सं0 9/विविध-14-50/2010-सा0प्र0-3499—भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु निम्नांकित संशोधन नियमावली बनाते हैंः-

1. संक्षिप्त नाम एवं प्रारम्भ।-(1) यह नियमावली ''बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति (संशोधन) नियमावली, 2011'' कही जा सकेगी।

(2) यह तुरत प्रवृत्त होगी।

2. बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2009 के नियम 2 (vii) एवं 3 (ii) (क) में शब्द ''स्पेशल ओलंपिक'' के स्थान पर शब्द ''पारा ओलंपिक'' प्रतिस्थापित किये जायेंगे।

3. नियमावली के नियम 3 (ii) (घ) के बाद में निम्नलिखित जोड़े जायेंगे ।-

(ङ) नेशनल गेम/नेशनल सीनियर चैम्पियनशीप में बिहार राज्य का प्रतिनिधित्व किया हो। (च) नेशनल गेम के वैसे खेल विधा, जो नियम 2 (vi) के अधीन परिभाषित नहीं हैं, में बिहार राज्य का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त किया हो।

4. नियमावली, 2009 के नियम 4.7 में वाक्य ''निर्धारित शैक्षणिक अर्हता प्राप्त उत्कृष्ट खिलाड़ी की नियुक्ति, चयन समिति की अनुशंसा के आधार पर कार्मिक एवं प्रशासनिक सुधार विभाग द्वारा समूह 'ग' के पदों पर की जायेगी'' के स्थान पर वाक्य ''निर्धारित शैक्षणिक अर्हता प्राप्त एवं खेल विधा संबंधी अपेक्षित अर्हता प्राप्त उत्कृष्ट खिलाड़ी की नियुक्ति, चयन समिति की अनुशंसा के आधार पर संबंधित नियुक्ति प्राधिकार के द्वारा समूह 'ग' के विभिन्न पदों पर की जायेगी'' प्रतिस्थापित किया जायेगा।

5. नियमावली, 2009 के नियम 4.8 में वाक्य ''किसी खेल विधा में, एक वर्ष में तीन से अधिक उत्कृष्ट खिलाड़ियों की नियुक्ति नहीं की जायेगी, के स्थान पर वाक्य ''किसी खेल विधा में एक वर्ष में पाँच से अधिक उत्कृष्ट खिलाड़ियों की नियुक्ति नहीं की जायेगी, जो किसी संवर्ग के कुल बल (मूल कोटि) के 10% के अन्तर्गत होगा'' प्रतिस्थापित किया जायेगा। इस हेतु सभी संवर्गीय नियमावली इस हद तक संशोधित समझे जायेंगे। 6. बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2009 की अनुसूची-। को संशोधित (संशोधित अनुसूची-। संलग्न) करते हुए क्रमांक 13, 14, 15, 16, 17 एवं 18 निम्नलिखित द्वारा क्रमशः प्रतिस्थापित एवं जोड़े जायेंगे :-

(15) नेशनल गेम के वैसे खेल विधा जो नियम 2 (vi) के अन्तर्गत परिभाषित नहीं है, में बिहार राज्य का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

(16) राष्ट्रीय स्तर में नेशनल जूनियर चैम्पियनशीप में राज्य का प्रतिनिधित्व करते हुए टीम/व्यक्तिगत स्पर्द्धा में प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

(17) राष्ट्रीय स्तर पर नेशनल गेम/नेशनल सीनियर चैम्पियनशीप में बिहार राज्य का प्रतिनिधित्व करने वाले खिलाड़ी।

(18) ऑल इण्डिया इंटर युनिवर्सिटी टूर्नामेंट में विश्वविद्यालय का प्रतिनिधित्व करते हुए व्यक्तिगत/टीम स्पर्द्धा में प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

1. ओलम्पिक खेल में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

2. विश्व कप में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

3. वल्र्ड यूनिवर्सिटी गेम में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी। 4. कॉमनवेल्थ गेम्स में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

5. एफ्रो एशियन गेम्स में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी। 6. एशियन गेम्स में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

7. एशियन चैम्पियनशिप में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी। 8. ओलम्पिक में भारत का प्रतिनिधित्व करने वाले खिलाड़ी।

9. कॉमनवेल्थ गेम में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी।

10. एफ्रो एशियन गेम्स में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी।

11. एशियन गेम में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी।

12. सैफ गेम में भारत का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

13. अन्य मान्यताप्राप्त अंतराष्ट्रीय गेम में भारत का प्रतिनिधित्व करनेवाले खिलाड़ी।

