la0 1003—बिहार हिन्दू रेलीजियस ट्रस्ट्‌स एक्ट, 1950 (अधिनियम 1, 1951) की धारा-83 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्य धार्मिक न्यास बोर्ड (स्टेट बोर्ड ऑफ रेलीजियस ट्रस्ट्‌स) की उप-विधियाँ में संशोधन किया गया है, जो पहले प्रकाशित हो चुका है और राज्य सरकार द्वारा पत्र संख्या-एल0आर0टी0-01-02/2007/6586/जे0, दिनांक 29 अगस्त, 2011 द्वारा सम्यक्‌ रूप से अनुमोदित और सम्पुष्ट हो चुका है ।

बिहार राज्य धार्मिक न्यास पर्षद उप-विधि 1955 का संशोधन

बिहार राज्य धार्मिक न्यास पर्षद उप-विधि 1955 में -

1. उप-विधि 25 में प्रयुक्त शब्द ''पच्चीस पैसे'' शब्द ''दस रूपये'' द्वारा प्रतिस्थापित किये जायेंगे।

2. उप-विधि 26 में प्रयुक्त ''पच्चीस पैसे'' ''एक रूपया'' और ''पचास पैसे'' क्रमशः शब्द ''पांच रूपये'', ''पन्द्रह रूपये'' एवं ''दस रूपये'' द्वारा प्रतिस्थापित किये जायेंगे।

3. उप-विधि 27 का संशोधन :-

(i) उप-विधि 27 की कंडिका (क) के सामने अंकित अंक ''1-00'' को अंक ''50-00'' द्वारा प्रतिस्थापित किये जायेंगे।

(ii) उप-विधि 27 की कंडिका (ख) के सामने अंकित अंक ''0-80'' को अंक ''25-00'' द्वारा प्रतिस्थापित किये जायेंगे।

(iii) उप-विधि 27 की टिप्पणी में प्रयुक्त शब्द ''एक रूपया'' को शब्द ''पचास रूपये'' द्वारा प्रतिस्थापित किये जायेंगे।(cid:18)बहार गजट (असाधारण), 15 िसत+बर 2011 2 (iv) उप-विधि 27 की कंडिका (ग) के सामने अंकित अंक ''0-50'' को अंक ''50-00'' द्वारा प्रतिस्थापित किये जायेंगे।

4. उप-विधि 29 में प्रयुक्त शब्द ''एक रूपया'' को शब्द ''दो सौ रूपये'' द्वारा प्रतिस्थापित किये जायेंगे।

5. उप-विधि 31 के क्रम संख्या (xxix) के बाद निम्नलिखित नया क्रम संख्याएँ (xxx) एवं (xxxi) अन्तः स्थापित किये जायेंगे। :-

''(xxx) बेची गयी अचल सम्पत्तियों की पंजी।

(xxxi) न्यास की संपत्तियों की बिक्री के लिए दिये गये सभी आदेशों की पंजी''। 6. उप-विधि 35 के बाद निम्नलिखित नयी उप-विधि-35क अन्तः स्थापित की जायेगीः-

''35क- यदि पर्षद्‌ किसी वित्तीय वर्ष के अन्त तक, जिसके लिए अंकेक्षण किया जाना हो, न्यास के अंकेक्षण के लिए अर्हता प्राप्त अंकेक्षक की प्रतिनियुक्ति नहीं कर पाता है, तब न्यास एक अर्हता प्राप्त चार्टर एकाउंटेन्ट, न्यास की लेखा के अंकेक्षण हेतु, नियुक्ति करेगी और वित्तीय वर्ष की समाप्ति के छह माह के भीतर अंकेक्षण-प्रतिवेदन अवश्य प्रस्तुत करेगी।

अंकेक्षण प्रतिवेदन की समीक्षा पर्षद्‌ द्वारा की जायेगी और तद्‌नुसार आवश्यक अनुदेश निर्गत किये जायेंगे। अध्यक्ष को नया अंकेक्षण कराने का अधिकार होगा, यदि उसका समाधान हो जाय कि पर्षद्‌ को प्रस्तुत किया गया अंकेक्षण प्रतिवेदन न्यास की आय-ब्यय का सत्य प्रतिबिम्ब नहीं है।''

