सं0-बी1-3-68/2010-43—बिहार विधान-सभा आम निर्वाचन, 2010 के अवसर पर 22-षिवहर एवं 30-बेलसंड विधान सभा निर्वाचन क्षत्रों में मतदान का समय परिवर्तित किये जाने से संबंधित भारत निर्वाचन आयोग की अधिसूचना संख्या 464/बिहार-वि.
स./2010, दिनांक 23 अक्तूबर 2010 सर्वसाधारणकी जानकारी के लिए प्रकाषित की जाती है।

सं0 464/बिहार-वि.स./2010 ः- यतः, भारत निर्वाचन आयोग ने अपनी अधिसूचना संख्या 464/बिहार-वि.स./2010, दिनांक 29 सितम्बर 2010 के भाग (आ) स्थित सारणी के कॉलम 1 में दर्षाये गये विधान-सभा क्षेत्रों में मतदान हेतु समय निर्धारित किया था।
यतः, आयोग ने उक्त सारणी में दर्षाये गये प्रत्येक विधान-सभा क्षेत्रों के सामने, कॉलम 2 में मतदान कराने हेतु समय निर्धारित किया थाः
यतः मुख्य निर्वाचन अधिकारी, बिहार ने पत्र संख्या एम-1-0049/2010-9937, दिनांक 22 अक्तूबर, 2010 द्वारा आयोग को सूचित किया कि दिनांक 22 अक्तूबर, 2010 को एक थानाध्यक्ष और कुछ पुलिस कर्मियों की बारूदी सुरंग द्वारा अकस्मात मौत हो गई। बारूदी सुरंग वहां वामपंथी उग्रवादियों द्वारा बिछाया गया था। इसके अलावा यह भी सूचित किया गया कि षिवहर जिला स्थित प्रखंड विकास पदाधिकारी, तरियानी का पिछले कुछ दिनों पहले अपहरण हो गया था, जो कि 30-बेलसंड विधान-सभा क्षेत्र के अंतर्गत आता है, और,
यतः, उपरोक्त वर्णित कारणों से मुख्य निर्वाचन अधिकारी, बिहार ने 22-षिवहर एवं 30-बेलसंड विधान-सभा क्षेत्रों के मतदान का समय सुबह 7 बजे से सायं 5 बजे के स्थान पर सुबह 7 बजे से सायं 3 बजे तक करने हेतु प्रस्तावित किया है ताकि मतदान कर्मियों एवं पुलिस अधिकारियों का जिला मुख्यालय में सुरक्षित आगमन हो सके क्योंकि मतदान समाप्ति के पष्चात् देर रात में उक्त विधान-सभा क्षेत्रों में उनका परिचालन जोखिम भरा है,
यतः, आयोग ने उक्त कारणों एवं मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्ट की समीक्षा के उपरान्त् उक्त विधान सभा निर्वाचन क्षेत्रों में मतदान का समय सुबह 7 बजे से सायं 3 बजे करने का निर्णय लिया है,
अतः, अब साधारण खण्ड अधिनियम 1897 की धारा-की धारा-की धारा-की धारा-21 21 21 21 के साथ पठित, के साथ पठित, के साथ पठित, के साथ पठित, लोक प्रतिनिधित्व अधिनियम, 1951 ((((1951 का 431951 का 431951 का 431951 का 43)))) की धारा-56 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग उक्त अधिसूचना में निम्नलिखित संषोधन करता है, अतः अब, उक्त अधिसूचना के सारणी के कालम 1 में वर्णित 22-षिवहर एवं 30-बेलसंड के सामने स्थित कालम 2 में सुबह 7.00 बजे से सायं 3.00 बजे प्रविश्ट प्रतिस्थापित की जायेगी।

NOTIFICATION

No. 464/BR-LA/2010 :- WHEREAS, the Commission had vide its notification No. 464/BR-LA/2010 dated 29th September, 2010 notified the schedule of General election to the Bihar Legisaltive Assembly from the Assembly Constituencies mentioned in column (1) of the Table shown under clause (B) in the said notification including 22-Sheohar and 30-Belsand Assembly Constituencies; and
WHEREAS, the Commission had also fixed hours of poll for each of the Assembly Constituencies mentioned in the said Table, in column (2) of the said Table, against each of the respective Assembly Constituencies; and
WHEREAS,the Commission has received report from the Chief Electoral Officer of Bihar vide his letter No.M-1-0049/2010-9937, dated 22nd October, 2010 in which it is reported that the Station House Officer of Sheohar District along with police personnel has been killed in a landmine blast on 22nd October, 2010 night. The landmine was reportedly planted by Left Wingh Extremists. Apart from that it is also reprted that the BDO of Tariyani of Sheohar District was kidnapped sometime back, the incident site of which falls under 30-Belsand Assembly Constituency; and
WHEREAS, in view of these incidents, the Chief Electoral Officer, Bihar has recommended that the hours of poll in 22-Sheohar and 30-Belsand Assembly Constituencies should be changed from the existing 7.00 AM to 5.00 PM to 7.00 AM to 3.00 PM for the safe arrival of the polling personnel and police personnel to the Distrcit Headquarters after the close of the poll as movement during night in the said areas will be risky; and
WHEREAS, the Commission considered the said report of the Chief Electoral officer, Bihar and has decided to change the hours of poll in the said two Assembly Constituencies and has fixed them as 7.00 AM to 3.00 PM ; and
NOW, THEREFORE, the Election Commission in exercise of the powers conferred on it under Section 56 of the Representation of the People Act, 1951 (43 of 1951) read with section 21 of the General Clauses Act, 1897, hereby makes the following amendments in its noitification referred to above, namely:-
For the existing entries in column (2) of the said Table, against 22-
Sheohar and 30-Belsand in column (1), the entry "7.00 AM to 3.00
PM" shall be substituted.
