एस0ओ0 149, दिनांक 6 जून 2011—विधि विभाग, बिहार सरकार के ज्ञापांक-ए0/एक्ट-14/2006- 1961/जे0, पटना, दिनांक 26 अप्रील 2010 द्वारा बिहार विशेष न्यायालय अधिनियम, 2009 की धारा-3 सहपठित बिहार विशेष न्यायालय नियमावली, 2010 के नियम-9 द्वारा प्रदा शक्तियों का प्रयोग करते हुए बिहार सरकार, ने पटना उच्च न्यायालय के परामर्श से, निगरानी अन्वेषण ब्यूरो एवं विशेष निगरानी इकाई द्वारा अन्वेषण के आधार पर, उक्त अधिनियम के अधीन संस्थित अननुपातिक आस्तियों के मामलों के त्वरित निपटारे तथा अवैध रूप से अर्जित अननुपातिक आस्तियों के अधिहरण के लिये पटना में दो, भागलपुर में दो और मुजफ्फरपुर में दो अपर जिला एवं सत्र न्यायाधीश के छः विशेष न्यायालय स्थापित किया है। इन छः न्यायालयों के पीठासीन पदाधिकारियों को एतद् द्वारा अधिनियम की धारा-13 के अधीन र्काव्यों एवं कृत्यों के निर्वहन हेतु अधिनियम की धारा 2(ख) के अर्थांतर्गत 'प्राधिकृत पदाधिकारी' के रूप में पदाभिहित किया गया है।
2. माननीय उच्च न्यायालय, पटना खण्ड पीठ (Division Bench) द्वारा सी0डब्ल्यू0जे0सी0 सं0-10455/2010 एवं सदृश मामलों में दिनांक 23 फरवरी 2011 को पारित न्यायादेश के आलोक में यह समुचित माना गया है कि वैसे पदाधिकारी द्वारा, जिन्होने संपाि के अधिहरण संबंधी आदेश दिया है, ऐसे मामलों का विचारण नहीं किया जाय। उक्त परिस्थितियों में 'प्राधिकृत पदाधिकारी ' के रूप मे अभिहित विशेष न्यायालयों के पीठासीन पदाधिकारी की अधिकारिता एवं उनके द्वारा संचालित आपराधिक मामलों के विचारण की अधिकारिता के संबंध में निम्नलिखित संशोधन किये गए हैः-

एस0ओ0 150, एस0ओ0 149 दिनांक 6 जून 2011 का अंग्रेजी में निम्नलिखित अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद-348 के खण्ड(3) के अधीन अंग्रेजी भाषा का प्राधिकृत पाठ समझा जायेगा।

S.O. 149, dated the 6th June 2011—In exercise of the powers conferred by Section 3 of The Bihar Special Courts Act, 2009 read with Rule 9 of the Bihar Special Courts Rules, 2010 the Government of Bihar has, in consulation with the High Court of Judicature at Patna, established six Special Courts of Additional District and Sessions Judge, two at Patna, two at Bhagalpur and two at Muzaffarpur for speedy disposal of disproportionate asset cases instituted under the aforesaid Act on the basis of investigation made by the Vigilance Investigation Bureau and the Special Vigilance Unit. Vide Memo No-A/Act-14/2006-1961/J, Patna, dated 26th April 2010 of Law Department, Government of Bihar. Presiding Officers of these six Courts have been designated as 'authorised officer' within the meaning of Section 2 (b) of the Act for discharge of duties and functions under Section 13 of the Act.
2. In view of the judgment passed by Division Bench of Hon'ble High Court of the Judicature at Patna in C.W.J.C. No. 10455/2010 and similar cases on 23rd February 2011, it is considered appropriate that trial of such cases may not be conducted by the 'authorised officer'3 (cid:18)बहार गजट (असाधारण), 6 जून 2011 who has made order relating to confiscation of the property. In the circumstances the following amendment is made in respect of jurisdiction of the Presiding Officer of the Special Courts designated as 'authorized officer' and jurisdiction of trial of the criminal cases conducted by them:-
