सं0 बी1-3-39/2011-21—विधि और न्याय मंत्रालय (विधायी विभाग) भारत सरकार द्वारा प्रवासी निर्वाचकों का नाम निर्वाचक सूची में निबंधित किये जाने हेतु निर्वाचक रजिस्ट्रीकरण नियम 1960 यथा संषोधित 2011 के नियम 8ख (8B) में किये गये संषोधनों के आलोक में बिहार गजट के असाधारण अंक सं0 80 दिनांक 24 मार्च 2011 में नियम 8क (8A) के अंतर्गत प्रकाषित अधिसूचना सं0 बी1-3-39/2011-18, दिनांक 23 मार्च 2011 को तदनुसार संषोधित करते हुये सर्वसाधारण की जानकारी के लिये हिन्दी व अंग्रेजी में प्रकाषित किया जाता है।

निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 8ए के अन्तर्गत अधिसूचना निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 8ए के अन्तर्गत अधिसूचना निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 8ए के अन्तर्गत अधिसूचना निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 8ए के अन्तर्गत अधिसूचना

सं0-बी1-3-39/2011-20—लोक प्रतिनिधित्व अधिनियम, 1950 की धारा-20क, जिसे लोक प्रतिनिधित्व (संषोधन) अधिनियम, 2010 द्वारा अंतर्विश्ट किया गया है और जो दिनांक 10 फरवरी, 2011 से प्रभावी हो चुका है, में निहित प्रावधानों के अनुसार प्रत्येक प्रवासी निर्वाचक अर्थात्‌ भारतीय नागरिक जो नियोजन, षिक्षा या अन्य किसी कारण से भारत में अपने सामान्य निवास के स्थान से अनुपस्थित रह रहा है और किसी अन्य देष की नागरिकता प्राप्त नहीं की है, और जिसका नाम मतदाता सूची में सम्मिलित नहीं है, वह उस विधान-सभा निर्वाचन क्षेत्र की निर्वाचक सूची में नाम निबंधित कराने हेतु अधिकृत है, जो उसके पासपोर्ट में प्रविश्टि के अनुसार भारत में उसका निवास स्थान है।

प्रत्येक प्रवासी निर्वाचक जिसका भारत में निवास स्थान निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 8क के अनुसार बिहार राज्य में अवस्थित है, एवं जिसने 01 जनवरी, 2011 को 18 वर्श की आयु पूर्ण कर ली है और जो अपना नाम निर्वाचक सूची में निबंधित कराने का इच्छुक है, से एतद्‌ द्वारा प्ररूप-6क में उस निर्वाचन क्षेत्र की निर्वाचक सूची में निबंधन हेतु आवेदन आमन्त्रित किया जाता है, जिसमें पासपोर्ट की प्रविश्टि के अनुसार उसका निवास स्थान अवस्थित है। आवेदकों के लिये दिषानिर्देषों सहित प्ररूप-6क नीचे दिया जा रहा है। प्ररूप-6क में दावा संबंधी आवेदन स्वयं उपस्थित होकर संबंधित विधान सभा निर्वाचन क्षेत्र के रजिस्ट्रीकरण पदाधिकारी को समर्पित किया जा सकता है अथवा उस रजिस्ट्रीकरण पदाधिकारी को प्ररूप-6क तथा दिषानिर्देषों में उल्लिखित अभिलेखों के साथ डाक द्वारा भेजा जा सकता है। जब दावा से संबंधित आवेदन डाक द्वारा भेज जाये तब उसके साथ पासपोर्ट के संगत पृश्ठों की सम्यक रूप से स्वतः अनुप्रमाणित छायाप्रतियां संलग्न होनी चाहिये।

बिहार राज्य के 243 विधान-सभा निर्वाचन क्षेत्रों में से प्रत्येक के रजिस्ट्रीकरण पदाधिकारी का पता मुख्य निर्वाचन पदाधिकारी, बिहार के वेबसाईट http://ceobihar.nic.in पर देखा जा सकता है।

(ड़) मैं मेरे द्वारा भारतीय नागरिकता का त्याग किए जाने या मेरे द्वारा किसी अन्य देष की नागरिकता अर्जित किए जाने पर मेरे वर्तमान निवास के देष में भारतीय मिषन के माध्यम से निर्वाचक रजिस्ट्रीकरण ऑफिसर को तत्काल सूचित करने का वचन देता हूं।

