सं0 वन अरा॰स्था॰- 14/2012-3060/प॰व॰—भारत के संविधान के अनुच्छेद-309 के परन्तुक में प्रदत्त शक्तियों का उपयोग करते हुए बिहार के राज्यपाल, पर्यावरण एवं वन विभाग के अन्तर्गत वनपाल एवं वनरक्षी संवर्ग के भर्ती एवं अन्य सेवा शर्तों को विनियमित करने के निमित्त निम्नलिखित नियमावली निरूपित करते हैं;

1. संक्षिप्त नाम, विस्तार एवं प्रारंभ । - (1) यह नियमावली ''बिहार अवर वन सेवा नियमावली, 2013'' कही जा सकेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह बिहार गजट में अधिसूचना के प्रकाशन की तिथि से प्रवृत्त होगी। 2. परिभाषायें । - इस नियमावली में जबतक किसी संदर्भ में अन्यथा अपेक्षित न हो- (क) 'अवर वन सेवा' में बिहार राज्य में पर्यावरण एवं वन विभाग, बिहार के अधीनस्थ सभी स्थापनाओं में कार्यरत वनरक्षी एवं वनपालों को सम्मिलित करते हुए वनरक्षी एवं वनपाल के संवर्ग शामिल होंगे;

(ख) ''वनरक्षी'' से अभिपे्रत है इस नियमावली के नियम 7 क में विनिर्दिष्ट संवर्ग के कार्मिक; (ग) 'वनपाल' से अभिपे्रत है इस नियमावली के नियम 7 ख में विनिर्दिष्ट संवर्ग के कार्मिक; (घ) ''नियुक्ति प्राधिकार'' से अभिपे्रत है इस नियमावली के नियम 8 में विनिर्दिष्ट प्राधिकार; (ड॰) ''वन प्रमण्डल पदाधिकारी'' से अभिप्रेत है बिहार राज्य में वन प्रमण्डलों के प्रभारी पदाधिकारी; (च) ''वन संरक्षक'' से अभिप्रेत है बिहार राज्य में वन अंचलों के प्रभारी पदाधिकारी; (छ) ''परिवीक्षाधीन'' से अभिपे्रत है वनपाल एवं वनरक्षी संवर्ग में परीक्ष्यमान रूप से नियुक्त व्यक्ति; (ज) 'प्रधान मुख्य वन संरक्षक' से अभिप्रेत है पर्यावरण एवं वन विभाग, बिहार में प्रधान मुख्य वन संरक्षक के रूप में पदस्थापित तथा 'बल के प्रमुख' के रूप में कार्यरत पदाधिकारी;

(झ) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग अथवा कार्मिकों के चयन एवं आनुषंगी विषयों के सम्पादन के निमित्त पर्यावरण एवं वन विभाग के द्वारा निर्धारित कोई अन्य अभिकरण;

() राज्य सरकार से अभिप्रेत है ''बिहार सरकार''। 3. सेवा का गठन। - बिहार राज्य में पर्यावरण एवं वन विभाग के अधीन अवर वन सेवा होगी जिसमें दो संवर्ग के कार्मिक होंगे :-

(क) वनरक्षी;

(ख) वनपाल।

परन्तु यह कि राज्य सरकार उपर्युक्त कोटि के कार्मिकों के अतिरिक्त किसी अन्य कोटि के कार्मिकों को भी इन संवर्गों में शामिल कर सकने के लिए आवश्यक अर्हत्ताओं का निर्धारण कर सकेगी।

4. संवर्ग । - वनपाल एवं वनरक्षी दोनों का संवर्ग राज्यस्तरीय होंगे जिसमें पर्यावरण एवं वन विभाग, बिहार के अधीनस्थ सभी स्थापना इकाईयां होंगी।

5. आरक्षण । - बिहार पदों एवं सेवाओं की रिक्तियों में आरक्षण (अनुसूचित जातियों, अनुसूचित जन जातियों एवं अृन्य पिछड़े वर्गो के लिये) अधिनियम 1991 एवं इसके अंतर्गत राज्य सरकार द्वारा समय-समय पर विहित नियमावली एवं रोस्टर नियुक्ति एवं प्रोन्नतियों पर लागू होंगे।

6. संवर्ग का अधिकृत बल । - वनरक्षी तथा वनपाल संवर्र्गाे के अधिकृत बल आवश्यकतानुसार पर्यावरण एवं वन विभाग द्वारा निर्धारित किया जाएगा। वनरक्षी एवं वनपाल के पद पर पूर्व से कार्यरत कर्मी अपने संबंधित संवर्ग बल में सम्मिलित माने जायेंगे।

7. नियुक्ति-क-वनरक्षी संवर्ग में नियुक्ति । - (i) वनरक्षी संवर्ग में नियुक्ति सीधी भर्त्ती से की जाएगी। (ii) नियुक्ति हेतु न्यूनतम शैक्षणिक योग्यता, अर्हत्ता तथा प्रक्रिया इस नियमावली के परिशिष्ट 'क' के अनुसार हाेंगी।

(iii) नियुक्ति परिवीक्षा पर होगी जो दो वर्षों की होगी। अगर परिवीक्षा पर नियुक्त कर्मी की कार्य अनुपालन के आधार पर मूल्यांकित सेवा एवं आचार संतोषप्रद नहीं पाया जायेगा एवं/या वह नियम 9 (i) के अंतर्गत सेवाकालीन वृत्तीय प्रशिक्षण सफलता पूर्वक पूरा नहीं कर पाता है तो परिवीक्षा अवधि एक वर्ष के लिए बढ़ाई जा सकेगी। अगर परिवीक्षा पर नियुक्त कर्मी की कार्य अनुपालन के आधार पर मूल्यांकित सेवा एवं आचार विस्तारित अवधि में भी संतोषप्रद नहीं हो तो उसे सेवान्मोचित कर दिया जायेगा।

(iv) परिवीक्षा अवधि के उपरान्त परीक्ष्यमान कर्मी के कार्य अनुपालन एवं आचार का मूल्यांकन प्रधान मुख्य वन संरक्षक, बिहार द्वारा गठित अंचल स्तरीय समिति द्वारा किया जाएगा जिसकी अनुशंसा पर कि परिवीक्षाधीन का सेवा संतोषप्रद है, नियुक्ति प्राधिकार द्वारा उसकी नियुक्ति सम्पुष्टि की जायेगी : परन्तु यदि परिवीक्षा पर नियुक्त कर्मी द्वारा नियुक्ति के तत्काल बाद परिवीक्षा अवधि में प्रशिक्षण प्राप्त न किया जा सके, तो उसकी नियुक्ति की संपुष्टि तत्‌संबंधी नियम-9 (i) के तहत सफलता पूर्वक प्रशिक्षण पूर्ण कर लेने के उपरान्त ही किया जा सकेगा।

ख- वनपाल संवर्ग में नियुक्ति- (i) वनपाल संवर्ग के स्वीकृत बल का अधिकतम 50 प्रतिशत सीधी भर्त्ती से तथा शेष अधिकृत बल वनरक्षी संवर्ग से प्रोन्नति द्वारा भरी जायेंगी।

(ii) नियुक्ति हेतु न्यूनतम शैक्षणिक योग्यता, अर्हता तथा प्रक्रिया इस नियमावली के परिशिष्ट 'ख' के अनुसार होंगी।

