अध्सिूचनाएं 4 Qjojh 2010 बिहार लघु खनिज समनुदान ;संशोध्नद्ध नियमावली 2010
सं0 230 /एम—चूॅंकि, पूर्ववत्र्ती बिहार राज्य के पुनर्गठन के पश्चात् उत्तरवत्र्ती बिहार में पहाड़ी क्षेत्राों की कमी हो गई है ;
चॅूंकि, घटे हुये वन एवं पहाड़ी क्षेत्राों के कारण पर्यावरण क्षेत्रा में असंतुलन का खतरा उत्पन्न हो गया है;
चूॅंकि, जनहित तथा वन्य प्राणियों, वनस्थनियों एवं पर्यावरण हित में राज्यान्तर्गत खनन् कार्यों का विनियमन आवश्यक हो गया हैऋ तथा
चूॅंकि, बिहार राज्य में पहाड़ों से पत्थर की उपलब्ध्ता मात्रा कुछ जिलों में ही सीमित है;
चॅूंकि, यदि खनन् कार्यों का विनियमन नहीं किया जाता है तो भविष्य में इस राज्य में पहाड़ियों का अस्तित्व समाप्त हो जायेगा जिससे पर्यावरण पर विपरीत प्रभाव पड़ने की संभावना प्रबल हो जायेगी जिसके परिणामस्वरूप मौसम में भी गंभीर बदलाव आ सकते हैं ।
अतः, वन्य प्राणियों, वनस्पत्तियों तथा पर्यावरण सन्तुलन के हित में पत्थर के खनन् को विनियमित करने का निर्णय लिया गया है ।
उपरोक्त उद्देश्यों की प्राप्ति के लिये बिहार के राज्यपाल खान एवं खनिज ;विकास एवं विनियमनद्ध अध्निियम 1957 की धरा-15 के अन्तर्गत प्रदत्त शक्तियों का उपयोग करते हुये निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम, विस्तार एवं आरंभः—;1द्ध यह बिहार लघु खनिज समनुदान ;संशोध्नद्ध नियमावली 2010 कहलायेगी ।
;2द्ध इसका विस्तार सम्पूर्ण बिहार राज्य में होगा ।
;3द्ध यह तुरत के प्रभाव से प्रवृत होगा ।2 (cid:18)बहार गजट (असाधारण)] 26 फरवर(cid:15) 2010 2. बिहार लघु खनिज समनुदान नियमावली 1972 में एक नये नियम 53 का जोड़ा जाना । -उक्त नियमावली 1972 में निम्नलिखित नियम 53 नियम 52 के बाद जोड़ा जायेगा—
53-बिहार लघु खनिज समनुदान नियमावली 1972 में अंतर्विठ किसी बात होते हुये
;1द्ध पत्थर का खनन पट्टा स्वीकृत नहीं किया जायेगा । ;2द्ध नियम 9 तथा 52 के तहत् स्वीकृत खनन पट्टों को उनकी शेष बचे अवध् ितक के लिये चलने दिया जायेगा परन्तु उनका नवीकरण इसके बाद नहीं किया जायेगा :
परन्तु, जहां तक नियमावली के प्रवृत होने के पूर्व पट्टे की अवध् ि समाप्त हो गई हो किन्तु इस नियमावली के प्रवर्तन के पूर्व भारत सरकार से अपेक्षित कानूनी अनुमोदन प्राप्त कर लिया गया हो वहां पट्टाधरी अन्य कानूनी बाध्यताओं को पूरा करने के अध्ीन रहते हुये नवीकरण का हकदार हो सकेगाः
परन्तु, और कि जनहित में यदि राज्य सरकार का समाधन हो जाय कि पत्थर के खनन से पर्यावरण पर कोई विपरीत असर नहीं पड़ रहा है तथा सार्वजनिक उपयोग के लिये पत्थर की आवश्यकता है, तो उपरोक्त प्रावधनों को किसी क्षेत्रा के लिये उतनी अवध् ि के लिये शिथिल किया जा सकेगा, जितनी आवश्यक हो ।
स्पष्टीकरण-'पत्थर' से अभिप्रेत है निर्माण कार्यों में उपयोग होने वाले पत्थर तथा इसमें बोल्डर, ग्रैवेल, शिंगल, चूने के विनिर्माण के लिये भट्ठे में काम आने वाला लाइमशेल, चूनापत्थर तथा बटन बनाने के कार्यों में आने वाला लाईम शेल एवं कंकड, गोला मिल के प्रयोजनार्थ व्यवहृत कैल्सेडोनी गुटिक ;पेबलद्ध, भवन निर्माण के प्रयोजनार्थ या सड़क बनाने अथवा घरेलू सामान के काम में आने वाला क्वार्टजाईट और बलुआ पत्थर, भवन निर्माण सामग्री के रूप में उपयोग होने वाले स्लेट और शेल, चक्की पत्थर सहित घरेलू वर्तन बनाने के काम आने वाला पत्थर, स्टोन सेट्स, स्टोन ब्रिक्स, सजावटी पत्थर में उपयोग होने वाला ग्रेनाईट तथा मार्बल सम्मिलित होंगे ।

4 Qjojh 2010 सं0 230 /एम0, दिनांक 4 Qjojh 2010 का अंग्रेजी में निम्नलिखित अनुवाद बिहार-राज्यपाल के प्राध्किार से इसके द्वारा प्रकाशित किया जाता है जिसे भारतीय संविधन के अनुच्छेद-348 के खण्ड ;3द्ध के अध्ीन अंग्रेजी भाषा में उसका प्राध्किृत पाठ समझा जायेगा ।

