अधिसूचना सं0-बी1-3-68/2010-50—बिहार विधान-सभा आम निर्वाचन, 2010 के शश्टम चरण के 211-नोखा एवं 223-औरंगाबाद विधान-सभा निर्वाचन क्षेत्रों में मतदान का समय परिवर्तित किये जाने से संबंधित भारत निर्वाचन आयोग की अधिसूचना संख्या-464/बिहार-वि.स./2010, दिनांक 15 नवम्बर 2010 सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती है।

सं0 464/बिहार-वि.स./2010 :-यतः, भारत निर्वाचन आयोग ने अपनी अधिसूचना संख्या 464/बिहार-वि.स./2010, दिनांक 27 अक्तूबर, 2010 के भाग (आ) स्थित सारणी के कॉंलम 1 में 223-औरंगाबाद एवं 211-नोखा विधान-सभा निर्वाचन क्षेत्रों को शामिल करते हुए मतदान हेतु समय निर्धारित किया था।
यतः, आयोग ने उक्त सारणी में दर्षाये गये प्रत्येक विधान-सभा क्षेत्रों के सामने, कॅांलम 2 में मतदान कराने हेतु समय निर्धारित किया थाः
यतः मुख्य निर्वाचन अधिकारी, बिहार ने पत्र संख्या एम-1-0049/2010-11090 दिनांक 11 नवम्बर, 2010 द्वारा आयोग को सूचित किया है कि 223-औरंगाबाद एवं 211-नोखा विधान-सभा निर्वाचन क्षेत्रों में उग्रवाद/माओवादी सक्रिय हैं और वे चुनाव के दौरान बम विस्फोट या बारूदी सुरंग द्वारा विस्फोट कर सकते हैं या मतदान सम्पन्न होने के बाद देर रात लौटते हुए पोलिंग पार्टी, पीसीसीपी एवं सीपीएफ पर हमला भी कर सकते है;
यतः, उपरोक्त वर्णित कारणों से मुख्य निर्वाचन अधिकारी, बिहार ने 223-औरंगाबाद एवं 211-नोखा विधान-सभा निर्वाचन क्षेत्रों के मतदान का समय सुबह 7 बजे से सायं 5 बजे के स्थान पर सुबह 7 बजे से सायं 3 बजे तक करने हेतु प्रस्तावित किया है । यतः, आयोग ने उक्त कारणों एवं मुख्य निर्वाचन अधिकारी, बिहार की रिपोर्ट की समीक्षा के उपरान्त् उक्त विधान-सभा निर्वाचन क्षेत्रों में मतदान का समय सुबह 7 बजे से सायं 3 बजे करने का निर्णय लिया है,
अतः, अब साधारण खण्ड अधिनियम 1897 की धारा 21 के साथ पठित, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 56 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग उक्त अधिसूचना में निम्नलिखित संषोधन करता है, अतः अब, उक्त अधिसूचना के सारणी के कॉलम 1 में वर्णित 223-औरंगाबाद एवं 211-नोखा के सामने स्थित कॉलम 2 में सुबह 7.00 बजे से सायं 3.00 बजे प्रविश्ट प्रतिस्थापित की जायेगी।

No. 464/BR-LA/2010: - WHEREAS the Commission had vide its notification No. 464/BR-LA/2010 dated 27th October, 2010 notified the schedule of General election to the Bihar Legislative Assembly from the Assembly Constituencies mentioned in column (1) of the Table shown under clause (B) in the said notification including 223-Aurangabad and 211-Nokha Assembly Constituencies; and WHEREAS, the Commission had also fixed hours of poll for each of the Assembly Constituencies mentioned in the said Table, in column (2) of the said Table, against each of the respective Assembly Constituencies; and WHEREAS, the Commission has received report from the Chief Electoral Officer of Bihar vide his letters No.M-1-0049/2010-11090 dated 11th November, 2010 in which it has been stated that in the region of 223-Aurangabad and 211-Nokha Assembly Constituencies there are intelligence inputs that the Maoist/extremists are active and they may try to do incidents like planting land mines or explosion of bombs during election or they may try to attack the Polling Parties, PCCP and CPF while returning after the poll. WHEREAS, in view of the above facts, the Chief Electoral Officer, Bihar has recommended that the hours of poll in 223-Aurangabad and 211-Nokha Assembly Constituencies should be changed from the existing 7.00 AM-5.00 PM to 7.00 AM to 3.00 PM; and WHEREAS the Commission considered the said report of the Chief Electoral officer, Bihar and has decided to change the hours of poll in the said two Assembly Constituencies and has fixed them as recommended by CEO, Bihar; and NOW, THEREFORE, the Election Commission in exercise of the powers conferred on it under Section 56 of the Representation of the People Act, 1951 (43 of 1951) read with section 21 of the General Clauses Act, 1897, hereby makes the following amendments in its notification referred to above, namely; For the existing entries in column (2) of the said Table, against 223-Aurangabad and 211-Nokha Assembly Constituencies in column (1), the entry "7.00 AM to 3.00 PM" shall be substituted.
