((((संसंसंसं0000 पपपपटना टना टना टना 606060609999)))) पपपपटनाटनाटनाटना, , , , सोमसोमसोमसोमवारवारवारवार,,,, 7777 *दस,ब*दस,ब*दस,ब*दस,बरररर 2009200920092009 खाद्य एवं उपभोक्ता संरक्षण विभाग --------- अधिसूचना 26 नवम्बर 2009 बिहार चावल एवं धान अधिप्राप्ति (उदग्रहण) आदेश, 2009 जी0 एस0 आर0 7, पटना, दिनांक 7 दिसम्बर 2009—चूँकि, बिहार-राज्यपाल को समाधान हो गया है कि चावल की आपूर्ति बनाये रखने तथा उचित मूल्य पर इसके साम्यपूर्ण वितरण और उपलब्धता सुनिश्चित करने के लिए आदेश निर्गत करना उनके लिए आवश्यक एवं समीचीन है । इसलिए, भारत सरकार, उपभोक्ता मामले, खाद्य एवं जन वितरण मंत्रालय, खाद्य एवं जन वितरण विभाग की अधिसूचना सं0 जी0 एस0 आर0 490 (ई), दिनांक 16 जून, 03 के साथ पठित एवं उक्त अधिसूचना में यथा उल्लिखित भारत सरकार की पूर्व सहमति से आवश्यक वस्तु अधिनियम, 1955 (अधिनियम-10, 1955) की धारा-3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल निम्नलिखित आदेश पुरःस्थापित करते हैंः- 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भः-

(1) यह आदेश बिहार चावल तथा धान अधिप्राप्ति (उदग्रहण) आदेश, 2009 कहलाएगा । (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह अधिसूचना निर्गमन की तिथि से दिनांक- 31 अगस्त 2010 तक खरीफ विपणन मौसम 2009-10 के लिए प्रवृत्त होगा ।

2. परिभाषाएंः जब तक कि सन्दर्भ में अन्यथा अपेक्षित न हो, इस आदेश में :- (क) जिला के सम्बन्ध मं ''समाहर्त्ता" से अभिप्रेत है जिला दंडाधिकारी तथा इसमें शामिल है इस आदेश के अधीन समाहर्त्ता के सभी या किन्ही कृत्यों का पालन करने के लिए राज्य सरकार द्वारा यथा प्राधिकृत जिला में पदस्थापित सरकार का अन्य पदाधिकारी ।

(ख) ''ग्राहक (कस्टम) मिल" से अभिप्रेत है ऐसा चावल मिल जहां नकद या वस्तु रूप में धान की कुटाई के भुगतान पर धान को चावल में बदला जाता है ।

(ग) ''प्रवर्तन पदाधिकारी" से अभिप्रेत तथा इसमें शामिल है उप निदेशक (खाद्य), जिला दंडाधिकारी, अपर जिला दंडाधिकारी (आपूर्ति), अपर समाहर्त्ता, विशेष प्रभारी पदाधिकारी, उप अनुभाजन पदाधिकारी, सहायक अनुभाजन पदाधिकारी, अनुमंडल दंडाधिकारी, जिला आपूर्ति पदाधिकारी, सहायक जिला आपूर्ति पदाधिकारी, प्रखंड आपूर्ति पदाधिकारी, पणन पदाधिकारी, आपूर्ति निरीक्षक, प्रखंड विकास पदाधिकारी, अंचलाधिकारी, खाद्य आयुक्त/सचिव, अपर सचिव, संयुक्त सचिव, उप सचिव, अवर सचिव, खाद्यायुक्त के सचिव, खाद्य एवं उपभोक्ता संरक्षण विभाग, उप2 (cid:18)बहार गजट (असाधारण)] 7 *दस,बर 2009 आरक्षी महानिरीक्षक (खाद्य) आरक्षी अधीक्षक (खाद्य) आरक्षी उपाधीक्षक (खाद्य) तथा निरीक्षक से अन्यून पंक्ति का कोई आरक्षी पदाधिकारी ।

(घ) ''खाद्य निगम" से अभिप्रेत है, खाद्य निगम अधिनियम, 1964 (अधिनियम -37, 1964) की धारा - 3 के अधीन स्थापित भारतीय खाद्य निगम ।

