अध्याय-1

1. संक्षिप्त शीर्षक, विस्तार तथा प्रारम्भ ।-(i) यह नियमावली बिहार कृषि भूमि (गैर कृषि प्रयोजनों के लिए सम्परिवर्तन) नियमावली, 2011 कही जाएगी।

(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह तुरंत प्रवृत्त होगी।

2. परिभाषाएँ ।- इस अधिनियम में, जबतक कोई बात विषय या संदर्भ में विरूद्ध न हो,

(क) "नियमावली" से अभिप्रेत है बिहार कृषि भूमि (गैर कृषि प्रयोजनों के लिए सम्परिवर्तन) नियमावली, 2011 ;

(ख) "अधिनियम" से अभिप्रेत है बिहार कृषि भूमि (गैर कृषि प्रयोजनों के लिए सम्परिवर्तन) अधिनियम, 2010 ;

(ग) "धारा" से अभिप्रेत है बिहार कृषि भूमि (गैर कृषि प्रयोजनों के लिए सम्परिवर्तन) अधिनियम, 2010 की धारा ;

(घ) "कृषि भूमि" से अभिप्रेत है कृषि एवं सहबद्ध क्रियाकलापों के लिए प्रयुक्त भूमि ; (ड़) "सम्परिवर्तन" से अभिप्रेत है कृषि से गैर कृषि प्रयोजन के लिए भूमि-उपयोग में परिवर्तन ; (च) "सम्परिवर्तन फीस" में अभिप्रेत सम्बन्धित परिस्थितियों में लागू होने योग्य फीस शामिल है ; (छ) "गैर कृषि भूमि" से अभिप्रेत है कृषि-भूमि से भिन्न भूमि ; (ज) "सरकार" से अभिप्रेत है बिहार सरकार ; (झ) "समाहर्त्ता" से अभिप्रेत है जिला समाहर्त्ता, जिसके क्षेत्राधिकार में सम्परिवर्तन के लिए आवेदित कृषि भूमि अवस्थित हो तथा इसमें इस अधिनियम के अधीन जिला समाहर्त्ता की शक्तियों का2 (cid:18)बहार गजट (असाधारण), 16 माच/ 2011 प्रयोग तथा कृत्यों का निर्वहन करने हेतु सरकार द्वारा प्राधिकृत कोई अन्य अधिकारी भी सम्मिलित है ;

() "सक्षम प्राधिकार" से अभिप्रेत है अनुमंडल पदाधिकारी, जिसके क्षेत्राधिकार में सम्बन्धित कृषि-भूमि या उसका भाग अवस्थित हो ;

(ट) "विहित प्रक्रिया" से अभिप्रेत है इस नियमावली द्वारा अथवा सरकार द्वारा किये गए आदेश द्वारा विहित प्रक्रिया ;

(ठ) "अधिसूचना" से अभिप्रेत है बिहार राजपत्र में प्रकाशित अधिसूचना तथा शब्द "अधिसूचित" तदनुसार समझा जायेगा ;

(ड) "अधिभोगी" में सम्मिलित हैं :-

(i) कोई व्यक्ति, भूमि अथवा उसके ऊपर निर्मित संरचना के लिए तत्समय लगान या लगान के अंश का भुगतान कर रहा हो या भुगतान के लिए उत्तरदायी हो ;

(ii) लगान-मुक्त अधिभोगी।

(ट) "स्वामी" में सम्मिलित है कोई व्यक्ति, जो तत्समय अपने लेखा में या किसी अन्य व्यक्ति के एजेन्ट, ट्रस्टी, अभिभावक, प्रबन्धक या प्राप्तकर्ता के रूप में, या किसी धार्मिक, शैक्षणिक या दातव्य प्रयोजन से, कृषि भूमि या वैसी भूमि पर निर्मित संरचना के लिए लगान या मुनाफा ले रहा हो, या लेने का हकदार हो तथा इसमें निम्नलिखित भी सम्मिलित हैं, जिन्हें राज्य सरकार या केन्द्र सरकार के द्वारा भूमि लीज पर दी गयी हैः- (i) कोई लीजधारी, यदि सरकार द्वारा उसे भूमि गैर कृषि प्रयोजनार्थ लीज पर दी गयी हो तथा उसे उससे आय प्राप्त हो रही हो ;