7. उप-विधि 37 में शब्द ''में जमा किया जायेगा और यदि न्यास के प्रधान कार्यालय के निकट स्टेट बैंक ऑफ इण्डिया की कोई शाखा न हो तो उस रिजर्व बैंक ऑफ इण्डिया एक्ट, 1934 में यथा परिभाषित और अध्यक्ष द्वारा अनुमोदित किसी अनुसूचित बैंक'' को शब्द ''या अध्यक्ष द्वारा अनुमोदित किसी राष्ट्रीयकृत बैंक'' द्वारा प्रतिस्थापित किया जायेगा।

8. उप-विधि 38 निम्नलिखित द्वारा प्रतिस्थापित की जायेगीः-

''38 निम्नलिखित पदाधिकारियों और सेवकों को उनके पद के सामने दिए गए वेतन के अनुसार पर्षद्‌ नियुक्त कर सकती हैः-

उक्त पदों पर नियुक्ति के लिये उम्मीदवारों की शैक्षणिक अर्हता, उम्र, वेतनमान आदि वही होगी, जो समय-समय पर समान पद वाले सरकारी पदाधिकारियों एवं कर्मियों के लिए उस पद के लिए आवश्यक है।

पर्षद्‌ सरकार के पूर्व अनुमोदन से पदाधिकारियों/कर्मचारियों के वेतन एवं भत्ते का पुनरीक्षण कर सकेगी।''

9. उप-विधि 38 के बाद निम्नलिखित नयी उप-विधि 38क जोड़ी जायेगी, यथा-

''38क- (i) यदि न्यायाधिकरण के पीठासीन न्यायाधीश उच्च न्यायालय के अवकाश प्राप्त न्यायाधीश हों तो उन्हें वेतन एवं उपलब्धियाँ अवकाश प्राप्त उच्च न्यायालय के न्यायाधीश के प्रावधानों के अनुसार पेंशन राशि घटाकर प्राप्त होंगी, लेकिन यदि वे अवकाश प्राप्त जिला न्यायाधीश हों तो वे अन्तिम वेतन में से पेंशन की राशि घटाकर अपना वेतन पाने के हकदार होंगे।

(ii) जब अधीक्षक अवकाश प्राप्त न्यायिक या प्रशासनिक पदाधिकारी हों तो वे भी अन्तिम वेतन में से पेंशन की राशि घटाकर अपना वेतन पाने के हकदार होंगे।'' 10. उप-विधि 43 में संशोधन-उप-विधि 43 में निम्नलिखित संशोधन किये जायेंगे, यथा-

(i) उप-विधि 43 के खण्ड (ध) में प्रयुक्त शब्द ''अस्थायी न्यासियों'' के बाद निम्नलिखित जोड़े जायेंग,े यथा :-

''और अधिनियम की धारा-28(2)(ज) के अधीन न्यासधारी के अपसारण के रिक्त स्थान पर न्यासधारी की नियुक्ति संस्थापक की इच्छा के शर्त्तों पर या पर्षद्‌ एवं न्यास के बीच आपसी सहमति से''

(ii) उप-विधि 43 के खण्ड (ल) के पश्चात्‌ निम्नलिखित नये खण्ड जोड़े जायेंगे, यथाः- ''(व) विवाद के किसी गम्भीर मामले या गम्भीर आरोपों की जाँच-पड़ताल करना एवं संबंधित पक्षकारों की सुनवाई के पश्चात्‌ निर्णय लेना ;

(श) किसी सार्वजनिक या निजी न्यास से संबंधित सभी विवादों को विनिश्चित करना; (ष) अधिनियम 32(1) के अधीन न्यास कमिटी का गठन करना ;

(स) न्यासी या न्यास के धार्मिक कार्यो से हितबद्ध कोई दो व्यक्ति को न्यास का अन्य सक्रान्त सम्पत्ति की वापसी के लिए अथवा अतिक्रमण हटाने के लिये या अधिनियम के किसी उपबंध के अधीन सम्पत्ति विवाद के निर्णय के लिए न्यायाधिकरण के समक्ष आवेदन करने की अनुमति प्रदान करना।'' 11. उप-विधि 55(घ) में संशोधन-उप-विधि 55(घ) के स्थान पर निम्नलिखित प्रतिस्थापित किये जायेंगे यथा-