(iii) सीधी नियुक्ति परिवीक्षा पर होगी जो दो वर्षों की होगी। अगर परिवीक्षा पर नियुक्त कर्मी की कार्य अनुपालन के आधार पर मूल्यांकित सेवा एवं आचार संतोषप्रद नहीं पाया जायेगा एवं/या वह नियम 9 (ii) के अंतर्गत सेवाकालीन वृत्तीय प्रशिक्षण सफलतापूर्वक पूरा नहीं कर पाता है तो परिवीक्षा अवधि एक वर्ष के लिए बढ़ाई जा सकेगी। अगर परिवीक्षा पर नियुक्त कर्मी की कार्य अनुपालन के आधार पर मूल्यांकित सेवा एवं आचार विस्तारित अवधि में भी संतोषप्रद नहीं हो तो उसे सेवोन्मोचित कर दिया जायेगा।

(iv) परिवीक्षा अवधि के उपरान्त परीक्ष्यमान कर्मी के कार्य अनुपालन एवं आचार का मूल्यांकन प्रधान मुख्य वन संरक्षक, बिहार द्वारा गठित अंचल स्तरीय समिति द्वारा किया जाएगा तथा जिसकी अनुशंसा पर कि परिवीक्षाधीन की सेवा संतोषप्रद्र है, उसकी नियुक्ति प्राधिकार द्वारा की जायेगी :

परन्तु यह कि यदि परिवीक्षा पर नियुक्त कर्मी द्वारा नियुक्ति के तत्काल बाद परिवीक्षा अवधि में प्रशिक्षण प्राप्त न किया जा सके तो उसकी नियुक्ति की संपुष्टि तत्‌संबंधी नियम-9 (ii) के तहत सफलता पूर्वक प्रशिक्षण पूर्ण कर लेने के उपरान्त ही किया जा सकेगा।

8. नियुक्ति प्राधिकार । - (क) वनरक्षी संवर्ग हेतु वन प्रमण्डल पदाधिकारी नियुक्ति प्राधिकार होंगे। (ख) वनपाल संवर्ग हेतु वन संरक्षक नियुक्ति प्राधिकार होंगे। 9. प्रशिक्षण । - (i) नियम 7.क के तहत वनरक्षी के रूप में नियुक्त प्रत्येक परिवीक्षाधीन को एक वर्ष का सेवाकालीन वृत्तीय प्रशिक्षण दिया जायेगा जिसे सफलतापूर्वक उत्तीर्ण करना अनिवार्य होगा। इसमें छह (6) माह की अवधि का सांस्थिक प्रशिक्षण एवं छह (6) माह की अवधि का क्षेत्रीय प्रशिक्षण शामिल होगा।3 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 (ii) नियम 7.ख के तहत वनपाल के रूप में नियुक्त प्रत्येक परिवीक्षाधीन को दो वर्ष का सेवाकालीन वृत्तीय प्रशिक्षण दिया जायेगा जिसे सफलतापूर्वक उत्तीर्ण करना अनिवार्य होगा। इसमें एक वर्ष की अवधि का सांस्थिक प्रशिक्षण एवं एक वर्ष की अवधि का क्षेत्रीय प्रशिक्षण शामिल होगा।

(iii) वनरक्षी से वनपाल के पद पर प्रोन्नति द्वारा नियुक्त कर्मी को उन्मुखीकरण प्रशिक्षण दिया जायेगा जो तीन माह से कम अवधि का नहीं होगा।

(iv) ऊपर उल्लिखित सेवा कालीन वृत्तीय प्रशिक्षण तथा उन्मुखीकरण प्रशिक्षण के पाठ्‌यक्रम का निर्धारण, प्रधान मुख्य वन संरक्षक, बिहार द्वारा विहित रीति से तद्‌संबंधी प्रशिक्षण संस्थान द्वारा किया जायेगा। तैराकी एवं शस्त्रचालन, सेवाकालीन प्रशिक्षण के अनिवार्य अंग होंगे।

10. वरीयता । - वनरक्षी तथा वनपाल संवर्गों की वरीयता सूचियों का संधारण राज्य स्तर पर प्रधान मुख्य वन संरक्षक, बिहार द्वारा किया जायेगा तथा इन्हीं सूचियों के आधार पर ही उच्चतर सोपान पर प्रोन्नति हेतु विचार किया जायेगा।

(क) वनरक्षी : (i) सीधी भत्र्ती से एक समव्यवहार में नियुक्त वनरक्षियों की आपसी वरीयता आयोग द्वारा तैयार की गई मेघा क्रमानुसार होगी।

(ii) वनरक्षियों को आयोग द्वारा दिये गये कुल प्राप्तांक समान होने की स्थिति में ऐसे वनरक्षियों में उम्र (मैट्रिक या समतुल्य परीक्षा के प्रमाण-पत्र के आधार पर जन्म तिथि), वरीयता का आधार होगी एवं अधिक उम्र के वनरक्षी, कम उम्र के वनरक्षी से वरीय होंगे।

(ख) वनपाल : (i) सीधी भत्र्ती से एक साथ संवर्ग में नियुक्त कर्मियों की आपसी वरीयता आयोग द्वारा तैयार की गई मेघा क्रमानुसार होगी।

(ii) प्रोन्नति द्वारा एक साथ नियुक्त वनपालों की आपसी वरीयता वनरक्षी के रूप में धारित उनकी आपसी वरीयता के अनुसार होगी।

(iii) वनपाल के पद पर एक ही वर्ष की रिक्तियों के विरूद्ध सीधी भत्र्ती एवं प्रोन्नति से नियुक्त होने वाले वनपालों में प्रोन्नति द्वारा नियुक्त वनपाल सीधी भत्र्ती द्वारा नियुक्त वनपालों से वरीय हाेंगे। 11. वेतनमान। -

(i) वनरक्षी संवर्ग को सरकार द्वारा समय-समय पर यथा निर्धारित वेतनमान एवं अन्य भत्ते देय हाेंगे। (ii) वनपाल संवर्ग को सरकार द्वारा समय-समय पर यथा निर्धारित वेतनमान एवं अन्य भत्ते देय हाेंगे। 12. वर्दी एवं बैज आदि । - (i) वनरक्षी तथा वनपाल के संवर्ग वर्दीधारी सेवा संवर्ग होगें। उनके द्वारा परिशिष्ट ''ग'' में यथा वर्णित वर्दी एवं रैंक आधारित बैज, आदि धारण किये जायेंगे।

(ii) वनरक्षी एवं वनपाल गृह (आरक्षी) विभाग के अधीन सिपाही एवं आरक्षी अवर निरीक्षक के लिये समय-समय पर अनुमान्य वार्षिक वर्दी भत्ता के समतुल्य राशि भुगतान के हकदार होंगे।

13. प्रोन्नति । - (i) वनरक्षी सम्वर्ग से प्रोन्नति का अगला पद वनपाल का होगा। वनपाल संवर्ग से प्रोन्नति का अगला पद वनों के क्षेत्र पदाधिकारी का होगा।

