21 दिसम्बर 2012 सं सा॰प्र॰ PV/OMNMCबि.रा.अ-QVQ—भारत-संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल बिहार अभिलेखीय सेवा संवर्ग की भर्ती की प्रक्रिया एवं सेवा-शर्तों को विनियंत्रिात करने के लिए निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ 1 - ;1द्ध यह नियमावली फ्बिहार अभिलेखीय संवर्ग नियमावली 2012य् कही जा सकेगी।
;2द्ध इसका विस्तार संपूर्ण बिहार राज्य में होगा। ;3द्ध यह अध्सिूचना की तिथि से प्रवृत होगी। 2. परिभाषाएं । - जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में -
;iद्ध फ्राज्य सरकारय् से अभिप्रेत है बिहार-सरकार, ;iiद्ध फ्नियुक्ति प्राध्किारय् से अभिप्रेत है अभिलेख निदेशक, बिहार राज्य अभिलेखागार निदेशालयऋ ;iiiद्ध फ्विभागय् से अभिप्रेत है मंत्रिामंडल सचिवालय विभाग, तथा ;ivद्ध फ्आयोगय् से अभिप्रेत है बिहार कर्मचारी चयन आयोग।
3. संवर्ग का गठन । - ;1द्ध इस संवर्ग में निम्नलिखित कोटि के पद होंगेः-
;iद्ध पुराभिलेखपाल ;iiद्ध सहायक निदेशक, अभिलेख ;iiiद्ध उप निदेशक, अभिलेख2 (cid:18)बहार गजट (असाधारण), 26 ,दस.बर 2012 उपर्युक्त कोटि के पदों का वेतनमान अनुसूची - I के आधर पर होगा जो, समय-समय पर, राज्य सरकार द्वारा किये गये संशोध्न के अनुसार संशोध्ति समझा जाएगा ।
;2द्ध इस नियमावली के प्रवृत्त होने के पूर्व से सृजित सहायक पुराभिलेखपाल एवं शोध् सहायक के पद को पुराभिलेखपाल के रूप में पदनामित माना जाएगा तथा इस नियमावली के प्रवृत्त होने की तिथि के पूर्व सहायक पुराभिलेखपाल तथा शोध् सहायक के पद पर कार्यरत व्यक्ति, पुराभिलेखपाल के पद पर कार्यरत माने जायेंगे। इनकी आपसी वरीयता का निर्धरण उनकी नियुक्ति की तिथि के आधर पर किया जायेगा।
;3द्ध इस नियमावली के प्रवृत्त होने की तिथि से प्रशिक्षण सह प्रदर्शनी पदाध्किारी एवं क्षेत्राीय अभिलेखागार पदाध्किारी के पदों को सहायक अभिलेख निदेशक के रूप में पदनामित माना जायेगा। 4. संवर्ग बल। - संवर्ग के विभिन्न कोटियों का संवर्ग बल वही होगा, जो, समय-समय पर, सरकार द्वारा अवधरित किया जाय। संवर्ग बल राज्य सरकार द्वारा, विभिन्न कोटि के अधीन पदों के सृजन के आलोक में संवर्ग बल को पुनरीक्षित समझा जायेगा।
5. आरक्षण। - समय-समय पर सरकार द्वारा विहित आरक्षण के प्रावधन इस संवर्ग के विभिन्न कोटि में लागू होंगे। 6. भर्ती। - संवर्ग की मूल कोटि के पुराभिलेखपाल के पद पर सीध्ी नियुक्ति बिहार कर्मचारी चयन आयोग की अनुशंसा पर की जायेगी।
7. अर्हता। - आयोग द्वारा चयन की अनुशंसा शैक्षणिक योग्यता अनुभव एवं अंतर्वीक्षा के आधर पर की जायेगी। चयन हेतु अर्हता ;शैक्षणिक योग्यताद्ध एवं चयन हेतु शैक्षणिक योग्यता, अनुभव एवं अंतर्वीक्षा का प्रतिशत अनुसूची-II के अनुसार होगा।
8. परिवीक्षा अवध् ि। - नियुक्ति के बाद परिवीक्षा अवध् िदो वर्षों की होगी। परिवीक्षा अवध् िमें सेवा संतोषजनक नहीं रहने पर परिवीक्षा अवध् िएक वर्ष के लिए बढ़ायी जा सकेगी। बढ़ायी गयी अवध् िमें भी सेवा संतोषजनक नहीं रहने पर बिना कारण बताये सेवामुक्त किया जा सकेगा।
9. प्रशिक्षण । - वैसे कर्मी जो अभिलेखीय अध्ययन में डिप्लोमा धारी नहीं है, उन्हें राज्य सरकार द्वारा राष्ट्रीय अभिलेखागार, नई दिल्ली अथवा अन्य संस्थान में मनोनीत किये जाने पर अभिलेखीय अध्ययन में एक वर्षीय डिप्लोमा का कोर्स करना होगा। पांच वर्ष के भीतर डिप्लोमा कोर्स में प्रशिक्षण नहीं प्राप्त होने पर उनकी प्रोन्नति रोक दी जायेगी। यह अवध्,ि विशेष परिस्थित में, राज्य सरकार द्वारा बढ़ायी जा सकेगी।
10. विभागीय परीक्षा एवं सेवा संपुष्टि । - ;iद्ध परिवीक्षाध्ीन व्यक्ति को परिवीक्षा अवध् िमें राज्य सरकार द्वारा आयोजित लेखा तथा हिन्दी टिप्पण एवं प्रारूपण परीक्षा उत्तीर्ण होने पर ही सेवा में संपुष्ट किया जा सकेगा।
;iiद्ध इस नियमावली के प्रवृत्त होने की तिथि को सेवा में कार्यरत एवं उक्त तिथि को 45 वर्ष की आयु पूरा कर लिये कामकों को उप-नियम ;iद्ध के अधीन निर्धारित विभागीय परीक्षा में उतीर्ण होना आवश्यक नहीे होगा।
11. प्रोन्नति । - ;1द्ध संवर्ग में उच्चतर पदों पर प्रोन्नति के लिए सेवा संपुष्ट होना एवं अभिलेखीय अध्ययन में एक वर्षीय डिप्लोमा होना अनिवार्य होगा। नियमावली की लागू होने की तिथि को 45 वर्ष पूरा कर लेने वाले के लिए एक वर्षीय डिप्लोमा की आवश्यकता नहीं होगी। वरीयता के आधर पर विभागीय प्रोन्नति समिति की अनुशंसा पर, राज्य सरकार द्वारा, निम्नलिखित रीति से प्रोति दी जा सकेगी -
;कद्ध पुराभिलेखपाल से सहायक अभिलेख निदेशक के पद परऋ
;खद्ध सहायक अभिलेख निदेशक से उप अभिलेख निदेशक के पद परऋ
;2द्ध प्रोन्नति में राज्य सरकार द्वारा समय-समय पर निर्धरित कालावध् िको पूरा किया जाना आवश्यक होगाऋ ;3द्ध बिहार लोक सेवा आयोग की सहमति की आवश्यकता वाले मामलों को छोड़कर अन्य मामलों में विभागीय प्रोति समिति निम्नलिखित को मिलाकर गठित होगीः-

