एस0ओ0 372, दिनांक 29 सितम्बर 2011—न्यूनतम मजदूरी अधिनियम, 1948 (11, 1948) की धारा-5 की उप-धारा (2) के साथ पठित उक्त अधिनियम की धारा-3 की उप-धारा-(1) के खंड (बी) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा उक्त अधिनियम की धारा-5 की उप-धारा-1 के खण्ड-(बी) के अधीन अधिसूचित प्रस्ताव पर प्राप्त सभी अभ्यावेदनों पर विचार करने तथा बिहार न्यूनतम मजदूरी परामर्शदातृ पर्षद से भी परामर्श करने के पश्चात्‌ बिहार-राज्यपाल निम्नांकित अनुसूचित नियोजनों में नियोजित कुछ कोटि के कर्मचारियों के लिए श्रम संसाधन विभाग की अधिसूचना संख्या 3323, 3324, दिनांक 01 जुलाई 2008 तथा अधिसूचना सं0 4993, 4994, दिनांक 01 अक्तूबर 2008 एवं अन्य में निर्धारित न्यूनतम मजदूरी की दरों का पुनरीक्षण करते हैं जैसा कि इसके साथ अनुबद्ध अनुसूची के स्तंभ-3 में उक्त अनुसूची के स्तंभ-2 में तत्संबंधी प्रतिवष्टियों में विर्निर्दिष्ट प्रत्येक केाटि के कर्मचारियों के सामने दर्शायी गयी है, सम्पूर्ण बिहार राज्य में उक्त नियोजन में नियोजित ऐसी विभिन्न कोटि के कर्मचारियों को भुगतेय होगी। 2. इस प्रकार पुनरीक्षित मजदूरी न्यूनतम दरें उक्त अधिनियम की धारा-4 की उप-धारा (1) के खण्ड-(III) के अन्र्तगत होगी। 3. यह अधिसूचना दिनांक 01 अक्टूबर, 2011 से प्रभावी होगी।

टिप्पणी :- (क) न्यूनतम मजदूरी की उपर्युक्त दरें अखिल भारतीय उपभोक्ता मूल्य सूचकांक (1960-100) 4120.07 बिन्दु जो वर्ष, 2010 के द्वितीय अर्द्धांश (जुलाई-दिसम्बर) का औसत है एवं दिनांक 16 सितम्बर 2011 को सम्पन्न न्यूनतम मजदूरी परामर्शदातृ पर्षद की बैठक में लिये गये निर्णय के अनुसार यह पुनरीक्षण वर्ष, 2011 के प्रथम अर्द्धांश (जनवरी-जून) के औसत उपभोक्ता मूल्य सूचकांक 4260.83 बिन्दु पर वृद्धि 4.81 प्रतिशत के समायोजन पर आधारित है, जो कि 15 प्रतिशत वृद्धि के अन्तर्गत है। अगली परिवर्त्तनशील मंहगाई भत्ता की गणना वर्ष, 2011 के द्वितीय अर्द्धांश (जुलाई-दिसम्बर) के औसत उपभोक्ता मूल्य सूचकांक पर आधारित होगा। (ख) दिनांक 16 सितम्बर 2011 को बिहार न्यूनतम मजदूरी परामर्शदातृ पर्षद के परामर्श के आलोक में उपभोक्ता मूल्य सूचकांक में 100 प्रतिशत शून्यीकरण के अतिरिक्त 15 प्रतिशत जोड़कर न्यूनतम मजदूरी की दर पुनरीक्षित किया गया है। (ग) मासिक मजदूरी की दरों का दैनिक मजदूरी की दरों में तथा दैनिक मजदूरी दरों का मासिक मजदूरी की दरों में रूपान्तरण क्रमशः मासिक मजदूरी की दरों में 26 से भाग देकर तथा दैनिक मजदूरी की दरों में 26 से गुणा करके किया जाएगा। (घ) न्यूनतम मजदूरी की उपर्युक्त दरों में सात दिनों की अवधि में विश्राम के दिन के लिए कर्मचारियों को देय पारिश्रमिक शामिल है। (ड.) साप्ताहिक विश्राम के दिन काम करनेवाला कर्मचारी बिहार न्यूनतम मजदूरी नियमावली, 1951 के नियम-25 में विहित दर से समयोपरि काम का दो गुणा मजदूरी भुगतान पाने का हकदार होगा। (च) पुरूष या स्त्री कामगार एक ही काम या उसी प्रकार के काम के लिए समान दर पर मजदूरी पायेंगे। स्पष्टीकरण :-(क) ßअकुशल कामÞ से अभिप्रेत है जिसमें बहुत ही कम या कुछ भी नहीं कुशलता या अनुभव की आवश्यकता होती है बल्कि वह बहुत ही साधारण प्रकृति का होता है। (ख) ßअर्द्ध-कुशल कामÞ से अभिप्रेत है वह काम जिसमें काम के अनुभव के आधार पर कुछ डिग्री या कुशलता या क्षमता की आवश्यकता होती है और जो कुशल कर्मचारी के पर्यवेक्षण/मार्गदर्शन में किया जा सकता है तथा इसके अन्र्तगत अकुशल पर्यवेक्षण का काम भी है। (ग) ßकुशल कामÞ से अभिप्रेत है जिसमें कोई कार्य के अनुभव के आधार पर या किसी तकनीकि या किसी व्यवसायिक संस्थान में शिल्पी के रूप में प्रशिक्षण के आधार पर अर्जित कुशलता या क्षमता की आवश्यकता होती है तथा जिसके सम्पादन के लिए पहल और विवेक की आवश्यकता होती है। (घ) ßअतिकुशल कामÞ से अभिप्रेत है वह काम जिसमें सघन तकनीकि या व्यवसायिक प्रशिक्षण या वर्षों के व्यवहारिक कार्य के अनुभव के आधार पर अर्जित कुछ खास कार्यों के सम्पादन में पूर्तियाँ की डिग्री और पूर्ण क्षमता की आवश्यकता होती है और इन कार्यों के निष्पादन के लिए कामगारों में विशेष या विनिश्चयों के लिए पूरी जवाबदेही की आवश्यकता होती है।

