1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।- (i) यह नियमावली ''बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2009'' कही जा सकेगी । (ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (iii) यह तुरत प्रवृत्त होगी । 2. परिभाषाएँ।- इस नियमावली में, जब तक किसी संदर्भ में अन्यथा अपेक्षित न हो :- (i) ''नियमावली'' से अभिप्रेत है ''बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2009; (ii) ''सरकार'' से अभिप्रेत है बिहार सरकार; (iii) ''राज्यपाल'' से अभिप्रेत है बिहार के राज्यपाल; (iv) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष, अर्थात्‌ पहली अप्रैल से अगले वर्ष का 31 मार्च तक; (v) ''नियुक्ति प्राधिकार'' से अभिपे्रत है कार्मिक एवं प्रषासनिक सुधार विभाग; (vi) ''खेल विधा'' से अभिप्रेत है वह खेल विधा जो ओलम्पिक खेल अथवा राष्ट्रमंडल खेल अथवा एषियन गेम्स अथवा अखिल भारतीय सिविल सर्विसेज प्रतियोगिता (संगीत, नृत्य एवं लघु नाट्‌य को छोड़कर) में खेले जाते हों; (vii) ''अन्तरराष्ट्रीय प्रतियोगिता'' से अभिप्रेत है ओलम्पिक, विष्व कप, वल्र्ड यूनिवर्सिटी गेम, राष्ट्रमंडल खेल, एषियन गेम्स, एफ्रो-एषियन गेम्स, एषियन चैंपियनषिप, सार्क गेम्स या स्पेषल ओलम्पिक्स, जिसमें भारतीय ओलंपिक संघ अथवा फेडरेषन टीम के रूप में भारत के द्वारा भाग लिया गया हो; (viii) ''राष्ट्रीय प्रतियोगिता'' से अभिप्रेत है वह प्रतियोगिता, जो इस नियमावली के अधीन निर्धारित खेल विधा के सर्वोच्च राष्ट्रीय फेडरेषन के द्वारा वरीय स्तर पर एक बार आयोजित की गयी हो, अथवा उपरोक्त खेल विधाओं में आयोजित मान्यता प्राप्त वार्षिक अखिल भारतीय अन्तर विष्वविद्यालय प्रतियोगिता;

(ix) ''व्यक्तिगत स्पर्द्धा'' से अभिपे्रत है वैसी स्पर्द्धा, जिसमें उपलब्धि व्यक्तिगत प्रयास से प्राप्त किया गया हो; तथा (x) ''टीम स्पर्द्धा'' से अभिपे्रत है वैसी स्पर्द्धा, जिसमें उपलब्धि एक से अधिक खिलाड़ी के द्वारा प्राप्त किया गया हो ।

3. अर्हताएँ।- इस नियमावली के अंतर्गत निम्नांकित अर्हता प्राप्त खिलाड़ी राज्य सरकार की सेवा में, उत्कृष्ट खिलाड़ी की श्रेणी में, नियुक्ति के पात्र होंगे, जो,

(i) बिहार राज्य के निवासी हों, एवं जिन्होंने इस नियमावली में परिभाषित खेल विधाओं में, (ii) (क) ओलम्पिक, विष्व कप, वल्र्ड युनिवर्सिटी गेम, राष्ट्रमंडल खेल, एषियन गेम, एफ्रो एषियन गेम, एषियन चैम्पियनषिप, स्पेषल ओलंपिक या सैफ गेम के टीम/व्यक्तिगत स्पर्द्धा में देष का प्रतिनिधित्व करते हुए टीम/व्यक्तिगत स्पर्द्धा में प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त किया हो, अथवा

(ख) नेषनल गेम, राष्ट्रीय सीनियर/जूनियर चैम्पियनषिप में राज्य का प्रतिनिधित्व कर टीम/व्यक्तिगत स्पर्द्धा में प्रथम, द्वितीय या तृतीय स्थान प्राप्त किया हो, अथवा

(ग) ऑल इंडिया इन्टर यूनिवर्सिटी टूर्नामेन्ट में विष्वविद्यालय का प्रतिनिधित्व कर प्रथम, द्वितीय अथवा तृतीय स्थान प्राप्त किया हो, अथवा