(च) मेरे निवास के देष में मेरे निवास के पते में कोई परिवर्तन होने पर निर्वाचक रजिस्ट्रीकरण आफिसर के अभिलेख के लिए मैं मेरे वर्तमान निवास के देष में भारतीय मिषन के माध्यम से निर्वाचक रजिस्ट्रीकरण ऑफिसर को तत्काल सूचित करने का वचन देता हूं। मैं यह जानता हूं कि मेरे निवास पर भेजा गया कोई नोटिस, जो कि निर्वाचक रजिस्ट्रीकरण आफिसर के अभिलेख के अनुसार मेरे वर्तमान निवास के देष में मेरे निवास का पता है, लोक प्रतिनिधित्व अधिनियम, 1950 और उसके अधीन बनाए गए नियमों के अधीन मुझे नोटिस की सम्यक्‌ तामील समझी जाएगी, और यह मेरा उत्तरदायित्व है कि मेरे वर्तमान निवास के देष में मेरे अद्यतन निवास के पते की सूचना मैं निर्वाचक रजिस्ट्रीकरण ऑफिसर को देता रहूं।

(छ) यदि मैं भारत वापस लौटता हूं और भारत में मामूली तौर पर निवासी हो जाता हूं, तो मैं संबंधित विधान सभा/संसदीय निर्वाचन-क्षेत्र के निर्वाचक रजिस्ट्रीकरण ऑफिसर को तत्काल सूचित करूंगा। (ज) मैंने किसी अन्य निर्वाचन-क्षेत्र की निर्वाचक नामावली में मेरा नाम सम्मिलित किए जाने के लिए आवेदन नहीं किया है।

(झ) इस या किसी अन्य निर्वाचन-क्षेत्र में मेरा नाम पहले सम्मिलित नहीं किया गया है।

1. विदेष में रहने वाला भारत का प्रत्येक ऐसा नागरिक, जिसने किसी विदेष की नागरिकता अर्जित नहीं की है और वर्श की 1 जनवरी को 18 वर्श की आयु पूरी कर ली है, उस अवस्थान से, जिसमें उसके पासपोर्ट में यथाउल्लिखित भारत में उसका निवास स्थान अवस्थित है, संबंधित निर्वाचन-क्षेत्र की नामावली में रजिस्ट्रीकरण के लिए प्ररूप 6क में आवेदन कर सकता है। प्ररूप 6क में आवेदन को संबंधित रजिस्ट्रीकरण आफिसर के समक्ष प्रस्तुत किया जा सकता है।

2. आवेदक ने वर्श की 1 जनवरी, को अठारह वर्श की आयु पूरी कर ली हो। उदाहरणार्थ, यदि निर्वाचक नामावली में नाम को सम्मिलित करने के लिए आवेदन 1 जनवरी 2011 की अर्हक तारीख के प्रतिनिर्देष से है, तो आवेदक द्वारा 1 जनवरी 2011 को 18 वर्श की आयु पूरी कर ली गई हो।

3. आवेदन को उस निर्वाचन क्षेत्र के, जिसके भीतर विधिमान्य पासपोर्ट में दिए गए अनुसार आवेदक के मामूली निवास का स्थान आता है, निर्वाचक रजिस्ट्रीकरण आफिसर (इआरओ) को सीधे प्रस्तुत किया जाना चाहिए। प्ररूप 6क में आवेदन को इआरओ को व्यक्तिगत रूप से प्रस्तुत किया जा सकता है या संबंधित इआरओ के डाक पते पर भेजा जा सकता है। [भारत के सभी निर्वाचन क्षेत्रों के इआरओ की विषिश्टियां और डाक पते भारत निर्वाचन आयोग की वेबसाइट (http://eci.nic.in) पर देखी जा सकती हैं]

4. आवेदक के पूर्ण मुख को दर्षित करने वाला एक हाल ही में खींचा गया आवेदक का पासपोर्ट आकार का एक रंगीन फोटो चिपकाएं, जिसकी पृश्ठभूमि हल्के रंग (अधिमानतः सफेद) की हो।

5. प्ररूप 6क के सभी स्तंभ भरें। विधिमान्य भारतीय पासपोर्ट में दिए गए अनुसार अपना नाम और अन्य विषिश्टियां लिखें। 6. यदि आवेदन डाक द्वारा भेजा जाता है तो इसके साथ आवेदक के फोटो और अन्य सभी विषिश्टियां अन्तर्विश्ट करने वाले पासपोर्ट के सुसंगत पृश्ठों और विधिमान्य वीजा पृश्ठांकन अन्तर्विश्ट करने वाले पृश्ठ की फोटो प्रतियां संलग्न की जानी चाहिए। ये फोटो प्रतियां सम्यक रूप से स्वतः अनुप्रमाणित होनी चाहिए। इन दस्तावेजों की अनुप्रमाणित फोटो प्रतियों के बिना भेजे गए आवेदन सीधे नामंजूर किए जाने के दायी होंगे।

