सं0 576/3/ई0वी0एम0/2013/एस.डी.आर. (उप निर्वाचन-वि.स.)—यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा-61 क यह उपबंध करती है कि निर्धारित ऐसे तरीके से वोटिंग मषीन द्वारा वोट देने तथा उन्हें रिकार्ड करने को ऐसे निर्वाचन क्षेत्रों द्वारा भी प्रयोग में लाया जा सकता है, जहां भारत निर्वाचन आयोग प्रत्येक मामले की परिस्थितियों के संबंध में ऐसा विनिर्दिश्ट करे; तथा
2. यतः आयोग ने असम में 08-अल्गापुर विधान-सभा निर्वाचन क्षेत्र, बिहार में 131-कल्याणपुर (अ०जा०) विधान-सभा निर्वाचन क्षेत्र, महाराश्ट्र में 271-चंदगड विधान-सभा निर्वाचन क्षेत्र, मिजोरम में 08-चालफिल्ह (अ० ज० जा०) विधान-सभा निर्वाचन क्षेत्र, उत्तर प्रदेष में 340- भाटपार विधान-सभा निर्वाचन क्षेत्र, पष्चिम बंगाल में 51-इंग्लिष बाजार, 70-रेजीनगर तथा 293-नलहाटी बीरभूम विधान-सभा निर्वाचन क्षेत्र तथा पंजाब में 73-मोगा विधान-सभा निर्वाचन क्षेत्र की परिस्थितियों पर विचार तथा वह उपरोक्त विधान-सभा निर्वाचन क्षेत्र में मतदान कराने के लिए इलेक्ट्रॉनिक वोटिंग मषीनों की पर्याप्त संख्या से संतुश्ट है। मतदान कार्मिकों को इलेक्ट्रॉनिक वोटिंग मषीनों के कुषल संचालन में भली-भांति प्रषिक्षित किया गया है तथा निर्वाचक भी इलेक्ट्रॉनिक वोटिंग मषीन के प्रचालन में पूर्णतः निपुण हैं। 3. अतः अब भारत निर्वाचन आयोग एतद्द्वारा 08-अल्गापुर विधान-सभा निर्वाचन क्षेत्र, असम; 131-कल्याणपुर (अ०जा०) विधान-सभा निर्वाचन क्षेत्र, बिहार; 271-चंदगड विधान-सभा निर्वाचन क्षेत्र, महाराश्ट्र; 08-चालफिल्ह (अ० ज० जा०) विधान-सभा निर्वाचन क्षेत्र, मिजोरम; 340-भाटपार विधान-सभा निर्वाचन क्षेत्र, उत्तर प्रदेष; 51-इंग्लिष बाजार, 70-रेजीनगर तथा 293- नलहाटी बीरभूम विधान-सभा निर्वाचन क्षेत्र पष्चिम बंगाल; तथा 73-मोगा विधान-सभा निर्वाचन क्षेत्र, पंजाब को ऐसे निर्वाचन क्षेत्रों के रूप में विनिर्दिश्ट करता है जहां 30 जनवरी, 2013 को अधिसूचित उक्त राज्यों की विधान-सभाओं के वर्तमान उप-निर्वाचनों में मतों को निर्वाचनों का संचालन नियम, 1961 के अधीन निर्धारित तरीके से तथा इस विशय पर आयोग द्वारा समय-समय पर जारी अनुपूरक अनुदेषों में इलेक्ट्रॉनिक वोटिंग मषीनों द्वारा डाला एवं रिकार्ड किया जाएगा।

No. 576/3/EVM/2013/SDR(Bye-LA):—Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituencies as the Election Commission of India may, having regard to the circumstances of each case specify; and 2. Whereas, the Commission has considered the circumstances in 08- Algapur Assembyly constituency in Assam, 131-Kalyanpur (SC) Assembly constituency in Bihar, 271-Chandgad Assembly constituency in Maharashtra, 08-Chalfilh (ST) Assembly constituency in Mizoram, 340-Bhatpar Assembly constituency in Uttar Pradesh, 51-English3 (cid:18)बहार गजट (असाधारण), 14 फरवर(cid:15) 2013 Bazar, 70-Rejinagar, and 293-Nalhati Birbhum, Assembly constituencies in West Bengal and 73-Moga Assembly constituency in Punjab, and is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the abovementioned Assembly constituencies, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;
3. Now, therefore, the Election Commission of India hereby specifies 08- Algapur Assembly constituency in Assam, 131-Kalyanpur (SC) Assembly constituency in Bihar, 271-Chandgad Assembly constituency in Maharashtra, 08-Chalfilh (ST) Assembly constituency in Mizoram, 340-Bhatpar Assembly constituency in Uttar Pradesh, 51-English Bazar 70- Rejinagar, 293-Nalhati Birbhum Assembly constituencies in West Bengal and 73- Moga Assembly constituency in Punjab, as the constituencies in which the votes at the current bye-elections to the Legislative Assemblies of the said States notified on 30th January, 2013 shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.