(घ) ओलम्पिक अथवा राष्ट्रमंडल खेल अथवा एफ्रो-एषियन गेम्स अथवा एषियन गेम्स अथवा सैफ गेम्स में भारत का प्रतिनिधित्व किया हो । 4. चयन प्रक्रिया।- 4.1 नियुक्ति हेतु चयन, उपरोक्त नियम में उल्लेखित खेल प्रतियोगिता में प्राप्त उपलब्धि के आधार पर होगा । उत्कृष्ट खिलाड़ी के पद पर नियुक्ति हेतु मात्र अर्हता प्राप्त होना यथेष्ट नहीं होगा, बल्कि इसके लिए अर्हता प्राप्त खिलाड़ियों को एक चयन प्रक्रिया से गुजरना होगा । चयन समिति, विहित प्रक्रिया का पालन कर मेधा सूची बनायेगी, जिसके आधार पर प्रति वर्ष मेधा अनुकूल नियुक्ति की जायेगी। चयन हेतु विज्ञापन प्रतिवर्ष कार्मिक एवं प्रषासनिक सुधार विभाग द्वारा अप्रील माह में निकाला जायेगा तथा सभी प्रक्रिया पूर्ण कर नियुक्ति अगस्त माह तक की जायेगी । 4.2 उत्कृष्ट खिलाड़ी का चयन राज्य सरकार द्वारा गठित चयन समिति के द्वारा किया जायेगा । समिति में निम्नांकित सदस्य होंगे :- (1) प्रधान सचिव/सचिव, कार्मिक एवं प्रषासनिक सुधार विभागः- अध्यक्ष (2) सचिव, कला, संस्—ति एवं युवा विभाग ः- सदस्य (3) महानिदेषक, बिहार राज्य खेल प्राधिकरण, पटना ः- सदस्य (4) कला, संस्—ति एवं युवा विभाग द्वारा मनोनीत खेल विषेषज्ञः- सदस्य (5) कार्मिक एवं प्रषासनिक सुधार विभाग द्वारा मनोनीत

अनुसूचित जाति/जनजाति के उपसचिव से अन्यून स्तर के पदाधिकारी ः- सदस्य

4.3 निर्धारित शैक्षणिक अर्हता तथा खेल विधाओं संबंधी अर्हता प्राप्त उत्कृष्ट खिलाड़ी की नियुक्ति हेतु खिलाड़ियों की मेधा सूची, अनुसूची-1 में अंकित प्रतियोगिताओं के वरीयता क्रम में ध्यान में रखते हुए तैयार की जायेगी ।

4.4 किसी एक खिलाड़ी के द्वारा प्राप्त किये गये कई उपलब्धियों में से उनके सर्वश्रेष्ठ उपलब्धि के आधार पर चयन किया जायेगा ।

4.5 नियुक्ति हेतु किसी भी वर्ष में प्राप्त किये गये खेल उपलब्धि को नियुक्ति के योग्य माना जायेगा, बषर्तें कि उत्कृष्ट खिलाड़ी का उम्र सरकारी नियोजन के अनुकूल हो।

4.6 उपर्युक्त खेल उपलब्धियों के आधार पर यदि किसी प्रकार का टाई होता है, तो टाई तोड़ने के लिए निम्नांकित विधि अपनाई जायेगी ।-

(क) व्यक्तिगत उपलब्धि टीम उपलब्धि से बड़ी मानी जायेगी । (ख) नये रिकॉर्ड बनाने की स्थिति में संबंधित खिलाड़ी को वरीयता दी जायेगी। (ग) उच्च स्तरीय प्रतियोगिता की उपलब्धि को वरीयता दिया जायेगा । (घ) उपर्युक्त के बावजूद टाई रहने पर जन्म तिथि को वरीयता दी जायेगी । (च) चालू वर्ष में प्राप्त उपलब्धि को प्राथमिकता दी जायेगी। (छ) अगर टाई फिर भी नहीं टूटता है तो विहित योग्यता के अंक प्रतिषत के आधार पर टाई तोड़ा जायेगा ।

