18 नवम्बर 2009 सं॰ 608 नि0—दण्ड प्रक्रिया संहिता, 1973 की धारा की उप-धारा (1) अधिनियम 2, 1974 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय निम्न तालिका के स्तंभ-2 में उल्लिखित कार्यपालक पदाधिकारी को न्यायालय की अधिसूचना की तिथि से एक वर्ष के लिए बिहार परीक्षा संचालन अधिनियम 1981 के अधीन उन वादों को जिन्हें वे दंड प्रक्रिया संहिता, 1973 के अंतर्गत क्षमतापूर्वक निष्पादित कर सकते हैं कि निष्पादन हेतु तालिका के स्तंभ-3 में उल्लिखित क्षेत्राधिकार के लिए द्वितीय श्रेणी का विशेष न्यायिक दंडाधिकारी नियुक्त करता है ।

उन्हें यथाकथित संहिता की धारा 261 के अंतर्गत बिहार परीक्षा संचालन अधिनियम, 1981 में वर्णित वादों के संक्षिप्त विचारण के लिए द्वितीय श्रेणी के न्यायिक दंडाधिकारी की शक्तियॉं भी प्रदान की जाती है ।

उन्हें अपने ़क्षेत्राधिकार के अन्तर्गत उन वादों में जिसका निष्पादन करने के लिए उन्हें प्राधिकृत किया गया है, संज्ञान लेने की शक्तियां भी प्रदान की जाती है।

The 18th November 2009 No. 608 A— In exercise of powers conferred upon the High Court under Sub-section (i) of section 13 of the Code of Criminal Procedure, 1973 (Act 2 of 1974) the Executive Officers named in column no.2 of the table given below are appointed as special Judicial Magistrate of the 2nd Class for a period of one year with effect from the date of notification within the territorial jurisdiction mentioned against their name in column no.3 of the table, to try the cases under the BIHAR CONDUCT OF EXAMINATION ACT, 1981. which they can competently try under the code of Criminal Procedure, 1973. These officers are also vested with the powers conferrable on a Judicial Magistrate of the 2nd Class to try summarily the cases under the BIHAR CONDUCT OF EXAMINATION ACT, 1981, as are covered by Section 261 of the Cr.P.C. They are also conferred with the powers to take cognizance of such cases which they have been authorized to try in their respective Territorial Jurisdiction.

——— 6 अप्रील 2009 संख्या 176 नि0—निलम्बन मुक्त होने के उपरान्त निम्न तालिका के स्तम्भ-2 में उल्लिखित न्यायिक पदाधिकारी (असैनिक न्यायाधीश, कनीय कोटि) को उसी तालिका के स्तम्भ-3 में निर्देशित जजी एवं स्थान पर एवं स्तम्भ-4 में दी गई श्रृंखला में मुंसिफ नियुक्त किया जाता है। पदाधिकारी को आवश्यकतानुसार, बंगाल, आगरा एवं आसाम सिविल कोर्ट बिहार एमेंडमेंट ऐक्ट-1987 (ऐक्ट XIX, 1987) द्वारा संबोधित बंगाल, आगरा एवं आसाम सिविल कोर्टस ऐक्ट, 1887 (ऐक्ट XII, 1887) की धारा-19 की उप-धारा (2) के अन्तर्गत उक्त तालिका के स्तम्भ-5 में यथानिर्देशित आर्थिक एवं प्रादेशिक क्षेत्राधिकार के भीतर होने वाले मौलिक वादों की साधारण प्रक्रिया के अधीन निष्पादन की शक्तियाँ प्रदान की जाती है। सम्बन्धित पदाधिकारी को उसी स्तम्भ-5 में निर्देशित आर्थिक एवं प्रादेशिक क्षेत्राधिकारी के अन्दर लघुवाद न्यायालय द्वारा संज्ञेय वादों के निष्पादन के लिए ऐसे न्यायालय के न्यायाधीश की शक्तियाँ भी प्रदान की जाती है।9 (cid:18)बहार गजट, 11 मई 2011 स्तम्भ-5 में दी गयी शक्तियों का प्रयोग तबतक नहीं किया जाय जबतक कि वे बिहार राजपत्र या जिला राजपत्र में अधिसूचित न हो जायें।

No. 176 A— Consequent upon revocation of his suspension the Judicial Officer of the rank of Civil Judge (Junior Division) named in column no.2 of the table given below is appointed as Munsif, in the Judgeship and station mentioned in column no.3, and in the chain indicated in column no.4 of the table.

As mentioned in column no.5, the officer is also vested with the powers under Sub-Section (2) of Section-19 of the Bengal, Agra and Assam Civil Courts Acts, 1887, (Act XII of 1887) as amended by the Bengal, Agra and Assam Civil Courts Bihar amendment Act, 1987 (Act XIX of 1987) to try under the ordinary procedure original suits of pecuniary and Territorial Jurisdiction.

