आर0 के0 प्रसाद,,,, संयुक्त सचिव।2 (cid:18)बहार गजट (असाधारण), 9 अूील 2012 fuokZpu foHkkx ——— vf/klwpuk 9 vizhy 2012 सं0 बी1-3-28/2012-09—यतः बिहार राज्य में, राज्य की विधान-सभा के सदस्यों द्वारा निर्वाचित राज्य की विधान परिशद के ग्यारह सदस्यों के स्थान 6 मई, 2012 को उनकी पदावधि समाप्त होने तथा सेवानिवृत्त होने पर रिक्त होने हैं।

यतः इस प्रकार उत्पन्न हुई रिक्त्यिों को भरने के प्रयोजन से द्विवार्शिक निर्वाचन कराया जाना है;

अतः, अब, लोक प्रतिनिधित्व अधिनियम 1951 (1951 का 43) की धारा-16 के अनुसरण में, जैसा की निर्वाचन आयोग ने सिफारिष की है कि बिहार राज्य के राज्यपाल इसके द्वारा राज्य की विधान-सभा के सदस्यों से यह अपेक्षा करते हैं कि वे, उक्त अधिनियम के उपबन्धों और उसके अधीन बनाए गए नियमों और आदेषों के अनुसार, उक्त रिक्तियों को भरने के प्रयोजन से राज्य की विधान परिशद्‌ के लिए ग्यारह सदस्य निर्वाचित कर दें।

No. B1-3-28/2012-09—WHEREAS, the seats of eleven members of the Legislative Council of the State of Bihar, elected by the members of Legislative Assembly of the State, are due to fall vacant on 6th May, 2012, on the retirement of those members, on the expiration of their term of office; and

WHEREAS, a biennial election has to be held for the purpose of filling the above vacancies so arising;

NOW, THEREFORE, as recommended by the Election Commission of India in pursuance of section 16 of the Representation of the People Act, 1951 (43 of 1951), the Governor of the Stateof Bihar is hereby pleased to call upon the members of the Legislative Assembly of the State, to elect eleven members to the Legislative Council of the State, for the purpose of filling the above vacancies, in accordance with the provisions of the said Act and of the rules and orders made thereunder.

सं. 322/बिहार-वि322/बिहार-वि322/बिहार-वि322/बिहार-वि....पपपप..../1/2012 (/1/2012 (/1/2012 (/1/2012 (1) :- यतः्‌ बिहार राज्य के राज्यपाल ने, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-16 के अधीन जारी और राज्य के शासकीय राजपत्र में 9 अप्रैल, 2012 को प्रकाषित अधिसूचना द्वारा राज्य की विधान-सभा के सदस्यों सेे यह अपेक्षा की है कि वे बिहार राज्य में विधान परिशद्‌ के लिए ग्यारह सदस्य निर्वाचित कर दें ।

अतः, अब, उक्त अधिनियम की, धारा-39 की उप-धारा (1) और धारा-56 के अनुसरण मे, भारत निर्वाचन आयोग एतद्‌द्वारा :-

(अ) उक्त निर्वाचन के संबंध में :-

(क) नाम निर्देषन करने की अन्तिम तारीख - 16 अप्रैल, 2012 (सोमवार) (ख) नाम निर्देषन की संवीक्षा की तारीख - 17 अप्रैल, 2012 (मंगलवार) (ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख- 19 अप्रैल, 2012 (गुरूवार) (घ) वह तारीख, जिसको यदि आवष्यक हुआ तो मतदान होगा- 26 अप्रैल, 2012 (गुरूवार), और (डज्ञ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा- 30 अप्रैल, 2012 (सोमवार) नियत करता है; और

(आ) 9.00 बजे पूर्वाहन्‌ से 4.00 बजे अपराह्‌न तक का समय, उस समय के रूप में नियत करता है जिसके दौरान यदि आवष्यक हुआ तो, उक्त विनिर्दिश्ट तारीख को मतदान होगा ।

ELECTION COMMISSION OF INDIA —————— NOTIFICATION Nirvachan Sadan, Ashoka Road, New Delhi-110 001 dated 9th April, 2012/Chaitra 20, 1934 (Saka) No. 322/BR-LC/1/2012 (1) : - WHEREAS, the Governor of the State of Bihar has, by notification issued under section 16 of the Representation of the People Act, 1951 (43 of 1951) and published in the official Gazette of the State on 9th April, 2012, been pleased to call upon the members of the Legislative Assembly of the State, to elect eleven members to the Legislative Council of the State :- Now, therefore, in pursuance of sub-section (1) of section 39 and section 56 of the said Act, the Election Commission of India hereby – (A) appoints, with respect to the said election –

(a) the 16th April, 2012 (Monday), as the last date for making nominations; (b) the 17th April, 2012 (Tuesday), as the date for the scrutiny of the nominations; (c) the 19th April, 2012 (Thursday), as the last date for the withdrawal of candidatures; (d) the 26th April, 2012 (Thursday), as the date on which a poll shall, if necessary, be taken; and

(e) the 30th April, 2012 (Monday), as the date before which the election shall be completed; and

(B) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken on the date specified above, for the election.

सं. 322/बिहार-वि.प./1/2012 (2) :- लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा-21 के अनुसरण में और धारा-22 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्वाचन आयोग, बिहार सरकार के परामर्ष से एतद्‌द्वारा तारीख 9 अप्रैल, 2012 को राज्य के शासकीय राजपत्र में प्रकाषित राज्यपाल की अधिसूचना के अनुसरण में राज्य की विधान-सभा के सदस्यों द्वारा, बिहार राज्य की विधान परिशद्‌ के लिए द्विवार्शिक निर्वाचन के संबंध में :-

(I) नीचे की सारणी के स्तम्भ (1) में विनिर्दिश्ट अधिकारी को रिटर्निग आफिसर के रूप में पदाभिहित करता है; और (II) उक्त सारणी के स्तम्भ (2) में विनिर्दिश्ट अधिकारी को रिटर्निंग आफिसर की उसके कृत्यांें के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।