(ii) वनरक्षी से वनपाल के पद पर एवं वनपाल से वनों के क्षेत्र पदाधिकारी के पद पर प्रोन्नति हेतु कालावधि सामान्य प्रशासन विभाग के संकल्प ज्ञापांक-1800, दिनांक 09.06.2011 द्वारा निर्धारित कोटि-वेतन आधारित कालावधि के अनुसार होगी एवं उक्त संकल्प के प्रावधानानुसार कालावधि में आवश्यकतानुसार छूट दी जा सकेगी।

14. पदस्थापन/स्थानान्तरण । - (i) सीधे या प्रोन्नति द्वारा नियुक्त वनरक्षी एवं वनपाल को विभिन्न वन प्रमंडलों एवं अंचलों को रिक्तियों के अनुसार नियुक्ति हेतु आवंटित किया जायेगा। नियुक्ति प्राधिकार द्वारा नियुक्ति के पश्चात्‌ प्रशिक्षण एवं पदस्थापन की कार्रवाई की जायेगी।

(ii) वनरक्षी एवं वनपाल का पदस्थापन एक वन प्रमंडल में अधिकतम छह वर्षो, एक अंचल में अधिकतम नौ वर्षो तथा एक रीजन में अधिकतम पन्द्रह वर्षो के लिये किया जा सकेगा, परन्तु प्रधान मुख्य वन संरक्षक, बिहार द्वारा प्रशासनिक कारणों से सम्पूर्ण राज्य में किसी भी समय किसी भी वनरक्षी या वनपाल का स्थानान्तरण एवं पदस्थापन किया जा सकेगा।

15 अनुषासन, नियंत्रण एवं अपील। - (i) बिहार अवर वन संवर्ग के कार्मिकों के संदर्भ में अनुशासनिक कार्रवाई/नियंत्रण, वर्गीकरण एवं अपील संबंधी मामलों का विनियमन बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 समय-समय पर यथा संशोधित में निहित प्रावधानों के अनुरूप होगा।

(ii) इस नियमावली में विशिष्ट रूप से प्रावधानित नहीं किये गये सेवा शर्त्त, बिहार सेवा संहिता एवं राज्य सरकार द्वारा समय-समय पर जारी अन्य निर्णयों से नियंत्रित होंगे।4 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 16. निर्वचन । - यदि इन नियमों के निर्वचन में कोई संदेह हो, तो उसे सरकार को निर्दिष्ट किया जायेगा जिसपर सरकार का विनिश्चय अंतिम होगा।

17. कठिनाई निराकरण की शक्ति। -इस नियमावली के प्रावधानों में से किसी को प्रभावी करने में यदि कोई कठिनाई उत्पन्न हो तो राज्य सरकार राजपत्र में प्रकार्शित आदेश द्वारा, इस नियमावली के प्रावधानाें से असंगत न हो ऐसा प्रावधान कर सकेगी जो कठिनाईयों के निराकरण के लिए आवश्यक या समीचीन प्रतीत हो।

18. नियम का विधान मंडल के समक्ष रखा जाना । - नियम बनाये जाने के पश्चात्‌ यथाशीघ्र, विधान मंडल के समक्ष, जब वह सत्र में हो, कुल चौदह दिनों की अवधि के लिये रखा जायेगा। यह अवधि एक सत्र या दो या उससे अधिक लगातार सत्राें में पूरी हो सकेगी। यदि उस सत्र के या उपर्युक्त अनुक्रमिक सत्रों के ठीक बाद वाले सत्र के सत्रावसान से पहले, सदन उस नियम में कोई परिवर्तन करने के लिए सहमत हो जाए अथवा सदन इस बात के लिए सहमत हो कि यह नियम नहीं बनाया जाना चाहिए तो तत्पश्चात्‌ वह निष्प्रभाव हो जाएगा, किन्तु ऐसे परिवर्तन या निष्प्रभाव होने से उसके अधीन पहल की गई किसी बात की विधि मान्यता पर प्रतिकूल प्रभाव नहीं पड़ेगा।

19. निरसन एवं व्यावृति । - (1) इस नियमावली के प्रारम्भ होने के ठीक पूर्व इस विषय में प्रवृत्त सभी आदेशों/नियमों जहां तक वह इस नियमावली के प्रावधानों से असंगत हों, को निरसित किया जाता हैः

परंतु इस विषय में पूर्व में प्रवृत्त नियमों/आदेशों के अन्तर्गत किये गये ऐसे सभी कार्य, जो इस नियमावली के प्रारम्भ की तिथि से पहले किये गये हों, के संबंध में माना जायेगा कि वे इस नियमावली के प्रावधानों के अंतर्गत किये गये हैं, जैसा कि यह नियमावली ऐसे कार्य के करने के समय प्रवृत्त हो।

(2) उप-नियम (1) के अधीन उस निरसन के होते हुए भी तथा उस हद तक कि वे इस नियमावली के विरूद्ध न हों, उसके अधीन प्रोद्‌भूत अथवा प्रोद्‌भूत माना गया कोई, अधिकार एवं उनके अधीन उपगत दायित्व प्रभावित नहीं होगा।

परिशिष्ट-'क' नियम-7 क देखें वनरक्षी कोटि में नियुक्ति हेतु न्यूनतम शैक्षणिक योग्यता, अर्हत्ता तथा प्रक्रिया

1. वनरक्षी कोटि के शत प्रतिशत पद सीधी भर्त्ती द्वारा, राज्य सरकार द्वारा निर्धारित आरक्षण नियमों का पालन करते हुए, भरे जायेगें;

2. बिहार अवर वन सम्वर्ग के अधीन वनरक्षी के पद पर सीधी भर्ती (पुरूष/महिला श्रेणी) आयोग की अनुशंसा से होगी। आयोग द्वारा उपर्युक्त अभ्यर्थियों के चयन हेतु, पर्यावरण एवं वन विभाग, बिहार सरकार द्वारा की गई अधियाचना के आलोक में, प्रतियोगिता परीक्षा आयोजित की जायेगी;

3. विभाग द्वारा दी गयी अधियाचना के आधार पर आयोग समय-समय पर, इस तरह से जैसा कि वह उचित समझे, इस सेवा की, आरक्षण कोटिवार, रिक्तियों को सीधी भर्ती द्वारा भरने की घोषणा करेगा;

परंतु यह और कि कुछ पदों को, राज्य सरकार के निर्णयानुसार, खिलाड़ियों/भूतपूर्व सैनिकों आदि के लिये कर्णाकिंत किये जाने पर आयोग इन्हेें भी घोषित करेगा;

परंतु यह कि ऐसे सरकारी सेवक, जिनकी सेवाकाल में मृत्यु हो गयी हो, के आश्रितों को अनुकम्पा पर नियुक्ति के लिये आयोग की अनुशंसा अपेक्षित नहीं होगी। इस कोटि में नियुक्ति, जो सभी आवश्यक अर्हतायें धारित करते हैं, सरकार द्वारा इस उद्‌देश्य से निर्मित प्रावधानों के तहत की जायेगी।

