सं0 बी.ई.आर.सी.-रेगुलेशन-6/06 (भाग-IV-1)-01—विद्युत अधिनियम, 2003 की धारा-181 (1) एवं 181 (2)(x) सह पठित धारा 50 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विभिन्न हितधारकों की समस्याओं का निराकरण करने हेतु बिहार विद्युत विनियामक आयोग एतद्‌ द्वारा ''बिहार विद्युत आपूर्त्ति संहिता-2007'' में निम्नलिखित संशोधन करता है जो मूलरूप में अधिसूचना संख्या-बी.ई.आर.सी.-रेगु.-6/2006-529 दिनांक 31 दिसम्बर, 2007 द्वारा निर्गत किया गया था।

1. संक्षिप्त नाम और प्रारम्भ संक्षिप्त नाम और प्रारम्भ संक्षिप्त नाम और प्रारम्भ संक्षिप्त नाम और प्रारम्भ :-

(i) इस संहिता को ''बिहार विद्युत आपूर्त्ति संहिता (तृतीय संशोधन) 2013'' कहा जायेगा। ( ii) यह बिहार राजपत्र में प्रकाशन की तिथि से प्रभावी होगा।

2. संहिता के अध्याय-7 में संशोधनसंहिता के अध्याय-7 में संशोधनसंहिता के अध्याय-7 में संशोधनसंहिता के अध्याय-7 में संशोधन :-

((((i)))) खण्ड 7खण्ड 7खण्ड 7खण्ड 7....12 (7) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा 12 (7) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा :- 12 (7) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा 12 (7) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा

''जब अनुबंध मांग को घटाने के लिए सहमति हो, तो उपभोक्ता घटाये गये भार के अनुसार नया एकरारनामा करेगा। अनुज्ञप्तिधारी जमानत की राशि का पुनः गणना करेगा एवं यदि जमा जमानत की राशि अधिक हुआ तो उसे भविष्य के विपत्र में समायोजन किया जायेगा, जिसके विपत्रों की संख्या 6(छः) से ज्यादा नहीं होगी। ऐसी स्थिति में घटाये गये भार के लिए विद्युत आपूर्त्ति उपयोग के लिए कोई अनिवार्य अवधि नहीं होगी और उचित सूचना देकर एकरारनामा रद्ध किया जा सकता है''। ((((ii)))) खण्ड 7खण्ड 7खण्ड 7खण्ड 7....13 (2) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा 13 (2) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा :- 13 (2) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा 13 (2) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा

'' आपूर्त्ति प्रारम्भ करने की तिथि से आपूर्त्ति उपभोग करने की अनिवार्य अवधि, या एकरारनामा की आरम्भिक अवधि निम्न विभव (एल.टी.), उपभोक्ता के लिए एक वर्ष, और उच्च विभव (एच.टी.), उच्च विभव निर्दिष्ट सेवा (एच.टी.एस.एस.), अति उच्च विभव (ई.एच.टी.) एवं रेलवे टै्रक्सन के लिए दो वर्षो की होगी। वर्त्तमान में प्रयोग में लाये जा रहे एकरारनामा के प्रपत्र को अनुज्ञप्तिधारी आयोग के अनुमोदन के पश्चात्‌ संशोधित कर सकते हैं ताकि इस संहिता के प्रावधानों के फलस्वरूप उत्पन्न होनेवाले आवश्यकताओं की पूर्त्ति हो सके एवं प्रपत्र वर्त्तमान अधिनियम, नियमावली, विनियम एवं इस संहिता के प्रावधानों के अनुरूप हो सके''।2 (cid:18)बहार गजट (असाधारण), 4 माच- 2013 ((((iii)))) खण्ड 7खण्ड 7खण्ड 7खण्ड 7....14 (1) निम्14 (1) निम्14 (1) निम्14 (1) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा नलिखित रूप में प्रतिस्थापित किया जायेगा :- नलिखित रूप में प्रतिस्थापित किया जायेगा नलिखित रूप में प्रतिस्थापित किया जायेगा

''एकरारनामा की प्रारम्भिक अवधि पूर्ण होने के बाद भी एकरारनामा प्रभावी रहेगा, जबतक कि वह रद्ध नहीं कर दिया जाय। सभी निम्नविभव (एल.टी.) श्रेणी के उपभोक्ता 1 (एक) माह का नोटिस देने के बाद एकरारनामा रद्द कर सकते हैं। एकरारनामा रद्द करने हेतु उच्च विभव (एच.टी.) एवं उच्च विभव निर्दिष्ट सेवाओं (एच.टी.एस.एस.) के उपभोक्ताओं के मामले में 3 (तीन) महीने एवं अति उच्च विभव (ई.एच.टी.) एवं रेलवे ट्रैक्सन सेवाओं के लिए 6(छः) महीने पूर्व नोटिस देना आवश्यक होगा।