The 4th February 2010 BIHAR MINOR MINERAL CONSESSION (AMENDMENT) RULES, 2010
No. 230/M—WHEREAS, after reorganization of erstwhile State of Bihar, in the successor State of Bihar hilly terrain has got reduced to very small area;
WHEREAS, due to reduced forest cover and hilly tract ecological and environmental imbalance is imminent.
WHEREAS, in public interest and in the interest of maintaining ecology, environment and flora and fauna in the State, it is necessary to regulate mining and quarrying operation;
WHEREAS, availability of stone from hills in the State of Bihar is restricted to only few district;
3 (cid:18)बहार गजट (असाधारण)] 26 फरवर(cid:15) 2010WHEREAS, if quarrying and mining is not regulated, it is apprehended that after sometime there would be no hills in the State which is likely to have an adverse impact on ecology and environment and cause serious climatic imbalance;
THEREFORE, in the interest of ecology, environment and flora and fauna of the State, it has been resolved to regulate mining and quarrying of stone in the State;
With a view to achieve above objective, the Governor of Bihar in exercise of power conferred under Section 15 of MMRD Act, 1957 makes following rule:-
1. Short title, extent and commencement:—(1) These rules may be called Bihar Minor Mineral Concession (Amendment) Rules, 2010.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with immediate effect. 2. Addition of a new rule 53 in the Bihar Minor Mineral Concession Rules 1972 The following rule 53 shall be added after rule 52 of the said Rules, 1972: – 53-Notwithstanding anything contained in the Bihar Minor Mineral Concession Rules, 1972 to the contrary –
(1) No mining lease for stone shall be granted. (2) Existing leases for stone granted under rule 9 and rule 52 would be allowed to subsist for the remaining period for which they have already been granted but they shall not be renewed thereafter:
Provided where period of lease has expired before coming into force of these Rules but requisite statutory approval from Govt. of India has been received before enforcement of these Rules, lessee may be entitled to renewal subject to fulfillment of other statutory obligation.
Provided further that in public interest, if the State Government is satisfied that quarrying or mining of stone may not adversely affect ecology and environment and further there is requirement of stone for public use, it may relax the above restriction in any area for such period as it may deem fit necessary.
Explanation-"Stone" means building stones and includes boulders, gravel, shingle, lime shell, kanker and limestone used in kilns for manufacturing of lime used as building material and lime shell used for manufacture of bottoms, chalcedony pebbles used for ball mill purpose only, Quartzite and sandstone when used for purposes of building or for making road metal and household utensils, slate and shell when used for building material, stone used for making household utensils including grinding stone, stone sets and stone bricks, granite (In case of use for decorating stone) and marble.
