एस0 ओ0 198, 7दनांक 18 अ/तूबर 2012—चू ँ7क रा:य सरकार क; राय है 7क जॉंच अिधिनयम 1952 (सं0-60, 1952) क; धारा-3(1) (cid:26)ारा ूद?त श(cid:18)@यA के आलोक मD 7दनांक 12.10.2012 को मधुबनी मD पुिलस (cid:26)ारा गोली चालन क; घटना क; जॉंच के िलए एक Hयाियक जॉंच आयोग का गठन आवँयक है ;
अत: (cid:18)बहार के रा:यपाल एकल सदःयीय Hयाियक जॉंच आयोग का गठन करते हL, !जसके अMयN माननीय HयायमूितO ौी उदय िसHहा, अवकाश ूाRत Hयायाधीश, पटना उSच Hयायालय हAगे।
2. आयोग के (cid:18)वचारणीय (cid:18)वHदु िनUनिल!खत हAगे :-
I. मधुबनी मD 7दनांक 12.10.2012 को घ7टत 7हंसा?मक घटनाओं क; पृंटभूिम, घटनाबम और उन ू?यN एवं परोN पZर!ःथितयA क; जॉंच करना !जसके कारण उ/त घटनाऍं हु] ,
II. 7दनांक 12.10.2012 को मधुबनी नगर मD पुिलस के (cid:26)ारा गोली चालन के औिच?य क; जॉंच और आवँयकतानुसार उ?तरदािय?व का िनधाOरण।2 (cid:18)बहार गजट (असाधारण), 18 अ/तूबर 2012 3. उ/त अिधिनयम क; धारा-5(1) (cid:26)ारा ूद?त श(cid:18)@यA का ूयोग करते हुए (cid:18)बहार-रा:यपाल यह भी िनदेश देते हL 7क उ/त अिधिनयम क; धारा-5 क; उप-धारा (2),(3),(4) और (5) के सभी उपबंध आयोग पर लागू हAगे।
4. आयोग (cid:26)ारा जॉंच कर अिधसूचना क; ितिथ से छ: माह के अHदर ूितवेदन सरकार को सम(cid:18)पOत 7कया जायेगा।

The 18th October 2012
S.O. 198, dated 18th October 2012—Whereas in exercise of powers conferred under section 3(1) of the Commissions of Inquiry Act, 1952 (No.60, 1952), the Government of Bihar is of the opinion that it is necessary to appoint a Commission of Inquiry for the purpose of Inquiring into the incident of police firing which took place on 12th October, 2012 in Madhubani town ;
Now, therefore, the Governor of Bihar is pleased to constitute a single member Commission of Inquiry comprising of Hon'ble Mr. Justice Uday Sinha, Retired Justice of Patna High Court as its Chairman.
2. The Commission will have the following terms of reference:-
3 (cid:18)बहार गजट (असाधारण), 18 अ/तूबर 2012i. To inquire into the background of violent incidents, sequence of events and those direct and indirect circumstances, which resulted into occurrence of those incidents,
ii. To inquire into the justification of police firing in Madhubani town on 12.10.2012 and fix the responsibilities there for, if necessary.
3. The Governor of Bihar is further pleased to exercise powers conferred by sub- section (1) of section 5 of the said Act to direct that all the provisions of sub- section (2) (3) (4) and (5) of the said section shall apply to this commission.
4. The Commission shall submit its report within 6 months from issue of this notification.