12. अवशिष्ट मामले ।- इस नियमावली में विशेष रुप से अनाच्छादित विषयों के संबंध में राज्य सरकार के इस विषय में सुसंगत प्रावधन लागू होंगेे।
13. कठिनाइयों का निराकरण ।- इस नियमावली के प्रावधनों को लागू करने में यदि कोई कठिनाई उत्प होती है। तो इस नियमावली के प्रावधनों के अध्यध्ीन, उसका निराकरण राज्य सरकार, अधिसूचना द्वारा, कर सकेगी। 14. निर्वचन । - इस नियमावली के किसी भी प्रावधन के निर्वचन के लिए विधि विभाग सक्षम होगा और इस संबंध् में उसका विनिश्चय अंतिम होगा।
15. निरसन एवं व्यावृति । - ;1द्ध इस संवर्ग के संबंध् में लागू सभी पूर्व नियम, संकल्प, परिपत्रा आदि को एतद द्वारा निरसित किया जाता है।
;2द्ध ऐसा निरसन के होते हुए भी, ऐसे नियम, संकल्प, परिपत्रा के अधीन की गई कार्रवाई या किया गया कुछ भी इस नियमावली के अधीन की गई कार्रवाई या किया गया कुछ भी समझा जायेगा मानो उस दिन यह नियमावली प्रभावी थी।

बिहार अभिलेखीय संवर्ग नियमावली 2012 की अनुसूची-II
पुराभिलेखपाल पद के लिए निर्धारित अर्हता-
;कद्ध इतिहास में ;विशेष पत्रा के रूप में आध्ुनिक भारतीय इतिहास सन् 1757-1947 के साथद्ध कम से कम द्वितीय श्रेणी में स्नातकोत्तर उत्तीर्ण।
;खद्ध अभिलेखीय अध्ययन में एक वर्षीय डिप्लोमा अथवा किसी मान्यता प्राप्त विश्वविद्यालय से पंजीकृत शोध् अध्येता के रूप में इतिहास में शोध् कार्य का दो वर्षों का अनुभव/किसी मान्यता प्राप्त शिक्षण संस्थान में आध्ुनिक भारतीय इतिहास में दो वर्षों का अध्यापन कार्य का अनुभव।
;गद्ध चयन का आधार शैक्षणिक योग्यता, अनुभव सह अंतर्वीक्षा होगा।
;घद्ध शैक्षणिक योग्यता एवं अनुभव पर 75% तथा अंतर्वीक्षा पर 25% अंक निर्धारित होगा।

