का.आ. (अ).- राश्ट्रपति, लोक प्रतिनिधत्व अधिनियम, 1951 (1951 का 43) की धारा-12 के अनुसरण में, नीचे सारणी के स्तंभ (2) में विनिर्दिश्ट प्रत्येक राज्य की विधान-सभा के निर्वाचित सदस्यों से, उक्त अधिनियम के उपबंधों और उसके अधीन बनाए गए नियमों और किए गए आदेषों के अनुसार, राज्य सभा के उन सदस्य (सदस्यों) के स्थान (स्थानों) को भरने के प्रयोजन के लिए, जिनकी पदावधि उक्त सारणी के स्तंभ (4) में तत्स्थानी प्रविश्टि में उल्लिखित तारीख को समाप्त होनी है, उनकी पदावधि के अवसान पर उक्त सारणी के स्तंभ (3) में प्रत्येक राज्य के सामने विनिर्दिश्ट संख्या में सदस्य (सदस्यों) को निर्वाचित करने की अपेक्षा करती है :-

New Delhi, the 12th March, 2012/22 Phalguna, 1933 (Saka)

S.O. (E).-In pursuance of section 12 of Representation of the People Act, 1951 (43 of 1951), the President is pleased to call upon the elected members of the Legislative Assembly of each State specified in column (2) of the Table below, to elect in accordance with the provisions of the said Act and of the rules and orders made thereunder, the number of member(s) specified against each State in column (3) of the said Table, for the purpose of filling the seat(s) of member (s) of the Council of States whose term of office is due to expire on the date mentioned in the corresponding entry in column (4) of the said Table, on the expiration of their term of office :-

सं0 318/रा0 स0 - बिहार/1/2012 (1) :- यतः, भारत के राश्ट्रपति लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-12 के अधीन जारी और 12 मार्च 2012 को भारत के राजपत्र मेें प्रकाषित अधिसूचना द्वारा बिहार राज्य की विधान-सभा के निर्वाचित सदस्यों से यह अपेक्षा की है कि वे छः सदस्यों की, 2 अप्रैल 2012 को उनकी पदावधि के अवसान, पर सेवा निवृत्त होने से राज्य सभा में उत्पन्न रिक्ति को भरने के लिए उक्त सदन हेतु छः सदस्य निर्वाचित कर दें ।

अतः, अब, उक्त अधिनियम की धारा-39 की उप-धारा (1) और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा ः-

(अ) उक्त वर्णित राज्यों में प्रत्येक निर्वाचन के संबंध में :-

(क) नाम निर्देषन करने की अन्तिम तारीख -19 मार्च, 2012 (सोमवार) (ख) नाम निर्देषन की संवीक्षा की तारीख -20 मार्च, 2012 (मंगलवार) (ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख-23 मार्च, 2012 (षुक्रवार) (घ) वह तारीख, जिसको यदि आवष्यक हुआ तो मतदान होगा, और -30 मार्च, 2012 (षुक्रवार) ं (ड़) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा 1 अप्रैल, 2012 (रविवार)

नियत करता है; और

(आ) 9.00 बजे पूर्वाह्न से 4.00 बजे अपराह्‌न तक का समय, उस समय के रूप में नियत करता है जिसके दौरान यदि आवष्यक हुआ है तो, उक्त विनिर्दिश्ट तारीख को, मतदान होगा ।

Dated : 12th March, 2012 Phalguna 22, 1933 (Saka) No. 318/CS-BR/1/2012 (1) :- Whereas, the President of India has, by notification issued under Section 12 of the Representation of the People Act, 1951(43 of 1951) and published in the Gazette of India on 12th March, 2012, been pleased to call upon the elected members of the Legislative Assembly of the State of Bihar to elect six members to the Council of States from Bihar to fill the vacancy in that House to be caused due to the retirement of six members on 2nd April, 2012, on the expiration of their term of office; Now, therefore, in pursuance of sub-section (1) of section 39 and section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby- (A) appoints, with respect to the said election; ,

(a) the 19th March, 2012 (Monday), as the last date for making nominations; (b) the 20th March, 2012 (Tuesday), as the date for the scrutiny of the nominations; (c) the 23rd March, 2012 (Friday), as the last date for the withdrawal of candidatures;

(d) the 30th March, 2012 (Friday), as the date on which a poll shall, if necessary, be taken; and

(e) the 1st April, 2012 (Sunday), as the date before which the election shall be completed; and

(B) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.

(I) उक्त सारणी के स्तम्भ (ंं1ं) में विनिर्दिश्ट अधिकारी को रिटर्निंंग आफिसर पदाभिहित करता है ; और (II) उक्त सारण्ाीं के स्तम्भ (2) में ं विनिर्दिश्ट अधिकारीं को, रिटर्निंग आफिसर की उसके कृत्यों के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

(i) designates the officer, specified in column (1) of the TABLE below, to be the Returning Officer; and

(ii) appoints the officer, specified in column (2) of the said TABLE, to be the

Assistant Returning Officer to assist the Returning Officer in the performance of his functions;