7. यदि आवेदन को व्यक्तिगत रूप से इआरओ के समक्ष प्रस्तुत किया जाता है तो आवेदन के साथ ऊपर यथाउल्लिखित पासपोर्ट के सुसंगत पृश्ठों की फोटो प्रतियां संलग्न की जानी चाहिए। रजिस्ट्रीकरण आफिसर द्वारा सत्यापन के लिए आवेदन के साथ मूल पासपोर्ट भी प्रस्तुत किया जाना चाहिए। सत्यापन के तुरन्त पश्चात्‌ पासपोर्ट को लौटा दिया जाएगा। मतदानमतदानमतदानमतदान

8. यह उल्लेखनीय है कि आप के नामांकन के पश्चात्‌, आप निर्वाचन क्षेत्र में मतदान करने में उस समय समर्थ होंगे यदि आप मतदान के दिवस को अपने मूल पासपोर्ट के साथ मतदान केन्द्र में स्वयं उपस्थित हैं।

Notification under Rule 8A of the Registration of Electors Rules, 1960.

No.-B1-3-39/2011–20—Under Section-20A of the Representation of the People Act, 1950, inserted vide Representation of the People (Amendment) Act, 2010, which has come into effect w.e.f. 10th February, 2011, every overseas elector, i.e., Indian citizen who is absenting from his place of ordinary residence in India owing to employment, education or otherwise, and has not acquired citizenship of any other country and who is not included in the electoral roll, is entitled to have his/her name registered in the electoral roll of the constituency in which his/her place of residence in India as mentioned in his/her passport is located.

In terms of rule 8A of the Registration of electors Rules, 1960, every overseas elector whose place of residence in India is located in the State of Bihar who has completed 18 years of age as on 1st January, 2011 and is desirous of registering his/her place of residence as shown in the passport is located. Form-6A may be either submitted7 (cid:18)बहार गजट (असाधारण), 13 अूील 2011 in person directly to the registration officer of the constituency concerned or sent to such registration officer by post along with the document mentioned in Form-6A and the guidelines. When the claim application is sent by post, it should be accompanied by photocopies of the relevant pages of the passport duly self attested.

GUIDELINES FOR FILLING UP THE APPLICATION FORM-6A

General Instructions

Who can file Form-6A

1. Every citizen of India staying in a foreign country, who has not acquired citizenship of a foreign country, and has completed 18 years of age as on 1st January of the year, can make an application in Form 6A for being registered in the roll for the constituency pertaining to the locality in which his place of residence in India as mentioned in the passport is located. The application in Form 6A can be presented to the registration officer concerned.

2. The applicant should have completed eighteen years of age as on 1st January of the year. For example, if the application is for inclusion of name in the electoral roll with reference to 1st January 2011 as the qualifying date, the applicant should have completed 18 years of age as on 1st January 2011.

Where to submit the application in Form-6A

3. The application should be submitted directly to the Electoral Registration officer (ERO) of the constituency within which the place of ordinary residence of the applicant as given in the valid passport falls. The Application in Form 6A can be presented in person to the ERO or sent by post addressed to the ERO concerned.

Documents to be attached

4. Paste one recent passport size coloured photograph with a light background (preferably white) showing the full face of the applicant.

5. Fill in all the columns in Form-6A. Write your name and other particulars as given in the valid Indian Passport.

6. If application is sent by post, it should be accompanied by photo-copy of the relevant pages of the passport containing the valid visa endorsement. These photo-copies should be got duly self attested. Applications without the attested photo-copies of these documents will be liable to be summarily rejected.

7. If the application is submitted in person before the ERO, the application should be accompanied by a photo-copy of the relevant pages of the passport as mentioned above. The original passport should also be produced alongwith the application11 (cid:18)बहार गजट (असाधारण), 13 अूील 2011 for verification by the registration officer. The passport will be returned immediately after verification.

Voting

8. It may be noted that after your enrolment, you will be able to cast vote in election in the constituency, if you are physically present in the polling station alongwith your original passport on the day of poll.
