सं॰ 9/विविध 14-50/2011-16943-सा0प्र0—भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल बिहार के उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु अधिसूचना सं0 6086 दिनांक 18.10.2009 द्वारा प्रकाशित बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2009 (अधिसूचना सं0 3499 दिनांक 30.03.2011 द्वारा यथा संशोधित) में संशोधन हेतु निम्नांकित संशोधन नियमावली बनाते हैंः-.
1. संक्षिप्त नाम एवं प्रारंभ।- (1) यह नियमावली 'बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति (द्वितीय संशोधन) नियमावली, 2012 कही जा सकेगी। (2) यह तुरत प्रवृत्त होगी।
2. उक्त नियमावली का नियम 3 (ii) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-
''3.(ii)(क) ओलंपिक, विश्व कप, वल्र्ड युनिवर्सिटी गेम, राष्ट्रमंडल खेल, एशियन गेम, एफ्रो- एशियन गेम, एशियन चैम्पियनशिप, पारा ओलंपिक या सैफ गेम के टीम/व्यक्तिगत स्पर्धाओं में देश का प्रतिनिधित्व करते हुए प्रथम, द्वितीय या तृतीय स्थान प्राप्त किया हो; अथवा
(ख) नेशनल गेम, राष्ट्रीय सीनियर/जूनियर चैम्पियनशिप में बिहार राज्य का प्रतिनिधित्व कर टीम/व्यक्तिगत स्पर्धा में प्रथम, द्वितीय या तृतीय स्थान प्राप्त किया हो; अथवा
(ग) ऑल इन्डिया इंटर युनिवर्सिटी टूर्नामेंट में बिहार राज्य के किसी विश्वविद्यालय का प्रतिनिधित्व कर प्रथम, द्वितीय या तृतीय स्थान प्राप्त किया हो; अथवा
(घ) ओलंपिक अथवा राष्ट्रमंडल गेम अथवा एफ्रो-एशियन गेम्स, एशियन गेम्स ़अथवा सैफ गेम्स में भारत का प्रतिनिधित्व किया हो; अथवा
(ड.) नेशनल गेम/नेशनल सीनियर चैम्पियनशिप में कला, संस्कृति एवं युवा विभाग द्वारा इस उद्देश्य हेतु अधिसूचित खेल विधाओं में नियुक्ति के वर्ष के पूर्व के दो वर्षोंं में बिहार राज्य का प्रतिनिधित्व किया हो।
(च) नेशनल गेम के वैसे खेल विधा, जो नियम 2(vi) के अधीन परिभाषित नहीं हैं, में बिहार राज्य का प्रतिनिधित्व करते हुए प्रथम, द्वितीय एवं तृतीय स्थान प्राप्त किया हो।2 (cid:18)बहार गजट (असाधारण), 12 *दस,बर 2012 उपर्युक्त अधिसूचित खेल विधाओं में समय-समय पर कला, संस्कृति एवं युवा विभाग द्वारा परिवर्तन किया जा सकेगा, लेकिन किसी प्रासंगिक वर्ष में नियुक्ति विज्ञापन की तिथि तक अधिसूचित खेल विधाओं के आधार होगा :
परंतु किसी अन्य खेल विधा में सीधे प्रवेश को मान्यता नहीं दी जाएगी बल्कि राज्य संघ/फेडेरेशन की ओर से चयनित होकर बिहार राज्य का प्रतिनिधित्व किया जाना आवश्यक होगा।''
3. उक्त नियमावली का नियम 4.7 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-
''4.7 विभिन्न खेल विधाओं संबंधी अर्हता एवं इन्टरमीडिएट या समकक्ष एवं उच्चतर शैक्षणिक अर्हता प्राप्त उत्कृष्ट खिलाड़ी की नियुक्ति चयन समिति की अनुशंसा के आधार पर संबंधित नियुक्ति प्राधिकार द्वारा ग्रेड-पे र 1900/- के विभिन्न पदों पर की जायेगी और मैट्रिक या समकक्ष शैक्षणिक अर्हता प्राप्त उत्कृष्ट खिलाड़ी की नियुक्ति चयन समिति की अनुशंसा के आधार पर संबंधित नियुक्ति प्राधिकार द्वारा ग्रेड-पे र 1800/- के विभिन्न पदों पर की जायेगी। विशेष परिस्थिति में इस नियमावली के अंतर्गत उत्कृष्ट खिलाड़ियों की नियुक्ति समूह ''ख'' में भी की जा सकेगी। किसी खेल विधा में उत्कृष्ट खिलाड़ियों के चयन में किसी तरह का विवाद होने पर चयन समिति का निर्णय अंतिम होगा।''
4. उक्त नियमावली का नियम 4.8 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-
''4.8 किसी खेल विधा में, एक वर्ष में पॉंच से अधिक उत्कृष्ट खिलाड़ियों की नियुक्ति नहीं की जायेगी परंतु केवल प्रतिभागिता (participation) के आधार पर {नियम 3 (ii) (ङ)} एक खेल विधा में अधिकतम तीन उत्कृष्ट खिलाड़ियों की ही नियुक्ति पर विचार किया जायेगा, जो किसी संवर्ग के कुल बल (मूल कोटि) के 10 प्रतिशत के अन्तर्गत होगा। इस हेतु सभी संवर्गीय नियमावली, इस हद तक संशोधित समझे जायेंगे। विकलांग खिलाड़ियों के लिए आयोजित मान्यता प्राप्त, सभी खेल विधाओं को एक ही खेल विधा मानते हुए नियुक्ति के लिए समेकित रुप से विचार किया जायेगा।''

सं॰ 9/विविध 14-50/2011 सा॰प्र0-16944/अधिसूचना संख्या 16943 दिनांक 12.12.2012 के तहत् निर्गत बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति (द्वितीय संशोधन) नियमावली, 2012 का निम्नलिखित अँगरेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाशित किया जाता है, जिसे भारत- संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन उक्त नियमावली का अँगरेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