(ड़) ''सरकार" से अभिप्रेत है, बिहार राज्य सरकार । (च) ''मिल मालिक" से अभिप्रेत है, धान-कुटाई एवं चावल उत्पादन में लगे चावल मिल के मालिक । (छ) ''धान" से अभिप्रेत है, अनुसूची-I में वर्णित किस्मों के धान । (ज) ''चावल" से अभिप्रेत है, अनुसूची-II में वर्णित किस्मों के चावल । (झ) ''अधिप्राप्ति मूल्य" से अभिप्रेत है, क्रमशः अनुसूची III तथा IV में वर्णित धान एवं चावल के विभिन्न किस्मों के लिए भारत सरकार द्वारा नियत न्यूनतम समर्थन मूल्य ।

(×k) ''चावल मिल" से अभिप्रेत है, संयंत्र उसकी मशीनरी तथा उसकी प्रसीमा सहित उसका ऐसा परिसर जिसमें या जिसके किसी भाग में चावल कुटाई की जाती है ।

(ट) ''अनुसूची" से अभिप्रेत है, इस आदेश के साथ संलग्न अनुसूची । (ठ) ''एक रूप विनिर्देश" से अभिप्रेत है, क्रमशः धान और चावल के लिए अनुसूची I एवं II के विनिर्देशों के अनुरूप ।

(ड) ''राज्य अभिकर्त्ता" से अभिप्रेत है, भारतीय खाद्य निगम । 3. चावल मिल में उत्पादित चावल का उदग्रहण (लेवी) (क) इस आदेश के प्रारम्भ की तारीख से प्रत्येक चावल मिल मालिक/मालकिन अपने मिल में प्राप्त धान से उत्पादित या विनिर्मित चावल की मात्रा का 50 प्रतिशत अनुसूची IV के अनुसार विहित सीमा के भीतर न्यूनतम समर्थन मूल्य पर भारतीय खाद्य निगम को बेचेगा/बेचेगी

(ख) खरीफ विपणन मौसम 2009-10 में प्रत्येक छोटा हॉलर तथा सेलर किसानों से न्यूनतम समर्थन मूल्य पर खरीदे गए धान से उत्पादित चावल में से 100 क्वींटल चावल भारतीय खाद्य निगम को बेचेगा ।

(ग) प्रत्येक किस्म का चावल एकरूप विनिर्देश को सम्पुष्ट करेगा जो क्रय अथवा अन्य रूप से उनके द्वारा उदगृहित एवं विनिर्मित विक्री के उद्वेश्य हेतु मिलर से भिन्न व्यक्ति से हो ।

4. एक रूप विनिर्देश के अनुरूप उदगृहीत चावल (क) राज्य अभिकत्र्ता को बेचा जाने वाला चावल इस आदेश की अनुसूची II के अनुसार चावल के एकरूप विनिर्देश के अनुरूप होगा ।

(ख) यदि मिल मालिक द्वारा बिक्री के लिए प्रस्तावित चावल का भंडार अनुसूची II में यथा अधिकथित एकरूप विनिर्देश के अनुरूप नही हो तो इसे मिल मालिक द्वारा अपनी लागत एंव जोखिम पर पुनर्नुकूलित या परिशोधित किया जाएगा ताकि उसे एकरूप विनिर्देश के अनुरूप किया जा सके ।

5. उदगृहीत (लेवी) चावल का परिदान (क) मिल मालिक द्वारा राज्य अभिकर्ता (भारतीय खाद्य निगम) को उदग्रहण के रूप में बेचा जाने वाला चावल 50 किलो के बैग में परिदत्त किया जाएगा ।

(ख) मिलर चावल/धान भंडारण को उदगृहित (लेवी) दिये बिना नही तो हटायेगा या बेचेगा ः- मिलर अपने चावल/धान के भंडारण के आधार पर चावल/धान उद्‌गृहीत (लेवी) दिये बिना चावल/धान को एक स्थान से दूसरे स्थान पर नहीं तो हटायेगा या बेचेगा या भेजेगा ।

(ग) लेवी चावल के उद्‌ग्रहण के मामले में समय-समय पर कृषकों के हित में सरकार द्वारा निर्गत आदेश/निर्देश लागू होंगे ।

