सं0 576/3/ई.वी.एम./2011/एस.डी.आर (वि.स.) - यतः, लोक प्रतिनिधित्व अधिनियम 1951 की धारा-61 क में यह उपबंधित है कि मतदान मषीनों द्वारा मत ऐसी रीति से डाले और रिकार्ड किए जाएंगे जैसा कि निर्वाचन आयोग ऐसे निर्वाचन क्षेत्रों केे लिए प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए निर्दिश्ट करे तथा
2. यतः आयोग ने मध्य प्रदेष में 56-जबेरा विधान-सभा निर्वाचन क्षेत्र और बिहार में 62-पूर्णियाँ विधान-सभा निर्वाचन क्षेत्र की परिस्थितियों पर विचार किया हैं, और वह संतुश्ट है कि उपर्युक्त वर्णित विधान-सभा निर्वाचन क्षेत्रों में मतदान के लिए पर्याप्त संख्या में इलेक्ट्रानिक वोटिंग मषीनें उपलब्ध हैं, तथा मतदान कर्मचारी इलेक्ट्रानिक वोटिंग मषीनों के दक्षतापूर्वक संचालन करने के लिए प्रषिक्षित हैं तथा निर्वाचक भी इलेक्ट्रानिक वोटिंग मषीनों की कार्यप्रणाली से पूर्णतया परिचित है;
3. अतः अब, भारत निर्वाचन आयोग एतद्द्वारा मध्य प्रदेष में 56-जाबेरा विधान-सभा निर्वाचन क्षेत्र और बिहार में 62-पूर्णियाँ विधान-सभा निर्वाचन क्षेत्र के विशय में 1 जून, 2011 को अधिसूचित किए गए उक्त राज्यों की विधान सभाओं के लिए चालू उप-निर्वाचन में, निर्वाचनों का संचालन नियम, 1961 के अधीन मत निर्धारित रीति से इलेक्ट्रानिक मतदान मषीनों के माध्यम से डाले और रिकार्ड किए जाएंगे जैसा कि इस विशय पर आयोग द्वारा समय-समय पर अनुपूरक अनुदेष जारी किए जाते हैं।

No.576/3/EVM/2011/SDR(LA) :- WHEREAS, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituencies as the Election Commission of India may, having regard to the circumstances of each case specify; and
2. WHEREAS, the Commission has considered the circumstances in 56- Jabera Assembly Constituency in Madhya Pradesh and 62-Purnia Assembly Constituency in Bihar, and is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the abovementioned Assembly Constituencies, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;
3 (cid:18)बहार गजट (असाधारण), 22 जून 20113. NOW, THEREFORE, the Election Commission of India hereby specifies 56-Jabera Assembly Constituency in Madhya Pradesh and 62-Purnia Assembly Constituency in Bihar, as the Constituencies in which the votes at the current bye-election to the Legislative Assemblies of the said States notified on 1st June, 2011, shall be given and recoded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.