14. राष्ट्रीय स्तर में नेशनल गेम, नेशनल सीनियर चैम्पियनशीप में राज्य का प्रतिनिधित्व करते हुए टीम/व्यक्तिगत स्पर्द्धा में प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

15. नेशनल गेम में वैसे खेल विधा जो नियम-2(vi) के अंतर्गत परिभाषित नहीं है, में बिहार राज्य का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

16. राष्ट्रीय स्तर में नेशनल जूनियर चैम्पियनशीप में राज्य का प्रतिनिधित्व करते हुए टीम/व्यक्तिगत स्पर्द्धा में प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।3 (cid:18)बहार गजट (असाधारण), 1 अूील 2011 17. राष्ट्रीय स्तर पर नेशनल गेम/नेशनल सीनियर चैम्पियनशीप में बिहार राज्य का प्रतिनिधित्व करने वाले खिलाड़ी। 18. ऑल इण्डिया इंटर यूनिवर्सिटी टूर्नामेंट में विश्वविद्यालय का प्रतिनिधित्व करते हुए व्यक्तिगत/टीम स्पर्द्धा में प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त खिलाड़ी।

सं0 9/विविध-14-50/2010सा0प्र0 3500/अधिसूचना सं0 3499, दिनांक 30 मार्च 2011 के तहत निर्गत बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति (संशोधन) नियमावली, 2011 का निम्नलिखित अंग्रेजी अनुवाद, बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारत-संविधान के अनुच्छेछ 348 के खंड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

No. 9/misc.-14-50/2010GA-3499—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar makes the following amendment rules for appointment of outstanding sports persons :-

1. Short title and commencement:—(1) These Rules may be called "The Bihar Outstanding Sport Persons Appointment (Amendment) Rules, 2011.

(2) It shall come into force at once. 2. In rule 2 (vii) and 3 (ii) (a) of the Bihar Outstanding Sport Persons Appointment Rules, 2009 the terms "Para Olympic" shall be substituted in place of terms "Special Olympic".

3. After rule 3 (ii) (d) of Rules following shall be added:- (e) has represented the State of Bihar in National Games/ National Senior Championship.

(f) has secured first, second and third position by representing the state of Bihar in the sports discipline of National Games which are not defined under rule 2(vi).

4. The sentence "The appointment on different posts of group "C" of outstanding sport persons on the basis of recommendation of selection Committee having prescribed educational qualification and requisite qualification with respect to sports discipline shall be made by the concerned appointing authority of rule 4.7 of the Bihar Outstanding Sport Persons Appointment Rules, 2009" shall be substituted in place of the sentence "The outstanding sport person having prescribed qualification and requisite qualification with respect to sports decipline shall be appointed on group "C" posts by the Personnel and Administrative Reforms Department on the basis of recommendation of the Selection Committee" of the Rules 2009.

5. The Sentence "Not more than five outstanding sportspersons shall be appointed in a year in any sports discipline, which will be under 10% of total strength (basic grade) of any cadre" shall be substituted in place of clause "Not more than three outstanding sportspersons shall be appointed in a year in any sports discipline" in rule 4.8 of the Rules 2009. For this purpose all cadre rules shall be amended to this extent.

6. By amending serial Nos. 13, 14, 15, 16, 17 and 18 of annexure- I (amended annexure-I attached) of the Bihar Outstanding Sport Persons Appointment Rules, 2009 shall be substituted and added by the following respectively :-

(13) The sport persons by representing India in other recognized International Games.

(14) The sports persons having secured First, Second and third position in the Team/Individual Competition by representing State in National Games/National Senior Championship at national level.

(16) The sports persons having secured First, Second and third position in the Team/Individual Competition by representing State in National Games/National Junior Championship at national level.

(17) The sports persons representing the State of Bihar in National Games/National Senior Championship at national level.

(18) The sports persons having secured First, Second and third position in the Team/Individual Competition by representing University in All India Inter University Tournament.

2. The sportpersons having secured First, Second and Third position in the World Cup by representing India.

3. The sportpersons having secured First, Second and Third position in the World University Games by representing India.

4. The sportpersons having secured First, Second and Third position in the Commonwealth Games by representing India.

5. The sportpersons having secured First, Second and Third position in the Afroasian Games by representing India.

6. The sportpersons having secured First, Second and Third position in the Asian Games by representing India.

7. The sportpersons having secured First, Second and Third position in the Asian Championship by representing India.

8. The sportpersons having representing India in Olympic.

9. The sportpersons having representing India in Commonwealth Games.

10. The sportpersons having representing India in Afroasian Games.

11. The sportpersons having representing India in Asian Games.

12. The sportpersons having secured First, Second and Third position in the SAF Games by representing India.