एस0ओ0 373, एस0ओ0 372, दिनांक 29 सितम्बर 2011 का अंग्रेजी में निम्नलिखित अनुवाद बिहार राज्य के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारत संविधान के अनुच्छेद-348 के खंड (3) के अधीन प्राधिकृत पाठ समझा जायेगा।

S.O. 372, dated 29th September 2011—In exercise of power conferred by clause (b) of sub-section (1) of section- 3 of the Minimum Wages Act, 1948 (11, of 1948) read with sub-section- 2 of section-5 of said Act and after having considered all the representations received on the proposal notified under clause (b) sub-section (1) of section- 5 of the said Act and also after consulting to Bihar Minimum Wages Advisory Board, the Governor of Bihar is pleased to revise the minimum rates of wages fixed by Labour Resources Department vide notification no. 3323, 3324, dated 01st July 2008 and notification no. 4993, 4994, dated 01st October 2008 and others for certain categories of employees employed in the following employments in the State of Bihar as specified in columns- 3 of the schedule-II hereto annexed against each such category & employees specified in the corresponding entry in column- 2 thereof which shall be payable in the whole of the State of Bihar to such different categories of employees employed in the said empolyment. 2. The Minimum rates of wages so revised shall be within the meaning of clause (iii) of sub-section-(1) of section-4 of the said Act. 3. This notification shall come into force with effect from the date of 01 October, 2011.

Note:—(a) The minimum rates of wages above are based on the All India Average Consumer Price Index Number (1960-100) 4120.07 point which is the average of the indices of the Second half of the year, 2010 (July-December) and as per decision taken in the meeting of the Minimum Wages Advisory Board held on dated 16th September 2011, this revision includes the average of first half of All India Consumer Price Index of year, 2011 i.e 4260.83 point, increase i.e 4.81 percent in the wage hike of 15 percent. Next Variable Dearness Allowance will be applicable on the average of All India Consumer Price Index of second half (July-December) of the year, 2011.

(b) Minimum rates of wages has been revised on the suggestions made by the Minimum Wage Advisory Board on 16th September 2011 by adding 15 percent of wages additional after 100 percent neutralization of consumer price index.

(c) Conversion of the monthly rate of wages into daily rates of wages and vice- versa shall be worked out by dividing the monthly rates by 26 and by multiplying the daily rates by 26.

(d) The Minimum rates of wages above are inclusive of the remuneration payable to the workers in respect of the day of rest in every period of seven days.

(e) A worker shall for the work done on the weekly day of rest be entitled to overtime payment as the rate prescribed in rule 25 of the Bihar Minimum Wages Rule, 1951.

(f) Men and Women workers shall get the same rates of wages for the same work or a similar nature of work.

Explanation :-

(a) "Unskilled work" means work which involve simple operations requiring little or no skill or experience on the job.

(b) "Semi-skilled" work means work which involves some degree of skill of competence acquired through experience on the job and which is capable of being7 (cid:18)बहार गजट (असाधारण), 29 िसत.बर 2011 performed under the supervision or guidance of a skilled employee and includes unskilled supervisory workers.

(c) "Skilled works" is one which involves skill or competence acquired through experience on the job or through training as an apprentice in technical or vocational institute and the performance of which calls for initative and judgment.

(d) "Highly Skilled" work means work which call for a degree of perfection and full competence in performance of certain tasks acquired through intensive technical or professional training or practical works experience for long years and also requires of a work to assume full responsibility for the judgment or decisions involved in the execution of these tasks.