(ii) कोई स्थानीय प्राधिकार, यदि भूमि स्थानीय प्राधिकार में निहित हो तथा उससे आय प्राप्त करने हेतु गैर कृषि प्रयोजनार्थ उपयोग में लायी गयी हो।

(ठ) " बाजार मूल्य" से अभिप्रेत है भारतीय स्टाम्प अधिनियम, 1899 के प्रावधानों के अधीन समाहर्त्ता द्वारा यथा अवधारित कृषि भूमि का मूल्य।

3. सम्परिवर्तन के लिए आवेदन ।- गैर कृषि प्रयोजन के लिए कृषि भूमि के सम्परिवर्तन हेतु आवेदन सक्षम प्राधिकार के समक्ष, अधिनियम की धारा-4 (1) में विनिर्दिष्ट सम्परिवर्तन फीस के साथ, प्रपत्र-1 में दिया जा सकेगा।

4. अन्तर राशि भुगतान हेतु सूचना ।- यदि अधिनियम की धारा 3 की उप-धारा (2) के तहत भुगतान किया गया सम्परिवर्तन फीस, विहित फीस से कम पाया गया है, तो सक्षम प्राधिकार द्वारा आवेदक को, आवेदन प्राप्ति के 30 दिनों के भीतर अन्तर राशि के भुगतान हेतु प्रपत्र संख्या-2 में एक सूचना निर्गत की जाएगी। यदि आवेदक अधिनियम की धारा 3 की उप-धारा (3) में विनिर्दिष्ट अन्तर राशि को ऐसी सूचना प्राप्ति के 30 दिनों के भीतर जमा नहीं करने की दशा में, सक्षम प्राधिकार आवेदक को एक द्वितीय सूचना निर्गत करेगा जिसमें उसे सूचना प्राप्ति के 15 दिनों के भीतर अन्तर राशि जमा करने का निदेश देगा। यदि आवेदक निदेश का अनुपालन करने में विफल रहता है तब उसका आवेदन नामंजूर करने का दायी होगा।

5. कतिपय मामलों में सम्परिवर्तन के लिए आवेदन ।- यदि बिहार अधिनियम 21,1993 के प्रवृत्त होने के बाद तथा इस अधिनियम के प्रारम्भ होने के पूर्व सम्परिवर्तन किया गया है, तो सम्परिवर्तन के लिए उत्तरदायी व्यक्ति के लिए अनिवार्य होगा कि सक्षम प्राधिकार के समक्ष प्रपत्र-3 में इस अधिनियम के प्रवृत्त होने की तिथि के 6 महीनों की अवधि के भीतर सम्परिवर्तन के तथ्य का उल्लेख करते हुए अधिनियम की धारा 4 (1) में उपबन्धित सम्परिवर्तन फीस तथा सम्बन्धित भूमि के अद्यतन बाजार मूल्य का 1 % अतिरिक्त फीस के साथ आवेदन करे, जिसमेें विफल रहने पर सक्षम प्राधिकार अधिनियम की धारा 6 के अनुसार कार्रवाई करेगा।

6. सक्षम प्राधिकार से वांछित अनुमति की अप्राप्ति की स्थिति में उसके समक्ष आवेदन ।- अधिनियम की धारा 3 की उप-धारा (7) में सन्दर्भ में आवेदन प्रपत्र-4 में दिए जा सकेंगे ।

7. अनधिकृत सम्परिवर्तन के लिए शास्ति ।- अधिनियम की धारा 6 की उप-धारा (1) के प्रसंग में सक्षम प्राधिकारी अनधिकृत सम्परिवर्तन के लिए उत्तरदायी व्यक्ति को कारण पृच्छा हेतु प्रपत्र-5 (क) में सूचना निर्गत करेगा।

