सं0-3/मु. संषोधन 27/2009-3373—भारतीय मुद्रांक अधिनियम, 1899 की धारा-75 के अधीन प्रदा शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) नियमावली, 2004 के अधीन फ्रैंकिंग मषीन/टैक्समीटर का उपयोग करने वाले उपयोक्ता पदाधिकारी को मुद्रांक शुल्क की वसूली के लिए कमीषन की राषि के भुगतान की प्रक्रिया का विनियमन करने के लिए बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) (संषोधन) नियमावली, 2009 का निम्नलिखित नियमावली बनाते हैंः - बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) (संषोधन) नियमावली, 2009 बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) (संषोधन) नियमावली, 2009 बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) (संषोधन) नियमावली, 2009 बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) (संषोधन) नियमावली, 2009
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ- (1) यह नियमावली बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) (संषोधन) नियमावली, 2009 कही जाएगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा।
(3) यह तुरन्त प्रवृा होगी।
2. बिहार स्टाम्प (फ्रैंकिंग मषीन/टैक्समीटर व्यवहार) नियमावली, 2004 के नियम-6 के परन्तुक को क्रमांकित करते हुए उसकी क्रम संख्या (i) की जाएगी। 2 (cid:18)बहार गजट (असाधारण)] 23 *दस,बर 2009 (ii) परन्तु यह कि उपयोक्ता पदाधिकारी द्वारा उसे भुगतान की जाने वाली कमीषन की राषि काटकर मषीन में प्रविष्ट की जाने वाली मुद्रांक शुल्क की शेष राषि चालान से कोषागार में जमा की जाएगी। उपयोक्ता पदाधिकारी के समक्ष चालान प्रस्तुत किए जाने पर वह कमीषन सहित पूरी राषि फ्रैंकिंग मषीन/टैक्समीटर में प्रविष्ट कर देगा।
(iii) परन्तु यह भी कि इस संषोधन की अधिसूचना के पूर्व कमीषन की देय राषि का सामंजन, उपयोक्ता पदाधिकारी के द्वारा फ्रैंकिंग मषीन/टैक्समीटर में राषि प्रविष्ट किए जाने के समय उपर्युक्त परन्तुक (क) में विहित प्रक्रिया के अनुसार, तीन बराबर किष्तों में कर ली जायेगी।''

The 17th December 2009 No. 3/Mu. Amendment 27/2009-3373—In exercise of the power conferred under section-75 of the Indian Stamp Act, 1899 (Act 11 of 1899), the Governor of Bihar makes the following rules to regulate the procedure of payment of amount of commission to the user officer of the Franking Machine/Tax meter under the Bihar Stamp (Use of Franking Machine/Tax meter) Rules, 2004.
The Bihar Stamp (Use of Franking Machine/Tax meter) (Amendment) Rules, 2009
1. Short title extent and commencement-- (1) These rules may be called "The Bihar Stamp (Use of Franking Machine/Tax meter) (Amendment) Rules, 2009."
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Proviso of rule-6 of the Bihar Stamp (Use of Franking Machine/Tax meter) Rules, 2004 shall be numbered and shall be serialled at serial number (i).
3. In rule-6 of the Bihar Stamp (Use of Franking Machine/Tax meter) Rules, 2004 following two proviso shall be added after proviso (i).—
(ii) Provided also that the user officer shall deposit the amount to be entered in the machine by the challan after deducting the amount of commission to be paid to him. The challan on being deposited before the user Officer, he shall enter the total amount including the amount of commission in the Franking Machine/Tax meter.
(iii)Provided further that the amount of payable commission before the notification of this amendment shall be adjusted by the user Officer in three equal installments at the time of entry of amount in the Franking Machine/Tax Meter in accordance with the prescribed procedure in proviso (ii).