4.7 निर्धारित शैक्षणिक अर्हता तथा खेल विधाओं संबंधी अर्हता प्राप्त उत्कृष्ट खिलाड़ी की नियुक्ति, चयन समिति की अनुषंसा के आधार पर, कार्मिक एवं प्रषासनिक सुधार विभाग द्वारा समूह 'ग' के पदों पर की जायेगी। ऐसी नियुक्ति बिहार सचिवालय सेवा, बिहार सचिवालय लिपिकीय सेवा एवं समूह ''ग'' के अन्य पदों पर की जायेगी। षैक्षणिक अर्हता मैट्रिक से कम रहने पर समूह ''घ'' में3 (cid:18)बहार गजट (असाधारण)] 24 +दस-बर 2009 नियुक्ति की जा सकेगी। विषेष परिस्थिति में इस नियमावली के अंतर्गत समूह 'ख' में भी नियुक्ति की जा सकेगी।

4.8 किसी एक खेल विधा में, एक वर्ष में, तीन से अधिक उत्कृष्ट खिलाड़ियों की नियुक्ति नहीं की जायेगी ।

4.9 नियुक्ति प्रक्रिया को पारदर्षी बनाने के लिए औपबंधिक मेधा सूची प्रकाषित की जायेगी । किसी प्रकार की षिकायत मेधा सूची प्रकाषन के 15 दिनों के अंदर प्रधान सचिव/सचिव, कार्मिक एवं प्रषासनिक सुधार विभाग, बिहार, पटना को समर्पित किया जा सकेगा । प्राप्त षिकायतों की जाँच के पश्चात्‌ प्रत्येक कोटि एवं पद के लिए अंतिम मेधा सूची जारी की जायेगी, जिसके आधार पर वरीयता अनुकूल नियुक्ति की जायेगी ।

4.10 चयन समिति द्वारा मेधा सूची तैयार करने के उपरांत प्रमाण-पत्रों के सत्यापन के पष्चात्‌ नियुक्ति की अनुषंसा होगी ।

5. उम्र सीमा।-

नियुक्ति हेतु राज्य सरकार (कार्मिक एवं प्रषासनिक सुधार विभाग) द्वारा समय-समय पर निर्धारित उम्र सीमा का प्रावधान लागू होगा ।

6. आरक्षण।-

उत्कृष्ट खिलाड़ी की नियुक्ति में यदि रिक्ति आरक्षित बिन्दु पर पड़ता हो तो आरक्षित बिन्दु को अग्रणित करते हुए उत्कृष्ट खिलाड़ी की नियुक्ति की जायेगी ।

7. निरसन एवं व्यावृति।-

कार्मिक एवं प्रषासनिक सुधार विभाग द्वारा निर्गत पत्रांक 3792, दिनांक 14.03.73 तथा संकल्प संख्या-1086 दिनांक 20.01.79 एवं उत्कृष्ट खिलाड़ी की नियुक्ति संबंधी अन्य अनुदेष निरसित समझे जायेंगे ।

ऐसा निरसन के होते हुए भी उपर्युक्त परिपत्र/संकल्प/अनुदेष के अधीन इस नियमावली के लागू होने के पूर्व की गयी कोई कार्रवाई या किये गये किसी कार्य पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा। 8. प्रकीर्ण।-

किसी अन्य नियमावली में इस नियमावली के प्रतिकूल किसी बात के होने पर भी इस नियमावली के प्रावधानों का अभिभावी प्रभाव होगा ।

9. कठिनाइयों का निराकरण।-

इस नियमावली के किन्हीं उपबंधों के कार्यान्वयन में होनेवाली कठिनाइयों के निराकरण के लिए, समय-समय पर सरकार यथावष्यक सामान्य या विषेष निदेष जारी कर सकेगी।

उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु खिलाड़ियों की प्राथमिकता सूची

1. ओलम्पिक खेल में भारत सरकार प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी ।

2. विष्व कप मेंं भारत का प्रतिनिधत्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी । 3. वल्र्ड यूनिवर्सीटी गेम में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी ।

4. कॉमनवेल्थ गेम्स में भारत का प्रतिनिधत्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी । 5. एफ्रो एषियन गेम्स में भारत का प्रतिनिधत्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

6. एषियन गेम्स में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी। 7. एषियन चैम्पियनषिप में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