6. मिल मालिकों को उदगृहीत (लेवी) चावल का भुगतान राज्य क्रय अभिकरण (भारतीय खाद्य निगम) मिल मालिकों को उदगृहीत चावल की सभी लागतों सहित लागत का भुगतान 5 दिनों के भीतर करेगा ।

7. आदेश या निदेश के अनुपालन सम्बन्धी कर्त्तव्य प्रत्येक मिल मालिक इस आदेश के अधीन निर्गत अपने कर्तव्यों का अनुपालन करेगा । 8. रजिस्टर तथा प्रतिवेदन का संधारण

(i) प्रत्येक मिल मालिक प्रत्येक दिन किसानों से न्यूनतम समर्थन मूल्य पर खरीदे गए धान, कूटे गए धान तथा उदग्रहण के अधीन परिदत्त चावल की मात्रा उपदर्शित करते हुए एक रजिस्टर का संधारण करेगा ।

(ii) मिल मालिक संबद्व जिला पदाधिकारी को प्रतिवेदन विवरणी देगा ।

9. मिल मालिक के भंडार का आवधिक सत्यापन

समाहर्त्ता/जिला पदाधिकारी एवं खाद्य एवं उपभोक्ता संरक्षण विभाग, बिहार सरकार के पदाधिकारी तथा समाहर्त्ता/जिला पदा0 या खाद्य एवं उपभोक्ता संरक्षण विभाग द्वारा यथा प्राधिकृत निरीक्षक से अन्यून पंक्ति का कोई पदाधिकारी चावल मिल में चावल के भंडार का सत्यापन करेगा । 10. प्रविष्टि, तलाशी, अधिग्रहण आदि करने की शक्ति3 (cid:18)बहार गजट (असाधारण)] 7 *दस,बर 2009 (क) समाहर्त्ता/जिला पदाधिकारी और खाद्य एवं उपभोक्ता संरक्षण विभाग, बिहार सरकार का पदाधिकारी तथा समाहर्त्ता/जिला पदाधिकारी या खाद्य एवं उपभोक्ता संरक्षण विभाग द्वारा यथा प्राधिकृत निरीक्षक से अन्यून पंक्ति का पदाधिकारी/अथवा अवर निरीक्षक से अन्यून पंक्ति का कोई आरक्षी पदाधिकारी इस आदेश का अनुपालन सुनिश्चित करने की दृष्टि से अथवा प्रवर्तन पदाधिकारी के समाधान करने के लिए कि इस आदेश का अनुपालन दंड प्रक्रिया संहिता, 1973 (अधिनियम-2, 1973) की तलाशी एवं अभिग्रहण से संबंधित उपबंध के साथ किया गया है तथा ये उपबंध उसी प्रकार लागू होंगे जिस प्रकार इस खंड के अधीन तलासी एवं अभिग्रहण के लिए लागू होते हैं ।

(ख) लेवी के अन्तर्गत चावल/धान नहीं देने की स्थिति में भंडारण अभिग्रहण :- जहां समाहर्ता/जिला पदाधिकारी अथवा इनके द्वारा प्राधिकृत पदाधिकारी या राज्य सरकार संतुष्ट हो जाता है कि कोई मिलर इस आदेश के अन्तर्गत लेवी के रूप में देय चावल/धान अपने व्यापार परिसर से राज्य सरकार या राज्य अभिकर्ता को देने में इंकार या विरोध किया है तो नियमतः उन्हें उनके परिसर के समस्त भंडारण का अभिग्रहण आदेश देना होगा । 11. जिले के समाहर्त्ता लेवी चावल का उद्‌ग्रहण कराने के लिए व्यक्तिगत रूप से जिम्मेवार होंगे तथा यह सुनिश्चित करेंगे कि किसानों को न्यूनतम समर्थन मूल्य का भुगतान किया गया हो तथा ऐसी कार्रवाई करेंगे, जिससे अनुदानित चावल के पुनर्कालचक्र को रोका जा सके ।

12. छूट देने की शक्ति (क) राज्य सरकार, केन्द्र सरकार की पूर्व सहमति से, जनहित में किसी क्षेत्र को उद्‌ग्रहण (लेवी) से छूट दे सकती है अथवा उद्‌ग्रहण की मात्रा कम कर सकती है ।