4. उम्र सीमा, शैक्षणिक योग्यता तथा शारीरिक मापदण्ड :- (i) उम्र सीमा

प्रतियोगिता परीक्षा में सम्मिलित होने के लिए पुरूष एवं महिला अभ्यर्थी की आयु निम्नवत रहेगी : सामान्य - न्यूनतम 18 वर्ष से अधिकतम 23 वर्ष पिछड़ा/अत्यंत पिछ़ड़ा जाति - न्यूनतम 18 वर्ष से अधिकतम 25 वर्ष अनुसूचित जाति/अनुसूचित जनजाति - न्यूनतम 18 वर्ष से अधिकतम 28 वर्ष ऐसे कार्यरत सरकारी सेवक, जिन्होंने नियमित सेवा में न्यूनतम तीन वर्षो की अवधि पूरी कर ली हो जो इस प्रतियोगिता परीक्षा में भाग लेना चाहें, उनके लिये आयु सीमा में अधिकतम 5 वर्षो की छूट दी जायेगी। अभ्यर्थी की आयु की गणना मैट्रिकुलेशन अथवा समकक्ष परीक्षा के प्रमाण-पत्र में अंकित जन्मतिथि के आधार पर की जायेगी। (ii) शैक्षणिक योग्यता

वनरक्षी के पद पर नियुक्ति हेतु न्यूनतम शैक्षणिक योग्यता मैट्रिक अथवा समकक्ष होगी जो मान्यता प्राप्त बोर्ड से होनी आवश्यक है।5 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 (iii) शारीरिक मापदंड

(ग) सीना का न्यूनतम फुलाव 05 सेंटीमीटर 05 सेंटीमीटर 4 घंटे में 25 किलोमीटर महिला उम्मीदवार क्रमांक शारीरिक प्रमाप अनुसूचित जाति/अनुसूचित जनजाति अन्य (क) न्यूनतम ऊंचाई 155 सेंटीमीटर 160 सेंटीमीटर (ख) पैदल चलने की क्षमता 4 घंटे में 14 किलोमीटर 4 घंटे में 14 किलोमीटर (iii) सरकारी सेवक जो इस प्रतियोगिता परीक्षा में भाग लेने हेतु इच्छुक हों एवं आवश्यक अहर्त्ताएं धारण करते हों, वे अपना आवेदन पत्र ''बिहार सरकारी सेवा (पदों के लिये आवेदन) नियम, 1951'' के प्रावधानों के अन्तर्गत समर्पित करेगें।

(iv) सरकारी सेवा में प्रवेश के इच्छुक नये अभ्यर्थियों हेतु प्रतियोगिता परीक्षा में भाग लेने के लिये, अधिकतम आयु के बन्धेज के अधीन, अवसरों की कोई सीमा नहीं होगी।

5. प्रतियोगिता परीक्षा में निम्नलिखित दो चरण होंगे- (क) लिखित परीक्षा (ख) शारीरिक परीक्षण (क) लिखित परीक्षा

आयोग द्वारा लिखित परीक्षा का आयोजन बिहार कर्मचारी चयन आयोग के द्वारा नियुक्ति हेतु ली जाने वाली परीक्षाओं के लिये संचालन नियमावली, 2010 (समय-समय पर यथा संशोधित) के अनुसार की जायेगी। (ख) शारीरिक परीक्षण

लिखित परीक्षा में प्राप्त अंक के आधार पर आयोग द्वारा एक मेधा सूची तैयार की जायेगी। मेधा सूची में सामान्य वर्ग एवं विभिन्न आरक्षण कोटियों में उपलब्ध रिक्तियों केे आलोक में अभ्यर्थियोेंं की संख्या का अनुपात आयोग द्वारा निर्धारित किया जायेगा। मेधा सूची में स्थान पाये उम्मीदवारों का शारीरिक परीक्षण कराया जायेगा जिसमें इस परिशिष्ट के नियम 4 (iii) के अनुसार शारीरिक मापदंड की जाँच के अतिरिक्त मेडिकल जाँच भी की जायेगी। शारीरिक परीक्षण प्रधान मुख्य वन संरक्षक द्वारा गठित समिति द्वारा किया जायेगा। स्थान, तिथि तथा परीक्षण की प्रक्रिया आयोग द्वारा निर्धारित की जायेगी, जिसकी सूचना अभ्यर्थियों को आयोग द्वारा समाचार पत्रों के माध्यम से, या जैसा कि आयोग उचित समझे, दी जायेगी।

6. आयोग द्वारा सरकार को अनुशंसा (i) शारीरिक परीक्षण में सफल अम्यर्थियों का, लिखित परीक्षा के आधार पर आयोग, अधियाचित रिक्तियों के अनुसार, सरकार द्वारा विहित आरक्षण कोटिवार एक अंतिम मेधा सूची तैयार करेगा एवं उसे प्रधान मुख्य वन संरक्षक, बिहार को नियुक्ति हेतु अनुशंसित करेगा।

(ii) बिहार राज्य के वन प्रमण्डलों में सम्बन्धित नियुक्ति पदाधिकारियों द्वारा, प्रधान मुख्य वन संरक्षक, बिहार, द्वारा विहित रीति से, आयोग द्वारा अनुशंसित अभ्यर्थियों की नियुक्ति की जायगी एवं उन्हें सेवाकालीन वृत्तीय प्रशिक्षण हेतु भेजा जायेगा।

(iii) नियुक्ति के पूर्व चयनित अभ्यर्थियों के संबंध में यह संपुष्टि कर ली जायेगी कि उनका आरक्षी विभाग से सत्यापन प्राप्त किया जा चुका है।

7. अंतिम रूप से चयनित अभ्यर्थियों की विभाग में वनरक्षी के पद पर नियुक्ति ''परिवीक्षाधीन'' के रूप में होगी। उन्हें विभाग द्वारा निर्धारित अवधि एवं पाठ्‌यक्रम के अनुरूप प्रशिक्षण प्राप्त करना होगा। परिवीक्षा अवधि दो वर्षों की होगी; परंतु यह कि यदि कोई वनरक्षी परिवीक्षा अवधि सफलतापूर्वक पूरा नहीं करता है अथवा राज्य सरकार/विभाग द्वारा नियमानुसार निर्धारित प्रशिक्षण में उत्तीर्ण नहीं होता है, तो नियुक्ति प्राधिकारी उसकी परिवीक्षा अवधि को अधिकतम एक वर्ष तक बढ़ा सकेंगे एवं वनरक्षी को पुनः प्रशिक्षण का अवसर देगें, परन्तु यदि द्वितीय अवसर दिये जाने पर भी वह प्रशिक्षण में असफल होते हैं तो उनकी सेवा को समाप्त कर दिया जायेगा।6 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 8. वानिकी से संबंधित विषयों का सैद्धान्तिक एवं व्यवहारिक प्रशिक्षण पाठ्‌यक्रम प्रधान मुख्य वन संरक्षक, बिहार द्वारा तैयार किया जायेगा।

9. (i) परिवीक्षा अवधि में वनरक्षी को सरकार द्वारा समय-समय पर निर्धारित वेतनमान एवं अन्य भत्ते देय होंगे।

(ii) परिवीक्षा अवधि को सफलतापूर्वक पूर्ण करने पर वनरक्षी की सेवा की सम्पुष्टि नियम 7 क (iv) में यथानिर्धारित प्रक्रियानुसार की जायेगी।

परिशिष्ट-'ख' नियम-7 ख देखें वनपाल कोटि में नियुक्ति हेतु न्यूनतम शैक्षणिक योग्यता, अर्हत्ता तथा प्रक्रिया

