सं0 6175—बिहार मोटर गाड़ी (संशोधन) नियमावली, 2003 द्वारा यथासंशोधित बिहार मोटर गाड़ी नियमावली, 1992 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप जिसे राज्य सरकार, मोटर यान अधिनियम, 1988(1988 का 59) की धारा-111 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाने का प्रस्ताव करती है और उक्त अधिनियम की धारा-212 की उप-धारा (1) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, एतद्द्वारा प्रकाशित किया जाता है; और एतद्द्वारा यह सूचना दी जाती है कि उक्त प्रारूप-नियमावली पर, उस तारीख से, जिस तारीख को बिहार राजपत्र में इसे प्रकाशित किया जाता है, 30 दिनों की समाप्ति के पश्चात् विचार किया जाएगा । 2. ऐसे आक्षेपों या सुझावों पर, जो पूर्वोक्त अवधि की समाप्ति के पूर्व उक्त प्रारूप नियमावली के संबंध में किसी व्यक्ति से प्राप्त हो सकेंगे, राज्य सरकार द्वारा विचार किया जाएगा ।
3. आक्षेप और सुझाव, यदि कोई हो, सचिव, परिवहन विभाग, विश्वेश्वरैया भवन, बेली रोड, पटना को भेजे जा सकेंगे ।2 (cid:18)बहार गजट (असाधारण), 27 -दस/बर 2010
प्रारूप-नियम
1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ—(1) यह नियमावली बिहार मोटर गाड़ी(संशोधन) नियमावली, 2010 कही जा सकेगी ।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा ।
(3) यह तुरंत प्रवृत्त होगी ।
2. उक्त नियमावली, 1992 के नियम 163 च(3) एवं 163 छ(4) में प्रयुक्त शब्द ''राज्य परिवहन आयुक्त'' शब्द ''जिला परिवहन पदाधिकारी'' द्वारा प्रतिस्थापित किये जायेंगे ।
3. उक्त नियमावली, 1992 के नियम 163 छ-4 (ड.) में प्रयुक्त शब्द ''राज्य परिवहन आयुक्त, बिहार, पटना'' शब्द ''संबंधित जिला परिवहन पदाधिकारी'' द्वारा प्रतिस्थापित किये जायेंगे ।
4. उक्त नियमावली,1992 के नियम 163 छ(1) में प्रयुक्त शब्द ''सचिव, परिवहन विभाग शब्द ''राज्य परिवहन आयुक्त'' द्वारा प्रतिस्थापित किये जायेंगे ।
5. उक्त नियमावली, 1992 के प्रपत्र एल.टी.एस. ए. एवं एल.टी.एस. आर. में अनुज्ञापन पदाधिकारी शब्द के बाद उल्लिखित शब्द ''बिहार, पटना'' एतद्द्वारा विलोपित किये जाते हैं ।

No. 6175—The following draft of certain rules further to amend the Bihar Motor Vehicles Rules 1992 as amended by Bihar Motor Vehicle (Amendment) Rules 2003, which the State Government proposes to make in exercise of the powers conferred by Section 111 of the Motor Vehicles Act, 1988(59 of 1988), is hereby published as required by Sub section (1) of Section 212 of the said Act and for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of 30 days from the date on which it is published in the Bihar Gazette.
2. The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid shall be considered by the State Government.
3. Objections and suggestions, if any, may be sent to the Secretary, Transport Department, Vishweshwarayia Bhawan, Bailey Road, Patna.

1. Short title, extent and commencement.—(1) These Rules may be called the Bihar Motor Vehicle (Amendment) Rules, 2010
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force at once.
2. The words "State Transport Commissioner, Bihar" used in Rules 163F(3) and 163G(4) of the said Rules, 1992 shall be substituted by the words "District Transport Officer"
3. The words "State Transport Commissioner, Bihar, Patna" used in Rule-163G- 4(e) of the said rules, 1992 shall be substituted by the words "concerned District Transport Officer"
4. The words "Secretary, Department of Transport" used in Rule-163G-(1) of the said Rules, 1992 shall be substituted by the words "State Transport Commissioner". 5. The words "Bihar, Patna" mentioned after the words "Licence Authority" in Forms LTS A and LTS R of the said Rules, 1992 are hereby omitted.
