5 जुलाई 2012 सं0 8/लोक-05-03/2012-सा0-9662—बिहार लोकायुक्त अधिनियम, 2011 की धारा-55 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार-राज्यपाल, लोकायुक्त के अध्यक्ष या अन्य सदस्यों का चयन करने के लिए गठित की जाने वाली खोजबीन समिति का कार्यकाल एवं समिति के सदस्यों को भुगतेय वेतन एवं भत्तों के लिए निम्नलिखित नियमावली बनाते हैं :- 1 संक्षिप्त नाम एवं प्रारम्भ ।-संक्षिप्त नाम एवं प्रारम्भ ।-संक्षिप्त नाम एवं प्रारम्भ ।-संक्षिप्त नाम एवं प्रारम्भ ।- (1) यह नियमावली बिहार लोकायुक्त खोजबीन समिति (कार्यकाल, वेतन एवं भत्ते) नियमावली, 2012 कही जा सकेगी। (2) यह तुरत प्रवृत्त होगी।
2 परिभाषाएँपरिभाषाएँपरिभाषाएँपरिभाषाएँ ।- (1) इस नियमावली में, जब तक संदर्भ में अन्यथा अपेक्षित न हो।-
(i) 'अधिनियम' से अभिप्रेत है बिहार लोकायुक्त अधिनियम, 2011; तथा (ii) 'समिति' से अभिप्रेत है अधिनियम की धारा-4 की उप-धारा (3) के अधीन समय-समय पर गठित की जाने वाली खोजबीन समिति।
(2) इस नियमावली में प्रयुक्त, किंतु इसमें अपरिभाषित शब्दों एवं पदों के वही अर्थ होंगे जो अधिनियम में उनके लिए समनुदेषित किये गये हों।
3. समिति का कार्यकाल ।समिति का कार्यकाल ।समिति का कार्यकाल ।समिति का कार्यकाल ।- खोजबीन समिति का कार्यकाल उसके गठन की तिथि के प्रभाव से 4 (चार) माह के लिए होगा।
4. समिति के सदस्यों को देय वेतन एवं भत्तसमिति के सदस्यों को देय वेतन एवं भत्तसमिति के सदस्यों को देय वेतन एवं भत्तसमिति के सदस्यों को देय वेतन एवं भत्ते ।े ।े ।े ।- समिति के सदस्यों को वही वेतन एवं भत्ते देय होंगे जो उन्हें अपने सेवांतकाल में देय था ।
5. यात्रा-यात्रा-यात्रा-यात्रा-भत्ता।भत्ता।भत्ता।भत्ता।- समिति के सदस्यों को ऐसी यात्रा-भत्ता देय होगी जो यात्रा-भत्ता उनकी पंक्ति एवं स्तर के पदाधिकारी को अनुमान्य है।
बिहार-राज्यपाल के आदेष से, नवीन चन्द्र झा, 2 (cid:18)बहार गजट (असाधारण), 10 जुलाई 2012 5 जुलाई 2012 सं0 8/लोक-05-03/2012सा0-9663—अधिसूचना संख्या 9662, दिनांक 05.07.2012 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके ्द्वारा प्रकाशित किया जाता है, जो भारत-संविधान के अनुच्छेद-348 के खंड (3) के अन्तर्गत उक्त अधिसूचना का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

No. 8/Lok-05-03/2012-GA-9662—In exercise of the powers conferred under section-55 of the Bihar Lokayukta Act, 2011, the Governor of Bihar, makes the following Rules for tenure and pay and allowances payable to the Members of the Search Committee to be constituted for selection of Chairperson or other Members of the Lokayukta:- 1. Short title and commencement. - (1) These Rules may be called as The Bihar Lokayukta Search Committee (Tenure, Pay and Allowances) Rules, 2012. (2) It shall come into force at once. 2. Definitions. - (1) In these Rules, unless there is anything repugnant in the context:- (i) 'Act' means the Bihar Lokayukta Act, 2011; and (ii) 'Committee' means the Search Committee to be constituted from time to time under sub-section (3) of Section -4 of the Act. (2) Words and expressions used in these Rules but not defined herein, shall have the same meanings as are assigned to them under the Act. 3. Tenure of the Committee. - The tenure of the Search Committee shall be for 4(four) months with effect from the date of its constitution. 4. Pay and allowances to be payable to the members of the Committee. - The pay and allowances of the members of the Committee shall be the same as was payable to them prior to their retirement. 5. Travelling Allowance.- The members of Committee shall be paid such Travelling Allowance as are admissible to the officers of his rank and status.
