निर्वाचन सदन , अषोक रोड , नई दिल्ली-110001. दिनांकः 28 फरवरी, 2011/फाल्गुन 9, 1932 (षक)

सं0 100/बिहार-वि.प./1/2010 (1) ः- यत्‌ः बिहार राज्य की विधान-सभा के सदस्यों द्वारा विधान परिशद्‌ के लिए निर्वाचित श्री रामधनी सिंह का स्थान, जिनकी पदावधि 06 मई, 2014 को सम्मिलित करते हुए उस तारीख तक थी, के समाप्त होने से पूर्व ही उनके त्याग-पत्र दिये जाने के कारण दिनांक 1 अक्तूबर, 2010 से रिक्त हो गया है ; और

यतः, इस प्रकार हुई रिक्ति को भरने केे प्रयोजन से उप-निर्वाचन कराना है ;

अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-151, धारा-39 की उप-धारा (1) और धारा-56 के अनुसरण में, भारत निर्वाचन आयोग एतद्‌द्वारा :-

(अ) बिहार राज्य की विधान-सभा के सदस्यों से यह अपेक्षा करता हैं कि वे 21 मार्च, 2011 (सोमवार) से पूर्व तथा उक्त अधिनियम और तद्‌धीन बनाए गए नियमों और किए गए आदेषों के उपबन्धों के अनुसार राज्य की विधान परिशद्‌ में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दें ;

(आ) उक्त निर्वाचन के संबंध में :-

(क) नाम निर्देषन करने की अन्तिम तारीख - 7 मार्च, 2011 (सोमवार)

(ख) नाम निर्देषन की संवीक्षा की तारीख - 8 मार्च, 2011 (मंगलवार)

(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख- 10 मार्च, 2011 (गुरूवार)

(घ) वह तारीख, जिसको यदि आवष्यक हुआ तो मतदान होगा, और 17 मार्च, 2011 (गुरूवार)

(ड़) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा 21 मार्च, 2011 (सोमवार)

नियत करता है ; और

(इ) 9.00 बजे पूर्वाहन्‌ से 4.00 बजे अपराह्‌न तक का समय, ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवष्यक हुआ है तो, निर्वाचन के लिए उपर्युक्त विनिर्दिश्ट तारीख को, मतदान होगा ।

No.100/BR-LC/1/2010(1) :- WHEREAS, the seat of Shri Ramdhani Singh, in the Legislative Council of the State of Bihar, elected by the members of the Legislative Assembly of the State, has become vacant on 1st October, 2010, by the reason of his3 (cid:18)बहार गजट (असाधारण), 28 फरवर(cid:15) 2011 resignation, before the expiration of his term of office which was upto and including the 6th May, 2014; and

WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;

NOW, THEREFORE, in pursuance of section 151, sub-section (1) of section 39 and section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby-

(A) calls upon the members of the Legislative Assembly of the State of Bihar to elect, before 21st March, 2011 (Monday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Legislative Council of the State;

(B) Appoints with respect to said election,-

(a) the 7th March, 2011 (Monday) as the last date for making nominations;

(b) the 8th March, 2011 (Tuesday), as the date for the scrutiny of the nominations;

(c) the 10th March, 2011 (Thursday), as the last date for the withdrawal of candidatures;

(d) the 17th March, 2011 (Thursday), as the date on which a poll shall, if necessary, be taken; and

(e) the 21st March, 2011 (Monday), as the date before which the election shall be completed; and

(C) fixes the hours from 9.00 A.M to 4.00 P.M, as the hours during which the poll shall, if necessary, be taken on the date specified above, for the election.

सं0 100/बिहार-वि.प./1/2010 (2) :- लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-21 के अनुसरण में और धारा-22 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग, बिहार राज्य सरकार के परामर्ष से तारीख 28 फरवरी, 2011 को राज्य के शासकीय राजपत्र में प्रकाषित आयोग की अधिसूचना के अनुसरण में इस राज्य की विधान सभा के सदस्यों द्वारा बिहार राज्य की विधान परिशद के लिए होने वाले उप निर्वाचनों के संबंध में, एतद्‌द्वारा :-

(I) नीचे की सारणी के स्तम्भ (1) में विनिर्दिश्ट अधिकारी को रिटर्निग आफिसर के रुप में पदाभिहित करता है ; और

(II) उक्त सारण्ाीं के स्तम्भ (2) में विनिर्दिश्ट अधिकारी को, रिटर्निंग आफिसर की उसके क्‌त्यांें के पालन में सहायता के लिए सहायक रिटर्निंग ऑफिसर नियुक्त करता है ।
