24 जनवरी 2011 सं0 3ए-5-से0नि-10/2008(अंश)-682वि0(2)—भारतीय संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल एतद्‌द्वारा बिहार सेवा संहिता 1952 में निम्नलिखित संशोधन करते हैं :-

बिहार सेवा (संशोधन) संहिता-2010

1. संक्षिप्त नाम एवं प्रारम्भ- (1) यह बिहार सेवा (संशोधन) संहिता 2010 कही जा सकेगी । (2) यह तुरंत के प्रभाव से प्रवृत्त होगी । 2. बिहार सेवा संहिता के नियम-73 के उप-नियम (1) के विद्यमान परंतुकों के बाद निम्नलिखित चतुर्थ परन्तुक जोड़ा जाएगा-

''परन्तु और भी कि बिहार चिकित्सा शिक्षा सेवा के चिकित्सा पदाधिकारी, की बार्धक्य सेवा निवृति उस माह की अंतिम तिथि को अपराह्‌न में होगी जिस माह में वह 65 वर्ष की आयुपूरी कर लेता है, किन्तु यदि किसी माह की पहली तिथि को उनकी जन्म तिथि है, तो वे उसके ठीक पहले के माह की अंतिम तिथि के अपराह्‌न में सेवा-निवृत्त होंगे । बिहार-राज्यपाल के आदेश से, मदन मोहन प्रसाद, विशेष सचिव। 2 (cid:18)बहार गजट (असाधारण), 24 जनवर(cid:15) 2011 The 24th January 2011 No. 3A-5.S.R.-10/2008(Part)-682/F.(2)—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, the Governor of Bihar hereby makes the following amendment in Bihar Service Code, 1952:-

Bihar Service (Amendment) Code 2010

1. Short title and Commencement- (1) This may be called Bihar Service (Amendment) Code 2010.

(2) It shall come into force with immediate effect. 2. The following Fourthproviso shall be added after the exiting proviso to sub-rule (1) of Rule 73 of Bihar service code –"Provided further also that the date of retirement of the Doctors of Bihar Medical Education Service, shall be the afternoon of the last day of the month in which he attains the age of 65 year. But if his date of birth is the first day of a month then the date of retirement shall be the afternoon of the last day of the penultimate month.
