1. संHMN नामसंHMN नामसंHMN नामसंHMN नाम, , , , (cid:18)वःता(cid:18)वःता(cid:18)वःता(cid:18)वःतार और ूारGभर और ूारGभर और ूारGभर और ूारGभ ।—(1) यह िनयमावली (cid:18)बहार (cid:18)विध (cid:18)व12 3बयाकलाप (िनवारण) (अनुशंसा और अिभयोजन क7 ःवीकृ ित) िनयमावली- 2012 कह(cid:15) जा सके गी ।

(2) इसका (cid:18)वःतार सGपूणQ (cid:18)बहार राEय मR होगा। (3) यह राजपऽ मR, इसके ूकाशन क7 ितिथ के ूभाव से ूवृB होगी। 2. . . . पTरभाषापTरभाषापTरभाषापTरभाषा ।—(1) इस िनयमावली मR, जब तक संदभQ मR अVयथा अपेHMत न हो—

(क) ÔÕअिधिनयमÕÕ से अिभूेत है (cid:18)विध (cid:18)व12 3बयाकलाप (िनवारण) अिधिनयम, 1967 (1967 का 37 ).

(ख) ÔÕूािधकरणÕÕ से अिभूेत है राEय सरकार, (cid:18)बहार (cid:26)ारा धारा-45 क7 उप-धारा (2) के अधीन िनयुC होने वाला ूािधकरण ;

(ग) ÔÕसं3हता'' से अिभूेत है दंड ू3बया सं3हता, 1973 ( 1974 का 2)।

(2) इस िनयमावली मR ूयुYत और अपTरभा(cid:18)षत शZद और अिभ[य(cid:18)CयD के वह(cid:15) अथQ हDगे, जो अिधिनयम मR उनके ूित बमश: समनुदेिशत 3कये गये हD।

4. अिभयोजन क7 मंजूर(cid:15) के िलए समयअिभयोजन क7 मंजूर(cid:15) के िलए समयअिभयोजन क7 मंजूर(cid:15) के िलए समयअिभयोजन क7 मंजूर(cid:15) के िलए समय----सीमासीमासीमासीमा।—राEय सरकार, अिधिनयम क7 धारा-45 क7 उप-धारा (2) के अधीन ूािधकरण क7 अनुशंसा क7 ूािN के दस कायQ3दवसD के भीतर अिभयोजन क7 ःवीकृ ित के संबंध मR िनणQय लेगी।[सं0 ए/(cid:18)व(cid:18)वध (53)55/2011Ñ6620] (cid:18)बहार-राEयपाल के आदेश से, आिमर सुबहानी, सरकार के ूधान सिचव। 2 (cid:18)बहार गजट (असाधारण), 24 जुलाई 2012 The 20th July 2012 Bihar Unlawful Activities (Prevention) (Recommendation and Sanction of Prosecution) Rules-2012 S.O. 145, dated 24th July 2012—In exercise of the powers conferred by sub-section (2) of Section 45, read with clause (f) of sub- section (2) of section 52, of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the State Government of Bihar hereby makes the following rules, namely:—

1. Short title, extent and commencement. —(1) These Rules may be called the Bihar Unlawful Activities (Prevention) (Recommendation and Sanction of Prosecution) Rules, 2012.

(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with effect from the date of its publication in the Official Gazatte.

2. Definition.—(1) In these Rules, Unless otherewise requires in the context.—

(a) "Act'' means the Unlawful Activites (Prevention) Act, 1967 (37 of 1967). (b) "Authority" means the Authority to be appointed by the Government of Bihar under sub-section (2) of Section 45;

(2) Words and expression used herein and not defined in these Rules, but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Time limit for making a recommendation by the Authority.—The Authority shall, under sub-section (2) of the Section 45 of the Act, make its report containing the recommendations to the State Government within ten working days of the receipt of the evidence gathered by the investigating officer under the Code.

4. Time limit for sanction of prosecution.—The State Government shall, under sub- section (2) of Section 45 of the Act, take a decision regarding sanction for prosecution within ten working days after receipt of the recommendations of the Authority.
