सं0 एल0जी0-1-13/2010/लेज-161—बिहार विधान मंडल द्वारा यथापारित निम्नलिखित अधिनियम, जिसपर राज्यपाल दिनांक 24 अप्रील 2010 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है।

बिहार सहकारी सोसाइटी (संशोधन) अधिनियम, 2010
बिहार सहकारी सोसाइटी अधिनियम, 1935 (अधिनियम VI, 1935) में संशोधन हेतु अधिनियम। प्रस्तावना :- चूँकि, बिहार राज्य में मत्स्य विकास की अपार सम्भावना है,
और चूँकि, राज्य सरकार द्वारा परम्परागत मछुआरों को प्रशिक्षित करते हुए और तकनीकी सहायता देते हुए मत्स्य उत्पादन में वृद्धि हेतु कई कार्यक्रम प्रारम्भ किए गए हैं,
और चूँकि, राज्य सरकार की यह नीति है कि जलकरों की बन्दोबस्ती परम्परागत मछुआरों की मत्स्यजीवी सहयोग समिति के साथ किया जाए,
और चूँकि, यह आवश्यक माना गया है कि मत्स्यजीवी सहयोग समितियों की संख्या को पुनर्गठित किया जाए ताकि बेहतर प्रबन्धन से मत्स्य उत्पादन में वृद्धि हो, जो राज्य के सकल घरेलू उत्पाद की वृद्धि में भी सहायक हो,2 (cid:18)बहार गजट (असाधारण), 30 अूील 2010 भारत गणराज्य के इक्कसठवें वर्ष में बिहार राज्य विधान मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-
1. संक्षिप्त नाम, विस्तार और प्रारम्भ।-(i) यह अधिनियम बिहार सहकारी सोसाइटी (संशोधन) अधिनियम, 2010 कहा जा सकेगा।
(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा।
(iii) यह उस तिथि से, जो राज्य सरकार राजपत्र में प्रकाशित करते हुए नियत करे, प्रवृत्त होेगा। 2. बिहार अधिनियम VI, 1935 की धारा-8 का संशोधन। - उक्त अधिनियम की धारा-8 की उपधारा-(1क) के बाद निम्नलिखित नई उपधारा-(1ख) अंतःस्थापित की जायेगी, यथा -
''(1ख) बिहार सहकारी सोसाइटी अधिनियम, 1935 अथवा किसी अन्य बिहार अधिनियम अथवा उसके तहत् गठित नियमावली अथवा किसी सहकारी समिति या सहकारी समितियों के वर्ग की उपविधि अथवा राज्य सरकार या निबंधक, सहयोग समितियाँ द्वारा निर्गत किसी आदेश में अन्तर्विष्ट किसी प्रतिकूल प्रावधान के होते हुए भी, एक प्रखण्ड में मात्र एक निबन्धित मत्स्यजीवी सहयोग समिति होगी, जिसका कार्यक्षेत्र प्रखण्ड की भौगोलिक सीमा तक विस्तारित होगा।
3. बिहार अधिनियम VI, 1935 की धारा-11क के बाद नई धारा-11ख का जोड़ा जाना। - उक्त अधिनियम की धारा-11क के बाद निम्नलिखित नई धारा-11ख जोड़ी जाएगी, यथा-
''11ख बिहार अधिनियम VI, 1935 या किसी अन्य अधिनियम अथवा उसके तहत् गठित नियमावली अथवा किसी सहकारी समिति या सहकारी समितियों के वर्ग की उपविधि अथवा राज्य सरकार या निबंधक, सहयोग समितियाँ द्वारा निर्गत किसी आदेश मेें अन्तर्विष्ट किसी प्रतिकूल बात के होते हुए भी, सभी विद्यमान प्रखण्डस्तरीय मत्स्यजीवी सहयोग समिति, जिनका कार्यक्षेत्र प्रखण्ड के भौगोलिक क्षेत्र तक सीमित हो, एक समिति में संविलित माने जाएँगे तथा बिहार अधिनियम VI, 1935 के अन्तर्गत एक नई समिति स्वतः निबन्धित समझे जाएँगे एवं निबंधक, सहयोग समितियाँ निबन्धन प्रमाण-पत्र निर्गत करेगा :
परन्तु, ऐसे पुनर्गठन होने पर विद्यमान सहयोग समिति अथवा बिहार अधिनियम VI, 1935 अथवा बिहार स्वावलम्बी सहकारी समिति अधिनियम, 1996 के अन्तर्गत निबन्धित सहकारी समिति के सभी सदस्य पुनर्गठित समिति के सदस्य समझे जाएँगे एवं सदस्यों को वैसे समिति के सदस्यों के सभी अधिकार एवं दायित्त्व प्राप्त हाेंगे। परन्तु यह और कि, वैसे पुनर्गठन के बाद, निबंधक/सरकार, पुनर्गठित समिति एवं वैसे सम्बद्ध समितियों, जिसके मत्स्यजीवी सहयोग समिति सदस्य हो, के कार्य संचालन हेतु तदर्थ प्रबन्ध समिति गठित करेगा, जिसकी अवधि एक वर्ष से अनधिक होगी तथा जिसके अधीन निर्वाचन के बाद नई प्रबन्ध समिति का गठन किया जाएगा।