As further mentioned in Column no.5, the officer is also vested with powers of a Judge of the Court of small causes for the trial of suits cognizable by such a Court with the necessary pecuniary and Territorial Jurisdiction.

सं0 648 नि0—दण्ड प्रक्रिया संहिता 1973 (अधिनियम 2, 1974) की धारा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय श्री अरबिन्द कुमार सिंह, अनुमंडल न्यायिक दंडाधिकारी, मुजफ्फरपुर को विधि विभाग (न्या0) के अधिसूचना संख्या 1534 जे0 दिनांक 13 मई 2006 में वर्णित क्षेत्राधिकार, यथा छपरा, सीवान, गोपालगंज, मुजफ्फरपुर, सीतामढ़ी, वैशाली, शिवहर, पूर्वी चम्पारण, प0 चम्पारण, दरभंगा, मधुबनी एवं समस्तीपुर जिला क्षेत्रों के लिए जिसका मुख्यालय मुजफ्फरपुर रहेगा को विधि विभाग के अधिसूचना संख्या 2218/जे0, दिनांक 1 जुलाई 2005 द्वारा स्थापित न्यायिक दण्डाधिकारी (मुंसिफ) के मुजफ्फरपुर में अतिरिक्त विशेष न्यायालय का विशेष दण्डाधिकारी सह पीठासीन पदाधिकारी नियुक्त करता है और दिल्ली स्पेशल पुलिस इस्टेबलिसमेन्ट ऐक्ट, 1946 की धारा 3 के अन्तर्गत डी.एस.पी.ई. मुजफ्फरपुर शाखा के द्वारा जाँच किए गए वादों के निष्पादन या निष्पादन हेतु सूपूर्द करने की शक्तियाँ प्रदान करता है।

इन्हे उक्त संहिता की धारा 190 की उपधारा (1) के खण्ड ( बी) के अधीन डी.एस.पी.ई. मुजफ्फरपुर शाखा द्वारा उपरोक्त जिला क्षेत्रो के लिए जाँच किए गए वैसे वादो की जिसका निष्पादन या निष्पादन हेतु सुपूर्द करने में वे सक्षम हैं संज्ञान लेने की शक्तियाँ भी प्रदान की जाती है।

The 5th December 2009 No. 648A—In exercise of powers conferred under Section 11 of the Code of Criminal Procedure, 1973 (Act 2 of 1974), the Court are pleased to appoint Sri Arvind Kumar Singh,Sub-Divisional Judicial Magistrate,Muzaffarpur, as the special Magistrate-cum-P.O. of the Additional Special Court of the Judicial Magistrate ( Munsif )at Muzaffarpur Established vide Law Department's Notification No.- 2218/J, dated 1st July 2005 for the entire State of Bihar with headquarters at Muzaffarpur to try and if necessary to commit for trial the cases investigated by the Delhi Special Police Establishment of other Branches also besides the Muzaffarpur Branch, with respect to the offrences covered under section 3 of the Delhi Special Police estabhlishment Act, 1946 for the area of Jurisdiction of the Districts of Chapra, Siwan, Gopalganj, Muzaffarpur, Sitamarhi, Vaishali, Sheohar, East Champaran, West Champaran, Darbhanga, Madhubani and Samastipur as mentioned in law ( J ) Deptt. Notification No. 1534-J Dated 13th May 2006. ——— 13 जुलाई 2009 सं0 327नि0—दंड प्रक्रिया संहिता, 1973 (अधिनियम 2, 1974) की धारा-11 की उप-धारा (3) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय द्वारा निम्नलिखित न्यायिक दंडाधिकारीयों (असैनिक न्यायाधीश, कनीय कोटि) को निम्न तालिका के स्तंभ-3 में उनके नाम के सामने अंकित जिला के लिए प्रथम श्रेणी के न्यायिक दंडाधिकारी की शक्तियाँ प्रदान की जाती है। पुनः उसी दण्ड प्रक्रिया की धारा 12 की उप-धारा (3) (अ) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए इन पदाधिकारियों को इसी तालिका के स्तंभ-4 में उनके नाम के सामने उल्लिखित अनुमंडल के लिए अनुमंडल न्यायिक दंडाधिकारी भी पदांकित किया जाता है।

No.327 A— In exercise of the powers conferred under Sub Section (3) of Section 11 of the code of Criminal Procedure, 1973 (Act 2 of 1974) the High Court are pleased to confer upon the Judicial Magistrates (Civil Judge, Junior Division) named in column no.2 of the table given below, the powers of a Judicial Magistrate of the 1st Class for the District noted against their names in column no.3 of the table. Further, in exercise of the powers conferred under Sub Section (3) (a) of Section 12 of the said Criminal Procedure Code, these Officers are designated as the Sub-Divisional Judicial Magistrate for the Sub-Division noted against their names in column no.4 of the said table.

