सं0 464/बिहार-वि.स./2010 ः- यतः, भारत निर्वाचन आयोग ने अपनी अधिसूचना संख्या 464/बिहार-वि.स./2010, दिनांक 15 अक्तूबर, 2010 के भाग (आ) स्थित सारणी के कालम 1 में दर्षाये गये 175-हिलसा, 232-बेलागंज, 233-अतरी एवं 234-वजीरगंज विधान-सभा क्षेत्रों में मतदान हेतु समय निर्धारित किया था।
यतः, आयोग ने उक्त सारणी में दर्षाये गये प्रत्येक विधान-सभा क्षेत्रों के सामने, कालम 2 में मतदान कराने हेतु समय निर्धारित किया थाः
यतः मुख्य निर्वाचन अधिकारी, बिहार ने पत्र संख्या एम-1-0049/2010-10761, एवं एम-1-0049/2010-10773 दोनों पत्र दिनांक 4 नवम्बर,, 2010 द्वारा आयोग को सूचित किया कि 175-हिलसा, 232-बेलागंज, 234-वजीरगंज विधान-सभा क्षेत्रों में नक्सल गतिविधियों एवं 233-अतरी विधान-सभा निर्वाचन क्षेत्र में भौगोलिक परिस्थति एवं नक्सल गतिविधियों के कारण पोलिंग पार्टी एवं पीसीसीपी को इवीएम के साथ स्ट्रौंग रूम में लौटने में कठिनाई होगी। यतः, उपरोक्त वर्णित कारणों से मुख्य निर्वाचन अधिकारी, बिहार ने 175-हिलसा, 232-बेलागंज, 234-वजीरगंज विधान-सभा क्षेत्रों के मतदान का समय सुबह 7 बजे से सायं 5 बजे के स्थान पर सुबह 7 बजे से सायं 4 बजे एवं 233-अतरी विधान-सभा निर्वाचन क्षेत्र में सुबह 7.00 बजे से 5.00 बजे के स्थान पर सुबह 7.00 बजे से 3.00 बजे तक करने हेतु प्रस्तावित किया है;
यतः, आयोग ने उक्त कारणों एवं मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्ट की समीक्षा के उपरान्त् उक्त चार विधान-सभा निर्वाचन क्षेत्रों में मतदान का समय मुख्य निर्वाचन अधिकारी द्वारा प्रस्तावित समय के अनुसार परिवर्तित करने का निर्णय लिया है, अतः, अब साधारण खण्ड अधिनियम 1897 की धारा-की धारा-की धारा-की धारा-21 के साथ पठित, 21 के साथ पठित, 21 के साथ पठित, 21 के साथ पठित, लोक प्रतिनिधित्व अधिनियम, 1951 ((((1951 का 431951 का 431951 का 431951 का 43)))) की धारा-56 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग उक्त अधिसूचना में निम्नलिखित संषोधन करता है,

No. 464/BR-LA/2010: - WHEREAS, the Commission had vide its notification No. 464/BR-LA/2010 dated 15th October, 2010 notified the schedule of General election to the Bihar Legislative Assembly from the Assembly Constituencies mentioned in column (1) of the Table shown under clause (B) in the said notification including 175-Hilsa, 232-Belaganj, 233-Atri and 234-Wazirganj Assembly Constituencies; and
WHEREAS, the Commission had also fixed hours of poll for each of the Assembly Constituencies mentioned in the said Table, in column (2) of the said Table, against each of the respective Assembly Constituencies; and
WHEREAS, the Commission has received report from the Chief Electoral Officer of Bihar vide his letters No.M-1-0049/2010-10761 and M-1-0049/2010-10773 both of dated 04th November, 2010 in which it is stated that in 175- Hilsa, 232- Belaganj and 234- Wazirganj Assembly Constituencies due to naxal threat and in 233-Atri AC due to geographical condition and naxal threat it will be very difficult for Polling Party and PCCP to return with the polled EVM safely to the Strong Room; and
WHEREAS, in view of the above facts, the Chief Electoral Officer, Bihar has recommended that the hours of poll in 175-Hilsa, 232-Belaganj and 234-Wazirganj Assembly Constituencies should be changed from the existing 7.00 AM-5.00 PM to 7.00 AM to 4.00 PM and in 233-Atri Assembly Constituency should be changed from the existing 7.00 AM-5.00 PM to 7.00 AM-3.00 PM; and
WHEREAS, the Commission considered the said report of the Chief Electoral officer, Bihar and has decided to change the hours of poll in the said four Assembly Constituencies and has fixed them as recommended by CEO, Bihar; and
NOW, THEREFORE, the Election Commission in exercise of the powers conferred on it under Section 56 of the Representation of the People Act, 1951 (43 of 1951) read with section 21 of the General Clauses Act, 1897, hereby makes the following amendments in its notification referred to above, namely:-
For the existing entries in column (2) of the said Table, against 175-Hilsa,
232-Belaganj and 234-Wazirganj in column (1), the entry "7.00 AM to 4.00
PM" and against 233-Atri in column (1), the entry "7.00 AM to 3.00 PM"
shall be substituted.
