सं0 17-स्था0(अधिसूचना)-210/2011-384—बिहार विशेष सर्वेक्षण एवं बंदोबस्त अधिनियम, 2011 की धारा-3 के आलोक में बिहार अभिघृति अधिनियम, 1885 (बिहार अधिनियम, VIII, 1885) की धारा-101 की उप-धारा (1) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल आदेश देते हैं कि बिहार और उड़ीसा म्यूनिसिपल एक्ट, 1922 (बिहार और उड़ीसा एक्ट, 7, 1922) के अन्तर्गत सभी नगरपालिकाओं और अधिसूचित क्षेत्र समितियों की स्थानीय सीमाओं के भीतर समाविष्ट क्षेत्रों को छोड़कर बिहार के 08 जिलों यथा बेगूसराय, लखीसराय, खगड़िया, जमुई, सिवान, पूर्णियाँ, कटिहार, मोतिहारी के अनुबद्ध अनुसूची में वर्णित कुल 117 अंचलों की स्थानीय सीमाओं के भीतर अवस्थित रेलवे की जमीनों और सरकारी जमीनों सहित सभी जमीनों का भू-सर्वेक्षण (अंतिम प्रकाशन स्तर तक) किया जाएगा और उसके संबंध में अधिकार अभिलेख तैयार किया जाएगा।
2. उक्त सर्वेक्षण एवं अधिकार अभिलेख में अभिलिखित की जाने वाली प्रविष्टियाँ निम्न रूप में होगी :-
(क) प्रत्येक रैयत अथवा अभिधारी का नाम (ख) प्रत्येक अभिधारी का वर्ग अर्थात वह पट्टेदार अथवा निश्चित लगान धारण करने वाला रैयत है अथवा गैर लगान रैयत या दर रैयत है। यदि वह पट्टेदार रैयत है तो स्थायी पट्टेदार रैयत है या नही और उसके पट्टेदार की अवधि में लगान बढ़ने वाला है या नही।
(ग) प्रत्येक अभिधारी अथवा अधिभोगी द्वारा धारित भूमि की स्थिति परिमाप और एक या अधिक चौहद्दियाँ। (घ) अधिकार अभिलेख तैयार करते समय भुगतेय लगान। (ङ) लगान नियत करने की रीति संविदा द्वारा नियत किया गया है या न्यायालय के आदेश द्वारा या किसी अन्य तरीके से।
(च) यदि लगान उत्तरोतर बढ़ने वाला हो तो वह किस समय तथा किन कार्रवाईयों से बढ़ता है। (छ) निम्नलिखित के संबंध में हर एक अभिधारी और भू-स्वामी के अधिकारी की बाध्यता।
(i) कृषि प्रयोजनों के लिए अभिधारियों द्वारा किसी नदी, तालाब या कुएँ या किसी अन्य आपूर्ति स्रोत से जल के उपयोग के संबंध में और
(ii) हरेक अभिधारी द्वारा धारित भूमि पर खेती के लिए जलापूर्ति सुनिश्चित करने के निमित साधित्र की मरम्मत और अनुरक्षण के संबंध में चाहे ऐसी साधित्र ऐसी भूमि की सीमाओं के भीतर अवस्थित हो या नही2 (cid:18)बहार गजट (असाधारण), 16 मई 2012 (ज) अभिधृति की कोई विशेष शर्त्त और अनुपात
(झ) जिन जमीनों का अधिकार अभिलेख तैयार किया जाता है उससे संबद्ध आवागमन संबंधी कोई अधिकार या अन्य सुविधाएँ।
(ञ) यदि भूमि के लगानमुक्त रूप में धारित होने का दावा किया जाए तो वस्तुतः लगान चुकाया जाता है या नही और यदि नही तो अधिभोगी लगान के भुगतान के बिना जमीन धारण करने का हकदार है या नही यदि है तो किस प्राधिकार के अधीन और
(ट) उक्त अधिनियम के अध्याय II में वर्णित प्रत्येक भू-स्वामी की निजी जमीन की अवस्थिति परिमाप और एक या अधिक चौहद्दियाँ।

No. 17-Astha.(Adhisuchana)-210/2011-384—In Exercise of powers under section - 3 of the Bihar Special Survey & Settlement Act, 2011 read with sub-section (1) of section 101 of the Bihar Tenancy Act, 1885 (Bihar Act VIII of 1885), the Governor of Bihar, is pleased to order that a survey shall be made (upto final publication stage) and record of rights prepared in respect of all lands including railways and Government lands comprised within external boundries of all the villages included in 117 "Anchals mentioned in the schedule here under of the 8 districts of the state of Bihar namely Begusarai, Lakhisarai,3 (cid:18)बहार गजट (असाधारण), 16 ebZ 2012 Khagaria, Jamui, Siwan, Purnia, Katihar, Motihari except of land comprised within the local limits of a Municipality Act, 1922 (Bihar and Orrissa Act, 7 of 1922).
2. The particulars to be recorded in the Survey and Record of Rights shall be comprising the following :-
(a) The name of each tenant or occupancy, (b) The class to which each tenant belongs that is to say whether he is a tenure holder, raiyat holding at fixed rates, non-occupancy raiyat or under raiyat, and if he is a tenure holder, Whether he is a permanent tenure-holder or not and whether his rent is liable to enhancement during the continuance of his tenure, (c) The situation and quantity and one or more boundaries of the Land held by each tenant or occupier,
(d) The rent payable at the time the Record of Rights is being prepared, (e) The manner in which that rent has been fixed whether by contract, by order of court, or otherwise.
(f) If the rent is gradually increasing the time at which and the steps by which it is increasing,
(g) The rights and obligations of each tenant and landlord in respect of :- (i) The use of water by tenants for agricultural purpose, whether obtained from a river, Jhil, tank or well or any other sources of supply and
(ii) The repair and maintenance of appliances for securing supply of water for the cultivation of Land held by each tenant whether or not such appliance be situated within the boundaries of such Land,
(h) The special conditions and incidents, if any of the tenancy, (i) any right of way or other ensement attaching to the Land for which a Record of Rights is being prepared.
(j) If the land is claimed to be held rent free, whether or not rent is actually paid and, if not paid, whether or not the occupant is entitled to hold the land without payment of rent and if so entitled, under what authority.
(k) The situation, quantity and one or more of the boundaries of each proprietor's private land as defined in chapter XI of the said Act.