——— 15 जुलाई 2009 सं0 331 नि0—दण्ड प्रक्रिया संहिता, 1973 की धारा की उप-धारा (1) अधिनियम 2 ए, 1974 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए उच्च न्यायालय की अधिसूचना की तिथि से एक वर्ष के लिए बिहार परीक्षा संचालन अधिनियम 1981 के अधीन उन वादों को जिन्हें वे दंड प्रक्रिया संहिता, 1973 के अंतर्गत क्षमतापूर्वक निष्पादित कर सकते हैं के निष्पादन हेतु तालिका के स्तंभ-3 में उल्लिखित क्षेत्राधिकार के लिए द्वितीय श्रेणी का विशेष न्यायिक दंडाधिकारी नियुक्त करता है । उन्हें यथाकथित संहिता की धारा 261 के अंतर्गत बिहार परीक्षा संचालन अधिनियम, 1981 में वर्णित वादों के संक्षिप्त विचारण के लिए द्वितीय श्रेणी के न्यायिक दंडाधिकारी की शक्तियॉं भी प्रदान की जाती है । उन्हें अपने क्षेत्राधिकार के अंतर्गत उन वादों में जिसका निष्पादन करने के लिए उन्हें प्राधिकृत किया गया है, संज्ञान लेने की शक्तियॉं भी प्रदान की जाती है।

No. 331 A— In exercise of powers conferred upon the High Court under Sub-Section (i) of Section 13 of the Code of Criminal Procedure, 1973 ( Act 2 of 1974 ) the Executive Officer, named in column no.2 of the table given below is appointed as special judicial Magistrate of the 2nd class for a period of one year with effect from the date of notification within the territorial jurisdiction mentioned against his name in column no.3 of the table, to try the Cases under the BIHAR CONDUCT OF EXAMINATION ACT,1981, which he can competently try under the code of Criminal Procedure, 1973.

This officer is also vested with the powers conferrable on a judicial Magistrate of the 2nd class to try summarily the cases under the BIHAR CONDUCT OF EXAMINATION ACT,1981, as are covered by section 261 of the Cr.P.C.

28 जुलाई 2009 सं0 357 नि0—निम्न तालिका के स्तम्भ-2 में उल्लिखित न्यायिक पदाधिकारी (असैनिक न्यायाधीश, कनीय कोटि) को उसी तालिका के स्तम्भ-3 में निर्देशित जजी एवं स्थान पर एवं स्तम्भ-4 में दी गई स्थानांतरण श्रृंखला में मुंसिफ नियुक्त किया जाता है।

पदाधिकारी को आवश्यकतानुसार, बंगाल, आगरा एवं आसाम सिविल कोर्ट बिहार एमेंडमेंट ऐक्ट-1987 (ऐक्ट XIX, 1987) द्वारा संबोधित बंगाल, आगरा एवं आसाम सिविल कोर्टस ऐक्ट, 1887 (ऐक्ट XII, 1887) की धारा 19 की उपधारा (2) के अन्तर्गत उक्त तालिका के स्तम्भ-5 में यथानिर्देशित आर्थिक एवं प्रादेशिक क्षेत्राधिकार के भीतर होने वाले मौलिक वादों की साधारण प्रक्रिया के अधीन निष्पादन की शक्तियाँ प्रदान की जाती है।

सम्बन्धित पदाधिकारी को उसी स्तम्भ-5 में निर्देशित आर्थिक एवं प्रादेशिक क्षेत्राधिकारी के अन्दर लघुवाद न्यायालय द्वारा संज्ञेय वादों के निष्पादन के लिए ऐसे न्यायालय के न्यायाधीश की शक्तियाँ भी प्रदान की जाती है।

स्तम्भ-5 में दी गयी शक्तियों का प्रयोग तबतक नहीं किया जाय जबतक कि वे बिहार राज्य पत्र या जिला राज्यपत्र में अधिसूचित न हो जायें।

The 28th July 2009 No. 357 A— The Judicial Officer Civil Judge (Junior Division) named in column no.2 of the table given below is appointed as Munsif in the Judgeship and station mentioned in column no.3, and in the chain indicated in column no.4 of the table.

As mentioned in column no.5, the officer concerned is also vested with the powers under Sub- Section (2) of Section-19 of the Bengal, Agra and Assam Civil Courts Acts, 1887, (Act XII of 1887) as amended by the Bengal, Agra and Assam Civil Courts Bihar amendment Act, 1987 (Act XIX of 1987) to try under the ordinary procedure original suits of pecuniary and Territorial Jurisdiction.

As further mentioned in Column no.5, the officer concerned is also vested with powers of a Judge of the Court of small causes for the trial of suits cognizable by such a Court with the necessary pecuniary and Territorial Jurisdiction.

The powers vested as per column no.5, should not, however, be exercised by the officer concerned unless they are published in the Bihar Gazette or in the District Gazette.
