((((संसंसंसं0000 पपपपटना टना टना टना 444491919191)))) पपपपटनाटनाटनाटना, , , , वृहःपवृहःपवृहःपवृहःपितवारितवारितवारितवार,,,, 24242424 िसत+बिसत+बिसत+बिसत+बरररर 2009200920092009 गृह (विषेष) विभाग ——— अधिसूचनाएं 23 सितम्बर 2009 एस॰ओ॰ 202, दिनांक 24 सितम्बर 2009—बिहार राज्य की अधिसूचना सं0 1495, दिनांक 8 फरवरी 2008 एवं यथा संषोधित अधिसूचना सं0 1795/सी0, दिनांक 18 फरवरी 2008 द्वारा बिहार-राज्यपाल ने जाँच आयोग अधिनियम, 1952 (सं0 60,1952) की धारा-3 (।ं) के अधीन, दिनांक 18 जनवरी 2008 एवं 19 जनवरी 2008 को कहलगाँव, जिला भागलपुर में हुई गोली कांड के सही तथ्यों, पृष्ठभूमि एवं गोली कांड के लिए जिम्मेवार तत्वों की पहचान सहित भविष्य में ऐसी घटनाओं की पुनरावृति न होने के लिए सुझाव देने हेतु, न्यायमूर्ति श्री सदानन्द मुखर्जी (सेवानिवृत्त) की अध्यक्षता में एकल सदस्यीय न्यायिक जाँच आयोग का गठन किया गया तथा अधिसूचना निर्गत होने की तिथि से तीन माह के अन्दर प्रतिवेदन सौंपने का निदेष दिया गया था। अधिसूचना संख्या 6887/सी, दिनांक 25 जून 2008, 68, दिनांक 6 जनवरी 2009, 3335, दिनांक 21 मई 2009 एवं 4917, दिनांक 10 जुलाई 2009 द्वारा आयोग के कार्यकाल का अवधि विस्तार क्रमषः 7 नवम्बर 2008, 31 मार्च 2009, 30 जून 2009 एवं 31 अगस्त 2009 तक के लिए किया गया । 2. और, अब, चूँकि, बिहार-राज्यपाल को समाधान हो गया है कि संबंधित कार्य पूरा करने के लिए 31 अक्तूबर 2009 तक के लिए और समय की आवष्यकता है। 3. अतः जाँच आयोग अधिनियम, 1952 की धारा-3 (।ं) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त जाँच आयोग का कार्यकाल इस शर्त्त के साथ दिनांक 31 अक्तूबर 2009 तक विस्तारित किया जाता है कि आयोग द्वारा विस्तारित अवधि के अंतर्गत अपना प्रतिवेदन निष्चित रुप से समर्पित कर दिया जायेगा। 2 (cid:18)बहार गजट (असाधारण)] 24 िसत+बर 2009 23 सितम्बर 2009 एस॰ओ॰ 203, एस॰ओ॰ 202, दिनांक 24 सितम्बर 2009 का अंग्रेजी में निम्नलिखित अनुवाद राज्यपाल के प्राधिकार से इसके द्वारा प्रकाषित किया जाता है जो भारत संविधान के अनुच्छेद-348 के खंड (3) के अधीन अंग्रेजी भाषा में इसका प्राधिकृत पाठ समझा जाएगा।

——— The 23rd September 2009 S.O. 202, dated 24th September 2009—Governor of Bihar was pleased to constitute one member Commission of inquiry under section-3 (i) of the Commission of Inquiry Act, 1952 (No. 60 of 1952) to inquire the incident of firing, which took place on 18th January 2008 and 19th January 2008 at Kahalagaon within the district of Bhagalpur, as it was a matter of public importance to know the true facts, background about the said incident and to identify those who were responsible for the trouble leading to firing, including suggestions regarding prevention of recurrence of such incident in future, under the chairmanship of its sole member, Mr. Justice Sadanand Mukharjee (retired), vide Home Department Notification No. 1495/c dated 8th February 2008, amended as Notification No. 1795/c dated 18th February 2008, with direction to submit its report within three month from the date of notification. The term of Commission was extended up to 7th November 2008; 31st March 2009; 30th June 2009 and 31st August 2009 respectively vide notification no. 6887/C, dated 25th June 2008, 68 dated 6th January 2009, 3335 dated 21st May 2009 and 4917 dated 10th July 2009.
2. NOW, the Governor of Bihar is further pleased that in order to complete enquiry, the Commission requires further extension upto 31st October 2009.
3. THEREFORE, in exercise of the powers conferred under section-3(i) of the Commission of inquiry Act, 1952, the tenure of the Commission is hereby, extended upto 31st October 2009, with the condition that the commission shall submit its report positively within this stipulated period.
