सं0 9/स0स0-20-102/99-सा0प्र0-7443—भारत के संविधान के अनुच्छेद 309 के परन्तुक में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार सचिवालय लिपिकीय सेवा नियमावली, 2006 का संशोेधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम एवं प्रारम्भ।-(1) यह नियमावली ''बिहार सचिवालय लिपिकीय सेवा (संशोेधन) नियमावली, 2011'' कही जा सकेगी।
(2) यह तुरत प्रवृत्त होगी।
2. उक्त नियमावली, 2006 के नियम 7 के उप-नियम (5) का प्रतिस्थापन ।-उक्त नियमावली, 2006 के नियम 7 का उप-नियम (5) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-
''(5) अधिकृत बल का शेष पन्द्रह प्रतिशत (15%) पद सचिवालय के विभागों एवं संलग्न कार्यालयों की नियमित स्थापना में कार्यरत समूह ''घ'' के मैट्रिक उत्तीर्ण कर्मियों से वरीयता के आधार पर प्रोन्नति द्वारा नियुक्ति से संबंधित नियुक्ति प्राधिकार द्वारा भरे जायेंगे।''
3. उक्त नियमावली, 2006 के नियम-7 के उप-नियम (7) में संशोधन।-उक्त नियमावली के नियम-7 के उप-नियम (7) मेें प्रयुक्त शब्द, अंक एवं कोष्ठक ''एवं (5)'' विलोपित किया जायेगा एवं शब्द ''परीक्षाओं'' शब्द ''परीक्षा'' द्वारा प्रतिस्थापित किया जायेगा।(cid:18)बहार गजट (असाधारण), 26 जुलाई 2011 2 4. उक्त नियमावली, 2006 के नियम-11 के उप-नियम (4) में संशोधन।-उक्त नियमावली के नियम-11 के उप-नियम (4) में प्रयुक्त शब्द ''अथवा नियम-7(5) के अधीन नियुक्त सभी कर्मी'' विलोपित हो जायेंगे। 5. उक्त नियमावली, 2006 के नियम-11 के उप-नियम (5) का प्रतिस्थापन।-नियम-11 के उप-नियम (5) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-
'(5) नियम-7(5) के अधीन प्रोन्नति द्वारा नियुक्त कर्मियों की आपसी वरीयता वही होगी जो पूर्व सेवा में थी।''
6. उक्त नियमावली, 2006 के नियम-11 के उप-नियम (6) में संशोधन।-नियम-11 के उप-नियम (6) में प्रयुक्त शब्द ''कनीय'' शब्द ''वरीय'' द्वारा प्रतिस्थापित हो जायेगा।

सं0 9/स0स0-20-102/99सा0प्र0-7444/अधिसूचना संख्या 7443 दिनांक 30 जून, 2011 के तहत निर्गत बिहार सचिवालय लिपिकीय सेवा (संशोधन) नियमावली, 2011 का संलग्न अँग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाशित किया जाता है, जिसे भारत संविधान के अनुच्छेद 348 के खंड (3) के अधीन उक्त नियमावली का अँग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

No. 9/Sa.Sa.-20-102/99GA-7443—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is please to make the following rules to amend the Bihar Secretariat Clerical Service Rules, 2006 :-
1. Short title and commencement:—(1) These Rules may be called "The Bihar Secretariat Clerical Service (Amendment) Rules, 2011.
(2) It shall come into force at once.
2. Substitution of Sub rule (5) of Rule 7 of the said Rules, 2006:—sub rule (5) of Rule 7 of the Bihar Secretariat Clerical Service Rules, 2006 shall be substituted by the following :—
"(5) Rest fifteen percent (15%) posts of authorised strength shall be filled up by appointment by promotion from the matriculate persons of Group 'D' working in the regular establishment of the Departments and its attached offices of the Secretariat, on the basis of seniority, by the concerned appointing authority."3 (cid:18)बहार गजट (असाधारण), 26 जुलाई 2011 3. Amendment in Sub rule (7) of Rule 7 of the said Rules, 2006:—The words, figure and brackets 'and (5)' used in sub rule (7) of Rule 7 of the said Rules shall be deleted and the word 'examinations' shall be substituted by the word 'examination'.
4. Amendment in sub rule (4) of Rule 11 of the said Rules, 2006 :—The words used in sub rule (4) of Rule 11 of the said Rules "or all the employees appointed under Rule 7(5)" shall be deleted.
5. Substitution of Sub rule (5) of Rule 11of the said Rules, 2006 :—Sub rule (5) of Rule 11 of the said Rules shall be substituted by the following:—
The inter se seniority of the persons appointed by promotion under Rule 7 (5) shall be the same which were in previous service.
6. Amendment in sub rule (6) of Rule 11 of the said Rules, 2006 :—The word "junior" used in sub rule (6) of Rule 11 shall be substituted by word "senior".