सक्षम प्राधिकार, यदि उसका समाधान हो जाय कि गैर कृषि हेतु सम्परिवर्तन अनधिकृत है तथा अधिनियम की धारा-3 के अधीन सक्षम प्राधिकार की वांछित अनुमति के बिना किया गया है, उक्त अनधिकृत सम्परिवर्तन के लिए उत्तरदायी व्यक्ति के विरूद्ध सम्परिवर्तन फीस की 50 % शास्ति प्रपत्र-5 (ख) में अधिरोपित करेगा जो सम्परिवर्तन हेतु अधिनियम की धारा-4 (1) में विनिर्दिष्ट सम्परिवर्तन फीस के अतिरिक्त होगा।3 (cid:18)बहार गजट (असाधारण), 16 माच/ 2011 8. सम्परिवर्तन फीस के भुगतान से उन्मुक्ति के लिए आवेदन ।- अधिनियम की धारा-7 की उप-धारा (1) के सन्दर्भ में सम्परिवर्तन फीस के भुगतान से उन्मुक्ति के लिए आवेदन-पत्र प्रपत्र 6 में दिया जायगा।

9. सक्षम प्राधिकार, यदि उसका समाधान हो जाय कि विनिर्दिष्ट सम्परिवर्तन फीस, शास्ति एवं अतिरिक्त फीस के साथ, यदि आवश्यक हो, जमा कर दिया गया है तथा अधिनियम के किसी प्रावधान का उल्लंघन नहीं करता है, आवेदित भूमि के संदर्भ में कृषि से गैर कृषि प्रयोजन के लिए सम्परिवर्तन की अनुमति प्रपत्र-7 में प्रदान करेगा।

10. अपील एवं पुनरीक्षण की प्रक्रिया ।- अधिनियम की धारा 9 के अधीन अपील एवं पुनरीक्षण की सुनवाई तथा निष्पादन यथासंभव सिविल प्रक्रिया संहिता, 1908 (अधिनियम 5, 1908) में दी गयी प्रक्रिया के अनुसार किया जाएगा।

जिला.....................................का निवासी हूँ। मैं अपनी कृषि भूमि जिसका पूर्ण विवरण निम्नवत है का उपयोग कृषि एवं सहबद्ध क्रियाकलापों से भिन्न प्रयोजन के लिए करना चाहता हूँ। आवेदित भूमि एवं प्रस्तावित भूमि उपयोग बिहार कृषि भूमि (गैर कृषि प्रयोजनों के लिए सम्परिवर्तन) अधिनियम, 2010 की धारा-8 में वर्णित भूमि एवं भूमि उपयोग जिसके लिए सम्परिवर्तन की अनुमति अनपेक्षित है, से भिन्न है।

मैं आवेदित कृषि भूमि के सम्परिवर्तन के लिए इस अधिनियम की धारा-4 उप-धारा (1) में सम्परिवर्तन हेतु विनिर्दिष्ट सम्परिवर्तन फीस जमा कर रहा हूँ। साथ ही मैं आवेदित भूमि के लिए इस अधिनियम की धारा 4 उप-धारा (2) में विनिर्दिष्ट दर से वार्षिक लगान/सेस अदा करने के लिए तैयार हूँ।

अतः अनुरोध है कि मेरी निम्न वर्णित कृषि भूमि को बिहार कृषि भूमि (गैर कृषि प्रयोजनों के लिए सम्परिवर्तन) अधिनियम, 2010 की धारा 3 उप-धारा (6) के अन्तर्गत गैर कृषि प्रयोजन के लिए सम्परिवर्तन की अनुमति देने की कृपा की जाय।

The Bihar Agriculture Land (Conversion for Non Agriculture Purposes) Rules, 2011

No. 8/नियम संशोधन 08-09/09-244(8) Ra.—In exercise of the powers conferred by Section 15 of the Bihar Agriculture Land (Conversion for Non Agriculture Purposes) Act, 2010, (Bihar Act 11 of 2010), the Governor of Bihar is pleased to make the following rules under the said Act:-

CHAPTER-I

1. Short title, extent and commencement.-(i) These Rules shall be called the Bihar Agriculture Land (Conversion for Non Agriculture Purposes) Rules, 2011.

