सं॰ 15/वि.स.से.-02-02/2008-45-सा0प्र0—बिहार सचिवालय सेवा अधिनियम 2007 (बिहार अधिनियम-03/2008) की धारा-19 की उप-धारा (1) में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार सरकार बिहार सचिवालय सेवा नियमावली-2010 में बिहार सचिवालय सेवा के विभिन्न स्तर के पदों पर प्रोन्नति हेतु गठित प्रोन्नति समिति से सम्बन्धित प्रावधान में संशोधन करने हेतु निम्नलिखित नियमावली बनाती है :-
1. संक्षिप्त नाम,विस्तार एवं प्रभाग ।
(i) यह नियमावली ''बिहार सचिवालय सेवा (संशोधन) नियमावली 2011'' कही जा सकेगी । (ii) इनका विस्तार राज्य सरकार के सचिवालय के विभागों तथा संलग्न कार्यालयों तक सीमित रहेगा।
(iii) यह तुरंत प्रवृत्त होगी ।
2. बिहार सचिवालय सेवा नियमावली 2010 के नियम11(3),12 (3)एवं 13(3) को विलोपित करते हुए निम्न वाक्यांश द्वारा प्रतिस्थापित किया जाता है । 11(3). प्रशाखा पदाधिकारी के गे्रड का 80 प्रतिशत पदों को सहायक ग्रेड से प्रोन्नति द्वारा भरे जाने हेतु विचार कर अनुश्ांसा करने के लिए विभागीय प्रोन्नति समिति में निम्नलिखित सदस्य रहेंगे :-
- सदस्य (क) प्रधान सचिव/सचिव, सामान्य प्रशासन विभाग अथवा उनके द्वारा नामित संयुक्त सचिव से अन्यून स्तर के पदाधिकारी - अध्यक्ष (ख) वित्त विभाग के संयुक्त सचिव से अन्यून स्तर के पदाधिकारी - सदस्य (ग) सामान्य प्रशासन विभाग के सचिवालय सेवा के स्थापना के वरीय प्रभारी पदाधिकारी (घ) सामान्य प्रशासन विभाग द्वारा नामित अनूसूचित जाति/अनुसूचित जनजाति के पदाधिकारी
- सदस्य2 (cid:18)बहार गजट (असाधारण), 2 फरवर(cid:15) 2011 12(3). प्रशाखा पदाधिकारी के ग्रेड से अवर सचिव के ग्रेड में प्रोन्नति हेतु विचार कर अनुशंसा करने के लिए विभागीय प्रोन्नति समिति में निम्नलिखित सदस्य रहेंगे :-
(क) प्रधान सचिव/सचिव, सामान्य प्रशासन विभाग - अध्यक्ष (ख) वित्त विभाग के संयुक्त सचिव से अन्यून स्तर के पदाधिकारी - सदस्य (ग) सामान्य प्रशासन विभाग के सचिवालय सेवा के स्थापना के वरीय प्रभारी पदाधिकारी - सदस्य (घ) सामान्य प्रशासन विभाग द्वारा नामित अनूसूचित जाति/ अनुसूचित जनजाति के पदाधिकारी - सदस्य 13(3). अवर सचिव के ग्रेड से उप-सचिव के ग्रेड में प्रोन्नति हेतु विचार कर अनुशंसा करने के लिए विभागीय प्रोन्नति समिति में निम्नलिखित सदस्य रहेंगे :-
(क) सदस्य, राजस्व पर्षद - अध्यक्ष (ख) प्रधान सचिव/सचिव, सामान्य प्रशासन विभाग - सदस्य (ग) वित्त विभाग के संयुक्त सचिव से अन्यून स्तर के पदाधिकारी - सदस्य (घ) सामान्य प्रशासन विभाग के सचिवालय सेवा के स्थापना के वरीय प्रभारी पदाधिकारी - सदस्य (च) सामान्य प्रशासन विभाग द्वारा नामित अनूसूचित जाति/ अनुसूचित जनजाति के पदाधिकारी - सदस्य
उप-सचिव के पद से निदेशक (संयुक्त सचिव स्तर के) के पद पर प्रोन्नति के संदर्भ में बिहार लोक सेवा आयोग (कार्य सीमन) विनियमावली 1957 के प्रावधान-7 के आलोक में विभाग के द्वारा कार्रवाई की जाएगी । 3. बिहार सचिवालय सेवा नियमावली, 2010 के शेष प्रावधान यथावत् लागू रहेंगे ।

सं॰ 15/बि.स.से.-02-02/2008-46-सा॰प्र॰/अधिसूचना संख्या 45. दिनांक 5 जनवरी 2011 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है जो भारत संविधान के अनुच्छेद 348 के खंड (3) के अधीन उक्त अधिसूचना का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

ÑÑÑÑÑÑÑÑÑÑÑÑ The 5th January 2011 No.- 15 BSS- 02-02/2008-45— In exercise of the power conferred by sub rule (1) of Rule 19 of Bihar Secretariat Service Act 2007 (Bihar Act-03/2008), the Government of Bihar is pleased to make the following Rules for promotion to the different posts of Bihar Secretariat assistant Service by amending the provisions of promotion committee constituted for promotion under Bihar Secretariate Rules 2010.
1. Short Title, Extension & Commencement. – (1) These Rules shall be called the Bihar Secretariat Service (amendment) Rules 2011.
(2) It shall extend to the departments of Secretariat of Govt. of Bihar and its attached offices.
(3) These Rules shall come into force immediately. 2. The Rule 11(3), 12(3), 13(3) of Bihar Secretariat Service Rules 2010 is hereby repealed and substituted by following proviso:-
- Chairman 11(3) There shall be a Departmental Promotion Committee with following members to recommend to fill up the 80% post of Section officers by promotion from the grade of Assistants. The promotion from the grade of Deputy Secretary to the grade of Director (Joint Secretary level) shall be considered in accordance with the provision laid down in the proviso 7 of Bihar Public Service Commission (limitation) Rules 1957 as amended in 2003.
3. The rest of the provision of Bihar Secretariat Service Rules 2010 shall remain applicable.