1. वनपाल की नियुक्ति निम्नलिखित रीति से की जायेगी :- (i) वनपाल कोटि के कुल स्वीकृत बल के अधिकतम पचास प्रतिशत पद सीधी भर्त्ती द्वारा तथा शेष पद वनरक्षी के पद से प्रोन्नति द्वारा भरे जायेंगे। यह भर्ती राज्य सरकार द्वारा निर्धारित आरक्षण नीति के अनुसार की जायेगी।

(ii) सीधी भर्त्ती से नियुक्ति इस परिशिष्ट के भाग (क) में उल्लिखित प्रक्रिया के अनुसार की जायेगी। (iii) वनरक्षी से वनपाल के पद पर प्रोन्नति द्वारा नियुक्ति इस परिशिष्ट के भाग (ख) में उल्लिखित प्रक्रिया के अनुसार की जायगी।

(क) सीधी भर्ती द्वारा नियुक्ति 2. वनपाल के संवर्ग में सीधी भर्ती (पुरूष/महिला श्रेणी) आयोग की अनुशंसा से की जायेगी। 3. आयोग द्वारा इस प्रयोजनार्थ, पर्यावरण एवं वन विभाग, बिहार सरकार द्वारा की गई अधियाचना के आलोक में, प्रतियोगिता परीक्षा आयोजित की जायेगी।

4. विभाग द्वारा दी गयी अधियाचना के आधार पर आयोग समय-समय पर, इस तरह से जैसा कि वह परंतु यह कि कुछ पदों को, राज्य सरकार के निर्णयानुसार, खिलाड़ियों/भूतपूर्व सैनिकों आदि के लिये कर्णाकिंत किये जाने पर आयोग इन्हेें भी घोषित करेगा।

5. उम्र सीमा, शैक्षणिक योग्यता तथा शारीरिक मापदण्ड

(i) उम्र सीमा

प्रतियोगिता परीक्षा में सम्मिलित होने के लिए पुरूष एवं महिला अभ्यर्थी की आयु निम्नवत रहेगीः सामान्य - न्यूनतम 18 वर्ष से अधिकतम 25 वर्ष पिछड़ा/अत्यंत पिछ़ड़ा जाति - न्यूनतम 18 वर्ष से अधिकतम 27 वर्ष अनुसूचित जाति/अनुसूचित जनजाति - न्यूनतम 18 वर्ष से अधिकतम 30 वर्ष

ऐसे कार्यरत सरकारी सेवक जिन्होंने नियमित सेवा में न्यूनतम तीन वर्षो की अवधि पूरी कर ली हो एवं जो इस प्रतियोगिता परीक्षा में भाग लेना चाहें, उनके लिये आयु सीमा में अधिकतम 5 वर्षो की छूट दी जायेगी। अभ्यर्थी की आयु की गणना मैट्रिकुलेशन अथवा समकक्ष परीक्षा के प्रमाण-पत्र में अंकित जन्मतिथि के आधार पर की जायेगी। (ii) शैक्षणिक योग्यता

वनपाल के पद पर भर्त्ती हेतु न्यूनतम शैक्षणिक योग्यता मान्यता प्राप्त बोर्ड/विश्वविद्यालय/ काउन्सिल से इन्टर विज्ञान अथवा समकक्ष होगी।

(iii) शारीरिक मापदंड

(iv) वे सरकारी सेवक जो इस प्रतियोगिता परीक्षा में भाग लेने हेतु इच्छुक हों एवं आवश्यक अर्हत्ताएं धारण करते हों, वे अपना आवेदन पत्र ''बिहार सरकारी सेवा (पदों के लिये आवेदन) नियम, 1951'' के प्रावधानों के अन्तर्गत समर्पित करेगें।7 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 (v) सरकारी सेवा में प्रवेश के इच्छुक नये अभ्यर्थियों हेतु प्रतियोगिता परीक्षा में भाग लेने के लिये, अधिकतम आयु के बन्धेज के अधीन, अवसरों की कोई सीमा नहीं होगी।

6. प्रतियोगिता परीक्षा में निम्नलिखित दो चरण होंगे-

क. लिखित परीक्षा ख. शारीरिक परीक्षण क. लिखित परीक्षा

(iii) नियुक्ति के पूर्व चयनित अभ्यर्थियों के संबंध में यह संपुष्टि कर ली जायेगी कि उनका आरक्षी विभाग से सत्यापन प्राप्त किया जा चुका है।

8. अंतिम रूप से चयनित अभ्यर्थियों की विभाग में वनपाल के पद पर नियुक्ति ''परिवीक्षाधीन'' के रूप में होगी। उन्हें विभाग द्वारा निर्धारित अवधि एवं पाठ्‌यक्रम के अनुरूप प्रशिक्षण प्राप्त करना होगा। परिवीक्षा अवधि दो वर्षों की होगी; परंतु यह कि यदि कोई वनपाल परिवीक्षा अवधि सफलतापूर्वक पूरा नहीं करता है अथवा राज्य सरकार/विभाग द्वारा नियमानुसार निर्धारित प्रशिक्षण में उत्तीर्ण नहीं होता है, तो नियुक्ति पदाधिकारी उसकी परिवीक्षा अवधि को अधिकतम एक वर्ष तक बढ़ा सकेंगे एवं उन्हें प्रशिक्षण का पुनः एक अवसर देंगे, परन्तु यदि द्वितीय अवसर प्राप्त होने पर भी प्रशिक्षण में असफल पाये जायेगें तो उनकी सेवा समाप्त कर दी जायेगी। 9. वानिकी से संबंधित विषयों का सैद्धान्तिक एवं व्यवहारिक प्रशिक्षण पाठ्‌यक्रम प्रधान मुख्य वन संरक्षक, बिहार द्वारा विहित किया जायेगा।

10. (i) परिवीक्षा अवधि में वनपाल को सरकार द्वारा समय-समय पर निर्धारित वेतनमान एवं अन्य भत्ते देय होंगे। (ii) परिवीक्षा अवधि को सफलता पूर्वक पूर्ण करने पर वनपाल की सेवा सम्पुष्टि नियम 7 ख (iv) में यथानिर्धारित प्रक्रियानुसार की जायेगी।

(ख) प्रोन्नति द्वारा नियुक्ति 11. विभाग में सेवारत वनरक्षी ही वनपाल के पद पर प्रोन्नति द्वारा नियुक्ति के योग्य समझे जायेंगे। 12. वनरक्षी से वनपाल सम्वर्ग में प्रोन्नति हेतु विचार करने के लिए प्रधान मुख्य वन संरक्षक, बिहार के द्वारा एक विभागीय प्रोन्नति समिति का गठन किया जायेगा जिसके अध्यक्ष मुख्य वन संरक्षक, से अन्यून स्तर के पदाधिकारी होंगे।

13. प्रधान मुख्य वन संरक्षक, बिहार के स्तर पर प्रत्येक वर्ष के दिसम्बर माह में वनपाल संवर्ग में प्रोन्नति द्वारा भरी जानेवाले रिक्तियों की गणना, आरक्षण कोटिवार, राज्य स्तर पर की जायेगी। तद्‌नुसार विभागीय प्रोन्नति समिति की बैठक कर प्रोन्नति पर विचार किया जायेगा।

14. वनपाल के पद पर प्रोन्नति हेतु वनरक्षी कीे पात्रता का विचार, वरीयता-सह-मेधा की नीति के आधार पर वनरक्षी के सेवा इतिहास एवं एतद्‌संबंधी सामान्य प्रशासन विभाग द्वारा निर्धारित नियमों/परिपत्रों/अनुदेशों के आलोक में विचार किया जायेगा।