(ii) It shall extend to the whole of the State of Bihar. (iii) They shall come into force immediately. 2. Definition.- In these Rules, unless there is any thing repugnant in the subject or context requires.- (a) "Rules" means the Bihar Agriculture Land (Conversion for Non Agriculture Purposes) Rules, 2011 ;

(b) "Act" means the Bihar Agriculture Land (Conversion for Non Agriculture Purposes), Act, 2010 ;

(c) "Section" means the section of the Bihar Agriculture Land (Conversion for Non Agriculture Purposes), Act, 2010 ;

(d) "Agriculture land" means land used for agriculture and allied activities ; (e) "Conversion" means change of land use from agriculture to non-agriculture purpose ;

(f) "Conversion fee" connotes fee as applicable in related circumstances ; (g) "Non-agriculture land" means land other than agriculture land ; (h) "Government" means the Government of Bihar ; (i) "Collector" means the District Collector in whose jurisdiction the agriculture land for which conversion is applied for is situate and also includes any other officer authorized by the Government to exercise the powers and perform the functions of the District Collector under this Act ;

(j) "Competent Authority" means the Sub-Divisional Officer in whose jurisdiction the concerning agriculture land or a part thereof is situate ;

(k) "Prescribed Procedure" means procedure prescribed by Rules or by government order made by the Government under this Act ;

(l) "Notification" means a notification published in the Bihar Gazette and the word "Notified" shall be construed accordingly ;

(m) "Occupier" includes: (i) any person for the time being paying or liable to pay the rent, or any portion of the rent, for the land or, for the structure constructed thereon ;

(ii) a rent-free occupant. (n) "Owner" includes any person for the time being receiving or entitled to receive, whether on his own account, or as an agent, trustee, guardian, manager or receiver, for another person, or for any religious, educational or charitable purpose, rent or profits for the agriculture land or for the structure constructed on such land and includes the following to whom the land have leased out by the State Government or the Central Government:-

(i) A lessee, if the land has been leased out by the Government for any non- agriculture purpose deriving income therefrom ;

(ii) a local authority, if the land is vested in the local authority and used for any non-agriculture purpose deriving income therefrom. (o) "Market Value" means value of the agriculture land as determined by the Collector under the provisions of the Indian Stamp Act, 1899.

3. Application for conversion.—An application for conversion of the agriculture land for non-agriculture purpose shall be made before the competent authority in Form 1 alongwith conversion fee as specified under section 4 (1) of the Act.

4. Notice for payment of difference amount.—If the conversion fee so paid as per sub- section (2) of section 3 of the Act is found to be less than the fee prescribed, then a notice in Form 2 shall be issued by the competent authority to the applicant under section 3(3) of the Act for payment of difference amount within 30 days of the receipt of the application. In case the applicant does not deposit the difference amount indicated in the sub- section (3) of section 3 of the Act, within 30 days of the receipt of such notice, the competent authority shall issue a second notice to the applicant directing him therein to deposit the difference amount within 15 days of the receipt of notice. If the applicant fails to comply with the direction, his application is liable to be rejected.

5. Application for conversion in certain cases.—In case the conversion has been made after the coming into force of the Bihar Act 21 of 1993 and prior to the commencement of this Act, it will be incumbent on the person responsible for the conversion to apply to the competent authority in Form 3 stating therein the fact of the said conversion within a period of 6 months from the date of the commencement of this Act along with conversion fee provided in Section 4(1) of the Act, and alongwith an additional conversion fee of 1% of the current market value of the land concerned, failing which the competent authority shall proceed in accordance with section 6 of the Act.

6. Application to the competent authority in case of non-receipt of the desired permission by him.—Application, with reference to sub section (7) of Section 3 of the Act may be made in Form 4.

7. Penalty for unauthorised conversion.—The competent authority with reference to sub- section (1) of Section 6 of the Act, shall issue notice for show cause to the person responsible for unauthorised conversion in Form 5 (a). The competent authority, if he is satisfied that the conversion for non agriculture purpose is unauthorised and is without the requisite permission of competent authority under Section 3 of the Act, will impose a penalty of 50% of the conversion fee over and above the conversion fee specified in section 4 (1) of the Act on the person responsible for such unauthorised conversion in Form-5(b). 8. Application for exemption from payment of conversion fee.—Application for exemption from the payment of conversion fee, with reference to sub section (1) of Section 7 of the Act, shall be made in Form 6. 9. The competent authority will grant permission for conversion from agriculture to non agriculture purpose in respect of the land applied for in Form -7, if he is satisfied that the prescribed conversion fee has been deposited alongwith penalty or additional conversion fee, if required, and does not contravene any provision of the Act. 10. Procedure of appeal and revision—The hearing and disposal of an appeal and revision under Section 9 of the Act, shall be made as far as possible as per the procedure laid down in Civil Procedure Code ,1908 (Act 5, 1908).
