सं0 1494—भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल राज्य में अवस्थित काराओं में नाई एवं सफाई मजदूर के पदों पर नियुक्ति एवं सेवा शर्त्तों के विनियमन हेतु निम्नलिखित नियमावली बनाते हैंः- 1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।—(1) यह नियमावली बिहार कारा नाई एवं सफाई मजदूर संवर्ग नियमावली, 2011 कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत के प्रभाव से प्रवृत होगी। 2. परिभाषाएँ।- जब तक संदर्भ में कोई बात विरूद्ध न हो, इस नियमावली में-

(i) ''राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार; (ii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है संबंधित कारा का अधीक्षक; (iii) ''नियंत्री प्राधिकार'' से अभिप्रेत है संबंधित काराधीक्षक; (iv) ''विभाग'' से अभिपे्रत है गृह विभाग; (v) ''कारा निरीक्षणालय'' से अभिप्रेत है, कारा महानिरीक्षक का कार्यालय, बिहार; (vi) ''स्क्रीनिंग समिति'' से अभिप्रेत है संबंधित वृत्त कारा के अधीक्षक की अध्यक्षता में गठित समिति;

तथा

(vii) ''बाह्‌य स्रोत'' से अभिप्रेत है वह संस्था/एजेंसी जिसके माध्यम से कार्य/सेवा कर्मी अभ्यर्थी प्राप्त किये जायेंगे और उस कार्य का पारिश्रमिक संबंधित संस्था को दिया जायेगा।

3. संवर्ग का गठन।- इस संवर्ग का पदबल राज्य सरकार द्वारा समय-समय पर यथा स्वीकृत एवं अधिसूचित पदबल/संख्याबल के अनुसार होगा।

4. आरक्षण।- नियुक्ति हेतु सरकार द्वारा समय-समय पर अवधारित आरक्षण नीति का अनुपालन आवश्यक होगा।

5 भर्ती।-(1) राज्य के काराओं में बंदियों की व्यक्तिगत स्वच्छता हेतु 'नाई' एवं काराओं के स्वच्छता अधिष्ठापन हेतु 'सफाई मजदूर' के पद पर भर्त्ती होगी।2 (cid:18)बहार गजट (असाधारण), 20 अ(cid:27)ील 2011 (2) पूर्व से काराओं में कार्यरत नाई एवं सफाई मजदूरों को पटना उच्च न्यायालय द्वारा L.P.A सं0 284/97 में दिनांक 11 दिसम्बर 2006 को पारित आदेश के आलोक में नियुक्ति हेतु एक अवसर प्रदान किये जाने के पश्चात्‌ शेष बचे पद एवं इस प्रकार नियुक्त नाई/सफाई मजदूर द्वारा रिक्त किये गये पदों पर बाह्‌य स्रोत से सरकार द्वारा समय-समय पर विहित प्रक्रिया एवं नियत विहित वेतन/पारिश्रमिक पर सेवा ली जायेगी।

6. अर्हता।-(i) शैक्षणिक अर्हता- राज्य सरकार द्वारा समूह ''घ'' (वर्ग-4) हेतु यथाविहित न्यूनतम अष्टम वर्ग उत्तीर्ण अथवा राज्य सरकार द्वारा समय-समय पर जो विहित किया जाये।

(ii) आयुः- न्यूनतम आयुसीमा 18 वर्ष और अधिकतम आयुसीमा वही होगी, जो राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्धारित की जायेगी।

(iii) शारीरिक रूप से स्वस्थ होना अनिवार्य होगा जिसके लिये नियुक्ति के पूर्व सिविल सर्जन की अध्यक्षता में गठित मेडिकल बोर्ड द्वारा जाँच की जायेगी।

(iv) माननीय उच्च न्यायालय द्वारा एल0पी0ए0 सं0 284/97 में दिनांक 11 दिसम्बर 2006 को पारित न्यायादेश के आलोक में राज्य के काराओं में राज्य सरकार द्वारा समय-समय पर निर्धारित कटऑफ तिथि तक पूर्व से कार्यरत नाई/सफाई मजदूरों की नियुक्ति हेतु उम्र सीमा शिथिल करने की शक्ति नियुक्ति प्राधिकार को होगी। 7. भर्ती की प्रक्रिया।- (क) (1) माननीय उच्च न्यायालय द्वारा L.P.A No. 284/97 में दिनांक 11 दिसम्बर 2006 को पारित आदेश के आलोक में पूर्व से कार्यरत नाई एवं सफाई मजदूरों को नियमित वेतनमान पर नियुक्ति का एक अवसर प्रदान करने हेतु कम से कम दो स्थानीय समाचार पत्रों में विज्ञापन प्रकाशित कराया जायेगा।

(2) राज्य के काराओं में सरकार द्वारा समय-समय पर निर्धारित कटऑफ तिथि तक कार्यरत नाई/सफाई मजदूरों से प्राप्त अभ्यावेदनों की स्क्रीनिंग हेतु निम्न प्रकार स्क्रीनिंग समिति गठित होगीः-