15. विभागीय प्रोन्नति समिति द्वारा प्रोन्नति हेतु योग्य पाये गये वनरक्षियों की सूची, वरीयता के अनुसार, प्रत्येक आरक्षण कोटि के लिए अलग-अलग तैयार की जायेगी एवं प्रधान मुख्य वन संरक्षक, बिहार को उपबंध 17 के अनुसार प्रोन्नति एवं पदस्थापन के लिए अनुशंसित की जायेगी।8 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 16. ऐसे वनरक्षी जो निलम्बित हों, अथवा जिनके विरूद्ध कोई आपराधिक मामला विचाराधीन हो या विभागीय कार्यवाही संचालित हो, उनके मामले भी प्रोन्नति हेतु विचारण के योग्य समझे जायेंगे एवं विचारण उपरान्त निर्णय सीलबन्द लिफाफे में रखा जायेगा। परन्तु ऐसे वनरक्षियों का प्रोन्नति संबंधी अंतिम आदेश उनका निलम्बन समाप्त होने अथवा आपराधिक मामला या विभागीय कार्यवाही के निष्पादन में अन्तिम आदेश पारित होने पर जैसा भी मामला हो, के बाद ही निर्गत किया जा सकेगा।

17. विभागीय प्रोन्नति समिति द्वारा प्रोन्नति हेतु अनुशंसित वनरक्षियों का वनपाल के पद पर प्रोन्नति एवं पदस्थापन का आदेश प्रधान मुख्य वन संरक्षक, बिहार द्वारा निर्गत किया जायेगा।

Astha.- 14/2012- 3060/E&F.—In exercise of powers conferred by Proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to frame the following Rules to regulate the recruitment and other conditions of service of the cadres of Foresters and Forest Guards, under the Department of Environment and Forest.

1. Short title, extent and commencement.—(1) These Rules may be called the Bihar Subordinate Forest Service Rules, 2013.

(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with effect from the date of publication in the Bihar Gazette. 2. Definitions.- Unless there is anything repugnant to the context, in this Rules:- (a) "Subordinate forest Service" includes Cadre of Forest Guards and Cadre of Foresters consisting of Forest Guards and Foresters respectively working in all the establishments under the control of the Environment and Forest Department, Bihar; (b) "Forest Guard" means an employee of the cadre referred to in Rule 7 A, of these Rules;

(c) "Forester" means an employee of the cadre referred to in Rule 7 B of these Rules; (d) "Appointing authority" means the authorities referred to in Rule 8 of these Rules; (e) "Divisional Forest Officer" means an officer in charge of a forest division in the State of Bihar;

(f) "Conservator of Forest" means an officer in charge of a forest circle in the State of Bihar;

(g) "Probationer" means a person appointed under probation in the cadres of Forest Guard and Forester;

(h) 'Principal Chief Conservator of Forests', means an officer posted as Principal Chief Conservator of Forest and working as 'Head of the Force' in the Department of Environment and Forest, Bihar;

(i) "Commission" means the Bihar Staff Selection Commission or any other agency determined by the Department of Environment and Forest for appointment and related matters of personnel;

(j) State Government means the "Government of Bihar." 3. Constitution of Service.- There shall be Subordinate Forest Service in the Environment and Forest Department, Bihar which shall include two cadres of employee :–

(a) Forest Guard; (b) Forester Provided that the State Government may determine the eligibility for including any category of employee other than above in these cadres.

4. Cadre.- Both the cadres of foresters and forest guards shall be of state level which shall include all establishments under control of the Environment and Forest Department, Bihar.

5. Reservation.- The provisions of the Bihar Reservation of vacancies in posts and services (for Scheduled Caste, Scheduled Tribe and other Backward Class) Act, 1991 and the Rules and roster there under as prescribed by the State Government from time to time shall be applicable for making appointment to and for granting promotions.

6. Authorised strength of Cadre.- The authorised strength of cadres of foresters and forest guards shall be determined by the Environment and Forest Department, Bihar as per requirement. The persons already working on the posts of Forest Guards and Foresters would be included in their respective cadre strength to be determined.

7. Appointment.- A- Appointment in the Cadre of Forest Guard :- (i) Appointment in this cadre shall be made by direct recruitment.

(ii) The procedure, minimum educational qualification and eligibility for appointment shall be as contained in Appendix-A to these Rules.

(iii) The appointment shall be made on probation which shall be for two years. In case the service, evaluated on the basis of performance of work and conduct of the employee, appointed on probation is not found satisfactory and/or he/she does not successfully complete the in-service professional training under Rule 9 (i), the probation period may be extended by one year. If the service evaluated on the basis of performance of work and conduct of the employee, appointed on probation is not found satisfactory even during the extended period, he/she shall be discharged form service.

(iv) The performance of work and conduct of the probationer shall be evaluated by a circle level committee constituted by the Principal Chief Conservator of Forests, Bihar and on whose recommendation, that the service of the probationer is satisfactory his appointment shall be confirmed by the appointing authority.

Provided that if the employee appointed on probation is not able to complete training during the period of probation just after recruitment, his/her appointment shall be confirmed only after successful completion of the training as prescribed under Rule 9 (i).

B. Appointment in the Cadre of Forester :-

(i) The maximum of 50% of the sanctioned strength of this cadre shall be filled by direct recruitment and the remaining sanctioned strength of this cadre shall be filled up by promotion from the cadre of Forest Guard.

(ii) The procedure of recruitment, minimum educational qualification and eligibility shall be as contained in Appendix-B to these Rules.

(iii) Appointment by direct recruitment shall be made on probation which shall be two years. In case the service, evaluated on the basis of performance of work and conduct of the employee, appointed on probation is not found satisfactory and/or he/she does not successfully complete in-service professional training under Rule 9(ii), the probation period may be extended by one year. If the service, evaluated on the basis of performance of work and conduct of the employee, appointed on probation is not found satisfactory even during the extended period, he/she shall be discharged from service.

(iv) The performance of work and conduct of the probationer shall be evaluated by a circle level committee constituted by the Principal Chief Conservator of Forests, Bihar and on whose recommendation, that the service of the probationer is satisfactory, his appointment shall be confirmed by the appointing authority.

Provided that if the employee appointed on probation is not able to undergo training during the period of probation just after recruitment, his/her appointment shall be confirmed only after successful completion of the training as prescribed under Rule 9 (ii)

8. Appointing Authority.- (a) The Divisional Forest Officer shall be the appointing authority of Forest Guard. (b) The Conservator of Forests shall be the appointing authority of Forester. 9. Training.– (i) Every probationer appointed under Rule-7A as Forest Guard shall be imparted one year in-service professional training, the successful completion of which shall be mandatory. This will include six months of academic training and six months of field training.

(ii) Every probationer appointed under Rule-7 B as Forester shall be imparted a two year in-service professional training, the successful completion of which shall be mandatory. This will include one year of academic training and one year of field training.

(iii) Every forester appointed by promotion from Forest Guard shall be imparted an orientation training, which shall not be less than 3 months duration.

(iv) The syllabus and curricula of the above mentioned in-service professional and orientation trainings shall be determined by the concerned training institute as prescribed by the Principal Chief Conservator of Forests, Bihar. Swimming and weapons handling shall be the mandatory components of in-service training.