सं0 एल0जी0 1-13/2010/लेज-162—बिहार विधान मंडल द्वारा यथा-पारित और राज्यपाल द्वारा दिनांक 24 अप्रील 2010 को अनुमत बिहार सहकारी सोसाइटी समिति (संशोधन) अधिनियम 2010 का निम्नलिखित अंगे्रजी अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड(3) के अधीन उक्त अधिनियम का अंगे्रजी भाषा में प्राधिकृत पाठ समझा जायेगा।

राजेन्द्र कुमार मिश्र, सरकार के सचिव।3 (cid:18)बहार गजट (असाधारण), 30 अूील 2010 [Bihar Act 22, 2010] THE BIHAR CO-OPERATIVE SOCIETIES (AMENDMENT) ACT, 2010 AN ACT TO AMEND THE BIHAR CO-OPERATIVE SOCIETIES ACT, 1935 [BIHAR ACT VI OF 1935] Preamble: - WHEREAS there is immense potential of Fishery development in the State of Bihar,
AND WHEREAS the State Government has launched various schemes to augment fishery production by introduction of technology and imparting training to the traditional fisherman,
AND WHEREAS the policy of the State Government is to settle sairats comprised of water bodies with traditional fisherman Co-operative Society,
AND WHEREAS it is felt necessary to reorganise the structure of Fishermen Co-operative societies to enable better management for enhanced production which will ultimately add to GSDP of the State,
BE it enacted by the Legislature of the State of Bihar in the Sixty One year of the Republic of India as follows: -
1. Short Title, Extent and Commencement.–(i) This Act may be called The Bihar Co-operative Societies (Amendment) Act, 2010.
(ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force on such day as the State Government may appoint by publication in official Gazette.
2. Amendment of Section-8 of the Bihar Act, VI, 1935.– In the said Act after sub- section (1a) of Section-8 a new sub-section (1b) shall be inserted as follows, namely - "(1b) Notwithstanding anything contrary contained in Bihar Co-operative Societies Act, 1935 or any other Bihar Act or rules framed thereunder or bye-laws of a Co-operative Society or class of Co-operative Societies or any order issued by the State Government or Registrar of Co-operative Societies, there shall be only one registered Fishermen Co-operative Society in a Block with its area of operation extending over the whole Geographical limit of the Block."
3. Addition of a new Section 11B after Section 11A of the Bihar Act VI of 1935.–
In the said Act after Section 11A a new Section 11B shall be added as follows; namely "11B Notwithstanding anything contrary contained in any provision of Bihar Act VI of 1935 or any other Act, rules made thereunder and bye-laws of a registered Co-operative Society or class of Co-operative Societies, any order issued by the State Government or Registrar, Co-operative Societies, all existing Fishermen Co-operative Societies at block level, area of operation being confined to the Geographical limit of the Block shall stand merged in one Co-operative Society and shall be deemed to be registered as a new Co-operative Society under Bihar Act VI of 1935, and the Registrar, Co-operative Societies shall issue registration certificate.
Provided that on such reorganisation, all members of the existing Co- operative Society or Societies registered under Bihar Act VI of 1935 or Bihar Self Supporting Co-operative Societies Act, 1996 shall be deemed to have become members of such reorganized society and shall have all rights and liabilities as members of the said Society.
4 (cid:18)बहार गजट (असाधारण), 30 अूील 2010Provided further that on such reorganisation, for managing the affairs of the new Society and all such affiliating Societies of which the Fishermen Co- operative Society is a member, the Registrar/Government shall constitute an ad hoc managing committee for a period not exceeding one year, within which the new managing committee shall be constituted after elections."