8. ओतम्पिक में भारत का प्रतिनिधित्व करने वाले खिलाड़ी। 9. कॉमनवेल्थ गेम में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी। 10. एफ्रो एषियन गेम्स में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी। 11. एषियन गेम में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी। 12. सैफ गेम में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी। 13. राष्ट्रीय स्तर में नेषनल गेम, नेषनल सिनियर चैम्पियनषिप में राज्य का प्रतिनिधित्व करते हुए टीम/व्यक्तिगत स्पर्धा मे। प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

14. सैफ गेम में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी।4 (cid:18)बहार गजट (असाधारण)] 24 +दस-बर 2009 15. ऑल इंडिया इंटर युनिवर्सिटी टूर्नामेंट में विष्वविद्यालय का प्रतिनिधित्व करते हुए व्यक्तिगत/टीम स्पर्धा में प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

संख्या-3/एम0-253/06 का0-6089/अधिसूचना संख्या-6086, दिनांक 18.12.2009 के तहत निर्गत बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2009 का निम्नलिखित अॅंगरेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद्‌ द्वारा प्रकाषित किया जाता है, जिसे भारत-संविधान के अनुच्छेद 348 के खंड (3) के अधीन उक्त नियमाली का अॅंगरेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

---------- The 18th December 2009 No. 3/M.-253/2006-6086.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar, makes the following Rules for appointment of outstanding Sportspersons- 1. Short title , extent & commencement.-(i) These Rules may be called as the Bihar Outstanding Sportspersons Appointment Rules, 2009. (ii) It shall extend to the whole State of Bihar. (iii) It shall come into force at once. 2. Definitions.- In these Rules, unless the context otherwise requires- (i) "Rules" means the Bihar Outstanding Sportspersons Appointment Rules,2009; (ii) "Government" means the Government of Bihar; (iii) "Governor" means the Governor of Bihar; (iv) "Year" means the financial year, i.e. from 1st April to 31st March; (v) "Appointing Authority" means the Personnel & Administrative Reforms Department; (vi) "Sports discipline" means such sports descipline which are played in Olympic games or Commonwealth games or Asian games or All India Civil Services Tournament(Except Music, Dance & Short play events); (vii) "International Tournament" means Olympic, World Cup, World University games, Afro-asian games, Asian championship, SAARC games or Special Olympics in which the India has participated as a team of the Indian Olympic Association or Federation; (viii) "National Tournament" means such competition, which has been conducted by the Supreme National Federation of the sports discipline determined under these Rules once at senior level or the recognised Annual All India Inter University Competitions conducted in the aforesaid sports discipline; (ix) "Personnel Competition" means such competition in which the achievement has been due to personal efforts; and (x) "Team Competition" means such competition in which the achievement has been due to efforts by more than one sportsperson. 3. Qualification- Under these Rules, the sportspersons having following qualifications, shall be suitable for appointment in the category of outstanding sportspersons under the services of the Government, who-5 (cid:18)बहार गजट (असाधारण)] 24 +दस-बर 2009 (i) is the resident of Bihar State, and who in the defined sports disciplines in these Rules (ii) (a) has secured First, Second and Third position in the team/ personal events by representing the country in the Olympic, World cup, World University games, Commonwealth games, Asian games, Afroasian games, Asian Championship, Special Olympic or SAF games, or (b) has obtained First, Second or Third position in the team/ personal events in National games, National Senior/ Junior Championship, or (c) has obtained First, Second or Third position in All India Inter University Tournament by representing University, or (d) has represented India in Olymnpic or Conmonwealth games or Afro- asian games or Asian games or SAF games. 4. Selection Procedure .- 4.1 The selection for appointment shall be on the basis of achievement obtained in the sports competition mentioned in the foregoing rule. For appointment on the post it shall not be sufficient for a outstanding sportsperson to have the requisite qualification only, rather the sportspersons havinag requisite qualification shall have to pass through a selection procedure. The selection committee, after adopting due procedure, shall prepare a merit list, on the basis of which appointment shall be made each year according to the merit. The advertisement for selection shall be made by the Personnel & Administrative Reforms Department in the month of April each year and after completion of all procedures appointment shall be made till the month of August. 4.2 The selection of outstanding sportspersons shall be made by the selection Committee constituted by the State Government. The following shall be the members of the Committee-

