सं॰ 3ए-9-विविध-24/2013-10709—भारत-संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल एतद्द्वारा लोक निर्माण विभाग के ज्ञांप 1344, दिनांक 04/02/1949 द्वारा प्रसारित कार्यभारित स्थापना की पुनरीक्षित सेवा-शर्त्त नियमावली, 1949 को निरसित करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1- संक्षिप्त नाम, विस्तार एवं आरंभ ।-(1) यह नियमावली कार्यभारित स्थापना पुनरीक्षित सेवा-शर्त्त, (निरसन) नियमावली, 2013 कही जाएगी ।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा ।
(3) यह तुरंत प्रवृत्त होगी ।
2- निरसन एवं व्यावृत्ति ।-(1) कार्यभारित स्थापना पुनरीक्षित सेवा-शर्त्त नियमावली, 1949 (लोक निर्माण विभाग के ज्ञांप 1344, दिनांक 04/02/1949) एतद्द्वारा निरसित की जाती है ।
(2) इस निरसन के होते हुए भी कार्यभारित स्थापना सेवा-शर्त्त नियमावली, 1949 के अधीन की गयी कोई भी कार्रवाई अथवा लिए गए निर्णय अथवा कार्यभारित कर्मियों की सेवा को नियमित करने के संबंध में लिये गये निर्णय वैध माने जायेंगे तथा इस निरसन नियमावली के आधार पर उसे चुनौती नहीं दी जा सकेगी ।
बिहार-राज्यपाल के आदेश से, 2 (cid:18)बहार गजट (असाधारण), 17 अ.तूबर 2013 The 17th October 2013 No. 3A-9-mis-24/2013-10709—In exercise of powers conferred under Proviso to Article 309 of the Constitution of India, Governor of Bihar is hereby pleased to make the following Rules to repeal the Revised conditions of service of Work-charged Establishment Rules, 1949 circulated vide Public Works Department Memo No. 1344, dated 04/02/1949:-
1. Short title, extent and commencement.— (1) These Rules may be called the revised conditions of service of Work-charged Establishment (Repeal) Rules 2013.
(2) It shall extend to the whole state of Bihar.
(3) It shall come into force at once.
2. Repeal and savings.—(1) The Revised conditions of service of Work-chargaed Establishment Rules, 1949 is hereby repealed.
(2) Notwithstanding such repeal any action taken or decision rendered or services of Work-charged employee regularised under Work-charged Establishment Rules, 1949, shall be deemed to have been valid and shall not be questioned on the ground of repeal of the said Rule.