(ख) राज्य सरकार, केन्द्र सरकार की पूर्व सहमति से, जनहित में किसी वर्ग या व्यक्ति को उद्‌ग्रहण (लेवी) अथवा इस आदेश के अन्य उपबंधों से छूट दे सकती है । 13. इस आदेश की कोई बात निम्नलिखित पर लागू नहीं होगी (i) कोई अन्य राज्य सरकार अथवा केन्द्र सरकार पर तथा (ii) भारतीय खाद्य निगम पर ।

14. शास्तियाँ जो कोई भी इस आदेश के किसी उपबंध, जो इसकी कंडिका 3, 5, 7 तथा 8 के अधीन हैं, का उल्लंघन करेगा, वह आवश्यक वस्तु अधिनियम (अधिनियम 10, 1955) की धारा-7 के अधीन दंडनीय होगा ।

15. पूर्ववर्त्ती आदेश का निरसन बिहार चावल एवं धान अधिप्राप्ति (उद्‌ग्रहण) आदेश, 2008 को एतद्‌ द्वारा निरसित किया जाता है ।

सं0 प्र04/ख.वि.अधि.(लेवी)-04/09-5036 बिहार-राज्यपाल के आदेश से, (ह0) अस्पष्ट, सरकार के उप-सचिव ।4 (cid:18)बहार गजट (असाधारण)] 7 *दस,बर 2009 अनुसूची - I ------------ धान की सभी किस्मों के लिए एक समान विनिर्दिष्टियाँ (विपणन मौसम 2009-10) धान ठोस, बिक्री योग्य, सूखी, साफ, सम्पूर्ण और आहार संपूर्णता से समृद्ध, रंग और आकार में एक समान होगी और फुूंदी, घुनों, दुर्गन्ध, आर्जिमोन मेक्सिकाना, लेथिरस सेटिक्स (खेसरी) एवं विषाक्त तत्वों के सम्मिश्रण से मुक्त होगा । धान ग्रेड ''ए'' और साधारण श्रेणियों में वर्गीकृत किया जाएगा ।

विनिर्दिष्टियों की अनुसूची -------------

नोट :--

1. उपर्युक्त अपवर्तनों की परिभाषा और विश्लेषण की विधि का अनुसरण समय-समय पर यथा संशोधित भारतीय मानक व्यूरों की खाद्यान्नों का विश्लेषण करने की विधि संख्या आईएस-4333(भाग-1) ः 1996, आईएस-4333(भाग-2) : 2002 और खाद्यान्नों की शब्दावली आईएस-2813-1995 में दी गई विधि के अनुसार करना होगा ।

2. नमूने लेने की इस विधि का अनुसरण समय-समय पर यथासंशोधित भारतीय मानक व्यूरो की ''अनाजों और दालों के नमूने लेने की विधि'' संख्या आईएस-14818-2000 के अनुसार करना होगा । 3. ''कार्बनिक विजातीय तत्वों'' के लिए 1.0 प्रतिशत की समूची सीमा के अंदर रहते हुए विषाक्त बीज 0.5 प्रतिशत से अधिक नहीं होंगे, जिसमें से घतूरे और अकरा के बीज (वीसिया प्रजातियाँ) क्रमशः 0.025 प्रतिशत और 0.2 प्रतिशत से अधिक नहीं होंगे ।5 (cid:18)बहार गजट (असाधारण)] 7 *दस,बर 2009 अनुसूची - II ------------ ग्रेड ''ए'' और साधारण श्रेणी के चावल के लिए एक-समान विनिर्दिष्टियाँ (विपणन मौसम 2009-10)

चावल ठोस, बिक्री योग्य, मीठा, सूखा, साफ, संपूर्ण और आहार संपूर्णता से समृद्ध, रंग और आकार में एक-समान होगा और फफूंदी, घुनों, दुर्गंध, विषाक्त तत्वों के सम्मिश्रण, किसी भी रूप में आर्जीमोन मेक्सिकाना और लेथिरस सेटिक्स (खेसरी) अथवा रंजक एजेंटों और निम्नलिखित अनुसूची में दी गई सीमा को छोड़कर सभी अशुद्धताओं से मुक्त होगा । यह खाद्य अपमिश्रण निवारण मानकों के भी अनुरूप होगा ।

