सं0 बी1-3-294/2009-70—राज्य सभा का उप-निर्वाचन, 2010 से संबंधित भारत निर्वाचन आयोग की अधिसूचना संख्या 100/रा.स.-बिहार/2/2009 (1), दिनांक 22 दिसम्बर 2009 एवं अधिसूचना संख्या 100/रा.स.-बिहार/2/2009 (2) दिनांक 22 दिसम्बर 2009 सर्वसाधारण की जानकारी के लिए पुनः प्रकाषित की जाती हैं।

अपर मुख्य निर्वाचन पदाधिकारी,।2 (cid:18)बहार गजट (असाधारण)] 22 +दस-बर 2009 भारत निर्वाचन आयोग निर्वाचन सदन , अषोक रोड , नई दिल्ली-11000/ 22 दिसम्बर, 2009, पौश 1, 1931(षक) अधिसूचना सं0 100/रा.स.-बिहार/2/2009 (1) :- यतः्‌ बिहार राज्य की विधान-सभा के निर्वाचित सदस्यों द्वारा निर्वाचित श्री महेन्द्र साहनी का स्थान, उनकी पदावधि जो 2 अप्रैल, 2012 को सम्मिलित करते हुए, उस तारीख तक थी, के समाप्त होने से पूर्व उनकी मृत्यु के कारण 6 नवम्बर, 2009 को रिक्त हो गया है; और

यतः, इस प्रकार हुई रिक्ति को भरने केे प्रयोजन से उप-निर्वाचन कराना है ; अतः अब, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-147, धारा-39 की उप-धारा (1) और धारा-56 के अनुसरण मे, भारत निर्वाचन आयोग एतद्‌द्वारा :- (अ) बिहार राज्य की विधान-सभा के निर्वाचित सदस्यों से यह अपेक्षा करता हैं कि वे 11 जनवरी, 2010 (सोमवार) से पूर्व तथा उक्त अधिनियम और तद्‌धीन बनाए गए नियमों और किए गए आदेषों के उपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दें ; (आ) उक्त निर्वाचन के संबंध में :-

(क) नाम निर्देषन करने की अन्तिम तारीख 29 दिसम्बर, 2009 (मंगलवार) (ख) नाम निर्देषन की संवीक्षा की तारीख 30 दिसम्बर, 2009 (बुधवार) (ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख 1 जनवरी, 2010 (षुक्रवार) (घ) वह तारीख, जिसको यदि आवष्यक हुआ तो मतदान होगा, और 8 जनवरी, 2010 (षुक्रवार) (ड़) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा 11 जनवरी, 2010 (सोमवार) नियत करता है; और,

(इ) 9.00 बजे पूर्वाहन्‌ से 4.00 बजे अपराह्‌न तक का समय, ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवष्यक हुआ है तो, निर्वाचन के लिए उपर्युक्त विनिर्दिश्ट तारीख को, मतदान होगा ।

आदेश से , के0 अजय कुमार, सचिव।3 (cid:18)बहार गजट (असाधारण)] 22 +दस-बर 2009 भारत निर्वाचन आयोग निर्वाचन सदन , अषोक रोड , नई दिल्ली-11000/ 22 दिसम्बर, 2009, पौश 1, 1931(षक) अधिसूचना सं0 100/रा.स.-बिहार/2/2009 (2) :- लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-21 के अनुसरण में और धारा-22 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्वाचन आयोग, बिहार राज्य सरकार के परामर्ष से एतद्‌द्वारा तारीख 22 दिसम्बर, 2009 को भारत के राजपत्र में प्रकाषित आयोग की अधिसूचना के अनुसरण में इस राज्य में राज्य सभा के लिए उप-निर्वाचन के संबंध में :-

(I) नीचे की सारणी के स्तम्भ (ं1) में विनिर्दिश्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है ; और (II) उक्त सारण्ाीं के स्तम्भ (2) में विनिर्दिश्ट अधिकारी को, रिटर्निंग आफिसर की उसके कृत्यांें के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

Pausa 1, 1931 (Saka) NOTIFICATION No. 100/CS-BR/2/2009 (1) :- WHEREAS, the seat of Shri Mahendra Sahni in the Council of States, elected by the elected members of the Legislative Assembly of the State of Bihar, has become vacant on 6th November, 2009 by the reason of his death, before the expiration of his term of office which was up to and including the 2nd April, 2012; and

WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;

NOW, THEREFORE, in pursuance of section 147, sub-section (1) of section 39 and section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby-

(A) calls upon the elected members of the Legislative Assembly of the State of Bihar to elect, before 11th January, 2010 (Monday), and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Council of States;

(B) appoints, with respect to the said election; ,

(a) the 29th December 2009 (Tuesday), as the last date for making nominations;

(b) the 30th December, 2009 (Wednesday), as the date for the scrutiny of the nominations;

(c) the 1st January, 2010 (Friday), as the last date for the withdrawal of candidatures;

(d) the 8th January, 2010 (Friday), as the date on which a poll shall, if necessary, be taken; and

(e) the 11th January, 2010 (Monday), as the date before which the election shall be completed; and

(C) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.

Pausa 1, 1931 (Saka) NOTIFICATION No. 100/CS-BR/2/2009 (2):- In pursuance of section 21, and in exercise of the powers conferred by sub-section (1) of section 22, of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India, in consultation with the Government of the State of Bihar, hereby—

(i) designates the officer, specified in column (1) of the TABLE below, to be the Returning Officer; and

(ii) appoints the officer, specified in column (2) of the said Table, to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;

in respect of the bye-election to the Council of States, to be held in that State in pursuance of the Commission's Notification, published in the Gazette of India on 22nd December, 2009:—
