((((संसंसंसं0000 पपपपटना टना टना टना 360360360360) ) ) ) पपपपटनाटनाटनाटना, , , , वृहःपवृहःपवृहःपवृहःपितितितितवारवारवारवार,,,, 10101010 जूनजूनजूनजून 2020202010101010 संसदीय कार्य विभाग -------- अधिसूचना 2 जून 2010 सं0 सं0का0-1/वि0मं0, विविध-11/2008(खण्ड)-1053—बिहार विधान मण्डल (सदस्यों का वेतन, भत्ते एवं पेंशन) अधिनियम, 2006 (अधिनियम सं0 16, 2006) की धारा-8 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार विधान मण्डल (सदस्यों का वेतन, भत्ते एवं पेंशन) नियमावली, 2006 का संषोधन के लिए निम्नलिखित नियमावली बनाते हैं :-
11.. ससंंक्ष्क्षििाप्प्तत ननाामम अआौैरर अआाररंंभ्भा।।--(1) यह नियमावली बिहार विधान मण्डल (सदस्यों का वेतन, भत्ते एवं पेंशन) (संशोधन) नियमावली, 2010 कही जा सकेगी।
(2) यह अधिसूचना निर्गत की तिथि से प्रभावी होगी। 22.. बििबहहाारर वििवध्धााानन ममण्ण्डडलल ((ससददस्स्ययाोेंं ककाा ववेेततनन,, भ्भात्त्त्तोे एएववंं पपेेंंष्षानन)) नििनययममााववललीी,, 22000066 ककाा नििनययमम 1177((44)) ककाा पप्र्रतिितस्स्थ्थााापपनन।। --उक्त नियमावली का नियम 17(4) के स्थान पर निम्नलिखित रूप से प्रतिस्थापित किया जाय :-
''(4) बिहार विधान मण्डल का पूर्व सदस्य एक सहयात्री के साथ प्रथम ए0सी0/द्वितीय ए0सी0/तृतीय ए0सी0/स्लीपर क्लास में प्रत्येक वर्ष 75000 रूपये मूल्य के रेल कूपन पर यात्रा करने का हकदार होगा।''
परंतु, वैसे पूर्व सदस्य जो, केन्द्र सरकार या किसी राज्य सरकार द्वारा मान्यता प्राप्त विश्वविद्यालय के अधीन वेतन पर नियोजित हैं, तो भी रेलवे कूपन पर यथा उपर्युक्त प्रावधानों के अनुसार यात्रा के हकदार होंगे;
परंतु, और, कि, वे रेलवे कूपन पर की गयी यात्रा के लिए अपने विश्वविद्यालय/कॉलेज से यात्रा भत्ता/दैनिक भत्ता प्राप्त नहीं कर सकेंगे तथा उन्हें इस आशय का शपथ-पत्र यथास्थिति, सचिव, विधान-सभा/सचिव, विधान परिषद् को एवं अपने नियोजन के प्राधिकार को देना होगा।
बिहार-राज्यपाल के आदेष से, पंचम लाल, प्रधान सचिव। 2 (cid:18)बहार गजट (असाधारण)] 10 जून 2010 2006), Governor of Bihar, for amendment in the Bihar Legislature (Members' Pay, Allowances and Pension) Rules, 2006 frames the following rules:— 1. Short name and commencement—(i) This rule may be called as the Bihar Legislature (Members' Pay, Allowances & Pension) Rules 2010. (ii) It will come in force from the date of its gazette notification. 2. Substitution of rule 17(4) of Bihar Legislature (Members' Pay, Allowances and Pension) rule 2006.—Rule 17(4) of the said rule shall be substituted by the following :—
"(4) Ex-member of the Bihar Legislature will be entitled to journey on railway coupon with One-co-traveler in First class A.C. / Second class A.C. / Third class A.C./Sleeper class compartment up to rupees 75,000/- in a year."
Provided that, such Ex-member who is employed in central government / any state government recognized any university even then he will be entitled to journey by railway coupon as mentioned above.
Provided further that, he can not draw traveling allowance / daily allowance from his University/College for the same journey; he will have to give an undertaking to that effect to the Secretary of Bihar Legislative Assembly / Bihar Legislative Council as the case may be and his Employment Authority.
