for the scheduled cast and scheduled Tribes under this sub-section shall commence from the first election held after the commencement of the Bihar Municipal (Amendment) Act, 1995 and Patna Municipal(Amendment) Act, 1995 shall be substituted as under:- "For the removal of doubts it is, hereby, declared that the principle of rotation for the purpose of reservation of offices for the Scheduled Caste, Scheduled Tribes, Backward classes, Women of Backward classes and Women of unreserved category under this sub- section shall commence from the first election held after the commencement of the Bihar Municipal Act, 2007." 4. Amendment in section-75 of the Bihar Act, 11,2007—After section-75 of the Bihar Municipal Act, the following Proviso shall be added—

" Provided further that the department may change the aforesaid expenditure limits by notification issued from time to time." 5. Amendment in section-79 of the Bihar Act, 11,2007—After section-79 (2) a proviso shall be added as follows—

Provided further that the State Government shall be competent to issue appropriate direction to urban local self-bodies for undertaking any scheme or project or any other work including identifying any agency for overall development of the urban area within the jurisdiction of such urban bodies irrespective of the source of the fund in respect of any item included in the twelfth schedule to the Constitution of India.

Proviso to Sub-section (2) of Section-79 shall be deemed to be included in Bihar Municipal Act, 2007 (Bihar Act No. 11 of 2007) with effect from the date of its enforcement and any action taken by the State Government shall be deemed to have been taken in exercise of power conferred under above proviso.