No. . 9/Misc.-14-50/2011-16943-GA-—In exercise of the powers conferred under proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following amendment Rules to amend The Bihar Outstanding Sports Person Appointment Rules, 2009 (as amended by notification no.- 3499 dated 30.03.2011) published vide notification no.- 6086 dated 18.10.2009 for appointment of outstanding sports persons:-
1.Short title and commencement. –(1) These Rules may be called "The Bihar Outstanding Sports Person Appointment (Second Amendment) Rules, 2012 .
(2) lt shall come into force at once. 2. said Rule 3(ii) of the said Rules shall be substituted by the following:-
"3(ii)(a) has secured First, Second or Third position in the team/ personal events by representing the country in the Olympic, World cup, World University games, Commonwealth games, Asian games, Afro-Asian games, Asian Championship, Para Olympic or SAF games, or
(b) has secured First, Second or Third position in the team/personal events in National games, National Senior/Junior Championship, or
(c) has secured First, Second or Third position in All India Inter University Tournament by representing any University of Bihar State, or
(d) has represented India in Olympic or Commonwealth games or Afro-Asian games, Asian games or SAF games, or3 (cid:18)बहार गजट (असाधारण), 12 *दस,बर 2012 (e) has represented in previous two years before the year of appointment in National games/ National Senior Championship in any sports discipline notified by the Department of Art, Culture and Youth.
(f) has secured first, second and third position by representing the state of Bihar in the sports discipline of National Games which are not defined under rule 2(vi).
Department of Art, Culture and Youth may change the list of such notified sports discipline time to time, but appointment shall be made according to the list of sports discipline notified till the date of advertisement in any relevant year. Provided that, direct participation in any sports discipline shall not be recognized. Representation of Bihar State on the basis of selected participant of any State Association/ Federation shall be must."
3. Rule 4.7 of the said Rules shall be substituted by the following:-
"4.7. Outstanding sports person having requisite qualification with respect to sports discipline and having Intermediate or equivalent and higher educational qualification shall be appointed on various posts in Grade pay `1900 by the appointing authority on the basis of recommendation of Selection Committee and outstanding sports person having Matriculation or equivalent educational qualification shall be appointed in various posts in Grade pay `1800 on the basis of recommendation of Selection committee. Outstanding Sports person, in special circumstances, may be appointed under these Rules in Group 'B' post also.
Decision of the Selection Committee shall be final in case of dispute regarding selection of outstanding sports person in any sports discipline."
4. Rule 4.8 of the said Rules shall be substituted by the following:-
"4.8. Not more than five outstanding sports persons shall be appointed in a year in any sports discipline, but in case of participation only {rule 3(ii) (e)}, only three outstanding sports persons in any one sports discipline shall be considered for appointment, which will be under 10% of total strength (basic grade) of any cadre. For this purpose, all cadre rules shall deemed to be amended to this extent. All recognized sports discipline organized for the physically handicapped sports person shall be considered as one sports discipline collectively for the purpose of appointment."