(1)Principal Secretary/Secretary, Personnel & Administrative Reforms Department Chairman (2) Secretary, Art, Culture & Youth Department Member (3) Director General, Bihar State Sports Authority, Patna Member (4) Sports specialist nominated by the Art, Culture & Youth Deptt. Member (5) An officer not below the rank of Deputy. Secretary belonging to SC/ST nominated by the Pesonnel & Administrative Reforms Deptt. Member 4.3 The merit list for appointment of outstanding sportsperson having requisite educational qualifiction as well as qualification with respect to sports discipline, shall be prepared keeping in view the seniority list mentioned in Annexure-1. 4.4 The selection shall be made on the basis of best achievement amongst the several achievements secured by a sportspersons. 4.5 For appointment, achievement secured by a sportsperson in any year shall deemed to be the suitability for appointment, provided that the age of the outstanding sportsperson is within the limit for government employment.

4.6 In case of tie on the basis of aforesaid sports achievements, the following procedure shall be adopted to break the tie-

(a) The personal achievement shall be treated as larger against the team achievement. (b) The player setting new record shall be preferred. (c) The achievement of high level tournament shall be preferred. (d) If the tie remains in spite of above, the date of birth shall be preferred. (e) The achievement of current year shall be given priority. (f) If the tie still remains, it shall be broken on the basis of percentage marks of prescribed qualification

4.7 The outstanding Sportsperson having prescribed educational qualification and requisite qualification with respect to sports discipline shall be appointed on group 'C' posts by the Personnel & Administrative Reforms Department on the basis of recommendation of the Selection Committee. Such appointment shall be made on the posts of Bihar Secretariat Service, Bihar Secretariat Clerical Service and other group 'C' posts. In case of qualification being below Matric appointment may be made on group 'D' posts. Under the special circumstances appointments may also be made on group 'B' posts under these Rules. 4.8 Not more than three outstanding sportspersons shall be appointed in a year in any sports discipline. 4.9 To make the appointment procedure transparent provisional merit list shall be published. Grievances of any kind may be submitted to the Principal Secretary/ Secretary, Personnel & Administrative Reforms Department within 15 days of publication of merit list. After examining the grievances the final merit list shall be issued, on the basis of which appointment shall be made in accordance with seniority. 4.10 After preparation of merit list by the Selection Committee, recommendation for appointment shall be made after verification of certificates. 5. Age limit.- The provision of age limit determined by the State Government (Personnel & Administrative Reforms Department) from time to time shall be effective. 6. Reservation.- If the vacancy in the appointment of outstanding sportspersons is on the reservation point, the outstanding sportsperson shall be appointed after carryin forward the reservation point. 7. Repeal & Savings.- The letter no. 3792, dated 14-03-73 and resolution no. 1086, dated 20-01-79 issued by the Personnel & Administrative Reforms Department and other instructions with respect to appointment of outstanding sportspersons shall be deemed to be repealed. Notwithstanding such repeal, anything done or any action takenunder the said circular/resolution/instructions prior to coming into force of these Rules, shall have no adverse effect. 8. Miscellaneous.- Notwithstanding contained any thing contrary to these Rules in any other Rules, provisions of these Rules shall have over-riding effect.

9. Removal of difficulties.- The Government may, from time to time, issue such general or special direction as may be necessary to remove difficulties in the operation of any of the provisions of these Rules.

Annexure - I THE PRIORITY LIST OF SPORTSPERSONS FOR APPOINTMENT OF OUTSTANDING SPORTSPERSONS

1. The sportspersons having secured First, Second and Third position in the Olympic Games by representing India.

2. The sportspersons having secured First, Second and Third position in the World Cup by representing India.

3. The sportspersons having secured First, Second and Third position in the World University Games by representing India.

4. The sportspersons having secured First, Second and Third position in the Commonwealth Games by representing India.

5. The sportspersons having secured First, Second and Third position in the Afroasian Games by representing India.

6. The sportspersons having secured First, Second and Third position in the Asian Games by representing India.

7. The sportspersons having secured First, Second and Third position in the Asian Championship by representing India.

8. The sportspersons representing India in Olympic. 9. The sportspersons representing India in Commonwealth games. 10. The sportspersons representing India in Afroasian games. 11. The sportspersons representing India in Asian games. 12. The sportspersons having secured First, Second and Third position in the SAF games by representing India.

13. The sportspersons having secured First, Second and Third position in the Team/Personal Competition by representing state in National Games, National Senior Championship at national level.