10. Seniority.- The gradation lists of cadres of Forest Guards and Foresters shall be prepared separately at the state level by the Principal Chief Conservator of Forests, Bihar and promotion to higher levels shall be decided, on the basis of such list(s) only.

(a) Forest Guard - (i) The inter-se seniority of Forest Guards appointed by direct recruitment in the same transaction shall be determined on the basis of merit list prepared by the Commission.

(ii) In the event of the aggregate marks awarded by the Commission to Forest Guards in the merit list prepared by it being equal, the age (i.e. the date of birth as per matriculation or equivalent certificate) shall be the basis of seniority amongst such Forest Guards, and those Forest Guard(s) with higher age shall rank senior to those of such Forest Guard (s) with lower age.

(b) Forester - (i) The inter-se seniority of Foresters appointed by direct recruitment in the same transaction shall be determined on the basis of merit list prepared by the Commission.

(ii) The inter-se seniority of Forester appointed by promotion through same transaction shall be as per their inter-se seniority as Forest Guard.

(iii) Forester appointed through promotion shall be senior to those appointed by direct recruitment against the vacancies of the same year.

11. Scales of Pay.- (i) The cadre of Forest Guard shall be entitled for pay and allowances as determined by the Government from time to time.

(ii) The cadre of Forester shall be entitled for pay and allowances as determined by the Government from time to time.

12. Uniform and badges etc.- (i) The cadres of Forest Guard and Forester shall be uniformed cadres. They shall wear the ranks and badges and uniform as mentioned in Appendix-C to these Rules.

(ii) The Forest Guards and Foresters shall be entitled to annual uniform allowance at the same rate as admissible from time to time to Constables and Assistant Sub Inspectors of Police respectively under the Home (Police) Department, Government of Bihar.

13. Promotion.- (i) The next promotional post of the cadre of the Forest Guard shall be the cadre of Forester. The next promotional post of the cadre of Forester shall be the cadre of Range Officer of Forests.

(ii) The minimum years of service (Kalawadhi) for promotion from the post of Forest Guard to the post of Forester and from the post of Forester to the post of Range Officer shall be as per the grade pay based minimum years of service as determined by the General Administration Department under Resolution No.1800 dated 09.06.2011 and necessary relaxation in minimum years of service (Kalawadhi) may be allowed as provided thereunder.

14. Posting and Transfer.- (i) Forest Guard and Forester appointed either directly or by promotion shall be allotted to different Forest Divisions and Circles respectively for appointment on the basis of vacancies. The appointing authority will arrange for training and posting after appointment.

(ii) Forest Guards and Foresters shall be posted in a Forest Division for a maximum period of six years, in a Circle for maximum period of nine years and in a Region for maximum period of fifteen years. Provided that the Principal Chief Conservator of Forests, Bihar may, for administrative reasons, transfer and post any Forest Guard or Forester any where within the State at any time.

15. Discipline, Control and Appeal.- (i) The provisions of the Bihar Government Servants (Classification, Control and Appeal) Rules, 2005 as amended from time to time shall apply to the members of Bihar Subordinate Forest Cadre in the matters of discipline, control, classification and appeals.

(ii) Other service conditions not specifically dealt in these Rules shall be governed by the Bihar Service code and other decisions of the State Government issued from time to time.

16. Interpretation.- In the event of any doubt in the matter of interpretation of any rule the same will be referred to State Government and the decision of State Government shall be final.

17. Power to Remove Difficulty.- If any difficulty arises in giving effect to any of the provisions of these rules, the Government may, by order published in the Official Gazette, make such provisions not inconsistent with the provisions of these rules, as may appear to it to be necessary or expedient for removing the difficulty.

18. Rules to be laid before Legislature.- Rules shall be laid, as soon as may be after it is made, before House of the Legislature, while it is in Session for a total period of fourteen days. This period may be comprised in one Session or in two or more successive Sessions. If, before the expiry of the Session immediately following in Session or the successive Sessions aforesaid, the House agree in making any modification in the Rule or the House agrees that the Rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be, so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under the Rule.

19. Repeal and Saving. – (1) All Rules and orders relating to Forest Guards and Foresters in force immediately before coming in force of this Rule shall, to the extent they are repugnant to these Rules, stand repealed from the date of coming in force of the these Rules:

Provided that any action taken before coming into force of these Rules, under such repealed Rules and orders, shall be deemed to have been taken under these Rules as if these Rules were in force at the time of taking such action.

(2) Notwithstanding such repeal as under sub rule (1) and to the extent they are not repugnant to these rules, any right accrued or deemed to have been accrued there under or any liability or obligation incurred there under shall not be affected.

Appendix-A

Procedure, eligibility and minimum educational qualification for appointment in the

category of Forest Guard :-

1. All vacancies of Forest Guards shall be filled by direct recruitment complying with the provisions of reservation as determined by the State Government;

2. Recruitment to the posts of Forest Guards (Male and Female) shall be done on the basis of recommendation of the Commission. The Commission shall conduct a competitive examination for selection of suitable candidates on the basis of requisition sent to it by the Department of Environment and Forest, Government of Bihar;

3. The Commission shall in the manner, as it deems appropriate, on the basis of such requisition received from the Department, notify the vacancies as per reservation policy of the Government to be filled by direct recruitment;

Provided that, some vacancies may also be notified by the Commission to be filled exclusively by sportsperson and/ or ex-defense personnel/ army men etc, as per decision of the State Government; Provided further that recommendations of the Commission will not be necessary for appointment on compassionate grounds of dependents of government servants who have deceased while in service. Appointment of persons under this category, who possess all the requisite qualifications, shall be done according to the provisions made by the government for this purpose.

4. Age limit, educational qualification and physical standards.

(i) Age limit-The minimum and maximum age limits of male and female

Relaxation of five years in the maximum age shall be given to government servants, who want to appear in such competitive examination provided that they have completed at least three years of regular service. The basis of calculation of age shall be the date of birth recorded in passing certificate of Matriculation or equivalent examination. (ii) Educational Qualification :- The minimum educational qualification required for recruitment as Forest Guard shall be Matriculation or equivalent from a recognized board.

(iv) Those government employees who want to take part in this competitive examination and fulfill necessary qualifications, shall submit their application under the provisions of "Bihar Government Servant (Applications for Posts) Regulation, 1951." (v) There shall be no limit on chances for candidates willing to enter in government service and appearing in the competitive examination subject to the maximum age limit. 5. The competitive examination shall consist of two parts :-

(a) Written Examination, and (b) Physical Test. (a) Written examination :- The Commission shall conduct written examination as per the provisions of "Rules for Conduct of examination by Bihar Staff Selection Commission for Appointment, 2010 (as amended from time to time).

(b) Physical Test :- The Commission shall prepare a Merit list of candidates on the basis of marks obtained in the written examination. The proportion of number of candidates in the merit list shall be determined by the Commission, in light of the vacancies available in general category and different reserved categories. The Candidates included in the merit list so prepared by the Commission shall be subjected to physical test as per prescribed physical standards in Rule 4(iii) of this Appendix, in addition to a medical test. Physical test shall be taken by a committee23 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 constituted by Principal Chief Conservator of Forests, Bihar. The date, venue and procedures for this test shall be determined and duly notified by the Commission to candidates through news papers or as the Commission deems appropriate.