1. वृत्त कारा के कारा अधीक्षक - अध्यक्ष 2. वृत्त कारा के सभी कारा अधीक्षक - सदस्य 3. जिला पदाधिकारी द्वारा मनोनीत अनु0 जाति/ जन जाति के एक पदाधिकारी - सदस्य (3) स्क्रीनिंग समिति द्वारा आहूत समिति की बैठक में कम से कम तीन कारा अधीक्षक सदस्यों सहित कुल पॉच सदस्यों की उपस्थिति आज्ञापक होगी। यह समिति कारा महानिरीक्षक के द्वारा समय-समय पर यथाविहित मानदंड/अनुदेशों के आलोक में उपलब्ध कराई गई आवेदकों की सूची का स्क्रीनिंग करने के पश्चात्‌ नियुक्ति हेतु अपनी अनुशंसा कारा महानिरीक्षक को प्रतिवेदित करेगी।

कारा महानिरीक्षक के माध्यम से प्राप्त अनुशंसा के आधार पर संबंधित कारा के अधीक्षक द्वारा अभ्यर्थी की मेडिकल जाँच के उपरांत नियुक्ति पत्र निर्गत किया जायेगा। (ख) बाह्‌य स्रोत से भर्ती का प्रक्रिया- कारा महानिरीक्षक, बिहार द्वारा खुली निविदा के माध्यम से अनुमोदित संस्था/एजेंसी से बाह्‌य स्रोत पर सेवा हेतु अभ्यर्थी प्राप्त किये जा सकेंगे। संबंधित संस्था/एजेंसी को सेवा पर दिये जाने वाले कर्मी के चरित्र एवं साफ-सुथरे आचरण की गारंटी देनी होगी।

8. वेतनमान एवं सेवा शर्तें। -नियमित वेतनमान में नियुक्त कर्मी को वेतनमान रू0 2550-3200 (अपुनरीक्षित) एवं पे बैण्ड-1 एस, वेतनमान रु0 4440-7440 एवं ग्रेड पे रु0 1300 (पुनरीक्षित) अथवा राज्य सरकार द्वारा समय-समय पर इन पदों के लिए यथा विहित वेतनमान एवं अनुमान्य अन्य भत्ते अनुमत होंगे।

बाह्‌य स्रोत से सेवा पर लिये गये ऐसे कर्मियों को इकरारनामें के अनुरूप विहित नियत पारिश्रमिक संबंधित संस्था/एजेंसी के माध्यम से अनुमत होगा।

9. सम्वर्ग। - राज्य सरकार द्वारा समय-समय पर निर्गत वर्गीकरण के अनुसार यह संवर्ग समूह 'घ' का होगा। साथ ही यह पूर्णतः संबंधित कारा तक ही सीमित होगा।

10. अनुशासन, अपील एवं दंड । -(1) नियमित वेतनमान पर नियुक्त नाई एवं सफाई मजदूर के पद पर कार्यरत कर्मचारियों पर बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली-2005 के प्रावधान लागू होंगे। बाह्‌य स्रोत आधारित कार्य पर लिए गए कर्मियों की सेवा असंतोषप्रद पाये जाने पर संबंधित काराधीक्षक द्वारा संबंधित फर्म/संस्था से बदल लिया जा सकेगा।

(2) ऐसे कर्मियों की सेवा किसी भी रूप में एवं किसी भी प्रकार से सरकारी सेवा के रूप में परिगणित नहीं होगी और न ही किसी भी प्रकार से ऐसे कर्मी द्वारा ऐसी सेवा का लाभ/दावा नियमित सेवा हेतु किया जा सकेगा।3 (cid:18)बहार गजट (असाधारण), 20 अ(cid:27)ील 2011 11. निरसन एवं निर्वचन। -

(1) इस नियमावली के प्रवृत होने की तिथि के प्रभाव से नाई एवं सफाई मजदूर पद हेतु पूर्व में अधिसूचित एवं लागू सभी संकल्प/परिपत्र/आदेश निरसित समझे जायेंगे।

(2) इस नियमावली के प्रावधानों के संबंध में किसी प्रकार के संदेह के निर्वचन की शक्ति सरकार के अनुमोदन से कारा निरीक्षणालय में निहित होगी।

The 1st April 2011 No.1494— In exercise of the powers conferred by proviso to Article 309 of the constitution of India, the Governor of Bihar makes following Rules to regulate the recruitment and services on the post of Nai and Safai mazdoors of Bihar Jails:-

1. Short title, extent and commencement.—(1) These rules shall be called "Bihar Jails Nai and Safai Mazdoor Cadre Rules, 2011".

(2) These rules shall apply to the whole of the State of Bihar. (3) These rules shall come into force with immediate effect.

