सं0 2/24-65/2007-431—बिहार एवं उड़ीसा लोक मांग वसूली अधिनियम, 1914 की धारा-48 की उप-धारा (1) सहपठित उप-धारा-(2) (सी) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राजस्व पर्षद, बिहार, एतदद्वारा अधिनियम के अधीन राजस्व पर्षद द्वारा विहित नियम एवं प्रपत्र में निम्नांंिकत संशोधन करते है :-
1. संक्षिप्त नाम, विस्तार और प्रारम्भ - (1) यह नियमावली बिहार एवं उड़ीसा लोक माँग वसूली (संशोधन) नियमावली, 2011 कही जा सकेगी।
(2) इसका विस्तार, सम्पूर्ण बिहार राज्य में होगा। (3) यह बिहार राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगी।
2. बिहार एवं उड़ीसा लोक माँग वसूली अधिनियम, 1914 के भाग II (बिहार एवं उड़ीसा लोक माँग वसूली अधिनियम, 1914 की धारा-48 के अधीन राजस्व पर्षद द्वारा विहित नियम एवं प्रपत्र) के नियम 18 के बाद निम्नलिखित नियम जोड़ा जायगाः-
19. नीलाम सर्टिफिकेट के लिए अध्यपेक्षा दायर करने के समय राष्ट्रीयकृत बैंक के द्वारा न्यायालय फीस के भुगतान का ढंग।- बिहार लोक मांग वसूली अधिनियम, 1914 की धारा-5 के अधीन अध्यपेक्षा दायर करते समय किसी राष्ट्रीयकृत बैंक को अध्यपेक्षित न्यायालय फीस का 25 प्रतिशत (पचीस प्रतिशत) जमा करना होगा। बाकी 75 प्रतिशत (पचहत्तर प्रतिशत) वसूल की गई नीलाम सर्टिफिकेट की राशि की प्रथम या अनुवर्ती किश्तों, यथास्थिति, पर प्रथम भार होगा तथा उसे अध्यपेक्षा करने वाले प्राधिकार के द्वारा राज्य सरकार के समुचित लेखा-शीर्ष में जमा किया जाएगा।
स्पष्टीकरणः-इस नियम के प्रयोजनार्थ "राष्ट्रीयकृत बैंक" से अभिप्रेत है बिहार एवं उड़ीसा लोक मांग वसूली अधिनियम 1914 की अनुसूची 1 के नियम 15 के खण्ड (i) या (ii) में यथोल्लिखित बैंक। 2 (cid:18)बहार गजट (असाधारण), 29 अूील 2011 The 29th April 2011 BIHAR AND ORISSA PUBLIC DEMANDS (AMENDMENT) RULES, 2011 No. 2/24-65/2007-431—In exercise of powers conferred by sub section (1) read with sub section (2) (c) of section 48 of the Bihar and Orissa Public Demands Recovery Act 1914, the Board of Revenue, Bihar hereby make the following amendment to the Rules and Forms prescribed by the Board of Revenue under the Act :-
1. Short title, extent and commencement - (1) These Rules may be called the Bihar and Orissa Public Demands Recovery (Amendment) Rules, 2011
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force from the date of publication in the Bihar Gazette. 2. The following rule shall be added after Rule 18 of the Bihar and Orissa Public Demands Recovery Rules Part II (Rules and Forms Prescribed by the Board of Revenue under section 48 of Bihar and Orissa Public Demands Recovery Act, 1914):-
19. Mode of payment of Court fee by a nationalized bank at the time of filing a requisition for certificate .- A Nationalized Bank shall be required to pay 25 percent (Twenty five percent) of the requisite court fee at the time of filing requisition under Section 5 of the Bihar and Orissa Public Demands Recovery Act, 1914. The balance 75 percent (Seventy five percent) shall be the first charge on the first and on subsequent instalments of the certificate amount realized, as the case may be, and the same will be deposited by the requisitioning authority in the appropriate head of account of the State Government.
Explanation:—For the purpose of this Rule "Nationalized Bank" means a bank as mentioned in clause (i) or (ii) of Rule 15 of Schedule 1 of the Bihar and Orissa Public Demands Recovery Act, 1914.