* 1 प्रतिशत छोटे टोटे सहित ** भार द्वारा खनिज तत्व 0.25 प्रतिशत से अधिक नहीं होंगे और भार द्वारा जीव-जनित अशुद्धियां 0.10 प्रतिशत से अधिक नहीं होगी ।

# पिन की नोक जितने क्षतिग्रस्त चावल सहित @ मूल्य कटौती के साथ 15 प्रतिशत तक की अधिकतम सीमा तक नमी तत्व वाले चावल (अरवा और सेला, दोनों) की खरीद की जा सकती है । 14 प्रतिशत तक कोई मूल्य कटौती नहीं होगी । 14 प्रतिशत से 15 प्रतिशत के बीच पूर्ण कीमत की दर पर मूल्य कटौती लागू होगी ।

चावल की ग्रेड-ए और साधारण किस्मों की विनिर्दिष्टियों के लिए लागू नोट

1. उपर्युक्त अपवर्तनों की परिभाषा और विश्लेषण की विधि का अनुसरण भारतीय मानक व्यूरो की समय-समय पर यथासंशोधित खाद्यान्नों का विश्लेषण करने की विधि संख्या आई0एस0-4333 (भाग-I) 1996 और आई0एस0-4333 (भाग-II) 2002 और ''खाद्यान्नों की शब्दावली'' 2813-1995 में किए गए उल्लेख के अनुसार किया जाना है । चोकरयुक्त दाने साबुत अथवा टूटे चावल के वे दाने होते हैं, जिनके सतही क्षेत्र का एक-चौथाई से अधिक चोकर से ढका होता है और इनका निर्धारण निम्नानुसार किया जाता है :-

विश्लेषण की विधि - पैट्री डिश (80 × 70 मिमी0) में 5 ग्राम चावल (साबुत चावल और टोटा) लें । मैथीलिन के नीले घोल (आसवित जल में भार द्वारा 0.05 प्रतिशत) के लगभग 20 मि0ली0 में इन दानों को डुबोएं और लगभग 1 मिनट रहने दें । मैथीलिन के नीले घोल को निथारकर निकाल दें । लगभग 20 मि0ली0 तनु हाइड्रोक्लोरिक अम्ल (आसवित जल में आयतन द्वारा 5 प्रतिशत का घोल) के साथ घुमाकर धोएं । पानी में घुमाकर धोएं और नीले रंजित दानों पर लगभग 20 मि0ली0 मैटानिल येलो घोल (आसवित जल में भार द्वारा 0.05 प्रतिशत) को डालें और लगभग 1 मिनट रहने दें । एफल्यूएंट को निथारकर निकाल दें और 2 बार ताजे पानी से धोएं । रंजित दानों को ताजे पानी में रखें और चोकरयुक्त दानों की गणना करें । विश्लेषण किए जा रहे नमूने के 5 ग्राम में दानों की कुल संख्या गिनें । 3 टूटे दानों की गणना एक साबुत दाने के रूप में की जाती है । गणना - चोकरयुक्त दानों का प्रतिशत = एन ×100/डब्ल्यू जिसमें एन=नमूने के 5 ग्राम में चोकरयुक्त दानों की संख्या डब्ल्यू=नमूने के 5 ग्राम में दानों की कुल संख्या । 2. नमूना लेने की विधि का अनुसरण समय-समय पर यथासंशोधित भारतीय मानक व्यूरो की अनाजों और दालों का नमूना लेने की विधि संख्या आई0एस0- 14818-2000 में दी गई विधि के अनुसार किया जाना है । 3. पूरे साबुत दाने के आकार के 8वें हिस्से से छोटा टोटा कार्बनिक विजातीय तत्व के रूप में समझा जाएगा । टोटे की औसत लम्बाई के आकार का निर्धारण करने के लिए चावल के मूल श्रेणी की लम्बाई को हिसाब में लेना चाहिए । 4. किसी भी लाट में अकार्बनिक विजातीय तत्व 0.25 प्रतिशत से अधिक नहीं होने चाहिए, यदि यह अधिक हो तो स्टॉक की सफाई की जानी चाहिए और इसे सीमा के अंदर लाना चाहिए । चावल के जिन दानों अथवा दानों के टुकड़ों की सतह पर मिट्‌टी जमी हो उन्हें अकार्बनिक विजातीय तत्व समझा जाएगा । 5. यदि दाब की सेलीकरण तकनीक द्वारा सेला चावल तैयार किया गया हो तो यह सुनिश्चित किया जाएगा कि सेलीकरण की सही प्रक्रिया अपनाई गई है अर्थात्‌ लागू किया गया दाब, समय जिस तक दाब लागू किया गया, उचित श्लेषीकरण, वातन और मिलिंग से पूर्व शुष्कन उचित रूप से किया गया है ताकि सेला चावल का रंग और पकाने की अवधि सही है तथा दाने पपड़ी से मुक्त हैं।7 (cid:18)बहार गजट (असाधारण)] 7 *दस,बर 2009 अनुसूची - III -------------- धान का अधिप्राप्ति मूल्य

