सरकार के उप-सचिव।2 (cid:18)बहार गजट (असाधारण)] 31 मई 2010 भारत सरकार विधि और न्याय मंत्रालय (विधायी विभाग) ———— अधिसूचना नई दिल्ली, तारीख 31 मई, 2010/ज्येश्ठ 10, 1932 (षक) का॰आ॰ (अ॰).- राश्ट्रपति, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-12 के अनुसरण में, नीचे दी गई सारणी के स्तंभ (2) में विनिर्दिश्ट प्रत्येक राज्य की विधान-सभा के निर्वाचित सदस्यों से, उक्त अधिनियम के उपबंधो और उसके अधीन बनाए गए नियमों और किए गए आदेषों के अनुसार, राज्य सभा के ऐसे सदस्य (सदस्यों) के, जिनकी पदावधि का उक्त सारणी के स्तंभ (4) की तत्स्थानी प्रविश्टि में वर्णित तारीख को अवसान होना है, स्थान (स्थानों) को, उनकी पदावधि के अवसान पर, भरने के प्रयोजन के लिए, उक्त सारणी के स्तंभ (3) में प्रत्येक राज्य के सामने विनिर्दिश्ट संख्या में सदस्य (सदस्यों) को निर्वाचित करने की अपेक्षा करती हैंः-

S.O (E) – In Pursuance of section 12 of the Representation of the People Act, 1951 (43 of 1951), the president is pleased to call upon the elected members of the Legislative Assembly of each State specified in Column (2) of the Table below, to elect, in accordance with the provisions of the said Act and of the rules and orders made thereunder, the number of member(s) specified against each state in column (3) of the said Table, for the purpose of filling the seat (s) of member(s) of the Council of States whose term of office is due to expire on the date mentioned in the corresponding entry in column (4) of the said Table, on the expiration of their term of office :-

सं0 318/2/2010 (1) :- यतः, भारत के राश्ट्रपति ने लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-12 के अधीन जारी और भारत के राजपत्र में 31 मई, 2010 को प्रकाषित अधिसूचना द्वारा नीचे की सारणी के स्तम्भ (1) में विनिर्दिश्ट राज्योेेेेेेें की विधान-सभा के प्रत्येक सदस्य से यह अपेक्षा की है कि उक्त सारणी के स्तम्भ (2) में राज्यों के सामने विनिर्दिश्ट संख्या में सदस्य निर्वाचित कर दें ।

अतः, अब, उक्त अधिनियम की धारा-39 की उप-धारा (1) और धारा-56 के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा :-

(अ) उक्त वार्णित निर्वाचन के संबंध में :-

(क) नाम निर्देषन करने की अन्तिम तारीख - 7 जून, 2010 (सोमवार) (ख) नाम निर्देषन की संवीक्षा की तारीख - 8 जून, 2010 (मंगलवार) (ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख- 10 जून, 2010 (गुरूवार) (घ) वह तारीख, जिसको यदि आवष्यक हुआ तो मतदान होगा, और 17 जून, 2010 (गुरूवार) (ड़) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा 19 जून, 2010 (षनिवार) नियत करता है; और,

(इ) 9.00 बजे पूर्वाहन्‌ से 4.00 बजे अपराह्‌न तक का समय, उस समय के रूप में नियत करता है जिसके दौरान यदि आवष्यक हुआ है तो, निर्वाचन के लिए उपर्युक्त विनिर्दिश्ट तारीख को, मतदान होगा ।

NOTIFICATION Nirvachan Sadan, Ashoka Road, New Delhi - 110001, Dated :31st May, 2010/ Jyaistha 10, 1932 (Saka) No. 318/2/2010 (1) :—WHEREAS, the President of India has, by notification issued under section 12 of the Representation of the People Act, 1951(43 of 1951) and published in the Gazette of India on 31st May, 2010, been pleased to call upon the5 (cid:18)बहार गजट (असाधारण)] 31 मई 2010 elected members of each of the Legislative Assemblies of the States, specified in column (1) of the TABLE below, to elect to the Council of States, the number of members specified against that State in column (2) of the said TABLE:

NOW, THEREFORE, in pursuance of sub-section (1) of section 39 and section 56 of the said Act, the Election Commission of India hereby— (A) appoints, with respect to the said election; ,

(a) The 7th June, 2010 (Monday), as the last date for making nominations; (b) the 8th June, 2010 (Tuesday), as the date for the scrutiny of the nominations; (c) the 10th June, 2010 (Thursday), as the last date for the withdrawal of candidatures;

(d) the 17th June, 2010 (Thursday), as the date on which a poll shall, if necessary, be taken; and

(e) the 19th June, 2010 (Saturday), as the date before which the election shall be completed; and

(B) fixes the hours from 9.00 A.M. to 4.00 P.M., as the hours during which the poll shall, if necessary, be taken in all the above mentioned States on the date specified above for the election.

सं0 318/2/2010 (2) :- लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-21 के अनुसरण में और धारा-22 की उप-धारा (1)द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग, नीचे की सारणी के स्तम्भ (1) में विनिर्दिश्ट प्रत्येक राज्य सरकार के परामर्ष से, राज्य सभा के द्विवार्शिक निर्वाचनों के संबंध में 31 मई, 2010 को भारत के राजपत्र में प्रकाषित भारत के राश्ट्रपति की अधिसूचना के अनुसरण में इसके द्वाराः-

(I) नीचे की सारणी के स्तम्भ (ं2) में तत्स्थानी प्रविश्टि में विनिर्दिश्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है ; और

(II) उक्त सारण्ाीं के स्तम्भ (3) में तत्स्थानी प्रविश्टि में विनिर्दिश्ट अधिकारी को, रिटर्निंग आफिसर की उसके कृत्यांें के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

No. 318/2/2010 (2):- In pursuance of section 21, and in exercise of the powers conferred by sub-section (1) of section 22, of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India, in consultation with the Government of the each States, specified in the column (1) of the TABLE below, hereby- (i) designates the officer, specified in the corresponding entry in column (2) of the said TABLE to be the Returning Officer; and

(ii) appoints the officer, specified in the corresponding entry in column (3) of the said Table, to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;

in respect of the biennial elections to the Council of States, to be held in that State in pursuance of the Notification of the President of India, published in the Gazette of India on 31st May, 2010 :-