''(घ) अधिनियम के अधीन परियोजनाओं की व्यवस्था एवं समितियों की नियुक्ति।''

12. उप-विधि 55 के बाद निम्नलिखित नयी उप-विधि जोड़ी जायेगी, यथा :-

''55क-बिहार हिन्दू धार्मिक न्यास अधिनियम, 1950 की धारा-32(2) के तहत पर्षद द्वारा निर्मित, उपांतरित स्कीम या किसी अन्य स्कीम के लिये प्रतिस्थापित की गयी कोई स्कीम राजपत्र में प्रकाशित की जायेगी।"

13. उप-विधि के साथ संलग्न परिशिष्ट-II के फार्म-1 में संशोधन ।-उप-विधि के साथ संलग्न परिशिष्ट-II के फार्म-1 की कॉलम-1, 12 एवं 15 को निम्नलिखित रूप में संशोधित किया जायेगा :-

(i) उप-विधि का परिशिष्ट-II फार्म 1 के क्रमांक 1 में उल्लिखित शब्द ''क्रम संख्या'' शब्द ''पंजीयन संख्या'' द्वारा प्रतिस्थापित किये जायेंगे।

(ii) उप-विधि का परिशिष्ट-II फार्म 1 के क्रमांक 12 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

"12. वार्षिक आय, यह पिछले वित्तीय वर्ष की होनी चाहिए और निम्नप्रकार दिखलाई जायः- (क) भू-सम्पत्तियों से आय। (ख) चढ़ावों से आय। (ग) विभिन्न फीस से आय।

(घ) विक्रय आगम से आय। (ड.) किराया से आय।

(च) दान से आय। (छ) सरकार से किसी अनुदान या बैंक या किसी संस्था से आय।

(ज) न्यास द्वारा संचालित सस्था से, कर्ज एवं सूद भुगतान के पश्चात्‌ एक मुश्त अधिशेष राशि, यदि अधिशेष आयकर अधिनियम के प्रावधानों अधीन अग्रेनीत नहीं किया हो।" (iii) "क्रमांक-15 के बाद निम्नलिखित नया क्रमांक-15 'क' जोड़ा जायेगाः- "15-'क' न्यास द्वारा स्थापित किसी संस्था का विस्तृत ब्यौरा।''

No. 1003—In exercise of the powers conferred under section 83 of the Bihar Hindu Religious Trusts Act, 1950 (Act 1 of 1951), the State Board of Religious Trusts Bihar, make the following amendments in the bye-laws, the same having been previously published, duly approved and confirmed by the State Government in their letter No. LRT-01-02/2007/6586/J, dated 29th August 2011.

AMENDMENTS OF THE BIHAR STATE RELIGIOUS TRUSTS BOARD'S

BYE-LAWS,1955 IN BIHAR STATE RELIGIOUS TRUSTS BOARD'S BYE-LAWS,1955 -

1. Amendment of bye-laws 25.—The number and letter "25p" used in bye-laws 25, shall be substituted by words "Rupees Ten."

2. Amendment of bye-laws 26.— The number and letter "25p" "one rupee" and "50p" used in bye-laws 26, shall be substituted by the words "Rupees five" "Rupees Fifteen'' and "Rupees Ten " respectively.

3. Amendment of bye-laws 27.—(i) Number "1-00" mentioned in front of Clause (a) of bye-laws 27, shall be substituted by number "50-00".

(ii) Number "0-80" mentioned in front of Clause (b) of bye-laws 27, shall be substituted by number "25-00".

(iii) Word "One rupee" used in note of bye-laws 27, shall be substituted by word "Fifty rupees"

(iv) Number "0-50" mentioned in front of Clause (c) of bye-laws 27, shall be substituted by number "50-00"5 (cid:18)बहार गजट (असाधारण), 15 िसत+बर 2011 4. Amendment of bye-laws 29.— The words "one rupee" used in bye-laws 29 shall be substituted by words "Two Hundred".