(अपवर्तन के पश्चात्‌)8 (cid:18)बहार गजट (असाधारण)] 7 *दस,बर 2009 The 26th November 2009 Bihar Rice & Paddy Procurement (Levy) Order 2009 G.S.R. 7, dated 7th December 2009—WHEREAS, the Governor of Bihar is satisfied that it is necessary and expedient for him to issue an order for maintaining the supplies of rice and for securing its equitable distribution and availability at Fair Price. THEREFORE, in exercise of the power conferred by section 3 of the Essential Commodoties Act 1955 (Act-10 of 1955) read with the Government of India, Ministry of Consumer Affairs, Food and Public Distribution, Department of Food & Public Distribution Notification No. GSR 490 (E) dated 16th June, 03 with the prior concurrence of Goverment of India as mentioned in the said notification, the Governor of Bihar is pleased to introduce the following order:— 1. Short title, extent and Comencement.

(1) This Order may be called the Bihar Rice & Paddy Procurement (Levy) Order 2009.

(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with date of issuance of this notification to 31st Augusr 2010 for the Kharif Marketing Season 2009-10.

2. Definitions : In this Order unless the context otherwise requires.

(a) "Collector" Means in relation to a district, the District Magistrate and includes such other officers of the Government posted in the district as may be authorised by the State Government to perform all or any of the functions of the collector under this order.

(b) "Custom Mill" means such rice mill where paddy has been changed into rice on payment of milling of paddy charges in cash or in kinds.

(c) "Enforcement Officer" means and includes the Deputy Director (Food), District Magistrate, Additional District Magistrate (Supply), Additional Collector, Special Officer incharge Rationing, Deputy, Rationing Officer, Assistant Rationing Officer, Sub-Divisional Magistrate, District Supply Officer, Assistant District Supply Officer, Block Supply Officer, Marketing Officer, Supply Inspector, Block Development Officer, Circle Officer, Food Commissioner/Secretary , Additional/Joint/Deputy/Under Secretary, (Food and Consumer Protection Department) Secretary to Food Commissioner. Deputy Inspector, General of Police(Food), Suprintendent of Police (Food), Deputy Superintendent of Police (Food) and any Police Officer not below the ranks of Inspector.

(d) "Food Corporation" means Food Corporation of India established under section-3 of the Food Corporation Act 1964 (Act-37 of 1964)

(e) "Government" means the State Government of Bihar. (f) "Miller" means the owner of rice mill engaged in milling of paddy and production of rice.

(g) "Paddy" means paddy of the varities described on schedule-I. (h) "Rice" means rice of the the varities described on schedule-II. (i) "Procurement Price" means the minimum support price fixed by the Government of India for different varities of Paddy and commodity of rice as in schedule-III & IV respectively.

(j) "Rice Mill" means the plant machinery with which and the premises including the precintes thereof in which or any part of whcih where rice milling operation is carried on .

(k) "Schedule" means a schedule appended to this order.

(l) "Uniform Specification" means confirmation to the specifications as per schedule I & II for paddy & rice respectively. (m)"State Agent" means Food Corporation of India.