परन्तु एकरारनामा की प्रारम्भिक अवधि पूर्ण होने के पहले यदि एकरारनामा रद्द करना है, कारण चाहे जो भी हो, तो उपभोक्ता टैरिफ आदेश के अनुसार प्रारम्भिक एकरारनामा की अवधि जो निम्न विभव के उपभोक्ताओं के लिए एक वर्ष एवं उच्च विभव, उच्च विभव निर्दिष्ट सेवाओं, अति उच्च विभव और रेलवे ट्रैक्सन सेवाओं के लिए दो वर्षो का है, के लिए शुल्क जो शेष अवधि या नोटिस की अवधि दोनो में जो अधिक हो का भुगतान करेगा। अनुज्ञप्तिधारी उपभोक्ता का अन्तिम विपत्र तैयार करने हेतु आपसी सहमति से निर्धारित तिथि को विशेष मीटर रीडिंग की व्यवस्था करेंगें। एकरारनामा, विपत्र वाले माह की अन्तिम तिथि को रद्ध किया जा सकेगा एवं अनुज्ञप्तिधारी तदनुसार अन्तिम विपत्र तैयार करेंगें।'' ((((iv)))) खण्ड 7खण्ड 7खण्ड 7खण्ड 7....15 (1) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा 15 (1) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा :- 15 (1) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा 15 (1) निम्नलिखित रूप में प्रतिस्थापित किया जायेगा

(क)(क)(क)(क) अनुज्ञप्तिधारी निम्नलिखित तालिकानुसार निर्दिष्ट अवधि के लिए अनुमानित खपत के समतुल्य

(ख)(ख)(ख)(ख) अनुज्ञप्तिधारी भावी उपभोक्ताओं के अनुरोध पर प्रारम्भिक जमानत की राशि का 50 प्रतिशत राशि जमा करने के बाद शेष राशि को अधिकतम तीन किश्तों में जमा करने का आदेश दे सकता है। इसप्रकार के मामले में घटते हुए अवशेष पर उपभोक्ता को विलम्ब भुगतान सरचार्ज भी देना होगा।

The 28th February 2013 No. BERC–Regulation 6/06 (Part–IV–I)-02––01—In exercise of powers conferred by Section 181(1) and 181(2)(x) read with Section 50 of the Electricity Act, 2003 and for removal of difficulties of various stakeholders, Bihar Electricity Regulatory Commission hereby makes the following amendment in Bihar Electricity Supply Code, 2007 which was originally issued vide Notification No. BERC/Reg–6/2006/529 dated 31st December, 2007.

3rd Amendment to Bihar Electricity Supply Code 2007

1. Short title and commencement: (i) This code may be called the "Bihar Electricity Supply Code (3rd Amendment), 2013.

(ii) This shall come into force with effect from the date of publication in Bihar Gazette.

2. Amendment in chapter 7 of the Code–

(i) Clause 7.12(7) shall be substituted as follows :-

"When reduction of contract demand is agreed to, the consumer shall execute a fresh agreement for reduced load. The licensee shall recalculate the security deposit and any excess security3 (cid:18)बहार गजट (असाधारण), 4 माच- 2013 deposit shall be adjusted in future bills not exceeding six succeeding bills in which case there will be no compulsory period for availing the supply at the reduced load and the agreement can be terminated after proper notice.

(ii) Clause 7.13(2) shall be substituted as follows :- "The compulsory period of availing supply from the date of commencement of supply or initial period of agreement shall be one year for LT consumers and two years for HT, HTSS, EHT & Railway Traction Services consumers. The licensee may modify the structure of the agreement formats presently in use with the approval of the Commission in order to meet any requirement that may arise as a consequence of the provisions of this Code so that the format is consistent with the Act and prevailing Rules, Regulations and the provisions of this Code."

(iii) The clause 7.14(1) shall be substituted by:- "The agreement shall remain in force even after completion of the initial period of agreement until it is terminated. All L.T. category of consumers may terminate the agreement after giving one month's notice. For termination of agreement three months' notice in case of HT and HTSS consumers and six months' notice in case of EHT & Railway Traction Services is required.

However, if the agreement is to be terminated for reasons whatsoever, before expiry of the initial period of agreement, the consumer shall be liable to pay charges as per tariff order for the balance period of the said one-year in case of LT and two years in case of HT, HTSS, EHT and Railway Traction Services or notice period as specified above whichever is higher. The licensee shall arrange for special meter reading, at a mutually acceptable date, to facilitate preparation of the final bill of the consumer. The agreement shall be terminated on the last day of the billing month and the licensee shall raise the final bill accordingly."

(iv) The clause 7.15(1) shall be substituted as follows:-

"(a) The licensee may take an initial security deposit from the prospective consumers for consumption equivalent to the estimated consumption of specific period as indicated in the table below-

(cid:18)बहार गजट (असाधारण), 4 माच- 2013 (b) The licensee, on the request of the prospective consumer, may allow payment of initial security deposit by the prospective consumer maximum in three installments, after deposit of minimum 50% (fifty percent) of the initial security deposit. The prospective consumer will be liable to pay delayed payment surcharge on reducing balance in such cases.
