सं0ः 576/एग्जिट/2013/एस0डी0आर0सं0ः 576/एग्जिट/2013/एस0डी0आर0सं0ः 576/एग्जिट/2013/एस0डी0आर0सं0ः 576/एग्जिट/2013/एस0डी0आर0—यतः, आयोग के दिनांक 11 जनवरी, 2013 के प्रेस नोट संख्या ई सी आई/पी एन/1/2013 द्वारा त्रिपुरा, मेघालय, नागालैंड की विधान-सभाओं के साधारण निर्वाचन तथा असम, बिहार, महाराश्ट्र, मिजोरम, पंजाब, उत्तर प्रदेष तथा पष्चिम बंगाल की राज्य विधान-सभाओं में आकस्मिक रिक्तियों को भरने के लिए उप-निर्वाचनों की समय-अनुसूची घोशित की गई थी। तथा यतः लोक प्रतिनिधित्व अधिनियम 1951, की धारा-126 के उपबंधों के अनुरूप , इस संबंध में निर्वाचन आयोग द्वारा यथा अधिसूचित, इस अवधि के दौरान किसी एग्जिट पोल के संचालन और उसके परिणाम के प्रसारण तथा प्रकाषन पर प्रतिबंध होगा। तथा यतः, त्रिपुरा, मेघालय, नागालैंड की विधान सभाओं के साधारण निर्वाचन और असम, बिहार, महाराश्ट्र, मिजोरम, पंजाब, उत्तर प्रदेष तथा पष्चिम बंगाल की राज्य विधान-सभाओं में आकस्मिक रिक्तियों को भरने के लिए उप- निर्वाचनों की घोशणा एक ही समय पर की गई है, एग्जिट पोल पर प्रतिबंध मतदान प्रारंभ होने के पहले दिन मतदान होने की तारीख तथा समय से शुरू होकर मतदान के आखिरी दिन तक मतदान समाप्त होने के आधे घंटे बाद तक जारी रहेगा; अब, इसलिए लोक प्रतिनिधित्व अधिनियम, 1951 की धारा-126क की उप-धारा (1) के अंतर्गत प्रदत शक्तियों का प्रयोग करते हुए निर्वाचन आयोग उक्त धारा की उप-धारा (2) के उपबंधों को ध्यान में रखते हुए 14.02.2013 अर्थात त्रिपुरा में मतदान के पहले दिन पूर्वाह्‌न 7.00 बजे और 24.02.2013 अर्थात्‌ असम, बिहार, और महाराश्ट्र की राज्य विधान-सभाओं में आकस्मिक रिक्तियों को भरने के लिए उप-चुनावों के लिए मतदान के अंतिम दिन के अपराह्‌न 5.30 बजे के बीच की अवधि को उस अवधि के रूप में अधिसूचित करता है जिसके दौरान त्रिपुरा, मेघालय तथा नागालैंड की विधान-सभाओं के वर्तमान साधारण निर्वाचनों और असम में 8- अल्गापुर विधान-सभा निर्वाचन क्षेत्र, बिहार में 131- कल्याणपुर (अ0ज0) विधान-सभा निर्वाचन क्षेत्र, महाराश्ट्र में 271- चंदगड़, विधान-सभा निर्वाचन क्षेत्र, मिजोरम में 8- चलफिल्ह (अ0ज0जा0) विधान-सभा निर्वाचन क्षेत्र, पंजाब में 73- मोगा विधान-सभा निर्वाचन क्षेत्र, उ0प्र0 में 340- भाटपर विधान-सभा निर्वाचन क्षेत्र पष्चिम बंगाल में 51- इंग्लिष बाजार, 70- रेजीनगर और 293- नालहाटी बीरभूम विधान-सभा निर्वाचन क्षेत्र के संबंध में किसी प्रकार का एग्जिट पोल करना और किसी प्रकार के एग्जिट पोल के परिणाम को प्रिंट या इलैक्ट्रोनिक मीडिया के माध्यम से प्रकाषित करना या उसका प्रचार प्रसार करना या उसका किसी भी अन्य तरीके से प्रचार प्रसार करना, प्रतिबंधित रहेगा। इसके अतिरिक्त यह भी स्पश्ट किया जाता है कि लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 126(1) (ख) के अधीन किसी भी इलेक्ट्रॉनिक मीडिया में किसी ओपीनियन पोल या किसी प्रकार के पोल सर्वेक्षण के परिणामों सहित किसी भी निर्वाचन मामले का प्रदर्षन उपरोक्त साधारण/उप-निर्वाचन के संबंध में मतदान के समापन के लिए नियत घंटो सहित 48 घंटो की अवधि के लिए प्रतिबंधित रहेगा।

No. 576/EXIT/2013/SDR—Whereas, the schedules for the General Elections to the Legislative Assemblies of Tripura, Meghalaya and Nagaland and bye-elections to fill 9 casual vacancies in the State Legislative Assemblies of Assam, Bihar, Maharashtra, Mizoram, Punjab, Uttar Pradesh and West Bengal were announced by the Commission vide press note No. ECI/PN/1/2013 dated 11th January, 2013 ; And whereas, as per the provisions of Section 126A of the RP Act, 1951, there shall be restrictions on conduct of any exit poll and publication and dissemination of result of such exit poll during such period, as may be notified by the Election Commission in this regard ; And whereas, the General Elections to the Legislative Assemblies of Tripura, Meghalaya and Nagaland and bye-elections to fill casual vacancies in the State Legislative Assemblies of Assam, Bihar, Maharashtra, Mizoram, Punjab, Uttar Pradesh and West Bengal have been announced together, the ban on exit polls shall start from the date and the time of commencement of the poll on the first day of poll and continue till half-an-hour after closing of the poll on the last day of poll;

Now, therefore, in exercise of the powers under sub-Section (1) of section 126A of the RP Act, 1951, the Election Commission having regard to the provisions of sub-Section (2) of the said Section, hereby notifies the period between 7.00 A.M. on 14/02/2013, i.e, the first day of poll in Tripura, and 5.30 P.M on 24/02/2013, i.e, the last day of poll for the bye- elections to fill casual vacancies in the State Legislative Assemblies of Assam, Bihar, and Maharashtra, as the period during which conducting any exit poll and publishing or publicizing by means of the print or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection with the current General Elections to the Legislative Assemblies of Tripura, Meghalaya & Nagaland and bye-elections from 8- Algapur Assembly Constituency in Assam, 131-Kalyanpur (SC) Assembly Constituency in Bihar, 271-Chandgad Assembly Constituency in Maharashtra, 8-Chalfilh (ST) Assembly Constituency in Mizoram, 73-Moga Assembly Constituency in Punjab, 340-Bhatpar Assembly Constituency in Uttar Pradesh, 51-English Bazar, 70-Rejinagar&293-Nalhati Birbhum Assembly Constituencies in West Bengal shall be prohibited. It is further clarified that under Section 126(1)(b) of the RP Act, 1951, displaying any election matter including results of any opinion poll or any other Poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for conclusion of poll in connection with aforesaid General/Bye-elections,
