राजेन्द्र कुमार मिश्र, सरकार के सचिव।2 (cid:18)बहार गजट (असाधारण), 10 नवम्बर 2009 विधि और न्याय मंत्रालय (विधि कार्य विभाग) अधिसूचना नई दिल्ली, 24 सितम्बर, 2009 सा.का.नि. 700(अ)-केन्द्रीय सरकार, नोटेरी अधिनियम, 1952 (1952 का 53) की धारा 15 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, नोटेरी नियम, 1956 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्ः- 1. (1) इन नियमों का संक्षिप्त नाम नोटेरी (दूसरा संशोधन) नियम, 2009 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2 नोटरी नियम, 1956 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 4 में, निम्नलिखित उप-नियम अंतःस्थापित किया जाएगा, अर्थातः-
''2क कोई व्यक्ति जो नोटेरी के रूप में नियुक्ति के लिए प्रारूप 2 में आवेदन कर रहा है वह समुचित सरकार के सक्षम प्राधिकारी को सीधे अभ्यावेदन प्रस्तुत कर सकेगा।''
3. उक्त नियमों के नियम 7क में उप-नियम (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :-
''2. उक्त प्रयोजन के लिए, समुचित सरकार द्वारा विधिक कार्य से संबंधित अपने अधिकारियों में से एक या अधिक साक्षात्कार बोर्ड का गठन किया जाएगा और प्रत्येक साक्षात्कार बोर्ड का अध्यक्ष उस सरकार के संयुक्त सचिव या विधि अधिकारी से अन्यून पंक्ति का नहीं होगा।''
4. उक्त नियमों से उपाबद्ध प्ररूप 2ख में ''भारत सरकार का संयुक्त सचिव/सरकार का सचिव ........................ ............................. (राज्य का नाम)'' शब्दों और कोष्ठकों के स्थान पर ''भारत सरकार का अपर सचिव/सरकार का सचिव ............................................................. (राज्य का नाम)'' शब्द और कोष्ठक रखे जाएंगे।

MINISTRY OF LAW AND JUSTICE (Department of Legal Affairs) NOTIFICATION New Delhi, the 24th September, 2009 G.S.R.700(E).—In exercise of the powers conferred by Section 15 of the Notaries Act, 1952 (53 of 1952), the Central Government hereby makes the following rules further to amend the Notaries Rules, 1956, namely:— 1. (1) These rules may be called the Notaries (Second Amendment) rules, 2009.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 4 of the Notaries Rules, 1956 (hereinafter referred to as the said rules), after sub-rule (2), the following sub-rule shall be inserted, namely :-
"2A. A person applying in Form II for appointment as a notary may submit the memorial direct to the Competent Authority of Appropriate Government." 3. In rule 7A of the said rules, for sub-rule (2), the following shall be substituted, namely:—
"2. For the said purpose, one or more Interview Boards shall be constituted by the appropriate Government from amongst its officers dealing with legal matters and the Chairperson of every Interview Board shall be an officer not below the rank of Joint Secretary or Law Officer of that Government."3 (cid:18)बहार गजट (असाधारण), 10 नवम्बर 2009 4. In FORM IIB appended to the said rules, for the words and brackets "Joint Secretary to the Government of India/Secretary to the Government of ……… …………………………… (Name of the State)", the words and brackets "Additional Secretary to the Government of India/Secretary to the Government of ……………...........………………….. (Name of the State)" shall be substituted.