No. Sa.Pra. 39/2010 B.S.A-494—In exercise of the powers conferred by the Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules for regulating process of recruitment and conditions of service of the Bihar Archival Service Cadre.
1. Short title, extent and commencement.- (1) These Rules may be called the "Bihar Archival Cadre Rules 2012".
(2) It shall extend to whole of the State of Bihar. (3) It shall come into force from the date of notification.
2. Definitions.- In these Rules, unless the context otherwise requires :-
(i) "State Government" means the Government of Bihar. (ii) "Appointing authority" means Director of Archives, Bihar State Archives Directorate.
(iii) "Department" means Cabinet Secretariat Department and (iv) "Commission" means Bihar Staff Selection Commission.
4(cid:18)बहार गजट (असाधारण), 26 ,दस.बर 2012 3. Constitution of Cadre .- In this cadre there shall be posts of following categories.
(i) Archivist (ii) Assistant Director of Archives (iii) Deputy Director of Archives
Pay scale of the posts of above noted categories will be on the basis of Schedule-I which will be deemed amended from time to time in accordance with amendment made by the State Government.
(2) The posts of Assistant Archivist and Research Assistant created before coming into force of these Rules will deemed to be designated as Archivist and the persons working on these posts before coming into force of these rules will be deemed as working on the post of Archivist. Their seniority will be fixed on the basis of their date of appointment.
(3) The posts of Training cum Exhibition Officer and Regional Archives Officer will deemed to be designated as Assistant Director of Archives from the date of coming into force of these rules.
4. Cadre Strength.— The cadre strength of various posts shall be such as determined by the State Government from time to time. Cadre strength shall deemed to be revised in light of creation of posts under dfferent categories in this cadre by Government orders.
5. Reservation.— The provisions relating to reservation prescribed by the government from time to time will be applicable in different categories of this cadre.
6. Recruitment.— The direct recruitment on the basic grade post of Archivists in the cadre shall be made on the recommendation of Bihar Staff Selection Commission.
7. Qualification.— Recommendation of selection by the Commission will be made on the basis of educational qualification, experience and interview. The criteria (educational qualification) for selection and percentage for educational qualification, experience and interview for selection will be according to Schedule-II.
8. Probation Period.—Probation period will be two years after the date of appointment. If the service is not found satisfactory during probation period, it can be extended for one year. If the service is not found satisfactory even during the extended period, the person concerned may be removed from service without any notice.
9. Training.— The personnels who are not Diploma holder in archival studies, will have to successfully complete one year Diploma course in Archival studies on being nominated by the State Government to the National Archives, New Delhi or to any other institution. Promotion of such personnel will be witheld if the one year Diploma Course is not completed within five years. This period may be extended by the State Government in special circumstances.
10. Departmental Examination and Confirmation in Service.— (i) The personnels under probation can be confirmed in service only after passing the Accounts and Hindi Noting and Drafting Examination conducted by the State Government.
(ii) Passing of the departmental examination as prescribed under sub rule (i) will not be essential for those personnels who are in service on the date of coming into force of these rules and are more than forty five years of age on that date.
11. Promotion.— (1) Confirmation in service and completion of one year diploma in archival studies will be essential for promotion to higher posts in the cadre, One year diploma will not be required for those who have completed 45 years of age on the date of coming into force of the Rules. Promotion will be granted by the State Government on the5 (cid:18)बहार गजट (असाधारण), 26 ,दस.बर 2012 basis of seniority on the recommendation of Departmental Promotion Committee in the following manner :- (a) From the post of Archivist to the post of Assistant Director. (b) From the post of Assistant Director to the post of Deputy Director.
(2) It will be essential to complete Kalawadhi as prescribed by the State Government from time to time for promotion.
(3) The Departmental Promotion Committee, in cases where concurrence of Bihar

12. Residuary Matters.— With regard to matters not specifically covered by these Rules the provision of relevant Rules of State Government will be applicable in these matters.
13. Removal of Difficulties.— If any difficulty arises in the implementation of the provisions of these Rules, the State Government may, by notification remove such difficulties subject to the provisions of these Rules.
14. Interpretations.— The Law Department will be competent for interpretation of any provision of these Rules and its decision shall be final.
15. Repeal & Saving.— (1) All Rules, Resolutions and Circulars etc. issued earlier with respect to this cadre are hereby repealed.
(2) Not withstanding such repeal, any thing done or any action taken according to these Rules, Resolutions and Circulars will be deemed to be done under these Rules as if it were effected on such date when such action was taken or anything was done.

Qualification required for the post of Archivist-
;aद्ध M.A in History (with special paper in Modern Indian History from 1757 to 1947) with minimum second class
;bद्ध One year Diploma in Archival Studies or minimum two years research experience as registered as Research Scholar in History from any recognized University/ two years teaching experience of Modern History in any recognized institutions. ;cद्ध Selection will be based on the basis of educational qualifications, exprience cum interview.
;dद्ध 75% marks will be fixed for educational qualification and exprience and 25% for interview.