6. Recommendation by the Commission to the Government :- (i) The Commission shall prepare a final merit list on the basis of marks obtained in written examination by the candidates who have passed the physical test, in the light of requisitioned vacancies, as per the reservation categories prescribed by the government and send it to the Principal Chief Conservator of Forests, Bihar for appointment.

(ii) The candidates so recommended by the Commission, shall be appointed in the Forest Divisions of the State by the concerned appointing authorities in the manner prescribed by the Principal Chief Conservator of Forests, Bihar and sent for in- service professional training.

(iii)It shall be confirmed before appointment of selected candidates that their verification from the Police department has been received.

7. The selected candidate shall be appointed as Forest Guard on probation. He shall have to undergo training in accordance with the course and period decided by the Department. The probation period shall be of two years.

Provided that if a Forest Guard is not able to successfully complete the probation period or pass the prescribed examination during training, the appointing authority may extend the period of probation for a maximum period of one year and allow more chance to such probationer for successfully completing the training, but if he fails in his second chance also, he shall be discharged from service.

8. The theoretical and practical course/ curricula of forestry and allied subject of in-service training shall be prescribed by the Principal Chief Conservator of Forests, Bihar 9. (i) The Forest Guard under probation shall be entitled to pay and allowances as determined by the state Government from time to time.

(ii) The appointment of the Forest Guard shall be confirmed on successful completion of the period of probation, in accordance with procedure laid down under Rule 7A (iv).

Appendix-B

Minimum educational qualification, eligibility and procedure for appointment in the

category of Forester :-

1. Recruitment in the Forester grade shall be made in the manner as mentioned below-

(i) The maximum of 50% of the total sanctioned strength of the cadre Forester shall be filled by direct recruitment and the remaining vacancies by promotion from the cadre of Forest Guard as per the reservation Policy of the State Government.

(ii) Direct recruitment shall be made in accordance with the procedure laid down in part-A of this Appendix.

(iii)Appointment by promotion from Forest Guard grade shall be made in accordance with the procedure laid down in part-B of this Appendix. (A) Appointment by Direct Recruitment.

2. Appointment by direct recruitment to the cadre of Forester (Male and Female) shall be made on recommendation of the Commission.

3. Competitive examination shall be conducted for this purpose, by the Commission, as per the requisition sent by the Department of Environment and Forest, Government of Bihar.

4. The Commission shall, on the basis of such requisition regarding vacancies and in the manner it deems suitable, notify the vacancies as per reservation policy of the24 (cid:18)बहार गजट (असाधारण), 4 िसत*बर 2013 Government to be filled through direct recruitment. Provided that the Commission shall also notify some vacancies to be earmarked for sportspersons/ ex-defence personnel etc as per the direction of the State Government.

5. Age limit, educational qualification and physical standards: (i) Age limit- The minimum and maximum age limits of male and female

Relaxation of five years in the maximum age limit shall be available to such working government employees, who have completed at least three years of regular service, if they want to appear at this competitive examination. (i) Education Qualification :- The minimum educational qualification required for recruitment as Forester shall be Intermediate (Science) or equivalent from a recognised University/Board/Council.

(iv) Those government employees who want to take part in this competitive examination and fulfill necessary qualifications, shall submit their applications under the provisions of "Bihar Government Servant (Application for Posts) Regulation, 1951." (v) There shall be no limit on chances for appearing in this competitive examination for candidates willing to enter in government service, subject to the maximum age limit.

6. The competitive examination shall consist of following two stages: – (a) Written Examination, and (b) Physical Test. (a) Written examination :- The Commission shall conduct a written examination as per the provisions of "Rules for conduct of Examination by Bihar Staff Selection Commission for Appointment, 2010 (as amended from time to time)

(b) Physical Test :-

The Commission shall prepare a merit list of candidates on the basis of marks obtained in the written examination. The proportion of number of candidates in the merit list shall be determined by the Commission, in light of the vacancies available in the general category and different reserved categories. The candidates included in the merit list so prepared by the Commission shall be subjected to physical test as per prescribed physical in Rule 5(iii) of this Appendix, in addition to a medical test. Physical tests shall be conducted by a committee constituted by the Principal Chief Conservator of Forests. The date, venue and procedures for this test shall be determined by the Commission, which shall be duly notified to the candidates through news papers or as the Commission deems appropriate.

7. Recommendation by the Commission to the Government:-

(i) The Commission shall prepare a final merit list on the basis of marks obtained in written examination of the candidates who have passed the physical test, in the light of requisitioned vacancies, as per the reservation categories prescribed by the Government and send it to the Principal Chief Conservator of Forests, Bihar for appointment. (ii) The candidates so recommended by the Commission, shall be appointed in the Forest Circles of the State by concerned appointing authorities in the manner prescribed by the Principal Chief Conservator of Forests, Bihar and they will be sent for in- service professional training. (iii) It shall be confirmed before appointment of selected candidates that their verification from the police department has been received. 8. Finally selected candidate shall be appointed as Forester on probation. He shall have to undergo training in accordance with the period and curricula decided by the Department. The probation period shall be of two years. Provided that if a Forester is not able to successfully complete probation period or pass the training as prescribed by the State Government/Department, then the appointing authority may extend the period of probation for a maximum period of one year and allow such probationer one more chance for training, but if he fails to successfully complete his training in the second chance also, he shall be discharged from service. 9. The theoretical and practical training course curricula of subjects allied to forestry shall be prescribed by the Principal Chief Conservator of Forests, Bihar

10 . (i) A Forester on probation shall be entitled to pay and allowances as determined by the Government from time to time. (ii) The appointment of a Forester shall be duly confirmed on successful completion of probation period, as per the provisions of Rule 7 B (iv). (B) Appointment by promotion

11. Only a serving Forest Guard shall be considered eligible for appointment by promotion to the cadre of Forester.

12. A Departmental Promotion Committee (DPC) shall be constituted by the Principal Chief Conservator of Forests, Bihar to consider the promotion from the post of Forest Guard to post of Forester, which shall be headed by an officer not below the rank of Chief Conservator of Forest.

13. The number of vacancies to be filled by promotion, category- wise, as per the reservation policy of the Government shall be assessed at the State level by the Principal Chief Conservator of Forests, Bihar in the month of December every year. The meeting of the DPC shall be held accordingly to consider the cases of promotion.

14. The consideration of candidature of a Forest Guard for promotion on the post of Forester shall be made on the principle of seniority-cum-merit in the light of service records of forests guard and rules/ circulars/ orders issued by the General Administration Department, in this regard.

15. The list of candidates found suitable for promotions by the DPC shall be prepared separately for each reservation category, at the state level, as per seniority and recommended to the Principal Chief Conservator of Forests, Bihar for issuing promotion and posting orders under clause 17.

16. Such Forest Guards who are under suspension, or against whom criminal proceedings are pending or disciplinary proceedings are under way, shall also be considered eligible for consideration for promotion and the decision shall be kept in sealed cover. But final order regarding promotion of such forest guards can be issued only after revoking of suspension or passing of final order in criminal proceeding or disciplinary proceeding.

17. The orders of promotion and posting of Forest Guards, to the post of Foresters as recommended by the Departmental Promotion Committee, shall be issued by the Principal Chief Conservator of Forests, Bihar.