5. Amendment of bye-laws 31.— In bye-laws 31 after serial no. (xxix) of bye- laws 31 new serial nos. (xxx) and (xxxi) shall be inserted, namely as follows:

"(xxx) Register of sold immovable properties. (xxxi) Register of all orders given for sale of trust properties". 6. Insertion of new bye-laws 35 A— After bye-laws 35 following new bye-laws shall be inserted , namely -:

"35 A- If the Board does not appoint any qualified Auditor for the audit of the trust by the end of the financial year for which the audit has to be conducted, the trust shall appoint a qualified Chartered accountant for the audit of the account of the trust and submit the audit report within six months from the expiry of the financial year without fail.

The audit report shall be scrutinized by the Board and necessary instruction shall be issued accordingly. The President shall have power to get a fresh audit conducted, if he is satisfied that the audit report submitted to the Board is not true reflection of income and expenditure of the trust".

7. Amendment of bye-laws 37.— In bye-laws-37 for the words" and if there be no branch of the State Bank of India near the Head Office of the trust then in a scheduled Bank as defined in the Reserve Bank of India Act, 1934 and approved by the president" the words" in any Nationalised Bank approved by the president" shall be substituted.

8. Amendment of bye-laws 38.—Bye-Laws 38 shall be substituted by the following :-

"The Board may appoint the following officers and employees in accordance

Educational qualification, age, pay scale etc. of the candidates for appointment to the said posts shall be same which are time-to-time necessary for Government officers and employees of the same posts.

The Board may revise pay and allowances of the officers/employees with prior approval of the Government ;"

9. After the bye-law 38 the following new bye-law 38 A shall be inserted.—

"38A- (a) If the Presiding Judge of the Tribunal is a retired High Court Judge, he will be getting salary and emoluments in accordance with the provisions for retired High Court Judges. But if he is a retired District Judge, he will be getting the last pay drawn minus pensions as his salary.

(b) If Superintendent is a retired judicial or administrative officer, he, too, will be entitled to the last pay drawn minus pension as his salary".

10. Amendment of bye-laws 43.—(I). In Clause (s) of the bye-law 43 after the words "temporary trustees" the following new words shall be added :-

" and to appoint trustees in vacancies created by the removal under section 28(2)(h) of the Act subject to the wishes of the founder or to a mutual compromise between the Board and the trust."

(II). After Clause (zii) the following new provisions shall be inserted:-

"(ziii) to enquire into any serious case of dispute or serious allegation and take a decision after hearing the concerned parties."

"(ziv) to decide all disputes whether any trust is a public or a private trust" "(zv) may constitute a trust committee under section 32(1) of the Act:" "(zvi) to grant permission to the trustee or two persons interested in the trust for filing cases in Tribunal for the recovery of the alienated properties or for removal of the encroached trust properties or for the decision on the property disputes referred to it under any provision of the Act." 11.Amendment of bye-laws 55.— The following shall be substituted for bye-laws 55(d) namely

"(d) The settlement of schemes and the appointment of committees under the Act."

12. Insertion of new bye-laws 55 A— After bye-laws 55 following new bye-laws shall be inserted, namely :-

"55A - Any scheme made or modified by the Board under section-32(2) of the Bihar Hindu Religious Trust Act, 1950 or any substituted scheme also for any other scheme will be published in Official Gazette."7 (cid:18)बहार गजट (असाधारण), 15 िसत+बर 2011 13. Amendment in Form-I of Appendix-II .—Serial- 1, 12 and 15 of form-1 of appendix-II of the bye-laws shall be amended as follows.-

(i) In Serial No. 1 of Form 1 Written in Appendix-II of Bye-laws, the words "serial No." shall be substituted by the words "registration No.,"

(ii) Serial no. 12 of Form-1 of Appendix-II of Bye-Laws shall be substituted by the following:- "12. Annual Income, This should be of the Preceding Financial Year and should be shown as below:-

(a) Income from landed properties. (b) Income from offerings. (c) Income from various fees. (d) Income from sale proceeds. (e) Income from rent. (f) Income from donation. (g) Income from any grant from the Government or Bank or any

other institutions.

(h) Consolidated surplus amounts from institutions run by the trust after deduction all loans and interests, if the surplus is not carried forward under provisions of the Income Tax Act." (iii) The following new Serial no.-15A shall be added after Serial no.-15:-

"15A. Details of any institution established by the Trusts."
