अधिसूचना सं0 बी1-3-68/2010-44—बिहार विधान-सभा आम निर्वाचन, 2010 के अवसर पर 116-तरैया एवं 120-अमनौर विधान-सभा निर्वाचन क्षत्रों में मतदान का समय परिवर्तित किये जाने से संबंधित भारत निर्वाचन आयोग की अधिसूचना संख्या 464/बिहार-वि.स./2010, दिनांक 26 अक्तूबर 2010 सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती है।

सं0 464/बिहार-वि.स./2010 ः- यतः, भारत निर्वाचन आयोग ने अपनी अधिसूचना संख्या 464/बिहार-वि.स./2010, दिनांक 4 अक्तूबर, 2010 के भाग (आ) स्थित सारणी के कॉंलम 1 में दर्षाये गये विधान-सभा क्षेत्रों में मतदान हेतु समय निर्धारित किया था।

यतः, आयोग ने उक्त सारणी में दर्षाये गये प्रत्येक विधान-सभा क्षेत्रों के सामने, कॅांलम 2 में मतदान कराने हेतु समय निर्धारित किया थाः

यतः मुख्य निर्वाचन अधिकारी, बिहार ने पत्र संख्या एम-1-0049/2010-10067, दिनांक 25 अक्तूबर, 2010 द्वारा आयोग को सूचित किया कि 116-तरैया एवम 120-अमनौर विधान सभा निर्वाचन क्षेत्रोें क्रमषः कुल 228 मतदान केन्द्रों में से कुल 74 एवम 210 मतदान केन्द्रों से कुल 76 मतदान केन्द्र नक्सल प्रभावित है जो सुरक्षा की दृश्टि से सवेदनषील है, और,

यतः, उपरोक्त वर्णित कारणों से मुख्य निर्वाचन अधिकारी, बिहार ने 116-तरैया एवम 120-अमनौर विधान सभा निर्वाचन क्षेत्रों के मतदान का समय सुबह 7 बजे से सायं 5 बजे के स्थान पर सुबह 7 बजे से सायं 4 बजे तक करने हेतु प्रस्तावित किया है । यतः, आयोग ने उक्त कारणों एवं मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्ट की समीक्षा के उपरान्त्‌ उक्त विधान सभा निर्वाचन क्षेत्रों में मतदान का समय सुबह 7 बजे से सायं 4 बजे करने का निर्णय लिया है,

अतः, अब साधारण खण्ड अधिनियम 1897 की धारा 21 के साथ पठित, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 56 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग उक्त अधिसूचना में निम्नलिखित संषोधन करता है, अतः अब, उक्त अधिसूचना के सारणी के कॉलम 1 में वर्णित 116-तरैया एवम 120 अमनौर के सामने स्थित कॉलम 2 में सुबह 7.00 बजे से सायं 4.00 बजे प्रविश्ट प्रतिस्थापित की जायेगी।

ELECTION COMMISSION OF INDIA ————— NOTIFICATION Nirvachan Sadan, Ashoka Road, New Delhi-110001, dated 26th October, 2010/04 Kartika 1932 (Saka) No. 464/BR-LA/2010:- Whereas the Commission had vide its notification No. 464/BR-LA/2010 dated 04th October, 2010 notified the schedule of General election to the Bihar Legislative Assembly from the Assembly Consitiuencies mentioned in column (1) of the table shown under clause (B) in the said notification including 116- Taraiya and 120- Amnour Assembly Constituencies; and Whereas, the Commission had also fixed hours of poll for each of the Assembly Constituencies mentioned in the said Table, in column (2) of the said Table, against each of the respective Assembly Constituencies; and Whereas, the Commission has received report from the Chief Electoral officer of Bihar vide his letter No. M-1-0049/2010-10067 dated 25th October, 2010 in which it is stated that 74 Polling stations out of 228 in 116- Taraiya Assembly Consituency and 76 polling stations out of 210 in 120- Amnour Assembly Constituency are naxal affected and therefore sensitive from security point of view; and Whereas, in view of the above facts, the Chief Electoral officer, Bihar has recommended that the hours of poll in 116-Taraiya and 120- Amnour Assembly Constituencies should be changed from the existing 7.00 AM to 5.00 PM to 7.00 AM to 4.00 PM;

Whereas, the Commission considered the said report of the Chief Electoral officer, Bihar and has decided to change the hours of poll in the said two Assembly Consitituencies and has fixed them as 7.00 AM to 4.00 PM; and Now, therefore, the Election Commission in exercise of the power conferred on it under Section 56 of the Representation of the People Act, 1951 (43 of 1951) read with section 21 of the General Clauses Act, 1897, hereby makes the following amendments in its notification referred to above, namely:- For the existing entries in column (2) of the said Table, against 116- Taraiya and 120- Amnour in column (1), the entry "7.00 AM to 4.00 PM" Shall be substituted.
