अधिसूचना सं0-बी1-3-179/2010-40—27-बांका संसदीय निर्वाचन क्षेत्र के उप-निर्वाचन, 2010 के अवसर पर इलेक्ट्रॉनिक मतदान मषीनों के प्रयोग से संबंधित भारत निर्वाचन आयोग का निदेष संख्या 576/3/ई.वी.एम./2010/एस.डी. आर(लो0स0) दिनांक 4 अक्तूबर 2010.सर्वसाधारण की जानकारी के लिए पुनः प्रकाषित की जाती है।

संख्या 576/3/ई.वी.एम./2010/एस0डी0आर(लो.स.) - यतः, लोक प्रतिनिधित्व अधिनियम 1951 की धारा 61 क में यह उपबंधित है कि मतदान मषीनों द्वारा मत ऐसी रीति से दिए और रिकार्ड किए जाएंगें जैसा कि भारत निर्वाचन आयोग ऐसे निर्वाचन क्षेत्र के लिए प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए निर्दिश्ट करे_ तथा

2. यतः बिहार राज्य में आयोग ने 27-बांका संसदीय निर्वाचन क्षेत्र की परिस्थितियों पर विचार किया है और वह संतुश्ट है कि उपर्युक्त संसदीय निर्वाचन क्षेत्र में मतदान के लिए पर्याप्त संख्या में इलैक्ट्‌्रॉनिक वोटिंग मषीनें उपलब्ध है, मतदान कर्मचारी इलैक्ट्‌्रॉनिक वोटिंग मषीन को दक्षतापूर्वक संचालन करने के लिए प्रषिक्षित हैं तथा निर्वाचक भी इलैक्ट्‌्रॉनिक वोटिंग मषीनों की कार्यप्रणाली से पूर्णतया परिचित हैं ;

3. अतः, अब, भारत निर्वाचन आयोग एतद्‌द्वारा बिहार राज्य में 27-बांका संसदीय निर्वाचन क्षेत्र को ऐसे निर्वाचन क्षेत्र के रूप में विनिर्दिश्ट करता है जिसमें 7 अक्तूबर, 2010 को अधिसूचित किए जाने वाले लोक सभा के चालू उप निर्वाचन में, निर्वाचनों का संचालन नियम, 1961 के अधीन निर्धारित रीति से इलैक्ट्‌्रॉनिक मतदान मषीनों के माध्यम से मत डाले और रिकार्ड किए जाएंगे जैसा कि इस विशय पर आयोग द्वारा समय-समय पर अनुपूरक अनुदेष जारी किए जाते हैं।

No. 576/3/EVM/2010/SDR(HP):- Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may be adopted in such constituency as the Election Commission may, having regard to the circumstances of each case specify;

and

2. Whereas, the Commission has considered the circumstances in 27- Banka Parliamentary Constituency in Bihar, and it is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the abovementioned Parliamentary Constituency, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;

3. Now, therefore, the Election Commission of India hereby specifies 27- Banka Parliamentary Constituency in Bihar, as the constituency in which the votes at the current bye- election to the House of the People from the said constituency to be notified on 7th October, 2010, shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.