3. Levy on Rice Produced in a Rice Mill

(a) Every miller shall sell 50% of the quantity of rice produced or manufactured out of paddy received by him/her on Minimum Support Price to Food Corporation of India within the prescribed limit as per schedule-IV in any rice mill from the date of commencement of this order. (b) Every small Hollers & Sellers may sell 100 quintal rice to Food Corporation of India out of paddy purchased on Minimum Support Price from Farmers during the Kharif Marketing Season 2009-2010.

(c) Each variety of rice conforming to specification purchased or otherwise acquired & milled by him for the purpose of sale from persons other than a miller.

4. Levy Rice in conformity with uniform specifications

(a) The rice required to be sold to the State Agent shall be in conformity with the uniform specifications of rice as per schedule-II of this order.

(b) In case any stock of rice offered for sale by the millers does not conform to the uniform specifications as laid down in schedule II it shall be reconditioned or rectified by the miller at his/her own cost and risk so as to bring it in conformity with uniform specifications.

5. Delivery of Levy Rice

(a) The levy rice required to be sold to the State Agent (FCI) by millers as levy will deliver in 50 kg. bags .

(b) Miller not to remove or Sell Stock of rice/paddy without delivering or selling apart levy—Miller Shall not remove or sell or transport rice/paddy from one place to another unless he/she has delivered or set apart the quantity of rice/paddy demanded or payable on the basis of his stock. (c) Orders/directions issued by State Govt. from time to time in the interest of farmers shall be applicable to levy rice procurement.

6. Payment of Levy Rice to the millers

State Purchasing Agency (FCI) shall pay the cost including all costs of levy rice to millers of rice within 5 days. 7. Duty to comply with order or direction. Every miller shall perform his duties issued under this order. 8. Maintenance of Register & Report

(i) Every miller shall maintain a register indicating the quantity of paddy purchased from farmers on Minimum Support Price, milled and rice delivered under levy on each day.

(ii) The miller shall furnish report return to concerned District Magistrate.

9. Periodical Verification of the Stock with the miller

The Collector/D.M. and Officers of the Food and Consumer Protection Department, Government of Bihar and as may be authorised by the Collector/D.M. or Food and Consumer Protection Department not below the rank of Inspector verify the stock of rice in the rice mill. 10. Power of entry search seizure etc.

(a) The Collector/District Magistrate and Officers of the Food Supply & Commerce Department and as may be authorised by the Collector/D.M. or10 (cid:18)बहार गजट (असाधारण)] 7 *दस,बर 2009 Food Supply and Commerce Department not below the rank of Inspector or any Police Officer not below the rank of a Sub-Inspector may with a view to securing compliance with this order or to satisfy Enforcement Officer that this order has been complied with the provisions of the code of criminal procedure 1973 (Act 2 of 1973) relating to search and seizure shall so far as may be apply to searches and Scizures under this clause.

(b) Seizure on Stock in case of non-delivery of rice/paddy under levy :- Where the collector or an Officer authorised by the Collector or the State Govt. is satisfied that any miller has refused or is evading to deliver to the State Govt. or the State Agent at his business premises the quantity of rice/paddy due as levy under this order, it shall be lawful for him to order seizure of the entire quantity of stock found within his/her premises.

11. The Collectors of the Districts will be personally responsible for procurement of levy rice from the Millers and shall ensure that the payment of Minimum Support Price made to the farmers and they shall take such action by which recycling of subsidised rice may be prevented. 12. Power to Exempt

(a) The state Government may in public interest exempt any area from levy or reduce quantum of levy with the prior concurrence of the Central Govt. (b) The State Govt. may in public interest exempt any class or person from levy or other provisions of this order with the prior concurrence of the Central Govt.

13. Nothing in this order shall apply to :

(i) Any other State Govt. or the Central Govt. and (ii) The Food Corporation of India.

14. Penalties

Whoever contravenes the any provisions which is under paras 3, 5, 7 & 8 of this order shall be punishable under section-7 of the Essential Commodities Act 1955 (Act 10 of 1955) 15. Repeal of the privious Order The Bihar Rice and Paddy Procurement (Levy) order 2008 is hereby repealed.

SCHEDULE – I -------------------- UNIFORM SPECIFICATION OF ALL VARIETIES OF PADDY (MARKETING SEASON 2009 - 2010) Paddy shall be in sound merchantable condition, dry, clean, wholesome of good food value, uniform in colour and size of grains and free from moulds, weevils, obnoxious smell, Argemone mexicana, lathyrus sativus (Khesari) and admixture of deleterious substances. Paddy will be classified into Grade "A" and Common groups.

