सं0-बी1-3-48/2010-11—बिहार विधान-सभा सदस्यों द्वारा बिहार विधान परिशद का द्विवार्शिक निर्वाचन, 2010 से संबंधित विभागीय अधिसूचना संख्या बी1-3-48/2010-10, दिनांक 24 मई 2010 तथा भारत निर्वाचन आयोग की अधिसूचना संख्या 322/बिहार-वि.प./1/2010 (1), दिनांक 24 मई 2010 एवं अधिसूचना संख्या 322/बिहार-वि.प./1/2010 (2), दिनांक 24 मई 2010 सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं।

सं0-बी1-3-48/2010-10—यतः बिहार राज्य में, राज्य की विधान-सभा के सदस्यों द्वारा निर्वाचित राज्य की विधान परिशद के सात सदस्यों के स्थान 21 जुलाई, 2010 को उनकी पदावधि समाप्त होने तथा सेवा-निवृत्त होने पर रिक्त होने हैं। यतः इस प्रकार उत्पन्न हुई रिक्त्यिों को भरने के प्रयोजन से द्विवार्शिक निर्वाचन कराया जाना है;

अतः, अब, लोक प्रतिनिधित्व अधिनियम 1951 (1951 का 43) की धारा-16 के अनुसरण में, जैसा की निर्वाचन आयोग ने सिफारिष की है कि बिहार राज्य के राज्यपाल इसके द्वारा राज्य की विधान-सभा के सदस्यों से यह अपेक्षा करते हैं कि वे, उक्त अधिनियम के उपबन्धों और उसके अधीन बनाए गए नियमों और आदेषों के अनुसार, उक्त रिक्तियों को भरने के प्रयोजन से राज्य की विधान परिशद्‌ के लिए सात सदस्य निर्वाचित कर दें।

No. B1-3-48/2010-10—WHEREAS, the seats of seven members of the Legislative Council of the State of Bihar, elected by the members of Legislative Assembly of the State, are due to fall vacant on 21st July, 2010, on the retirement of those members, on the expiration of their term of office; and

WHEREAS, a biennial election has to be held for the purpose of filling the above vacancies so arising;

NOW, THEREFORE, as recommended by the Election Commission of India in pursuance of section 16 of the Representation of the People Act, 1951 (43 of 1951), the Governor of the State of Bihar is hereby pleased to call upon the members of the Legislative Assembly of the State, to elect seven members to the Legislative Council of the State, for the purpose of filling the above vacancies, in accordance with the provisions of the said Act and of the rules and orders made thereunder.

सं. 322/बिहार-वि.प./1/2010 (1) :- यतः्‌ बिहार राज्य के राज्यपाल ने, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-16 के अधीन जारी और राज्य के शासकीय राजपत्र में 24 मई, 2010 को प्रकाषित अधिसूचना द्वारा राज्य की विधान-सभा के सदस्यों सेे यह अपेक्षा की है कि वे बिहार राज्य में विधान परिशद्‌ के लिए सात सदस्य निर्वाचित कर दें।

अतः, अब, उक्त अधिनियम की, धारा-39 की उप-धारा (1) और धारा-56 के अनुसरण मे, भारत निर्वाचन आयोग एतद्‌द्वाराः- (अ) उक्त निर्वाचन के संबंध में :-

(क) नाम निर्देषन करने की अन्तिम तारीख - 31 मई, 2010 (सोमवार)

(ख) नाम निर्देषन की संवीक्षा की तारीख -

1 जून, 2010 (मंगलवार)

(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख-

3 जून, 2010 (गुरूवार)

(घ) वह तारीख, जिसको यदि आवष्यक हुआ तो मतदान होगा, और 10 जून, 2010 (गुरूवार)

(ड़) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा 12 जून, 2010 (षनिवार)

नियत करता है; और

(आ) 9.00 बजे पूर्वाहन्‌ से 4.00 बजे अपराह्‌न तक का समय, उस समय के रूप में नियत करता है जिसके दौरान यदि आवष्यक हुआ तो, उक्त विनिर्दिश्ट तारीख को मतदान होगा।

No. 322/BR-LC/1/2010 (1) :—WHEREAS, the Governor of the State of Bihar has, by notification issued under section 16 of the Representation of the People Act, 1951 (43 of 1951) and published in the official Gazette of the State on 24th May, 2010, been pleased to call upon the members of the Legislative Assembly of the State, to elect seven members to the Legislative Council of the State :-

NOW, THEREFORE, in pursuance of sub-section (1) of section 39 and section 56 of the said Act, the Election Commission of India hereby –4 (cid:18)बहार गजट (असाधारण)] 24 मई 2010 (A) appoints, with respect to the said election –

(a) the 31st May, 2010 (Monday), as the last date for making nominations;

(b) the 1st June, 2010 (Tuesday), as the date for the scrutiny of the nominations;

(c) the 3rd June, 2010 (Thursday), as the last date for the withdrawal of candidatures;

(d) the 10th June, 2010 (Thursday), as the date on which a poll shall, if necessary, be taken; and

(e) the 12th June, 2010 (Saturday), as the date before which the election shall be completed; and

(B) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken in all the above mentioned States, on the date specified above, for the election.

सं. 322/बिहार-वि.प./1/2010 (2) :- लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-21 के अनुसरण में और धारा-22 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्वाचन आयोग, बिहार सरकार के परामर्ष से एतद्‌द्वारा तारीख 24 मई 2010 को राज्य के शासकीय राजपत्र में प्रकाषित राज्यपाल की अधिसूचना के अनुसरण में राज्य की विधान-सभा के सदस्यों द्वारा, बिहार राज्य की विधान परिशद्‌ के लिए द्विवार्शिक निर्वाचन के संबंध में :-

करता है ; और

(II) उक्त सारणी के स्तम्भ (2) में विनिर्दिश्ट अधिकारी को रिटर्निंग आफिसर की उसके कृत्यांें के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।