2. Definitions.- In these Rules, unless the context otherwise requires-

(i) "State Government" means the Government of Bihar; (ii) "Appointing Authority" means concerned Jail Superintendent; (iii) "Controlling Authority" means concerned Jail Superintendent; (iv) "Department" means Home Department: (v) "Inspectorate of Prisons" means office of the Inspector General of Prisons;

(vi) "Screening Committee" means Committee constituted under the Chairmanship of Jail Superintendent of the Circle Jail, and

(vii) "Out Source" means the agency or organisation through which personnel shall be hired and the wages for the work shall be given to that concerned agency or organisation.

3. Constitution of Cadre.- This cadre shall comprise of such number of posts/strength as sanctioned and notified by the State Government from time to time.

4. Reservation.- The reservation policy for appointment determined by the State Government from time to time shall be applicable.

5. Recruitment.- (1) Recruitment shall be made on the post of Nai for personal hygiene of prisoners in Jails and on the post of "Safai Mazdoor" for sanitary work within jails of the State.

(2) In the light of the order passed by Hon'ble High Court in LPA No-284/97 dated 11th December 2006, one opportunity for appointment shall be given to working Nai and Safai Mazdoor and, thereafter, rest of the posts and such posts vacated by Nai/Safai Mazdoor appointed thus, services shall be outsourced as per prescribed procedure and on fixed salary/wages as prescribed by the Government from time to time.

6. Qualification.- (i) Minimum Educational Qualification. – As prescribed by the State Government for Group 'D' (Class-IV), class eight pass or as decided by the State Govt. from time to time.

(ii) Age.- Minimum age shall be 18 years and maximum age shall be the same as decided by the State Government (General Administration Department).

(cid:18)बहार गजट (असाधारण), 20 अ(cid:27)ील 2011 (iii) Applicant shall have to be physically fit, for which a fitness test shall be held by a medical board constituted under chairmanship of Civil Surgeon before appointment.

(iv) The appointing authority shall have the power to relax the age limit for those Nai/Safai Mazdoors who were working till the prescribed cut off date issued by the State Government from time to time, in the light of the order passed in LPA No. 284/97, dated 11th December 2006 by Hon'ble Patna High Court. 7. Process of recruitment:-

(A) (1) In the light of the order passed in LPA No. 284/97, dated 11th December 2006 by Hon'ble Patna High Court, to provide an opportunity for appointment on regular pay scale to previously working Nai and Safai Mazdoors, advertisement shall be published in at least two local daily newspapers.

(2) A Screening Committee for screening applications received from Nai/Safai Mazdoor working upto the cut off date as decided by the State Government from time to time in the jails of the State, shall be consituted as follows:-

(1) Jail Superintendent of the Circle Jail- Chairman (2) All Jail Superintendents of the Circle - Members (3) An SC/ST Officer nominated by the District Magistrate - Member (3) The presence of at least three from Jail Superintendents and total five, members in the meeting called by the Screening Committee shall be mandatory. This Committee, as per the guidelines issued by the Inspector General of Prisons from time to time, after screening the list of applicants, shall make recommendations for appointments to the Inspector General of Prisons.

The Superintendent of the concerned Jail shall, on the basis of recommendation received through the I.G. Prisons, issue appointment letters after medical test of the candidates.

(B) Process of recruitment through Out Sourcing:- Applications shall be received for the service through open advertisement by the I.G. Prisons from recognized agencies/organisations.

The concerned agencies/organisations shall have to guarantee the character and good behaviour of the personnel provided for the service.

8. Pay Scale and Service Condition:- The employees appointed in regular pay scale will be allowed either pay scale Rs. 2550-3200 (unrevised) and Pay Band-1S, scale Rs. 4440-7440 and Grade Pay-1300 (revised), or any other pay and allowances as prescribed by the State govt. from time to time.

Employees hired through outsourcing will be allowed to get prescribed fixed wages through the concerned agencies/organisations as per the contract.

9. Cadre:- The cadre shall be of Group 'D' according to the classification made by the Govt. from time to time. The cadre shall be limited to concerned Jail only.

10. Discipline, Appeal and Punishment:- (1) The Provisions of the Bihar Government Service (Classification, Control and Appeal) Rules 2005 shall apply in case of Nai and Safai Mazdoor appointed on regular pay scale.

The concerned Jail Superintent shall get the services of an employee replaced by another one through the agencies/organisations if his/her services are not found satisfactory.

(2) Services of such workers shall neither, in any way and in any form, be counted as a government service nor any claim for regular service shall be made by such workers in any way.

11. Repeal and interpretation:-

(1) All resolutions/circulars/orders issued previously regarding the posts of Nai and Safai Mazdoor shall be deemed to have been repealed with effect from the date on which these rules shall come into force.

(2) Power of interpretation of any kind of doubt regarding provisions of these rules shall be vested in Inspectorate of Prisons with approval of the Government.