Schedule of Specification

NOTE

1. The definitions of the above refractions and method of analysis are to be followed as per BIS "Method of analysis for foodgrains" IS : 4333 (Part-I) : 1996, IS : 4333 (Part-II) : 2002 and "Terminology for foodgrains" IS : 2813 - 1995, as amended from time to time.

2. The method of sampling is to be followed as per BIS method for sampling of Cereals and Pulses IS : 14818-2000 as amended from time to time.

3. Within the overal limit of 1.0% for organic foreign matter, poisonous seeds shall not exceed 0.5% of which Dhatura and Akra seeds (Vicia species) not to exceed 0.025% and 0.2% respectively.

SCHEDULE – II ----------------- UNIFORM SPECIFICATION FOR GRADE ' A ' & COMMON RICE (MARKETING SEASON 2009 - 2010)

Rice shall be in sound merchantable condition, sweet, dry, clean, wholesome, of good food value, uniform in colour and size of grains and free from moulds, weevils, obnoxious smell, admixture of unwholesome poisonous substances, Argemone mexicana and Lathyrus sativus (Khesari) in any form, or colouring agents and all impurities except to the extent in the schedule below. It shall also conform to PFA Standards :

SCHEDULE OF SPECIFICATION

* Including 1% small brokens. ** Not more than 0.25% by weight shall be mineral matter and not more than 0.10% by weight shall be impurities of animal origin.

# Including pin point damaged grains. @ Rice (both raw and parboiled) can be procured with moisture content upto a maximum limit of 15% with value cut. There will be no value cut up to 14%. Between 14% to 15% moisture, value cut will be applicable at the rate of full value.

NOTES APPLICABLE TO THE SPECIFICATION OF GRADE 'A' AND COMMON VARIETIES OF RICE ------------------------------------- 1. The definition of the aboverefractions and method of analysis are to be followed as given in Bureau of Indian Standard "Method of analysis for Foodgrains" No's IS : 4333 (Part-I) : 1966 and IS : 4333 (Part-II) : 2002 "Terminology for Foodgrains" IS : 2813-1995 as amended from time to time. Dehusked grains are rice kernels whole or broken which have more than 1/4th of the surface area of the kernel covered with the bran and determined as follows :

ANALYSIS PROCEDURE Take 5 grams of rice (sound head rice and brokens) in a petri dish (80 × 70 MM). Dip the grains in about 20 ml. of Methylene Blue solution (0.05% by weight in distilled water) and allow to stand for about one minute. Decant the Methylene Blue solution. Give a swirl wash with about 20 ml. of dilute hydrochloric acid (5% solution by volume in distilled water). Give a swirl wash with water and pour about 20 ml. of Metanil Yellow solution (0.05% by weight in distilled water) on the blue stained grains and allow to stand for about one minute. Decant the effluent and wash with fresh water twice. Keep the stained grains under fresh water and count the dehusked grains. Count the total number of grains in 5 graims of sample under analysis. Three brokens are counted as one whole grain.

CALCULATIONS :

Percentage of Dehusked grains = N × 100 W Where N = Number of dehusked grains in 5 graims of sample W= Total grains in 5 grams of sample.

2. The Method of sampling is to be followed as given in Bureau of Indian Standard "Method of sampling of Cereals and Pulses" No IS : 14818-2000 as amended from time to time.

3. Brokens less than 1/8th of the size of full kernels will be treated as organic foreign matter. For determination of the size of the brokens average length of the principal class of rice should be taken into account.

4. Inorganic foreign matter shall not exceed 0.25% in any lot, if it is more, the stocks should be cleaned and brought within the limit. Kernels or pieces of kernels having mud sticking on surface of rice, shall be treated as Inorganic foreign matter.

5. In case of rice prepared by pressure parboiling technique, it will be ensured that correct process of parboiling is adopted i.e. pressure applied, the time for which pressure is applied, proper gelatinisation, aeration and drying before milling are adequate so that the colour and cooking time of parboiled rice are good and free from encrustation of the grains.
